- USE REQUIREMENTS BY DISTRICTS
Within a residential R-O district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
601.1.
Purpose of the District. The purpose of an R-O historic preservation residential district is to preserve the large homes located for the most part along the beachfront which lend character and set the atmosphere of Pass Christian.
601.2.
Uses Permitted.
601.2.1.
Detached single dwellings having a minimum of 3,000 square feet of floor area without counting the area of garages, carports, and porches, but not including mobile homes or shell homes.
601.2.2.
Public parks and playgrounds.
601.2.3.
One nonilluminated sign advertising the sale or rent of the land or building upon which it is located. Such sign shall not exceed three square feet in area and shall be located at a point not less than 15 feet from the street line. The sign may remain in place until no longer needed provided it is kept in a nondeteriorating condition.
601.2.4.
Customary signs in conjunction with residential usage, such as mailbox signs, names of residents, and house names and/or numbers.
601.2.5.
Gazebos, bathhouses, swimming pools, tennis courts, pavilions, and other similar uses for the private use of the occupants of the property.
601.2.6.
Accessory buildings, provided such shall be permitted only in the rear yard and shall not be less than 7½ feet from any property line.
601.2.7.
Home occupations subject to section 407.
601.3.
Uses Permitted as Special Exceptions.
601.3.1.
Guest cottages of a noncommercial nature for the use of friends and relatives.
601.3.2.
The renting of rooms within existing structures (but not the building of additions for rental purposes), provided that the number of such rental units shall not exceed two.
601.4.
General Regulations.
601.4.1.
Notwithstanding the fact that many deeds to property in this district include land to the tide line of the Gulf of Mexico or Mississippi Sound, lot area and setback for property so described shall be measured from the north line of Scenic Drive, or if Scenic Drive does not cross the property from the north line of Beach Boulevard. Easements for Scenic Drive, the seawall, and Beach Boulevard along with highway department restrictions, and federal court decisions concerning the sand beach exclude any property south of the north margin of the northernmost easement from any building by the property owners except piers.
Within a residential R-1 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
602.1.
Purpose of the District.
The purpose of an R-1 ample single-family residential district is to provide a district of single-family homes on larger than average lots.
602.2.
Uses Permitted.
602.2.1.
Detached single dwellings, but not including mobile homes or shell homes.
602.2.2.
Churches and related accessory buildings, provided they are located on a lot fronting a major artery or connecting route and are placed not less than 50 feet from any property line with required off-street parking spaces separated from property lines by a planted buffer at least ten feet in width and an impenetrable fence not less than three feet in height.
602.2.3.
Church bulletin boards, provided that they not exceed 12 square feet in area.
602.2.4.
Public and private schools offering general education courses.
602.2.5.
Golf courses and country clubs occupying an area of not less than 40 acres.
602.2.6.
Railroad rights-of-way and passenger stations.
602.2.7.
Public utility stations such as electrical substations, sewerage pumping stations, provided that they are surrounded by an impenetrable fence at least eight feet high, have a reasonable buffer zone on all four sides, and there is no storage of vehicles or equipment on the premises.
602.2.8.
Public parks and playgrounds.
602.2.9.
One nonilluminated sign advertising the sale or rent of the land or buildings upon which it is located. Such sign shall not exceed three square feet in area and shall be located at a point not less than one half the front yard depth from the street line. The sign may remain in place until no longer needed provided it is kept in a nondeteriorating condition.
602.2.10.
Customary signs in conjunction with residential usage, such as mailbox signs, names of residents and house numbers.
602.2.11.
Noncommercial greenhouses, provided that no structure nor odor or dust-producing substance nor use shall be permitted within 100 feet of any property line and that no products shall be publicly displayed or offered for sale.
602.2.12.
Accessory buildings, provided such shall be permitted only in a rear yard and shall not be less than five feet from any property line.
602.2.13.
The renting of rooms within the residential structure, provided that the number of persons so accommodated shall not exceed two.
602.2.14.
Home occupations subject to section 407.
602.2.15
Modular Homes
602.3.
Uses Permitted as Special Exceptions.
602.3.1.
Guest cottages of a noncommercial nature for use of friends and relatives.

