M MANUFACTURING

DISTRICT

§ 153.170 GENERAL PROVISIONS.

   Uses permitted in the M Manufacturing District shall be subject to the following conditions.
   (A)   All business, servicing, or processing, except for off-street parking and off-street loading facilities as prescribed by the city council in accordance with the provisions of §§ 153.16 through 153.24, shall be conducted within completely enclosed buildings.
   (B)   All storage within 650 feet of any dwelling or the R Residence District, except of motor vehicles in operable condition, shall be within completely enclosed buildings, or effectively screened by a solid wall or fence (including solid entrance and exit gates) not less than 6 feet nor more than 8 feet in height.
   (C)   Storage, utilization, or manufacture of materials or products which decompose by detonation shall not be permitted in the M Manufacturing District. Such materials shall include, but shall not be limited to, all primary explosives, such as lead azide, lead styphnate, fulminates, and tetracene; all high explosives, such as TNT, RDX, HMX, PETN, and picric acid; propellants and components thereof, such as nitrocellulose, black powder, boron hydrides, hydrazine and its derivatives; pyrotechnics and fireworks, such as magnesium powder, potassium chlorate, and potassium nitrate; blasting explosive, such as dynamite and nitroglycerin, unstable organic compounds such as acetylides, tetrazoles and ozonides; strong oxidizing agents such as liquid oxygen, perchloric acid, perchlorates, chlorates, and hydrogen peroxide in concentrations greater than 35%; and nuclear fuels, fissionable materials and products, and reactor elements, such as uranium 235 and plutonium 239.
   (D)   Storage or utilization of inflammable, combustible, or explosive liquids, gases, materials, or products shall not be permitted in the M Manufacturing District, except as an incident to the manufacturing process, or, in the case of automobile service stations, retail distribution facilities, under the conditions in § 153.72. However, this shall not be so construed as to permit the storage, utilization, or manufacture of any materials or products referred to in division (C).
   (E)   Every use permitted in the M Manufacturing District shall be set back from residential areas for a distance the city council may deem necessary and shall meet the standards the city council may prescribe, to the end that no use shall become injurious or offensive to any persons or property by reason of the emission or creation of noise, vibration, smoke, dust, or other particulate matter, toxic or noxious materials, odors, fire or explosive hazards, or glare or heat. Any use which shall be or become injurious or offensive to the public health, safety, or welfare, by reason of any of the aforementioned factors shall not be permitted in this district, anything to the contrary herein notwithstanding.

§ 153.171 PERMITTED USES.

   (A)   Permitted uses of land or buildings, as hereinafter enumerated, shall be permitted in the M Manufacturing District, under the conditions specified. No building or lot shall be devoted to any use other than a use permitted hereunder, with the exception of the following:
      (1)   Uses lawfully established on the effective date of this ordinance.
      (2)   Special uses allowed in accordance with the provisions of § 153.172.
   (B)   The following uses are permitted in the M Manufacturing District:
      (1)   Any use permitted in the B Business District.
      (2)   Automobile service stations.
      (3)   Apparel and other products assembled from finished textiles.
      (4)   Cosmetic manufacture.
      (5)   Drugs and pharmaceutical products manufacture.
      (6)    Dyeing and cleaning establishments.
      (7)   Dwelling units for watchmen and their families, located on the premises where they are employed in such capacity.
      (8)   Engraving.
      (9)   Electronic or electrical pro-ducts assembly.
      (10)   Fur goods manufacture, but not including tanning and dyeing.
      (11)   Garages for storage, repair, and servicing of motor vehicles.
      (12)   Glass products manufacture, from previously manufactured glass.
      (13)   Household appliance products assembly and manufacture from prefabricated parts.
      (14)   Laundries.
      (15)   Lumber and building material yards.
      (16)   Municipal buildings and uses, except sewage treatment plants.
      (17)   Musical instruments assembly and manufacture.
      (18)   Office buildings.
      (19)   Plastic products manufacture, but not including the processing of raw materials.
      (20)   Public utility and public service uses.
      (21)   Research and testing laboratories.
      (22)   Storage wholesale warehouses.
      (23)   Sporting and athletic equipment manufacture.
      (24)   Uses of light manufacturing character similar to those enumerated hereinabove, provided that all conditions and requirements of §§ 153.170 through 153.175 are complied with.
      (25)   Accessory uses.
      (26)   Printing shops.

§ 153.172 SPECIAL USES.

   (A)   Special uses, as enumerated in § 153.172 (B), may be allowed in the M Manufacturing District, subject to the issuance of special use permits in accordance with the provisions of §§ 153.216 through 153.224.
   (B)   The following special uses may be allowed in the M Manufacturing District:
      (1)   Sewage treatment plants, community.
      (2)   Storage or utilization of inflammable,
combustible, or explosive liquids, gases, materials, or products, subject, however, to the provisions of § 153.170, and to the following conditions:
         (a)   The storage or utilization shall be an incident to the manufacturing process, or, in the case of automobile service stations, retail distribution facilities.
         (b)   The storage or utilization shall not be permitted within 500 feet of any dwelling or the R Residence District.
         (c)   The storage shall be within underground tanks or completely enclosed buildings equipped with an automatic fire extinguishing system.
         (d)   The storage or utilization shall comply with all fire prevention and safety rules, regulations, ordinances, or statutes heretofore or hereafter promulgated by the state, the city, or other interested governmental body.

§ 153.173 HEIGHT REGULATIONS.

   No building or structure shall exceed the height prescribed by the city council in each case, provided, that the regulations shall be substantially uniform as to uses of like character.

§ 153.174 AREA REGULATIONS.

   Every building or structure shall comply with all regulations promulgated by the city council as to setbacks, yards and open spaces, lot areas, and widths, provided that the regulations shall be substantially uniform as to uses of like character.

§ 153.175 OFF-STREET PARKING AND OFF-STREET LOADING REGULATIONS.

   Off-street parking and off-street loading facilities shall be provided in each case as may be prescribed by the city council in accordance with the provisions of §§ 153.16 through 153.24.
