- AUTHORITY, PURPOSE, AND SCOPE
This ordinance has been drafted, subjected to public review, recommended by the Ozark Planning Commission, and adopted by the Ozark City Council under the authority of the Code of Ala. 1975, Title 11, Chapter 52.
This appendix shall be known as the Zoning Ordinance of the City of Ozark, Alabama, and the Zoning Map, which is a part of this appendix, shall be known as the Zoning Map of the City of Ozark, Alabama.
The specific purpose of this appendix is to influence the use of property within the City of Ozark in accordance with the Code of Ala. 1975, Title 11, Chapter 52; and generally to implement and support the developmental policies of the City Council of the City of Ozark.
The provisions of this appendix shall apply to all property located within the corporate boundary of the City of Ozark. All uses, structures, sites, lots and parcels must be in compliance with the provisions of this appendix.
The provisions of this appendix shall be considered minimum requirements to promote the public health, safety, and welfare.
In any situation in which there is a conflict between the provisions of this appendix, and those of any statute, or any local law or regulation, the most restrictive of such provisions shall apply and be enforced.
If any clause, portion, provision, or section of this appendix is held to be invalid by any court of competent jurisdiction, such holding shall not render invalid any other clause, portion, provision, or section.
On the effective date of this appendix, all other local ordinances or parts of ordinances in conflict or inconsistent with this appendix, including but not limited to Ordinance No. [2003-10] and all amendments thereto, are hereby repealed to the extent necessary to give this appendix full force and effect.
