15.42 Historic

Preservation Overlay District HP

15.42.010 Purpose

This Chapter is enacted and intended for the purpose of more fully preserving historic and architecturally significant districts and landmarks within the City of Parowan, said districts and landmarks being among the City's most valuable cultural, educational and economic assets, and further, so that the character of the districts and landmarks herein shall not be lost through expansion of or changes in commercial or other activities in the City, and further, so that the districts and landmarks herein will be preserved for the future use, observation, education, pleasure, and general welfare of the inhabitants of Parowan City.

15.42.020 Definitions

As used in this chapter the following words shall have the following meanings:

  1. Demolition: The act of tearing down, destroying, removing, or otherwise defacing the exterior of any structure within a historic district or landmark site.
  2. Historic District: A defined geographic territory within Parowan City and within which special zoning rules applied pursuant to this Chapter for the purpose of preserving historically significant structures or landmarks.
  3. Landmarks: Any structure, monument, or other historically significant object which is listed with any national or local history society or which is designated pursuant to this Chapter by action of the Historic Preservation Committee.
    1. Development Standards
    2. Appeal of Historic Preservation Committee or Planning Commission Decisions
    3. Demolition of Hazardous Structures
    4. Severability
    5. Enforcement and Penalties
  4. Monument: Any statue, structure, sign, masonry, or other devise or edifice designed for the purpose of commemorating or marking the location of a historically significant event, person, location, or time.
  5. New Construction: Any attempt whatsoever to alter the existing condition of any property within a historic district or any landmark or monument as defined herein except such activity as falls within the definition of demolition set forth hereinabove.
  6. Remodeling: Repair, renovation, change, modification, deletion, or alteration of any structure existing within a historic preservation district or any landmark or monument as defined herein.
  7. Street Scapes: Any structure or vacant property visible from any public thoroughfare within a historic district.
  8. Structures: All buildings, walls, fences, signs, utility fixtures, poles, steps, sidewalks, facades, or any appurtenant element thereto.

15.42.030 Creation Of Historic Preservation Committee

  1. Creation: There is hereby created a Historic Preservation Committee for the City of Parowan. Said committee shall consist of five (5) members, four (4) of whom shall be qualified voters of the City of Parowan, with the remaining member to be a member of the City Planning and Zoning Committee or the Parowan City Council. Said member shall be selected and appointed by the Mayor with the consent of the City Council without respect to their political affiliations and shall serve without compensation, except for reasonable expenses as directed by the Parowan City Council.
  2. Terms of Office, Vacancies: The term of office for the designated member of the Historic Preservation Committee who is also a member of the City Council or an advisor to the Planning Commission shall correspond to tenure in the City Council or Planning Commission. The terms of office for the appointed members of the Historic Preservation Committee shall be for four (4) years. As an exception to this term, the terms of four (4) members of first appointed Historic Preservation Committee shall be one (1), two (2), three (3), and four (4) years respectively, so that no more than two (2) terms will expire in any given year. Each appointment thereafter shall be for a term of four (4) years. Vacancies occurring otherwise than through the expiration of term shall be filled by appointment by the Mayor with the consent of the City Council. The person thus appointed will fill the unexpired term. Members may be removed from the Historic Preservation Committee by a majority vote of the City Council for cause, which cause shall include a repeated and persistent failure to attend at least seventy-five (75) percent of the required meetings during the course of a year or for other non-performance of other duties.
  3. Election of Officers, Meetings: The Historic Preservation Committee shall elect from among its membership a chairman, a vice-chairman, and a secretary and shall adopt policies, rules, and regulations for its own organization and for the transaction of its business, not in conflict with other ordinances of the City or the laws of the State of Utah. Meetings of the Historic Preservation Committee shall be open to the public and shall be held in accordance with requirements of the laws of the State of Utah regarding public meetings. The Historic Preservation Committee shall keep a record of its proceeding in whatever form is deemed most convenient. The Historic Preservation Committee shall meet either regularly or at the call of its chairman with twenty-four (24) hours notice to the public whenever there is business to be transacted by the committee.
  4. Committee Jurisdiction: The jurisdiction of the Historic Preservation Committee shall be limited to the Historic Districts and landmarks and monuments. The committee shall be concerned only with those elements of development, redevelopment, rehabilitation, and preservation that effect visual quality of the Historic District of landmark or monument. The committee shall not consider interior design, interior arrangement, or building features not subject to public view nor shall it make any requirement except for the purpose of preventing development or demolition inconsistent with the standards set forth hereinafter.
  5. List of Historical Buildings, Landmarks, and Monuments: The Historic Preservation Committee may be requested by the Planning and Zoning Commission of Parowan City or the Parowan City Council to compile and supply to those bodies a list of all existing buildings, or other structures as well as monuments and landmarks in Parowan City which the committee deems to be of historic interest because the architecture, period of construction, persons who have resided or events which have occurred therein, or for other appropriate historic reasons. Such a list shall briefly describe each building or structure, the date of its construction, as nearly as can be ascertained, the reason for including in the list and the name and address of its present owner as shown on the records of the County Recorder of Iron County. The Committee shall file such list and subsequent amendments or additions thereto with the Planning and Zoning Commission. Any such list shall be made available to any person desiring the same for only the cost of copying the list.