Within a residential R-1A district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
603.1.
Purpose of the District.
The purpose of an R-1A standard single-family residential district is to provide a district in which the concept of single-family living is preserved but which allows lots of less area than is required in an R-1 district.
603.2.
Uses Permitted.
603.2.1.
All residential uses permitted in an R-1 district.
603.2.2.
All nonresidential uses permitted in an R-1 district subject to R-1 district use requirements.
603.3.
Uses Permitted as Special Exceptions.
603.3.1.
Uses permitted in an R-1 district as special exceptions.
Within a residential R-2 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
604.1.
Purpose of the District.
The purpose of an R-2 standard duplex residential district is to provide a district in which single-family homes can be built on small lots, duplex residences can be erected, and low-rise apartments are permitted.
604.2.
Uses Permitted.
604.2.1.
All residential uses permitted in R-1A and R-1 districts.
604.2.2.
All nonresidential uses permitted in R-1A and R-1 districts subject to R-1A and R-1 district use requirements respectively.
604.2.3.
Two-family dwellings, including duplexes and semidetached structures.
604.2.4.
One garage apartment, to be occupied by not more than one family, provided that for such garage apartment there shall be a minimum of 4,000 square feet of lot area above the minimum required for the principal structure.
604.2.5.
Low-rise apartments on large lots, number of units in proportion to lot area (3,500 square feet/unit).
604.2.6.
Nursery schools or kindergartens, provided at least 100 square feet of outdoor play area is available to each child; the outdoor play area is enclosed by a fence having a height of not less than three feet six inches; one nonilluminated sign may be used for identifying the establishment, but may not exceed ten square feet in area and must contain no advertising; and the principal and all accessory buildings shall meet all yard and setback and height requirements of the district.
604.3.
Uses Permitted as Special Exceptions.
604.3.1.
Any use permitted as special exceptions in an R-1 district.
Within a residential R-3 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
605.1.
Purpose of the District.
The purpose of an R-3 substandard residential district is to recognize the district in which at the time of the adoption of zoning lot areas were below optimum and to provide recognition for areas which may be in transition from a residential to a commercial use.
605.2.
Uses Permitted.
605.2.1.
Any use permitted in an R-2 district.
605.2.2.
Multifamily dwellings.
605.2.3.
Apartment hotels.
605.2.4.
Cooperative apartments.
605.2.5.
Roominghouses and boardinghouses not catering to overnight travelers.
605.2.6.
Customary home occupations, including the professional offices of a physician, dentist, musician, lawyer, architect, artist, and engineer, conducted within the dwelling, provided that not more than one-fourth of the total floor area shall be used for such occupation, and no external evidence of such occupation is visible except a nonilluminated sign not more than three square feet in area wholly attached to the dwelling may be displayed. This subsection is not subject to subsections 407.1, 407.2, 407.6, and 407.10.
605.2.7.
Hospitals for human care except those primarily for the treatment of mental disorders, charitable institutions, and sanitariums.
605.2.8.
Offices or clinics for medical or dental practice.
605.2.9.
Any activity which is customarily considered as being accessory to a hospital, clinic, college, or university.
605.2.10.
Professional offices and studios including executive, administrative, writing, clerical, stenographic and drafting uses; provided there be no sales, exterior displays, exterior storage of goods or materials, warehousing or indoor storage of goods or materials beyond that normally incidental to the above permitted occupations; and, provided no more than 15 people be employed in any establishment on any one lot.
605.2.11.
Private clubs and lodges, excepting those in which the conduct of commercial affairs play a major role.
605.3.
Uses Permitted as Special Exceptions.
605.3.1.
Any uses permitted as special exceptions in an R-2 district.
605.3.2.
Individual mobile homes on single lots.
605.3.3.
Funeral homes, mortuaries, or undertaking establishments.
Within a mobile home park district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
606.1.
Purpose of the District.
The purpose of an M mobile home park district is to provide a location for mobile homes.
606.2.
Uses Permitted.
606.2.1.
Any use permitted in an R-3 multifamily [substandard] district, excluding funeral homes, mortuary or undertaking establishments.
606.2.2.
Mobile home park.
606.2.3.
Mobile home subdivisions.
606.2.4.
Accessory structures.
Within a commercial C-1 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
607.1.
Purpose of the District.
The purpose of a C-1 commercial central business district is to provide a district for the conduct of personal and business services and retail business of the city.
607.2.
Uses Permitted.
607.2.1.
Hotels/motels.
607.2.2.
Financial institutions.
607.2.3.
Transportation passenger stations, terminals and depots.
607.2.4.
Theaters.
607.2.5.
Federal, state, county, and local government offices and buildings.
607.2.6.
Restaurants.
607.2.7.
Retail dry goods, variety, appliance, hardware and tobacco stores.
607.2.8.
Furniture stores.
607.2.9.
Barbershops, beauty salons, and other personal service establishments.
607.2.10.
Office buildings.
607.2.11.
Public parks.
607.2.12.
Public parking garages.
607.2.13.
Newspaper offices.
607.2.14.
Parking lots provided they shall be paved so as to provide a durable and dustless surface so as to dispose of all surface water accumulation. Lights so used to illuminate the parking area will be so arranged as to reflect away from any adjacent premises.
607.2.15.
Ground signs, wall signs, projecting signs, and roof signs shall be permitted within the required building lines provided:
607.2.15.1.
Signs shall bear only the name of the establishment and the principal business or service.
607.2.15.2.
Professional offices and personal services shall be permitted one sign not to exceed three square feet in area for each professional office or personal service establishment.
607.2.15.3.
Retail sales and services shall be permitted one projecting sign or ground sign and one wall or roof sign and a total sign area of five square feet for each ten feet of frontage on a public street.
607.2.15.4.
Business, noncommodity sales establishments shall be permitted one projecting sign or ground sign and one wall or roof sign, and a total sign area of three square feet for each ten feet of frontage on a public street.
607.2.15.5.
Hotels shall be permitted one ground sign or projecting sign not to exceed 20 square feet in area and two signs only of a wall sign or roof sign variety, and five square feet in area of [for] each 20 feet of street frontage.
607.2.15.6.
That for each establishment there shall be permitted one projecting or ground sign overhanging the public right-of-way up to four feet beyond the right-of-way line and not exceeding 40 square feet in area overhanging the public right-of-way, provided there is a clearance of nine feet above the ground and that such signs shall not overhang a vertical projection of the curb line. No support or any part of the sign structure shall be upon the public right-of-way. No permit shall be issued for any sign overhanging the public right-of-way in accordance with this provision unless such applicant posts a bond or public liability insurance in the amount of $10,000.00 per person, $20,000.00 for any accident, and $5,000.00 for property damage. Such bond or liability insurance shall remain in effect at all times while such sign overhangs the public right-of-way.
607.2.16.
Laundry and dry-cleaning pickup stations.
607.2.17.
Florist shop.
607.2.18.
Bookstore or stationery store.
607.2.19.
Drugstores.
607.2.20.
Music stores.
607.2.21.
Office supply stores.
607.2.22.
Jewelry stores.
607.2.23.
Any residential use permitted without a special exception in an R-3 district and subject to all R-3 area and setback requirements.
607.2.24.
All uses [sic] in which would be permitted outside a municipality in a qualified resort area as defined in section 5, paragraph (O) of House Bill No. 112 of the 1966 session of the Legislature of the State of Mississippi and signed into law on the 21st day of May, 1966, and known as the "Local Option Alcoholic Beverage Control Law"; and any such other uses which may subsequently be authorized for such qualified resort areas by the Mississippi Legislature.

