CHAPTER 9

OPEN SPACE AND PUBLIC LAND ZONING DISTRICTS

10-9-1: PURPOSE:

The purpose of the open space zoning districts is to conserve and protect open spaces, desert washes and floodplains, wildlife habitat, and lands agreed to be left undeveloped through the plan approval process. The primary purpose of designating these areas is to raise the degree of assurance that designated open space for conservation and recreational areas will remain open as well as to further the goals and objectives of the Parker general plan. The open space districts are further delineated in the following categories:
   A.   OSC open space conservation zoning district: The purpose of this zoning district is to conserve wildlife corridors, significant natural features, natural or historic wetland areas, and open space lands within the community.
   B.   OSR open space recreational zoning district: The purpose of this zoning district is to provide for land uses in areas generally subject to periodic flooding. It is further intended to provide for land uses in areas that have been set aside to serve recreational functions or to provide open space areas.
   C.   PL public land zoning district: The purpose of this zoning district is to provide for those governmental and public uses which are necessary to serve the public at various locations throughout the incorporated area, and to distinguish them from private uses. It is intended that this district establish regulations and standards to ensure that governmental and public uses are not exempt from regulation. (Ord. 03-2005, 9-6-2005)

10-9-2: PERMITTED USES:

   A.   OSC Open Space Conservation District: Permitted uses in the OSC open space conservation district shall be only those uses listed as permitted by right or permitted as a conditional use within this zoning district; all other uses are prohibited. Permitted uses are subject to all other applicable standards of this title. No building permit shall be issued for a use not specifically mentioned and for which the town has not issued an approval.
      1.   Growing and harvesting of field crops, trees, flowers and vegetables.
      2.   Nurseries for the propagation and growing of plants, trees, bushes, flowers, and vegetables and other food crops without an on site retail or wholesale component.
      3.   Public or community gardens, provided they are a minimum of ten (10) acres in size.
      4.   Undeveloped natural land.
      5.   Unpaved trails or pathways for use by hikers, bicyclists, and equestrians.
      6.   Archaeological or historic sites.
   B.   OSR Open Space Recreation District: Permitted uses in the OSR open space recreational district shall be only those uses listed as permitted by right or permitted as a conditional use within this zoning district; all other uses are prohibited. Permitted uses are subject to all other applicable standards of this title. No building permit shall be issued for a use not specifically mentioned and for which the town has not issued an approval.
      1.   Private golf course, including clubhouse and driving range located thereon, but not including miniature golf courses or stand-alone practice driving ranges, operated for commercial purposes, when not associated with a golf course.
      2.   Private parks maintained by a homeowners' or property owners' association.
      3.   Paved or unpaved trails or pathway systems for use by hikers, bicyclists, pedestrians, and equestrians, including trailheads for such uses.
      4.   Manmade water features and watercourses, canals, dams, and retention areas.
      5.   Public or private arboretums, wildlife reserves or sanctuaries.
      6.   Utility services, but not including offices, treatment plants generating stations, substations, switching or splitting stations.
   C.   PL Public Land District: Permitted uses in the PL public land district shall be only those uses listed as permitted by right or permitted as a conditional use within this zoning district; all other uses are prohibited. Permitted uses are subject to all other applicable standards of this title. No building permit shall be issued for a use not specifically mentioned and for which the town has not issued an approval.
      1.   Public parks, including, but not limited to, picnic grounds, playgrounds, athletic playing fields, swimming pools, golf courses, fairgrounds, and rodeo grounds.
      2.   Public schools (K–12), athletic fields, and playgrounds.
      3.   Government office buildings and grounds, excluding storage and equipment yards.
      4.   Community activity centers and facilities, and civic and convention centers for group assembly, display, and exhibition.
      5.   Public facilities and institutions such as hospitals, art centers and museums.
      6.   Publicly owned or operated libraries, fire stations, police stations and post offices.
An application for rezoning to PL public land shall only be made by an agency of the local, state, or federal government. In the event that a government agency leases or disposes of its land that is zoned PL, the land may not be developed or used in any manner, and the town shall not issue any type of permit, until the land has been rezoned by the new lessee or landowner. 10-9-3: USES SUBJECT TO CONDITIONAL USE PERMIT:

   A.   OSR Open Space Recreational District: The following uses are permitted in the OSR open space recreational district only after review and approval of a conditional use permit in accordance with section 10-3-4 of this title. Conditional uses are subject to all other applicable standards of this title and those requirements that may reasonably be imposed by the town council. If a specific use is not listed as either a permitted use or a conditional use, it is prohibited.
      1.   Retail operation when in conjunction with and accessory to a permitted use including, but not limited to, snack bars, restaurant, gift shop, equipment sales or rental.
      2.   Commercial riding and boarding stables, provided the site contains at least ten (10) acres. Additional acreage may be required based on the number of horses stabled thereon.
   B.   PL Public Land District: The following uses are permitted in the PL public land district only after review and approval of a conditional use permit in accordance with section 10-3-4 of this title. Conditional uses are subject to all other applicable standards of this title and those requirements that may reasonably be imposed by the town council. If a specific use is not listed as either a permitted use or a conditional use, it is prohibited.
      1.   Retail operation when in conjunction with and accessory to a permitted use including, but not limited to, snack bars, restaurant, gift shop, equipment sales or rental.
      2.   Outdoor storage yards for government vehicles, equipment, and materials.
      3.   Public safety and law enforcement facilities, including detention centers.
      4.   Recycling transfer stations or automated collection centers, municipal or county landfills.
      5.   Water and sewer treatment plants and utility generating plants.
      6.   Airports, whether civilian or military. (Ord. 03-2005, 9-6-2005)

10-9-4: PROHIBITED USES:

   A.   OSC Open Space Conservation District: The following uses are prohibited in the OSC open space conservation district including, but not limited to:
      1.   All industrial land uses.
      2.   All commercial land uses, except for a visitor center operated in conjunction with an archaeological or historic site.
      3.   All residential land uses, except that a single dwelling may be permitted when in conjunction with the growing and harvesting of field crops, trees, flowers and vegetables or for on site security when in conjunction with an archeological or historic site.
      4.   Churches or places of worship and private or parochial schools.
   B.   OSR Open Space Recreational District: The following uses are prohibited in the OSR open space recreational district including, but not limited to:
      1.   All residential and industrial land uses.
      2.   Churches or places of worship, except for those existing at the time of the adoption hereof.
      3.   Private schools, parochial schools or boarding schools. (Ord. 03-2005, 9-6-2005)

10-9-5: REVIEW PROCESS:

   A.   All development and construction within the open space and public land zoning districts shall require site plan review, by the planning and zoning commission, prior to the applicant's submittal for building or grading permits. All applications for site plan review shall comply with the submittal requirements outlined in section 10-3-7 of this title. The required fee shall accompany all applications. 10-9-6: COMPLIANCE WITH OTHER PROVISIONS:

   A.   General Provisions: The general provisions in chapter 11 of this title shall apply.
   B.   Landscape Regulations: The landscaping provisions in chapter 12 of this title apply.
   C.   Parking Regulations: The parking regulations are as provided in chapter 13 of this title.
   D.   Outdoor Lighting: All outdoor lighting shall comply with chapter 14 of this title.
   E.   Signs: All signage shall comply with chapter 15 of this title. (Ord. 03-2005, 9-6-2005)

10-9-7: DENSITY, AREA, BUILDING AND YARD REGULATIONS:

The chart, which follows, specifies the minimum lot sizes, minimum lot width, maximum building heights, minimum yard setbacks, and maximum lot coverage percentages.
