CHAPTER 17

09 AIRPORT DISTRICT PROVISIONS

17.09.010: SUPPLEMENTAL DISTRICT:

The airport district shall be a supplemental district and overlay to the other use districts under this zoning code. (Ord. 1953, 2010)

17.09.020: DEFINITIONS:

As used in this chapter, unless the context otherwise requires:
AIRPORT: An area of land or water that is used or intended to be used for the landing and taking off of aircraft including its buildings and facilities, if any.
AIRPORT HAZARD: Any structure, object of natural growth or use of land which obstructs the airspace required for the flight of aircraft in landing or taking off at an airport or is otherwise hazardous to such landing or taking off of aircraft.
AIRPORT HAZARD AREA: Any area of land or water upon which an airport hazard might be established if not prevented as provided in this chapter.
PERSON: Any individual, firm, partnership, corporation, company, association, or joint stock association, and includes any trustee, receiver, assignee, or other similar representative thereof.
STRUCTURE: Any object constructed or installed by man, including, but without limitation, buildings, towers, smokestacks, and overhead transmission lines.
TREE: Any object of natural growth. (Ord. 1953, 2010)

17.09.030: PERMITS REQUIRED:

Permits from the local airport zoning authority may be required only within an airport hazard area where federal standards are exceeded and if the proposed construction is within:
   A.   A ten (10) nautical mile radius of the geographical center of a publicly owned or operated airport, a military airport, or an airport open for public use which has a published instrument approach procedure;
   B.   A six (6) nautical mile radius of the geographical center of a publicly owned or operated airport, a military airport, or an airport open for public use which has no published instrument approach procedure and has runways in excess of three thousand two hundred feet (3,200') in length; or
   C.   A 2.5 nautical mile radius of the geographical center of a publicly owned or operated airport, a military airport, or an airport open for public use which has no published instrument approach procedure and has runways three thousand two hundred feet (3,200') or less in length. 17.09.040: STANDARDS:

In determining whether to issue or deny a permit, the local airport zoning authority shall consider:
   A.   The nature of the terrain and height of existing structures;
   B.   Public and private interests and investments;
   C.   The character of flying operations and planned developments of airports;
   D.   Federal airways as designated by the federal aviation administration that lie within the radii described in subsections 17.09.030A through C of this chapter;
   E.   Whether the construction of the proposed structure would cause an increase in the minimum descent altitude or the decision height at the affected airport;
   F.   Technological advances;
   G.   The safety of persons on the ground and in the air;
   H.   Land use density; and
   I.   Whether the application seeks a permit or variance for the erection, alteration, or modification of any structure which would result in the structure exceeding the federal obstruction standards pursuant to 14 CFR, part 77. (Ord. 1953, 2010)

17.09.050: AIRPORT ZONING COMMISSION:

There is hereby created a joint airport zoning board, which board shall have the same power to adopt, administer and enforce airport zoning regulations applicable to the airport hazard area associated with the airport located within the city. Each joint board shall have as members three (3) representatives appointed by the city of Okmulgee and two (2) representatives appointed by the Okmulgee County commissioners. A chairman shall be elected by a majority of the members so appointed. The chairman shall be elected by the appointed membership of the board for a term of two (2) years. The existing airport zoning commission shall continue in office until the end of their existing terms of office. (Ord. 1953, 2010)

17.09.060: CONFLICT OF REGULATIONS:

In the event of conflict between any airport zoning regulations adopted under this chapter and any other and more general zoning regulations applicable to the same area, whether the conflict be with respect to the height of structures or trees, the use of land, or any other matter, and whether such other regulations were adopted by the political subdivision which adopted the airport zoning regulations or by some other political subdivision or the commission, the more stringent limitation or requirement shall govern and prevail.