Within a commercial C-2 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
608.1.
Purpose of the District.
The purpose of a C-2 commercial neighborhood district is to provide retail stores and personal services for the convenience of the people of the adjacent area.
608.2.
Uses Permitted.
608.2.1.
Laundries, self-service or automatic, and laundry pickup stations.
608.2.2.
Grocery stores.
608.2.3.
Plumbing supply stores.
608.2.4.
Paint stores.
608.2.5.
Radio and television repair shops.
608.2.6.
Barbershops; beauty shops.
608.2.7.
Pet stores.
608.2.8.
Hobby shops.
608.2.9.
Supermarkets.
608.2.10.
Shoe repair shops.
608.2.11.
Bakeries.
608.2.12.
Gasoline service stations provided the service station shall be located on a lot lying at the intersection of two or more streets or on a major street.
Any tube or tire repairing, storage of merchandise and supplies shall be conducted wholly within buildings. No provision of this paragraph shall be interpreted to permit general automobile repairing, painting, body and fender work or steam cleaning.
Any structure, such as a grease rack or automobile washing apparatus, gasoline pumps, buildings and underground storage tanks, including principal use signs, shall be set back not less than 25 feet from any property line. Such areas between the property line and any service station will be kept free from trash and rubbish and no part therein shall serve as a collection point for waste material.
The means of access or egress shall be provided no less than 20 feet from intersection of street rights-of-way and not less than 25 feet from any residential district boundary line. Access and egress shall be arranged and designed so as to minimize the interference with the flow of traffic through the intersection.
Lighting shall be arranged so as not to shine nor reflect upon any adjacent premises.
608.2.13.
Parking lots in compliance with subsection 607.2.14.
608.2.14.
All uses permitted in [a] C-1 district.
608.2.15.
Retail fish markets.

Within a commercial C-3 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
609.1.
Purpose of the District.
The purpose of a C-3 commercial highway district is for the conduct of personal and business services primarily for the motoring public on major streets and arterial highways.
609.2.
Uses Permitted.
609.2.1.
Public garages for retail service only, including automobile repairing, painting, upholstering and body and fender work, provided that these and other operations shall be conducted within a building enclosed on at least three sides; provided further that if the building is located within 50 feet of a lot in a residence zone with no intervening street, the wall of the building nearest such zone shall have no openings other than doors or stationary windows, and such doors shall be permitted only if the building is adjacent to any alley and they may be opened only at intervals necessary for ingress or egress.
609.2.2.
Auto sales provided all repair and servicing shall be done within an enclosed building subject to section 609.2.1.
609.2.3.
Laundries, self-service or automatic, and laundry pickup stations.
609.2.4.
Mortuaries.
609.2.5.
Feed stores.
609.2.6.
Tourist homes.
609.2.7.
Motels.
609.2.8.
Drive-in theaters.
609.2.9.
Drive-in eating establishments where customers may or may not dine within their automobiles.
609.2.10.
Wholesale fruit markets.
609.2.11.
Commercial nurseries.
609.2.12.
Pawnshops.
609.2.13.
Dry-cleaning and pressing establishments where cleaning and pressing is done on the premises.
609.2.14.
Gasoline service stations subject to provisions of subsection 608.2.13 [608.2.12].
609.2.15.
Restaurants.
609.2.16.
Building material yards.
609.2.17.
Public utility stations and facilities.
609.2.18.
All uses permitted in [a] C-2 district.
[609.2.19.
Signs.]
609.2.19.1.
The business is located in conjunction to a street with an allowable speed limit of 50 miles per hour or higher.
609.2.19.2.
There are no traffic signals which would require a full stop within 2,500 feet of the location of the proposed sign.
609.2.19.3.
The sign would be constructed to withstand winds of up to 150 miles per hour.
609.2.19.4.
The sign would be constructed of fire resistance [resistant] material with a minimum one-hour burn rate.

Within a commercial C-4 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
610.1.
Purpose of the District.
The purpose of a C-4 limited commercial district is to serve residents and visitors and to accommodate activities designed for entertainment and recreation.
610.2.
Uses Permitted.
610.2.1.
All uses permitted in an R-2 district.
610.2.2.
Hotels, motels, apartment hotels, and apartment buildings and permitted accessory uses which shall include:
Pharmacies, drugstores, restaurants, lounges, flower shops, gift shops, barbershops, beauty shops, travel agencies, other hotel and motel related commercial activities.
Provided that such stores, shops, or restaurants must be operated incidental thereunto and must be located within the main administrative building of hotels, motels, apartment hotels, and apartment buildings. The total floor area of the total combined permitted accessory uses shall not occupy more than 25 percent of the gross floor area of the main use. The required off-street parking for a permitted accessory use must be provided in addition to the required off-street parking required for the main use. Swimming pools are permitted anywhere in the buildable lot area.
610.3.
Uses Permitted as a Special Exception.
610.3.1.
Gasoline service stations operated in conjunction with a hotel or motel, and subject to the provisions of a C-2 district.
610.4.
General Regulations.
610.4.1.
Uses that would be permitted in an R-2 district shall be subject to the area and setback requirements of the R-2 district.
610.4.2.
Hotels, motels, apartment hotels, and apartment motels, situated along a major street shall have a minimum front yard of a [sic] 75 feet. The required off-street parking may be provided in the interior third or 25 feet of the required front yard. The balance of the required front yard must be landscaped suitably and maintained as open area void of structures or buildings of any type. Permitted signs may be erected or placed only on the interior third of the required front yard.

