CHAPTER 4

ZONING DISTRICTS AND MAP

10-4-1: PURPOSE:

The town of Parker is hereby zoned and divided into zoning districts and overlay districts. The purpose of establishing these districts is:
   A.   To implement the goals, objectives, and policies of the town of Parker general plan;
   B.   To conserve and promote the public health, safety and general welfare;
   C.   To encourage the most appropriate use of land throughout the town and to ensure logical and orderly growth and development of the physical elements of the town;
   D.   To conserve and enhance the economic, social, and aesthetic values of the town;
   E.   To protect, maintain, and improve the integrity and character of the established neighborhoods, regulate new development, and improve the town's overall quality of life. (Ord. 03-2005, 9-6-2005)

10-4-2: ESTABLISHMENT OF ZONING DISTRICTS:

   A.   In accordance with the requirements of the zoning enabling act 1 that zoning regulations be by districts, the town of Parker, as shown on the zoning map(s) accompanying this title and incorporated herein by this reference, is hereby divided into the following zoning districts and overlay districts:
      1.   Single Residence Districts:
 
RR-20
Rural residential - minimum twenty (20) acres per dwelling unit.
RR-2.5
Ranch residential - minimum one hundred eight thousand nine hundred (108,900) square feet (21/2
R1-43
Low density residential - minimum forty three thousand five hundred sixty (43,560) square feet (1 acre) per dwelling unit.
R1-18
Low density residential - minimum eighteen thousand (18,000) square feet per dwelling unit.
R1-10
Medium density residential - minimum ten thousand (10,000) square feet per dwelling unit.
R1-7
Medium density residential - minimum seven thousand five hundred (7,500) square feet per dwelling unit.
 
      2.   Multiple Residence Districts:
 
R-2
Medium-high density residential - minimum three thousand six hundred (3,600) square feet per dwelling unit (maximum 12 dwelling units per acre).
R-3
High density residential - minimum two thousand four hundred (2,400) square feet per dwelling unit (maximum 18 dwelling units per acre).
R-4
Very high density residential - minimum one thousand eight hundred (1,800) square feet per dwelling unit (maximum 24 dwelling units per acre).
 
      3.   Commercial Districts:

      4.   Industrial Districts:

      5.   Open Space Conservation, Recreational And Public Use Districts:

      6.   Overlay Districts:

   B.   Additional zoning districts may be added from time to time upon the recommendation of the planning and zoning commission to the town council. Proposed changes to the zoning district regulations or the official zoning map, including the addition of new districts, may be submitted by the planning and zoning commission, town staff, town council, or any other interested party.
   C.   Uses not listed as a permitted use or a conditional use within the applicable zoning district regulations are prohibited.
   D.   If a use does not conform to the uses designated as permitted uses within the zoning district, the applicant may submit an application for an amendment to the official zoning map and/or the text of this title, or an interpretation of district boundaries or permitted uses pursuant to chapter 3 of this title. 10-4-3: ZONING MAP:

   A.   The locations and boundaries of zoning districts shall be designated on a map or maps entitled zoning map(s) of the town of Parker and said map(s) and all notations, references and other information shown thereon shall be as much a part of this title as if the matters and information set forth by said map(s) were all fully described herein.
   B.   The zoning map(s), dated and signed by the mayor and town clerk, shall be located in the office of the zoning administrator and a copy shall be kept on file with the town clerk. Any changes thereto shall be clearly shown on the zoning map(s) when officially adopted by the town council. (Ord. 03-2005, 9-6-2005)

10-4-4: DISTRICT BOUNDARIES:

   A.   Where uncertainty exists concerning the boundaries of any zoning district shown on the zoning map(s), the following rules shall apply:
      1.   Where zoning district boundaries are indicated as approximately following street or alley lines or the centerlines thereof, such lines shall be construed to be the zoning district boundaries.
      2.   Where zoning district boundaries are so indicated that they approximately follow property lines, such property lines shall be construed to be zoning district boundaries.
      3.   Where zoning district boundaries are indicated as approximately following the line of any stream or other waterway, the center of such stream or waterway shall be construed to be zoning district boundaries.
      4.   If zoning district boundary lines are fixed by dimensions shown on the zoning map(s), such dimensions shall govern.
      5.   In cases where the above described lines are not used, the zoning district lines shall be determined by using the scale of the zoning map.
      6.   Whenever any street, alley or other public way is vacated by the town council, the zoning districts adjoining each side of such street, alley or public way shall be considered as extended to the center of such vacation and all areas included in the vacation shall then be subject to all appropriate regulations of those zoning districts.
   B.   Any dispute as to the boundary or location of property within a zoning district shall be resolved in accordance with chapter 3 of this title.
   C.   Conditions imposed by special ordinance in conjunction with amendments to the zoning map(s) are referenced to separate files maintained in the office of the zoning administrator and are hereby made a part of the zoning map(s). (Ord. 03-2005, 9-6-2005)

10-4-5: ESTABLISHING TOWN ZONING IN ANNEXED AREAS:

   A.   Pursuant to Arizona Revised Statutes section 9-462 et seq., Parker may enact an ordinance authorizing county zoning to continue in effect until municipal zoning is applied to land previously zoned by the county and annexed by the municipality, but in no event for longer than six (6) months after the annexation.