15.42.040 Zoning Enforcer Responsibility

The Zoning Enforcement Officer of Parowan City is hereby empowered to function as the inspecting agent or officer for the Historic Preservation Committee and is authorized to investigate and report at the request of the committee concerning matters of structural integrity, architectural design, location of structures, and other such items as such reports are necessary for the proper operation of the Historic Preservation Committee.

15.42.050 Designation Of District Boundaries

The following geographical area is hereby designated as the Parowan Historic Preservation District.

The district shall include real property with frontage on the designated street (both sides) unless otherwise described herein.

Areas composing this Historic Preservation District are as follows:

  1. 200 South Street, from 600 West to its intersection with Main Street.
  2. Parowan City Main Street from 200 South to 500 North.
  3. Center Street (Highway 143) from its intersection with Main Street east to the south boundary line of the Parowan City Cemetery.
  4. The entire area bounded on the south by 2nd South, on the north by 2nd North, on the east by 1st East, and on the west by 1st West, enclosing an eight (8) square block area.
  5. All monuments and landmarks so designated existing within the Parowan City limits.

15.42.060 Changes In Historic District

The Historic Preservation Committee may recommend to the Planning Commission and City Council of Parowan City such changes as it feels are appropriate in the boundaries of the Historic District created by this Chapter. Such changes are to be adopted, if at all, pursuant to the procedures established for zone changes in the law in the State of Utah and the ordinances of Parowan City.

15.42.070 Demolition Permits

It shall be unlawful for any person to demolish any structure or edifice within the Historic District or any landmark or monument without first having procured from the Planning Commission of Parowan City a permit for said demolition. No application for the demolition permit shall be approved without the application first having been referred to Historic Preservation Committee for their recommendations pursuant to this Chapter. Upon receipt of an application for demolition the Historic Preservation Committee shall review the proposed action and within thirty (30) days make its recommendation to the Planning Commission either approving the demolition project as appropriate or recommending denial of the application and stating in said denial its reason therefore. All applications for demolition permits shall be accompanied by a post demolition or post removal schematic construction plan or landscaping plan indicating the future use to which the site is to be put.

15.42.080 Committee Action

In the event an application for demolition is referred to the Historic Preservation Committee, and the proposed plan is deemed inappropriate by said Committee, the Committee may require that the Planning and Zoning Commission of Parowan City withhold any action on the application for demolition permit for a period of 45 days during which period the Committee shall negotiate with the owner of the property to determine whether an alternative to demolition is appropriate or feasible.

If at the end of the 45 day delay period no solution has been agreed upon, the application shall be forwarded to the Planning Commission for approval and issuance of the permit upon condition that the premises on which the demolition is to occur shall be maintained clean, orderly, and in good condition to avoid becoming an eyesore, weed patch, or otherwise detrimental to the street scape in the area or to public health. The Planning Commission may impose such requirements as it deems fit regarding improvements to be placed on the property after demolition, to include but not be limited to grass and sprinklers, and may require such bonding as necessary to guaranty the installation and maintenance of those improvements as provided under the subdivision ordinance of Parowan City.