Within a planned industrial park district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
611.1.
Purpose of the District.
The purpose of an I-1 planned industrial park district is to provide a district for the planned development of an industrial complex. Such a complex may have one or more industries and is developed and remains under the control of a supervising authority.
611.2.
Uses Permitted.
The owner, or owners, of any contiguous and compact tract of land shall submit to the planning commission a petition for the rezoning and subsequent exclusive use and development of all such tract of land as a planned industrial park district.
In a planned industrial park district no building or structure shall be hereafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specifically authorized by the governing authority, after study and recommendation by the planning commission.
Any industrial use, upon approval of the planning commission, shall be permitted in a planned industrial park district provided no nuisance will result with regard to excessive:
a.
Smoke and other particular [particulate] matter.
b.
Noise.
c.
Odor.
d.
Fire or explosive hazard.
e.
Gases.
f.
Glare or hear [heat].
g.
Vibration.
h.
Water pollution.
i.
Other factors detrimental to the health, safety and welfare of the area.
j.
Billboard.
611.3.
Special Requirements.
The planning commission shall satisfy themselves [itself] that the conditions listed above are met before recommending approval of any use in a planned industrial park. Pursuant to this section, the applicant shall be required to furnish:
a.
Overall development plan.
b.
Data describing all processes and equipment involved in the proposed use.
c.
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices, and pedestrian walks.
d.
Plans illustrating adequate off-street parking according to standards established by the planning commission.
e.
Traffic routing system so designed as to minimize nuisance effects due to the generation of traffic to and from the use.
f.
Comprehensive landscaping plan.
g.
Any other information the planning commission may need to adequately consider the effect the proposed uses may have upon the cost of providing adequate service to the area.
The planning commission shall further satisfy themselves [itself] that the uses proposed for any planned industrial park district shall be compatible with the adjacent and nearby uses of land and that they are consistent with the intent and purposes of this ordinance to promote the public health, safety, morals, or general welfare.
611.4.
Off-Street Parking and Loading Requirements.
The off-street parking and loading requirements shall conform to article IV, "General Regulations."
611.5.
Signs and Outdoor Advertising.
The signs and outdoor advertising requirements shall conform to article IV, "General Regulations."

Within a heavy industrial district, as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
613.1.
Purpose of the District.
This industrial district is intended to provide for heavy industrial uses.
613.2.
Uses Permitted.
613.2.1.
Any use permitted in [an] I-2 light industrial district.
613.2.2.

Within a floodplain district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
614.1.
Purpose of the District.
This district is intended to comprise those areas which are below an elevation of 12.5 feet above mean sea level. It is a subclassification of other districts designated by the suffix "F" appended to the designation of any of the other types of districts.
614.2.
Uses Permitted.
Those uses otherwise permitted in the zoning district as it exists without the suffix "F"; except that all structures erected shall be located on a landfill or on piling, or pillars of not less than mean sea level elevation of 13 feet, provided such fill, piling or pillars do not restrict or impede the flow of waters in the floodway.
614.3.
Elevation.
Any unprotected land at or below mean sea level elevation of 12½ feet shall be classified as a floodplain. Protected land shall consist of any land located at or below mean sea level elevation of 12½ feet which is protected from flooding, inundation, or the effects of tidal action by a levee, dike, or other flood protection device.

Within a special use district, as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
615.1.
Purpose of District.
The purpose of a special use district is to enable the planning commission and City of Pass Christian, Mississippi, to establish zoning districts for mixed uses of land in accordance with the following procedures and regulations.
615.2.
Establishment of District.
The establishment of a special use district shall adhere to the regulations imposed for like categories or functions under this zoning ordinance.
615.3.
Types of Districts.
The types of special use district which could be established shall include but not be limited to such districts as:
615.3.1.
Medical complex district, to include activities such as hospitals, public health centers, nurses training facilities, pathology laboratories, doctors' clinics and offices, extended care and nursing facilities, dental clinics and offices, and other closely related and compatible uses.
615.3.2.
Recreational district to include active and passive activities such as neighborhood centers, parks and playgrounds, swimming pools, picnic areas, and other closely related and compatible uses.
615.3.3.
Educational institutions district to include activities such as grade schools, secondary schools and colleges, auditoriums, libraries, recreational facilities, and other closely related and compatible uses.
615.3.4.
Central business district, to include retail and wholesale activities, light industrial uses, high density residential uses and uses outlined in the following public district.
615.3.5.
Public district, to include municipal functions and services such as city hall, county courthouse, fire department, police department, post office, public utilities, public parking complexes, and other closely related and compatible uses.
615.3.6.
Housing district, to include such residential uses as single- and two-family residences, garden apartments, townhouses and high-density development. Any use, service or function (for example, as related to the educational district—bookstore, grill, post office, washeteria, etc.) directly related to the specific intent of the special use district will be permitted, provided [if], in the opinion of the planning commission, there are no existing services or functions conveniently located and adequate to serve the proposed development.
615.3.7.
Gaming district, to include such uses as would require a license from the State of Mississippi to operate a dockside gaming establishment.
615.4.
General procedures.
In applying for a special use district, or an amendment to such a district, an overall development plan shall be submitted to the planning commission along with a report showing the need of such a district and its effect on adjacent and surrounding uses. This overall development plan shall include, but not be limited to:
615.4.1.
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices and pedestrian walks.
615.4.2.
Plans illustrating adequate off-street parking according to standards established in this ordinance.
615.4.3.
Plans showing entrance and exits to the area and the traffic routing system so designed as to minimize nuisance effects due to the generation of traffic to and from the area.
615.4.4.
Any other information the planning commission may need to adequately consider the effects the proposed uses may have upon the cost of providing adequate services to the area.
The commission may attach reasonable special conditions to the approval of such district or amendments to ensure that there will be no departure from the intent of this zoning ordinance.
All proposed special use districts shall follow the procedures for subdivision approval even though the ownership of land may not be divided. A preliminary and final plat, both approved by the planning commission, shall be required for every special use district. The planning commission may establish a schedule of reasonable fees to be charged for plat review. The district shall be developed according to the approval of the final plat. Building permits and certificates of occupancy shall be required for each building according to the existing codes and regulations.
615.5.
General Regulations.
All special use districts shall:
615.5.1.
Contain a minimum of five acres, except for an expansion of an existing special use district. If the existing special use district does not contain five acres, then the additional acreage shall contain at least the amount needed to bring the total land area to five acres.
615.5.2.
Be compatible with adjacent land use, if not, adequate buffers and screening shall be required.
615.5.3.
Start construction within one year after approval of final plat. If initial construction (for example footings, foundations) does not begin within one year, all land shall revert to the original zoning. In any case, where there was no original zoning, all land will be rezoned to conform with adjacent uses.
615.5.4.
Conform to established regulations. Even though this district will have mixed uses, each separate use will meet the requirements of similar uses in other districts. For example, all residential uses in this district will comply with the applicable residential regulations as set forth in this zoning ordinance.
615.5.5.
Since a mixture of uses are permitted within this district, no building, structure, land or premises shall be used and no building or structure shall be hereinafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specified [specifically] authorized by the governing body after study and recommendation by the planning commission.
615.5.6.
Be binding upon the applicant or applicants, their successors and assigns, and shall limit the development to all conditions and limitations established in such plans.
615.5.7.
Proposed expansions or revisions to any originally approved special use district shall be submitted to the planning commission. Upon receiving this request, the planning commission shall follow the general procedures and regulations as previously set forth.

