ARTICLE XI

- AMENDING THE ORDINANCE

Section 1. - Petition for change.

A proposed change of district boundaries or regulations of this appendix may be initiated by the city council, the planning commission or by petition of property owners or agent of such owners of property within the area proposed to be changed, subject to this appendix.

Section 2. - Action on petition.

Any proposed amendment, modification or repeal shall first be submitted to the planning commission for its recommendation and report. The planning commission shall have sixty (60) days within which to submit its recommendations to the city council. If the planning commission fails to submit a report within the sixty-day period, it shall be deemed to have approved the proposed amendment and the city council shall proceed to hold a public hearing pursuant to Code of Ala. 1975, Tit. 11, Ch. 52. Any party or parties wishing to speak for or against an amendment shall appear and speak at the public hearing.

Section 3. - Fees.

A schedule of application fees for consideration of all approvals, permits, certificates, and public hearings required under this appendix shall be established by separate resolution or ordinance. Such fees shall be computed so as to recover all costs incurred by the city in reviewing and processing zoning-related requests, including advertising fees; and shall be adopted and revised as necessary by the city council.

Section 4. - Limitation on re-hearing a petition for change.

No action shall be initiated for an amendment to this appendix affecting the same parcel of land more than once a year, unless specifically authorized by the city council on the grounds that the circumstances and conditions relevant to the amendment request have changed significantly since the prior hearing.
