12 - DISTRICT REGULATIONS
Sections:
A.
Purpose. The purpose of this district is to allow limited agricultural activity within the corporate limits of the municipality until such time that the area is rezoned for urban use.
B.
Uses by Right. A use by right is any of the following uses, which are permitted upon issuance of a zoning permit by the zoning administrator:
1.
Accessory buildings and uses;
2.
Dwelling, single-family;
3.
Farming.
C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the planning commission:
1.
Cemetery;
2.
Church;
3.
Clubs;
4.
Family care home;
5.
Greenhouse;
6.
Home occupation;
7.
Keeping of livestock;
8.
Kennel;
9.
Manufactured home/modular home;
10.
School.
D.
Lot Area. No parcel of land shall be divided for sale into lots less than thirty-five (35) acres after the passage of the ordinance codified in this title.
1.
All subdivision of land shall comply with the Ordway West subdivision regulations;
2.
The land shall front on a dedicated roadway.
E.
Setback Requirements.
1.
Minimum front yard: thirty (30) feet;
2.
Minimum side yard: ten feet;
3.
Minimum rear yard: fifteen (15) feet.
F.
Lot Coverage. The total coverage of all buildings shall not occupy more twenty-five (25) percent of the lot area.
G.
Height of Buildings.
1.
Maximum height for principal uses: forty-five (45) feet;
2.
Maximum height for accessory uses: thirty (30) feet.

B.
Uses by Right. A use by right is any of the following uses, which are permitted upon issuance of a zoning permit by the zoning administrator:

Dwelling, single-family;
3.
Park;
4.
School;
5.
Modular home.
C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the municipal planning commission:
1.
Charitable institution;
2.
Church;
3.
Club;
4.
Extended care facility;
5.
Family care home;
6.
Home for the developmentally disabled;
7.
Home occupation;
8.
Hospital;
9.
Manufactured home/mobilehome.
D.
Lot Area. No parcel of land existing in single ownership at the time of the passage of the ordinance codified in this title can henceforth be divided for sale into less than six thousand seven hundred fifty (6,750) square feet.
1.
Lot Dimensions. No parcel of land shall be less than fifty (50) feet and one hundred (100) feet in depth.
E.
Setback Requirements.
1.
Minimum front yard: twenty (20) feet;
2.
Minimum side yard: five feet, total side yard: fifteen (15) feet;
3.
Minimum rear yard: fifteen (15) feet.
F.
Lot coverage. The total ground area covered by all buildings on the parcel shall not exceed fifty (50) percent of the total ground area of the parcel.
G.
Height of Buildings.
1.
Maximum height for principal uses: thirty-five (35) feet;
2.
Maximum height for accessory uses: twenty (20) feet.

C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the municipal planning commission:
1.
Church;
2.
Club;
3.
Extended care facility;
4.
Family care home;
5.
Home for the developmentally disabled;
6.
Home occupation;
7.
Hospital;
8.
Hotel;
9.
Mobilehome park;
10.
School.
D.
Lot Area. No parcel of land existing in a single ownership at the time of the passage of the ordinance codified in this title can henceforth be divided for sale into lots of less than five thousand (5,000) square feet and each additional unit shall require an additional one thousand five hundred (1,500) square feet of lot area.

Lot Dimensions. No parcel of land shall be less than fifty (50) feet in width and one hundred (100) feet in depth.
E.
Setback Requirements.
1.
Minimum front yard: twenty (20) feet;
2.
Minimum side yard: five feet, total side yard: fifteen (15) feet;
3.
Minimum rear yards: fifteen (15) feet.
F.
Lot Coverage. The total ground area covered by all buildings on the parcel shall not exceed fifty (50) percent of the total ground area of the parcel.
G.
Height of Buildings.
1.
Maximum height for principal uses: forty-five (45) feet;
2.
Maximum height for accessory uses: fifty (50) feet.

1.
Accessory buildings and uses;
2.
Barber and beauty shop;
3.
Business and professional office;
4.
Convenience store
5.
Delicatessen;
6.
Drygoods store;
7.
Drugstore;
8.
Hardware store;
9.
Laundromat;
10.
Restaurant.
C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the municipal planning commission:
1.
Hotel;
2.
Medical, dental and health clinics;
3.
Parking lots;
4.
Supermarket;
5.
Service station, gasoline;
6.
Bar and lounge;
7.
Retail liquor outlets;
8.
Single family apartment dwellings.
D.
Lot Area. No parcel of land shall be subdivided into lots for sale less than five thousand (5,000) square feet after the passage of the ordinance codified in this title.
E.