This ordinance is a permissive ordinance, not a prohibitive ordinance. Uses not listed in any district are prohibited in all districts. In the case of a use not provided for in any zone under the provisions of this ordinance, the application for a building permit or certificate of occupancy shall be referred to the Planning Commission. The Planning Commission in such cases shall make recommendations to the Mayor and Board of Aldermen within sixty (60) days to insert the proposed use in an appropriate zoning district.

- USE REQUIREMENTS BY DISTRICTS
Within a residential R-O district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
601.1.
Purpose of the District. The purpose of an R-O historic preservation residential district is to preserve the large homes located for the most part along the beachfront which lend character and set the atmosphere of Pass Christian.
601.2.
Uses Permitted.
601.2.1.
Detached single dwellings having a minimum of 3,000 square feet of floor area without counting the area of garages, carports, and porches, but not including mobile homes or shell homes.
601.2.2.
Public parks and playgrounds.
601.2.3.
One nonilluminated sign advertising the sale or rent of the land or building upon which it is located. Such sign shall not exceed three square feet in area and shall be located at a point not less than 15 feet from the street line. The sign may remain in place until no longer needed provided it is kept in a nondeteriorating condition.
601.2.4.
Customary signs in conjunction with residential usage, such as mailbox signs, names of residents, and house names and/or numbers.
601.2.5.
Gazebos, bathhouses, swimming pools, tennis courts, pavilions, and other similar uses for the private use of the occupants of the property.
601.2.6.
Accessory buildings, provided such shall be permitted only in the rear yard and shall not be less than 7½ feet from any property line.
601.2.7.
Home occupations subject to section 407.
601.3.
Uses Permitted as Special Exceptions.
601.3.1.
Guest cottages of a noncommercial nature for the use of friends and relatives.
601.3.2.
The renting of rooms within existing structures (but not the building of additions for rental purposes), provided that the number of such rental units shall not exceed two.
601.4.
General Regulations.
601.4.1.
Notwithstanding the fact that many deeds to property in this district include land to the tide line of the Gulf of Mexico or Mississippi Sound, lot area and setback for property so described shall be measured from the north line of Scenic Drive, or if Scenic Drive does not cross the property from the north line of Beach Boulevard. Easements for Scenic Drive, the seawall, and Beach Boulevard along with highway department restrictions, and federal court decisions concerning the sand beach exclude any property south of the north margin of the northernmost easement from any building by the property owners except piers.
Within a residential R-1 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
602.1.
Purpose of the District.
The purpose of an R-1 ample single-family residential district is to provide a district of single-family homes on larger than average lots.
602.2.
Uses Permitted.
602.2.1.
Detached single dwellings, but not including mobile homes or shell homes.
602.2.2.
Churches and related accessory buildings, provided they are located on a lot fronting a major artery or connecting route and are placed not less than 50 feet from any property line with required off-street parking spaces separated from property lines by a planted buffer at least ten feet in width and an impenetrable fence not less than three feet in height.
602.2.3.
Church bulletin boards, provided that they not exceed 12 square feet in area.
602.2.4.
Public and private schools offering general education courses.
602.2.5.
Golf courses and country clubs occupying an area of not less than 40 acres.
602.2.6.
Railroad rights-of-way and passenger stations.
602.2.7.
Public utility stations such as electrical substations, sewerage pumping stations, provided that they are surrounded by an impenetrable fence at least eight feet high, have a reasonable buffer zone on all four sides, and there is no storage of vehicles or equipment on the premises.
602.2.8.
Public parks and playgrounds.
602.2.9.
One nonilluminated sign advertising the sale or rent of the land or buildings upon which it is located. Such sign shall not exceed three square feet in area and shall be located at a point not less than one half the front yard depth from the street line. The sign may remain in place until no longer needed provided it is kept in a nondeteriorating condition.
602.2.10.
Customary signs in conjunction with residential usage, such as mailbox signs, names of residents and house numbers.
602.2.11.
Noncommercial greenhouses, provided that no structure nor odor or dust-producing substance nor use shall be permitted within 100 feet of any property line and that no products shall be publicly displayed or offered for sale.
602.2.12.
Accessory buildings, provided such shall be permitted only in a rear yard and shall not be less than five feet from any property line.
602.2.13.
The renting of rooms within the residential structure, provided that the number of persons so accommodated shall not exceed two.
602.2.14.
Home occupations subject to section 407.
602.2.15
Modular Homes
602.3.
Uses Permitted as Special Exceptions.
602.3.1.
Guest cottages of a noncommercial nature for use of friends and relatives.

