CHAPTER 17

08 INDUSTRIAL DISTRICT PROVISIONS

17.08.010: PURPOSES:

The industrial districts are designed to preserve and promote the development of efficient industrial facilities and to maximize the compatibility with other land uses by:
   A.   Achieving the industrial goals, objectives and policies of the Okmulgee comprehensive plan.
   B.   Meeting the need for industrial services and goods of the city of Okmulgee and its trade area.
   C.   Preserving and promoting the development of efficient industrial areas and to minimize the adverse effects of industrial uses on other land uses, roadways and highways by:
      1.   Establishing bulk and area controls.
      2.   Requiring off street parking and loading facilities.
      3.   Establishing the various districts necessary to meet the need for a variety of industrial types.
      4.   Controlling the number, area, location, and types of signs.
      5.   Protecting the character of industrial districts and their peculiar suitability for industrial uses.
The IL industrial low intensity district: The IL district is designed to provide areas for light manufacturing, wholesaling, warehousing, and other industrial activities having no or few objectionable environmental influences. Normally, no noise or vibration from any operation conducted on the premises, other than that emanating from vehicular traffic (either continuous or intermittent) shall be detectable at any boundary line of the IL district. Manufacture of flammable materials that produce explosive vapors or gases is prohibited in IL districts. All land in the M1 and M2 zoning district under the 1964 zoning code shall be presumed to be IL under this zoning code unless an application for a zoning change is filed within ninety (90) days of the passage of this zoning code.
The IH industrial heavy intensity district: The IH district is designed and intended to provide areas for heavy manufacturing and other activities that may constitute substantial objectionable environmental influence or hazards. It is designed and intended to preserve existing high intensity industrial development and to facilitate the development of new high intensity industrial areas. All land in the M3 zoning district under the 1964 zoning code shall be presumed to be IH under this zoning code unless an application for a zoning change is filed within ninety (90) days of the passage of this zoning code. 17.08.020: PRINCIPAL USES:

The principal uses permitted in the industrial district are designated by use units. The use units are a grouping of individual uses and are fully described, including their respective off street parking, loading, and screening requirements and other use conditions in chapter 11 of this title. The use units permitted in industrial districts are set forth in table 1 of this section.

17.08.030: ACCESSORY USES:

   A.   Permitted In Industrial Districts: Accessory uses customarily incident to a principal use permitted in an industrial district are permitted in such a district. Provided that no residential use shall be allowed in any industrial zoning district, except that a guard may reside on the premises.
   B.   Accessory Use Conditions:
      1.   Accessory buildings shall meet the minimum building setback lines of the applicable district.
      2.   Accessory storage of materials, equipment, or products within two hundred feet (200') of an abutting residential district shall be screened by the erection of a screening wall or fence along the lot line or lines in common with the abutting residential district.
      3.   Accessory signs in the IL and IH district are subject to the use conditions of use unit 23.
   C.   Antenna Supporting Structures:
      1.   Antenna and antenna supporting structures which are accessory to an industrial use are permitted to be mounted on an industrial building or a customary accessory building; provided, that it does not exceed sixty five feet (65') in height measured from the average ground elevation at the industrial building to the highest horizontal point of the antenna and antenna supporting structure and that the surface area of all such mounted antennas shall not exceed ten (10) square feet. Only one side having the largest surface area is to be calculated. These provisions do not apply to principal use antenna structures or to antennas that are accessory to uses requiring planning commission approval.
      2.   Structures other than an industrial building or customary accessory building which are used to support accessory antennas (including guylines) shall:
         a.   Be located in the rear yard only, and be limited to one such structure;
         b.   Not exceed thirty five feet (35') in height, measured from the average ground elevation at the industrial building to the highest point of the antenna and antenna supporting structure;
         c.   Not encroach upon the land or airspace of any abutting property; and
         d.   Not exceed twenty four inches (24") in width above twenty five feet (25') in height, exclusive of guylines. (Ord. 1953, 2010)

17.08.050: SPECIAL USES, REQUIREMENTS:

The special uses which may be permitted in the industrial districts, as designated in section 17.08.020, table 1 of this chapter, are subject to the minimum requirements set out below, and such additional safeguards and conditions as may be imposed by the planning commission.
   A.   The accessory use provisions of the industrial districts pertaining to signs apply to signs which are accessory to uses permitted by special use; provided that each sign permitted shall primarily identify the principal industrial building; permitted convenient goods and services shall be secondary.
   B.   Special housing facilities in the use unit 2 (area wide special uses) shall meet the applicable use conditions and off street parking and loading requirements as provided in chapter 11 of this title.
   C.   Special uses that may be permitted in each industrial district category shall comply with and shall meet the applicable use conditions and off street parking and loading requirements as provided in chapter 11 of this title. (Ord. 1953, 2010)

17.08.060: VISUAL SCREENING:

All IL and IH zoning districts shall be permanently screened from adjoining and contiguous agricultural and residential districts by an opaque wall or fence which shall be a minimum height of eight feet (8'), and constructed with all braces and supports placed inside the district boundaries. For this purpose, adjacent and contiguous shall not include any property separated from the industrial district by a public arterial street, but shall include any property separated from the industrial district by a public minor or collector street.
