ARTICLE III

Establishment of Districts

§ 150-8 Districts enumerated.

The Town of Owasco is hereby divided into the following types of zoning districts:
Agricultural Residential District (AR). The purpose of the Agricultural Residential Zoning District is to promote the continued use of the land for agricultural production of all scales. The intent of the Agricultural Residential Zoning District is to protect the rural agrarian character of the Town of Owasco by requiring larger lot sizes and restricting expansion of public water and sewer lines (see Article IV for procedures and requirements).
Residential District (R). The purpose of the Residential Zoning District is to allow for future residential development in areas adjacent to the higher density urban development patterns of the City of Auburn, significant transportation corridors such as State Route 38A (East Lake Road), and the Town's historical hamlets. The intent of the Residential Zoning District is to provide for future residential development in areas that are either currently served by water or that have already been experiencing a pattern of more dense development than elsewhere in the Town. This District will provide for a greater mix of housing types and densities leading to more housing choices for residents of all ages and income levels. The Residential District will also provide for certain limited Neighborhood Commercial uses through the intuitive reuse of buildings that were previously built or designed for commercial use and are currently integrated in the fabric of existing neighborhoods (see Article IV for procedures and requirements).
Lakeshore District (L). The purpose of the Lakeshore Zoning District is to allow for residential development along the Owasco Lake shore while also protecting the water quality of the lake from nonpoint and point source pollution that can occur when runoff from land flows into the lake, carrying sediment and other pollutants that adversely affect water quality, as well as to protect the natural and aesthetic beauty of the lakeshore in the Town of Owasco. The intent of the Lakeshore Zoning District is to minimize excessive and incompatible development in fragile lakefront areas (see Article IV for procedures and requirements).
Planned Development District, encompassing AR, R, and L Districts (PDD). The purpose of Planned Development Zoning Districts is to provide flexible land use and design regulations for certain types of development that merit case-by-case land impact considerations and the establishment of specific performance criteria. In a Planned Development Zoning District, land and building may be used for any lawful purpose in any established district as authorized by the Town Board of Owasco in specific instances. Where deemed appropriate, the Town Board of Owasco may consider a proposed Planned Development Zoning District through an approval process requiring a Zoning District change from the original district to a PDD, in which the approved plat and a complete set of use and dimensional regulations become the basis for continuing land use controls (see Article VIII for procedure and requirements).
Stream Corridor, Lakeshore, and Floodplain Environmental Protection Overlay District (EPOD-SLF). The purpose of the Stream Corridor, Lakeshore, and Floodplain Environmental Protection Overlay Zoning District is to protect and preserve the waterways, prevent soil erosion and sedimentation due to removal of vegetation, dredging, filling, damming, or channelization, and to prevent activities which degrade water quality or fish and wildlife habitat. The intent of the District is to provide special controls to guide land development adjacent to waterway corridors in the Town of Owasco (see § 150-41 for procedure and requirements).
Steep Slope Environmental Protection Overlay District (EPDO-SS). The purpose of the Steep Slope Environmental Protection Overlay Zoning District is to minimize the impacts of development activities on slopes 15% or greater in the Town of Owasco by regulating activities in such areas and by requiring approval prior to project commencement. The intent of this District is to minimize the disturbance or removal of existing vegetation, prevent increased soil erosion and stormwater runoff, maintain established drainage systems, locate development where it is less likely to cause future slope failures, and to retain, as much as possible, the natural character of these areas (see § 150-42 for procedure and requirements).
Solar Energy System Overlay District (FOD-S). The purpose of the Solar Energy System Overlay Zoning District is to facilitate the responsible development of Tier 3 solar energy systems, as defined in Article IX, on adequately sized and located parcels. This District aims to harness the benefits of renewable energy resources while protecting resources considered significant to the community. The intent of the District is to establish specialized procedures to guide the placement and operation of large-scale solar energy systems in a manner that aligns with community objectives, such as preserving environmental resources, agricultural resources, and ensuring neighborhood compatibility (see Article X for procedures and requirements).

§ 150-9 Zoning Map.

Said districts are bounded as shown on a map entitled "Zoning Map of the Town of Owasco," adopted __________, and certified by the Town Clerk, which accompanies and which with all explanatory matter thereon, is hereby made a part of this Zoning Law (Note: See Appendix A for the Zoning Map.[1])

§ 150-10 Interpretation of district boundaries.

Where uncertainty exists with respect to the boundaries of any of the aforesaid districts as shown on the Zoning Map, the following rules shall apply:
Where district boundaries are indicated as approximately following the center lines of streets or highways, street lines or highway right-of-way lines, such centerlines, street lines, or highway right-of-way lines shall be construed to be said boundaries.
Where district boundaries are so indicated that they approximately follow the lot lines, such lot lines shall be construed to be said boundaries.
Where district boundaries are so indicated that they approximately parallel to the centerlines or street lines of streets or the centerlines of right-of-way lines of highways, such district boundaries shall be construed as being parallel thereto and at such distance therefrom as shall be determined by the use of the scale shown on the Zoning Map.
In case of further uncertainty as to the true location of a Zoning District boundary line in a particular instance, the Zoning Board of Appeals shall determine the location of such boundary.