15.42.090 Building Permits

  1. No application for a building permit for new construction within a Historic District or adjacent to or within one hundred (100) feet of any landmark or monument in Parowan City shall be approved unless such application shall first be referred to the Historic Preservation Committee for its review and recommendation. The same provision shall apply to permits being sought for remodeling or repair to be performed within those same areas.
  2. Upon receipt of an application for remodeling or new construction, the Historic Preservation Committee shall meet and make its recommendations for approval or disapproval of the application within two (2) weeks of the referral. If the Historic Preservation Committee fails to act within the two (2) week period, the application shall be returned to the Planning Commission for consideration and the Planning Commission shall deem the application approved by the Historic Preservation Committee.

15.42.100 Development Standards

  1. A passing upon an application to demolish, or demolition in part, or remove, or alter the exterior architectural appearance of any existing building or structure located within any Historic District or landmark or monument area, or an application for new construction or remodeling, the Historic Preservation Committee shall consider, along with the Planning and Zoning Commission, among other things, the historic, architectural, and aesthetic features of the structure, the nature and character of the surrounding area, the use of such structure and its importance to the City, and the feasibility and desirability of preservation of the area. General guidelines to be followed in this consideration are attached hereto and labeled "Appendix A".
  2. In passing upon an application for construction of new buildings or structures in a Historic District, the Historic Preservation Committee and the Planning and Zoning Committee shall consider whether the proposed building or structure will be visually compatible with the buildings and places to which it is to be visually related and will consider the relative heights of the buildings, the proportion of the building's front facade to the other buildings in the area, the proportion of the openings within the facade of the facility, the rhythm of solids to voids in front facades, the rhythm of spacing of buildings on the street, the scale of the building, the directional expression of the front elevation, and the presence or absence of sufficient parking.
  3. The above development standards shall supersede any other specified regulations. Any person aggrieved by any decision of the Historic Preservation Committee or the Planning and Zoning Committee may appeal that decision to the Board of Adjustments of Parowan City, in the manner provided in the Parowan City Ordinances. This Ordinance shall not prohibit the demolition of structures which pose an immediate hazard to human health and safety as determined by the Building Inspector, or Chief of Police nor shall this Section preclude ordinary maintenance and repair not otherwise subject to Building Department regulation. It is the intent of this Section to preserve from deliberate acts and deliberate or inadvertent neglect, structures within Historic Districts or adjacent to landmarks or monument sites.

If any Section of this Ordinance or part thereof shall be found to be unconstitutional or invalid, such decision shall not effect the validity of the remaining portions of this Ordinance.

The provisions of this Chapter are subject to the enforcement provisions established in PCMC 15.02.100, PCMC 15.02.110, and PCMC 15.02.120.

15.42.101 "Appendix A"