Within a residential R-1A district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
603.1.
Purpose of the District.
The purpose of an R-1A standard single-family residential district is to provide a district in which the concept of single-family living is preserved but which allows lots of less area than is required in an R-1 district.
603.2.
Uses Permitted.
603.2.1.
All residential uses permitted in an R-1 district.
603.2.2.
All nonresidential uses permitted in an R-1 district subject to R-1 district use requirements.
603.3.
Uses Permitted as Special Exceptions.
603.3.1.
Uses permitted in an R-1 district as special exceptions.
Within a residential R-2 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
604.1.
Purpose of the District.
The purpose of an R-2 standard duplex residential district is to provide a district in which single-family homes can be built on small lots, duplex residences can be erected, and low-rise apartments are permitted.
604.2.
Uses Permitted.
604.2.1.
All residential uses permitted in R-1A and R-1 districts.
604.2.2.
All nonresidential uses permitted in R-1A and R-1 districts subject to R-1A and R-1 district use requirements respectively.
604.2.3.
Two-family dwellings, including duplexes and semidetached structures.
604.2.4.
One garage apartment, to be occupied by not more than one family, provided that for such garage apartment there shall be a minimum of 4,000 square feet of lot area above the minimum required for the principal structure.
604.2.5.
Low-rise apartments on large lots, number of units in proportion to lot area (3,500 square feet/unit).
604.2.6.
Nursery schools or kindergartens, provided at least 100 square feet of outdoor play area is available to each child; the outdoor play area is enclosed by a fence having a height of not less than three feet six inches; one nonilluminated sign may be used for identifying the establishment, but may not exceed ten square feet in area and must contain no advertising; and the principal and all accessory buildings shall meet all yard and setback and height requirements of the district.
604.3.
Uses Permitted as Special Exceptions.
604.3.1.
Any use permitted as special exceptions in an R-1 district.
Within a residential R-3 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
605.1.
Purpose of the District.
The purpose of an R-3 substandard residential district is to recognize the district in which at the time of the adoption of zoning lot areas were below optimum and to provide recognition for areas which may be in transition from a residential to a commercial use.
605.2.
Uses Permitted.
605.2.1.
Any use permitted in an R-2 district.
605.2.2.
Multifamily dwellings.
605.2.3.
Apartment hotels.
605.2.4.
Cooperative apartments.
605.2.5.
Roominghouses and boardinghouses not catering to overnight travelers.
605.2.6.
Customary home occupations, including the professional offices of a physician, dentist, musician, lawyer, architect, artist, and engineer, conducted within the dwelling, provided that not more than one-fourth of the total floor area shall be used for such occupation, and no external evidence of such occupation is visible except a nonilluminated sign not more than three square feet in area wholly attached to the dwelling may be displayed. This subsection is not subject to subsections 407.1, 407.2, 407.6, and 407.10.
605.2.7.
Hospitals for human care except those primarily for the treatment of mental disorders, charitable institutions, and sanitariums.
605.2.8.
Offices or clinics for medical or dental practice.
605.2.9.
Any activity which is customarily considered as being accessory to a hospital, clinic, college, or university.
605.2.10.
Professional offices and studios including executive, administrative, writing, clerical, stenographic and drafting uses; provided there be no sales, exterior displays, exterior storage of goods or materials, warehousing or indoor storage of goods or materials beyond that normally incidental to the above permitted occupations; and, provided no more than 15 people be employed in any establishment on any one lot.
605.2.11.
Private clubs and lodges, excepting those in which the conduct of commercial affairs play a major role.
605.3.
Uses Permitted as Special Exceptions.
605.3.1.
Any uses permitted as special exceptions in an R-2 district.
605.3.2.
Individual mobile homes on single lots.
605.3.3.
Funeral homes, mortuaries, or undertaking establishments.
Within a mobile home park district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
606.1.
Purpose of the District.
The purpose of an M mobile home park district is to provide a location for mobile homes.
606.2.
Uses Permitted.
606.2.1.
Any use permitted in an R-3 multifamily [substandard] district, excluding funeral homes, mortuary or undertaking establishments.
606.2.2.
Mobile home park.
606.2.3.
Mobile home subdivisions.
606.2.4.
Accessory structures.
Within a commercial C-1 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
607.1.
Purpose of the District.
The purpose of a C-1 commercial central business district is to provide a district for the conduct of personal and business services and retail business of the city.
607.2.
Uses Permitted.
607.2.1.
Hotels/motels.
607.2.2.
Financial institutions.
607.2.3.
Transportation passenger stations, terminals and depots.
607.2.4.
Theaters.
607.2.5.
Federal, state, county, and local government offices and buildings.
607.2.6.
Restaurants.
607.2.7.
Retail dry goods, variety, appliance, hardware and tobacco stores.
607.2.8.
Furniture stores.
607.2.9.
Barbershops, beauty salons, and other personal service establishments.
607.2.10.
Office buildings.
607.2.11.
Public parks.
607.2.12.
Public parking garages.
607.2.13.
Newspaper offices.
607.2.14.
Parking lots provided they shall be paved so as to provide a durable and dustless surface so as to dispose of all surface water accumulation. Lights so used to illuminate the parking area will be so arranged as to reflect away from any adjacent premises.
607.2.15.
Ground signs, wall signs, projecting signs, and roof signs shall be permitted within the required building lines provided:
607.2.15.1.
Signs shall bear only the name of the establishment and the principal business or service.
607.2.15.2.
Professional offices and personal services shall be permitted one sign not to exceed three square feet in area for each professional office or personal service establishment.
607.2.15.3.
Retail sales and services shall be permitted one projecting sign or ground sign and one wall or roof sign and a total sign area of five square feet for each ten feet of frontage on a public street.
607.2.15.4.
Business, noncommodity sales establishments shall be permitted one projecting sign or ground sign and one wall or roof sign, and a total sign area of three square feet for each ten feet of frontage on a public street.
607.2.15.5.
Hotels shall be permitted one ground sign or projecting sign not to exceed 20 square feet in area and two signs only of a wall sign or roof sign variety, and five square feet in area of [for] each 20 feet of street frontage.
607.2.15.6.
That for each establishment there shall be permitted one projecting or ground sign overhanging the public right-of-way up to four feet beyond the right-of-way line and not exceeding 40 square feet in area overhanging the public right-of-way, provided there is a clearance of nine feet above the ground and that such signs shall not overhang a vertical projection of the curb line. No support or any part of the sign structure shall be upon the public right-of-way. No permit shall be issued for any sign overhanging the public right-of-way in accordance with this provision unless such applicant posts a bond or public liability insurance in the amount of $10,000.00 per person, $20,000.00 for any accident, and $5,000.00 for property damage. Such bond or liability insurance shall remain in effect at all times while such sign overhangs the public right-of-way.
607.2.16.
Laundry and dry-cleaning pickup stations.

