ARTICLE XIII

Dimensional Requirements

§ 150-91 Purpose and intent.

The regulations for each district pertaining to minimum lot size, minimum lot width, minimum front setback, minimum side setback, minimum rear setback, maximum building height, and maximum building and impervious coverage shall be specified in this Article, subject to further provisions of this chapter as specified in Article IV.

§ 150-93 Area of lot and yard requirements.

The lot or yard areas required for any new building or use shall not include any part of a lot that is required by any other building or use to comply with the requirements of this article. No lot shall be so altered that the area of the lot or the dimensions of yards or other open spaces are smaller than herein prescribed.

§ 150-94 Exceptions to lot requirements.

The provisions of § 150-92 shall not prevent the construction of a single-family dwelling, provided that the yard requirements are observed, on any lot which was lawful when created and which, prior to the effective date of this Article, was in separate ownership duly recorded by plan or deed.
Exemption of lots shown on approved subdivision plats shall be made in accordance with the provisions of § 265-a of the New York State Town Law.
Flag lots. Flat-lot development shall not be permitted, except where such development is the only reasonable development option, and shall conform to the provisions of § 150-124G(4).

§ 150-95 Clear sight triangles.

On any corner lot, no wall, fence, or other structure shall be erected or altered or no hedge, tree, shrub, or other growth, except agricultural crops, shall be maintained which may cause danger to traffic on a public street by obscuring the view. Visual obstructions shall be limited to a height of not more than two feet above street level within the triangular area bounded by the street lines and a straight line drawn between points on each such street line 25 feet from the intersection of said street lines, as demonstrated in the diagrams below.

Where a private accessway intersects a public street, visual obstructions shall be limited to a height of not more than two feet above street level within the triangular area bounded by the street line, the edge of a private accessway, and a straight line drawn between points on both the street line and the edge of the accessway 10 feet from the intersection of said lines.
Fences, terraces, and projections in required yards. Subject to this section, the provisions of § 150-92 shall not apply to the following:
Fences or walls less than seven feet high above the natural grade when located in a rear or side yard.
Fences or walls less than four feet high above the natural grade when located in a front yard.
Terraces, steps, uncovered porches, or other similar features not over three feet high above the floor level of the ground story.
Arbors, open trellises, flagpoles, recreation, and drying yard equipment.
Subject to this section, the front yard requirements of § 150-92 shall not apply to accessory signs and farm stands.

§ 150-96 Exceptions to yard requirements.

Other provisions of this chapter notwithstanding, no residence in any district need have a front yard greater in depth than the average depth of the front yards of the lots next thereto on either side, a vacant lot or lot with a front yard greater than the minimum required depth being counted as if it were the minimum front yard for that district in which it is located, but in no case shall the front yard in any residential district be less than 20 feet in depth.
Front and side yards of corner lots. On a corner lot, the street side yard shall equal the required front yard for lots facing that street.
Subject to § 150-95, the front yard requirements of § 150-92 shall not apply to accessory signs and farm stands.

§ 150-97 Exception to height requirements.

Maximum height regulations shall not apply to farm buildings, church spires, chimneys, or other structures build above the roof and not devoted to human occupancy, nor to structures specifically regulation in other sections of this article.