B.
Uses by Right. A use by right is any of the following uses, which are permitted upon issuance of a zoning permit by the zoning administrator:

Accessory buildings and uses;
2.
Agricultural implement and sales store;
3.
Automobile accessory store;
4.
Automobile and trailer sales area;
5.
Business and professional office;
6.
Drive-in restaurant;
7.
Hotels;
8.
Mortuaries;
9.
Motels;
10.
Vehicle repair services.
C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the municipal planning commission:
1.
Bar and lounge;
2.
Drive-in theatres;
3.
Educational institution;
4.
Kennels;
5.
Convenience store;
6.
Retail liquor outlet;
7.
Restaurant;
8.
Service station, gasoline;
9.
Supermarket.
D.
Lot Area. No parcel existing in single ownership at the time of the passage of the ordinance codified in this title shall be divided for sale in units smaller than ten thousand (10,000) square feet.
1.
The parcel shall provide for an access or frontage road if it fronts on a state or federal highway.
E.
Setback Requirements.
1.
Minimum front yard: fifty (50) feet;
2.
Minimum side yard: ten feet;
3.
Minimum rear year: twenty (20) feet.
F.
Lot Coverage. The total coverage of all buildings shall not occupy more than fifty (50) percent of the lot area.
G.
Height of Buildings.
1.
Maximum height for principal uses: forty-five (45) feet;
2.
Maximum height for accessory uses: twenty (20) feet.

Purpose. The standards of this district are designed to retain and provide areas for the manufacture, warehousing, jobbing and limited retailing of products which by their inherent characteristics and the operation involved are not obnoxious to one another or surrounding uses.
B.
Uses by Right. A use by right is any of the following uses, which are permitted upon issuance of a zoning permit by tho zoning administrator:
1.
Agricultural implements, manufacture, sales, service;
2.
Auto garages, rental vehicles;
3.
Auto, service and body work;
4.
Auto storage;
5.
Beer, ale and liquor, wholesale;
6.
Brick manufacture, wholesale;
7.
Can, wholesale;
8.
Cement products, retail, wholesale;
9.
Concrete batching or "ready mix" plant;
10.
Contractors' equipment and supplies, retail, wholesale;
11.
Fences, manufacture, retail, wholesale;
12.
Freight depot;
13.
Frozen food lockers;
14.
Industrial equipment, assembly, retail, rental, storage, wholesale;
15.
Motor freight company garage;
16.
Truck parking, service garage;
17.
Warehousing.
C.
Uses by Review. A use by review is any of the following uses, which are permitted only upon issuance of a special use permit by the Ordway planning commission:
1.
Any processing or fabrication industry; 2. Cafe, cafeteria;
3.
Feed and/or grain, manufacture, wholesale, retail;
4.
Junk yard;
5.
Residence for watchman or caretaker.
D.
Lot Area. No parcel of land shall be subdivided into lots for sale less than ten thousand (10,000) square feet after the passage of the ordinance codified in this title.
E.
Setback Requirements.
1.
Minimum front yard: fifty (50) feet;
2.
Minimum side yard: ten feet;
3.
Minimum rear yard: fifteen (15) feet.
F.
Lot Coverage. No requirements.
G.
Height of Buildings. No requirements.
H.
Performance Standards.
1.
The volume of sound generated by this use shall not inherently or recurrently exceed sixty (60) decibels at any point of any boundary line of the zone lot on which the use is located.
2.
The vibrations generated by this use shall not inherently or recurrently be perceptible, without instruments at any point of any boundary line of the zone on which the use is located.
3.
The emission of heat, glare, radiation and fumes by this use shall not emit any obnoxious or dangerous degree of heat, glare, radiation or fumes beyond any point of any boundary line of the zone on which the use is located.

A.
Purpose. The standards of this district are designed to retain and provide areas for the unobstructed passage of floodwaters and give protection from floods to the population, buildings and structures located therein and in the surrounding areas, as defined by information available to the municipal planning commission.
B.
Uses by Right. A use by right is any of the following uses, which are permitted without issuance of a zoning permit by the zoning administrator until such time that a distinction can be made between a low hazard zone and a floodway zone in relation to an intermediate regional flood:
1.
Farming;
2.
Park;
3.
Riding trails and fields.
C.
Uses by Review. A use by review is any of the uses in the A-1, R-1, R-2, C-1, C-2 and I-1 districts, which are either uses by right or uses by review when the appropriate district underlays the floodplain overlay district and all floodplain stipulations are met. Where interpretation is required as to the exact location of the boundaries of the floodplain, the applicant shall provide the necessary information to make that interpretation.