607.2.24.
All uses [sic] in which would be permitted outside a municipality in a qualified resort area as defined in section 5, paragraph (O) of House Bill No. 112 of the 1966 session of the Legislature of the State of Mississippi and signed into law on the 21st day of May, 1966, and known as the "Local Option Alcoholic Beverage Control Law"; and any such other uses which may subsequently be authorized for such qualified resort areas by the Mississippi Legislature.

608.1.
Purpose of the District.
The purpose of a C-2 commercial neighborhood district is to provide retail stores and personal services for the convenience of the people of the adjacent area.
608.2.
Uses Permitted.
608.2.1.
Laundries, self-service or automatic, and laundry pickup stations.
608.2.2.
Grocery stores.
608.2.3.
Plumbing supply stores.
608.2.4.
Paint stores.
608.2.5.
Radio and television repair shops.
608.2.6.
Barbershops; beauty shops.
608.2.7.
Pet stores.
608.2.8.
Hobby shops.
608.2.9.
Supermarkets.
608.2.10.
Shoe repair shops.
608.2.11.
Bakeries.
608.2.12.
Gasoline service stations provided the service station shall be located on a lot lying at the intersection of two or more streets or on a major street.
Any tube or tire repairing, storage of merchandise and supplies shall be conducted wholly within buildings. No provision of this paragraph shall be interpreted to permit general automobile repairing, painting, body and fender work or steam cleaning.
Any structure, such as a grease rack or automobile washing apparatus, gasoline pumps, buildings and underground storage tanks, including principal use signs, shall be set back not less than 25 feet from any property line. Such areas between the property line and any service station will be kept free from trash and rubbish and no part therein shall serve as a collection point for waste material.
The means of access or egress shall be provided no less than 20 feet from intersection of street rights-of-way and not less than 25 feet from any residential district boundary line. Access and egress shall be arranged and designed so as to minimize the interference with the flow of traffic through the intersection.
Lighting shall be arranged so as not to shine nor reflect upon any adjacent premises.
608.2.13.
Parking lots in compliance with subsection 607.2.14.
608.2.14.
All uses permitted in [a] C-1 district.
608.2.15.
Retail fish markets.

Within a commercial C-3 district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
609.1.
Purpose of the District.
The purpose of a C-3 commercial highway district is for the conduct of personal and business services primarily for the motoring public on major streets and arterial highways.
609.2.
Uses Permitted.
609.2.1.
Public garages for retail service only, including automobile repairing, painting, upholstering and body and fender work, provided that these and other operations shall be conducted within a building enclosed on at least three sides; provided further that if the building is located within 50 feet of a lot in a residence zone with no intervening street, the wall of the building nearest such zone shall have no openings other than doors or stationary windows, and such doors shall be permitted only if the building is adjacent to any alley and they may be opened only at intervals necessary for ingress or egress.
609.2.2.
Auto sales provided all repair and servicing shall be done within an enclosed building subject to section 609.2.1.
609.2.3.
Laundries, self-service or automatic, and laundry pickup stations.
609.2.4.
Mortuaries.
609.2.5.

609.2.19.1.
The business is located in conjunction to a street with an allowable speed limit of 50 miles per hour or higher.
609.2.19.2.
There are no traffic signals which would require a full stop within 2,500 feet of the location of the proposed sign.
609.2.19.3.
The sign would be constructed to withstand winds of up to 150 miles per hour.
609.2.19.4.
The sign would be constructed of fire resistance [resistant] material with a minimum one-hour burn rate.

610.1.