  1. PURPOSE: The purpose of the Parowan City Historic Preservation Overlay District Appendix A is to preserve the distinctive historical character of Parowan, communicate the community's vision for development within the Parowan City Historic Preservation Overlay District, mitigate negative visual impacts, and foster development which complements and furthers the City's unique sense of place.
  2. APPLICABILITY: The requirements of this section apply to all development within the Historic Preservation District and any other designated Historic Monuments and/or Historic Buildings as defined by PCMC 15.42. All owner/developers are required to submit to submit site plans, list of building materials, exterior colors, and architectural elevations to the Historic Preservation Committee. Parowan City demonstrates special interest in and concern for development within the City's Historic Preservation District. Development within this area has the greatest impact on the City's historical character and sense of place. Special consideration must be given to the type and quality of architecture. All development within the Historic District should be consistent with guidelines set forth by the Historic Committee.
    1. Interpretation, Appeals, and Exceptions
      1. Any question as to the meaning of any word, phrase, section, or intent of these standards shall be resolved by the interpretation of the Historical Preservation Committee.
      2. Exceptions to these standards may be granted where it can be demonstrated that such exception is necessary for innovative design, which may vary from the requirements of this section, but nonetheless is deemed to meet the overall intent of this section or in the case of individual projects or buildings where sire-specific conditions may impact the ability to comply with these standards.
  3. ARCHITECTURAL AND SITE DESIGN GUIDELINES FOR DEVELOPMENT. All owner/developers are required to submit site plans, list of building materials, exterior colors, and architectural elevations to the Historic Preservation Committee.
    1. Architectural Design
      1. The architectural character of buildings shall visually portray a high quality look and feel consistent with a single theme of historic architecture within Parowan City.
      2. Big box type structures with architectural appliques shall not be considered in compliance with these standards.
      3. Franchise architecture, or building design that is trademarked or identified with one particular company may not be in compliance with these guidelines.
      4. Building facades shall be articulated to enhance visual interest and break building mass into smaller scale components.
      5. Building articulation shall be accomplished through combinations of the following techniques:
        1. Facade modulation-stepping portions of the building wall to create shadow lines and changes in volumetric space.
        2. Use of engaged columns or other structural system expressions.
        3. Horizontal and vertical divisions by use of textures and materials combined with facade modulation.
        4. Providing projections such as balconies, covered entrances, porte-cocheres, and awnings.
        5. Variation in rooflines by use of dormer windows, overhangs, arches and stepped roofs.
      6. All building facades, which can be viewed from public rights of way or residential dwelling areas shall receive equal architectural design consideration.
      7. Blank wall areas shall not exceed 10 feet in height or 20 feet in width. Blank walls shall be divided by the use of an arrangement of windows and doors, reveal and relief, architectural details, and /or changes in texture.
      8. Windows shall compromise a minimum of 30% of the front ground level facade, in commercial applications.
      9. All commercial buildings should consider including the following building design treatments:
        1. Canopies or porticos integrated with the building massing and style.
        2. Sculptured art work.
        3. Raised cornice or building banding.
        4. Peaked roof forms.
        5. Arches.
        6. Ornamental and structural architectural details integrated into the overall design.
        7. Clock bell towers or cupolas.
        8. Balconies.
        9. Any other treatment approved by the Historical Preservation Committee which is deemed to meet the intent of these requirements.
    2. Building Materials
      1. Approved exterior building materials shall include the following:
        1. Stucco of an earth tone.
        2. Natural brick (unpainted or stained).
        3. Textured Concrete Masonry Units of an earth tone (split face block).
        4. Composite siding having the appearance of wood.
        5. Architectural concrete with recessed panels and reveal lines.
        6. Natural rock or cultured stone.
        7. Other maintenance free materials as approved by the Historical Preservation Committee which are deemed to meet the intent of these standards.
      2. The following may be prohibited as predominant exterior building materials, as determined by the Historical Preservation Committee:
        1. Corrugated or reflective metal panels.
        2. Smooth or rib faced cinder/concrete block.
        3. Plastic or metal siding.
        4. Smooth unfinished concrete tilt up panels.
        5. Tile.
    3. Roof Design and Mechanical Screening
      1. Sloped roofs shall provide articulation and variations to divide the massiveness of the roof. Sloped roofs shall include eaves, which are a minimum of two feet in width.
      2. Flat roofs shall be screened with parapets on all sides of the building. If no roof top equipment exists or is proposed, the parapet shall be a minimum of two feet in height.
      3. All parapets shall feature cornice treatments. Parapets shall include a cap element to define the upper edge of the building.
      4. Roof mounted mechanical units shall be located or screened so as not to be visible from adjacent public and private streets or properties. Roof mounted mechanical screening shall be accomplished by:
        1. Raising the parapet on all sides of the building to screen the highest mechanical unit or vent on the roof.
        2. A secondary roof screening system designed to be high as the highest mechanical unit or vent. Secondary roof screening systems shall be of complimentary materials and shall appear as an integrated component of the building.
    4. Awning and Canopies