D.
Lot Area. No parcel of land shall be divided for sale into lots less than one acre after the passage of the ordinance codified in this title.
1.
Minimum lot width: one hundred fifty (150) feet;
2.
Minimum lot depth: one hundred fifty (150) feet.
E.
Setback Requirements.
1.
Minimum front yard: thirty (30) feet;
2.
Minimum side yard: ten feet;
3.
Minimum rear yard: fifteen (15) feet.
F.
Lot Coverage. The total coverage of all buildings shall not occupy more than twenty-five (25) percent of the lot area.
G.
Height of Buildings.
1.
Maximum height for principal uses: thirty-five (35) feet;
2.
Maximum height for accessory uses: twenty (20) feet.
H.
Special Flood District Regulations. No development, new construction, substantial improvement, use, fill, encroachments, construction or alteration on or over any portion of a floodway shall be permitted which along, or cumulatively with other such activities, is designed so that it would cause or result in any of the following:
1.
The storage or processing of materials that in times of flooding are buoyant, flammable, explosive or otherwise potentially injurious to human, animal or plant life;
2.
The disposal of garbage or other solid waste materials;
3.
Substantial solid debris being carried downstream by floodwaters;
4.
Any enlargement of a floodplain which would cause damage to or on lands other than those being proposed for development;
5.
Human occupation of fixed residential structures, either permanent or temporary, which are not floodproofed to at least one foot above the level of the one hundred (100) year flood in accordance with the standards for completely floodproofed structures contained within Sections 210.2.1 FP 1 or 210.2.2. FP 2 of the U.S. Army Corps of Engineers publication entitled, "Floodproofing Regulations," June, 1972, GPO: 19730-505-026 Edition or any subsequent edition thereto;
6.
Any proposed construction in a floodplain which is not anchored to prevent flotation, collapse or lateral movement of the structure;
7.
Any obstruction which would adversely affect the efficiency of or restrict the flow capacity of a designated floodplain so as to cause foreseeable damage to others, wherever located;
8.
Designs for new or replacement water supply systems and sanitary sewage systems do not minimize or eliminate infiltration of floodwaters and do not provide for on-site waste disposal systems to be located so as to avoid impairment of them, or contamination from them, during or subsequent to flooding;
9.
The location of any portion of a new mobilehome park, of any expansion to an existing mobilehome park, and the location of any new mobile structure not in a mobilehome park.

Lot Area. No parcel of land shall be divided for sale into lots less than one acre after the passage of the ordinance codified in this title.
1.
Minimum lot width: one hundred fifty (150) feet;
2.
Minimum lot depth: one hundred fifty (150) feet.
E.
Setback Requirements.
1.
Minimum front yard: thirty (30) feet;
2.
Minimum side yard: ten feet;
3.
Minimum rear yard: fifteen (15) feet.
F.
Lot Coverage. The total coverage of all buildings shall not occupy more than twenty-five (25) percent of the lot area.
G.
Height of Buildings.
1.
Maximum height for principal uses: thirty-five (35) feet;
2.
Maximum height for accessory uses: twenty (20) feet.
H.
Special Flood District Regulations. No development, new construction, substantial improvement, use, fill, encroachments, construction or alteration on or over any portion of a floodway shall be permitted which along, or cumulatively with other such activities, is designed so that it would cause or result in any of the following:
1.
The storage or processing of materials that in times of flooding are buoyant, flammable, explosive or otherwise potentially injurious to human, animal or plant life;
2.
The disposal of garbage or other solid waste materials;
3.
Substantial solid debris being carried downstream by floodwaters;
4.
Any enlargement of a floodplain which would cause damage to or on lands other than those being proposed for development;
5.
Human occupation of fixed residential structures, either permanent or temporary, which are not floodproofed to at least one foot above the level of the one hundred (100) year flood in accordance with the standards for completely floodproofed structures contained within Sections 210.2.1 FP 1 or 210.2.2. FP 2 of the U.S. Army Corps of Engineers publication entitled, "Floodproofing Regulations," June, 1972, GPO: 19730-505-026 Edition or any subsequent edition thereto;
6.
Any proposed construction in a floodplain which is not anchored to prevent flotation, collapse or lateral movement of the structure;
7.
Any obstruction which would adversely affect the efficiency of or restrict the flow capacity of a designated floodplain so as to cause foreseeable damage to others, wherever located;
8.
Designs for new or replacement water supply systems and sanitary sewage systems do not minimize or eliminate infiltration of floodwaters and do not provide for on-site waste disposal systems to be located so as to avoid impairment of them, or contamination from them, during or subsequent to flooding;
9.
The location of any portion of a new mobilehome park, of any expansion to an existing mobilehome park, and the location of any new mobile structure not in a mobilehome park.
