01 - GENERAL PROVISIONS
The ordinance codified in this title shall be known as the Zoning Ordinance of the City of Oskaloosa.

The provisions of this title shall be applicable to all property within the corporate limits of the city and its two mile extra-territorial jurisdiction, as provided by Chapter 414, Code of Iowa. The zoning jurisdiction does not include:
A.
The City of Beacon.
B.
The City of University Park.
C.
The area in Mahaska County noted in the Comprehensive Plan Future Land Use Map that is generally east of University Park described as the eastern city limits of University Park continuing to Osburn Avenue in Mahaska County, and all quarter-quarter sections, or portions thereof, east of Osburn Avenue bounded by 265 th Street on the south and Highway 92 on the north.

The purposes of this title are to:
A.
Serve the public health, safety, and general welfare of the city and its jurisdiction.
B.
Classify property in a manner that reflects its suitability for specific uses.
C.
Provide for sound, attractive development within the city and its jurisdiction.
D.
Encourage compatibility of adjacent land uses.
E.
Protect environmentally sensitive areas.
F.
Further the objectives of the comprehensive plan of the city.

The city intends that this title and any amendments to it shall be consistent with the City's Comprehensive Plan and other adopted plans. It is the city's intent to amend this title whenever such action is deemed necessary to keep regulatory provisions in conformance with the Comprehensive Plan.

This title shall be held to provide the minimum requirements necessary for the promotion of the public health, safety, and welfare. If any provision of this title conflicts with any other provision of this title, any other ordinance of the city, or any applicable state or federal law, the more restrictive provision shall apply. Where for specific land, the requirements of any other ordinances of the city are more stringent or restrictive than the requirements set forth in this title, nothing herein shall be construed to waive compliance with the provisions of such other ordinance.

Nothing in this title shall relieve any property owner or user from satisfying any condition or requirement associated with a previous approval, special permit, variance, development permit, or other permit issued under any local, state, or federal ordinance or statute.

The provisions of this title shall be held to be minimum requirements.

If any chapter, section, clause, or phrase of this title is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this title.

This title shall be posted in a publicly accessible digital format as well as published in book form and shall, together with the maps being a part hereof, be filed in city hall of the city.

The effective date is the adopted date or most recent amended date of this title by the city council.