      1. Awnings and canopies must be functional by placement over windows or doorways only.
      2. Awnings or canopies shall project a minimum of four feet from the building when located over pedestrian areas and no less than two feet otherwise.
      3. Awnings or canopies shall maintain a minimum clearance of ten feet above any sidewalk or pedestrian route.
      4. All island canopies shall be built of the same quality materials and architecture as the store associated with the island. Island canopy structural columns shall be faced with the same architectural materials as the associated build.
    5. Parking Areas
      1. Large Expanses of paved parking areas without landscape breaks or islands shall be prohibited.
    6. Landscape
      1. Landscaping shall feature a unified theme throughout the site or development.
      2. The use of foundation plantings is encouraged to break up building mass and soften the facade.
      3. All landscaping material should consider featuring an automatic irrigation system.
      4. The use of raised planters to differentiate pedestrian area from vehicular areas is encouraged.
    7. Pedestrian Amenities
      1. Sidewalks shall be a minimum of six feet in width with an additional two feet of width provided when the sidewalk is adjacent to parking area and subject to vehicle overhang.
      2. Where a pedestrian circulation path crosses vehicular routs, a change in paving materials or markings shall be provided to distinctly differentiate the conflict point and add aesthetic appeal.
      3. One pedestrian access route to the building front shall be provided for each vehicular access rout to the site with a minimum of one route meeting the requirements of the Americans with Disabilities Act.
    8. Service and Accessory Facility Screening
      1. Service, refuse, loading docks, truck parking areas and other areas that tend to be unsightly shall be screened from view by the use of a combination of walls, fences and landscaping.
      2. Enclosure material shall be composed of 6' high solid masonry, or decorative pre-cast concrete walls with opaque gates. Gates shall be self-latching. Chain link fence material with slats is prohibited.
    9. Fencing Standards
      1. Fences within the district must be approved by the Historical Preservation Committee.
      2. Fencing forward of the primary facade is allowed provided the fence does not exceed four feet in height, provides an open view, and the fence style compliments the building architecture.
      3. Fences must comply with PCMC 15.08.170 regarding fencing standards and the city requirement for a fencing permit.
    10. Site Lighting
      1. Site and building lighting shall be designed to prevent direct glare or light spillage to adjacent public right of way or properties. Light should reflect down, not up with any exceptions to be determined by the Historical Preservation Committee.
      2. Light Fixtures shall be a maximum of 30 feet in height in vehicular areas and 15 feet in height in pedestrian areas.
      3. Fixtures shall be a complimentary design element of the building and site.
    11. Sign Regulations - Commercial Zones. Permitted signs are as follows:
      1. Wall & Projecting signs shall be submitted to the Historic Preservation Committee for review and approval prior to installation and shall adhere to the following requirements:
        1. Wall signs, either attached or painted, shall not rise above the roofline nor project more than eighteen inches (18") from the wall;
        2. Projecting signs shall not project more than four feet (4') from the building. Signs projecting over the public right of way must have a minimum ground clearance of ten feet (10").
      2. Awning signs must have a minimum ground clearance of ten feet (10'), and shiny, "Day-Glo" fluorescent or brilliant luminescent colors are not permitted.
      3. Freestanding Pole Sign & Low-Profile Sign: One freestanding pole sign or low profile monument type sign may be allowed for each parcel of property or commercial complex, provided the following standards are met:
        1. Low profile monument type signs which utilize carved wood, etched/sandblasted stone or engraved metal and do not exceed six feet (6') in height and are no more than twenty-four (24) square feet;
        2. Pole signs, provided the support pole is located on private property and the sign does not exceed twenty feet (20') in height, nor exceed twenty-four (24) square feet in area. Sign face may project over the public right of way, provided there is a minimum clearance of ten feet (10') from ground to the sign and sign face does not project closer than eight feet (8') to back of curb.
      4. Color of Signs:
        1. Painted signs should be in subdued earth tone colors only, "Day-Glo" or fluorescent colors are not permitted. Electric signs are permitted.
      5. Prohibited Signs:
        1. Roof signs or any sign projecting above the roofline.
        2. Flashing sings, including any sign or device in which the artificial light is not maintained stationary and constant in intensity and color at all times when in use.
        3. Permanent signs made of cardboard, paper, canvas or similar impermanent material.
        4. Awnings with a shiny or wet look are not appropriate in the historical district.

15.42.110 Appeal Of Historic Preservation Committee Or Planning Commission Decisions

Any person aggrieved by any decision of the Historic Preservation Committee or the Planning and Zoning Committee may appeal that decision to the Board of Adjustments of Parowan City, in the  manner provided in the Parowan City Ordinances.

15.42.120 Demolition Of Hazardous Structures

This Ordinance shall not prohibit the demolition of structures which pose an immediate hazard to human health and safety as determined by the Building Inspector, or Chief of Police nor shall this Section preclude ordinary maintenance and repair not otherwise subject to Building Department regulation.  It is the intent of this Section to preserve from deliberate acts and deliberate or inadvertent neglect, structures within Historic Districts or adjacent to landmarks or monument sites.

15.42.130 Severability

If any Section of this Ordinance or part thereof shall be found to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance.

15.42.140 Enforcement And Penalties

The provisions of this Chapter are subject to the enforcement provisions established in PCMC 15.02.100, PCMC 15.02.110, and PCMC 15.02.120.
