ARTICLE I

General Provisions

§ 150-1 Title.

This chapter shall be known and cited as the "Town of Owasco Zoning Law."

§ 150-2 Compliance and applicability to existing uses and structures.

No building or structure or land shall be used or occupied, and no building or part thereof, shall be erected, moved, enlarged, or altered unless in conformity with the regulations of this chapter.
This chapter shall not require any change to any structure or use legally existing at the effective date or to any planned or started structure or use that was in compliance with existing laws prior to the effective date and completed within one year thereafter, except as may be provided in Article XIX, Non-Conformities.

§ 150-3 Purpose.

This chapter is made to promote the health, safety, morals, and the general welfare of the community and to lessen congestion in the streets; to secure safety from fire, flood, panic, and other dangers; to provide adequate light and air; to prevent the overcrowding of land; to avoid concentration of population; and to facilitate the adequate provisions of transportation, water, sewerage, schools, parks, and other public requirements. Under and pursuant to Article 16 of the Town Law of the State of New York, the size of buildings and other structures, the percentage of lot that may be occupied, the size of the yards, the density of population, and the use of buildings, structures, and land for trade, industry, residence, or other purposes are hereby restricted and regulated as hereinafter provided in order for orderly growth while retaining the rural and suburban atmosphere and character of the Town of Owasco.

§ 150-4 Interpretation and special agreements.

In the interpretation and application of the provisions of this chapter, they shall be considered to be the minimum requirements necessary to achieve the objectives of this chapter. There is no intention to interfere with or abrogate or annul any easement, covenant, or other agreement between parties. Except where other rules, regulations, or ordinances; or any easement, covenant, or other agreement impose greater restrictions upon use, dimensions, or bulk; or require larger open spaces, the provisions of this chapter shall apply.

§ 150-5 Jurisdiction.

The regulations and provisions of this chapter shall apply to and affect all lands in the Town of Owasco.