610.2.
Uses Permitted.
610.2.1.
All uses permitted in an R-2 district.
610.2.2.
Hotels, motels, apartment hotels, and apartment buildings and permitted accessory uses which shall include:
Pharmacies, drugstores, restaurants, lounges, flower shops, gift shops, barbershops, beauty shops, travel agencies, other hotel and motel related commercial activities.
Provided that such stores, shops, or restaurants must be operated incidental thereunto and must be located within the main administrative building of hotels, motels, apartment hotels, and apartment buildings. The total floor area of the total combined permitted accessory uses shall not occupy more than 25 percent of the gross floor area of the main use. The required off-street parking for a permitted accessory use must be provided in addition to the required off-street parking required for the main use. Swimming pools are permitted anywhere in the buildable lot area.
610.3.
Uses Permitted as a Special Exception.
610.3.1.
Gasoline service stations operated in conjunction with a hotel or motel, and subject to the provisions of a C-2 district.
610.4.
General Regulations.
610.4.1.
Uses that would be permitted in an R-2 district shall be subject to the area and setback requirements of the R-2 district.
610.4.2.
Hotels, motels, apartment hotels, and apartment motels, situated along a major street shall have a minimum front yard of a [sic] 75 feet. The required off-street parking may be provided in the interior third or 25 feet of the required front yard. The balance of the required front yard must be landscaped suitably and maintained as open area void of structures or buildings of any type. Permitted signs may be erected or placed only on the interior third of the required front yard.

Within a planned industrial park district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
611.1.
Purpose of the District.
The purpose of an I-1 planned industrial park district is to provide a district for the planned development of an industrial complex. Such a complex may have one or more industries and is developed and remains under the control of a supervising authority.
611.2.
Uses Permitted.
The owner, or owners, of any contiguous and compact tract of land shall submit to the planning commission a petition for the rezoning and subsequent exclusive use and development of all such tract of land as a planned industrial park district.
In a planned industrial park district no building or structure shall be hereafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specifically authorized by the governing authority, after study and recommendation by the planning commission.
Any industrial use, upon approval of the planning commission, shall be permitted in a planned industrial park district provided no nuisance will result with regard to excessive:
a.
Smoke and other particular [particulate] matter.
b.
Noise.
c.
Odor.
d.
Fire or explosive hazard.
e.
Gases.
f.
Glare or hear [heat].
g.
Vibration.
h.
Water pollution.
i.
Other factors detrimental to the health, safety and welfare of the area.
j.
Billboard.
611.3.
Special Requirements.
The planning commission shall satisfy themselves [itself] that the conditions listed above are met before recommending approval of any use in a planned industrial park. Pursuant to this section, the applicant shall be required to furnish:
a.
Overall development plan.
b.
Data describing all processes and equipment involved in the proposed use.
c.
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices, and pedestrian walks.
d.
Plans illustrating adequate off-street parking according to standards established by the planning commission.
e.
Traffic routing system so designed as to minimize nuisance effects due to the generation of traffic to and from the use.
f.
Comprehensive landscaping plan.
g.
Any other information the planning commission may need to adequately consider the effect the proposed uses may have upon the cost of providing adequate service to the area.
The planning commission shall further satisfy themselves [itself] that the uses proposed for any planned industrial park district shall be compatible with the adjacent and nearby uses of land and that they are consistent with the intent and purposes of this ordinance to promote the public health, safety, morals, or general welfare.
611.4.
Off-Street Parking and Loading Requirements.
The off-street parking and loading requirements shall conform to article IV, "General Regulations."
611.5.
Signs and Outdoor Advertising.
The signs and outdoor advertising requirements shall conform to article IV, "General Regulations."

Within a floodplain district as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
614.1.
Purpose of the District.
This district is intended to comprise those areas which are below an elevation of 12.5 feet above mean sea level. It is a subclassification of other districts designated by the suffix "F" appended to the designation of any of the other types of districts.
614.2.
Uses Permitted.
Those uses otherwise permitted in the zoning district as it exists without the suffix "F"; except that all structures erected shall be located on a landfill or on piling, or pillars of not less than mean sea level elevation of 13 feet, provided such fill, piling or pillars do not restrict or impede the flow of waters in the floodway.
614.3.
Elevation.
Any unprotected land at or below mean sea level elevation of 12½ feet shall be classified as a floodplain. Protected land shall consist of any land located at or below mean sea level elevation of 12½ feet which is protected from flooding, inundation, or the effects of tidal action by a levee, dike, or other flood protection device.

Within a special use district, as shown on the Zoning Map, City of Pass Christian, Mississippi, the following use provisions shall apply.
615.1.
Purpose of District.
The purpose of a special use district is to enable the planning commission and City of Pass Christian, Mississippi, to establish zoning districts for mixed uses of land in accordance with the following procedures and regulations.
615.2.
Establishment of District.
The establishment of a special use district shall adhere to the regulations imposed for like categories or functions under this zoning ordinance.
615.3.
Types of Districts.
The types of special use district which could be established shall include but not be limited to such districts as:
615.3.1.
Medical complex district, to include activities such as hospitals, public health centers, nurses training facilities, pathology laboratories, doctors' clinics and offices, extended care and nursing facilities, dental clinics and offices, and other closely related and compatible uses.
615.3.2.
Recreational district to include active and passive activities such as neighborhood centers, parks and playgrounds, swimming pools, picnic areas, and other closely related and compatible uses.
615.3.3.
Educational institutions district to include activities such as grade schools, secondary schools and colleges, auditoriums, libraries, recreational facilities, and other closely related and compatible uses.
615.3.4.
Central business district, to include retail and wholesale activities, light industrial uses, high density residential uses and uses outlined in the following public district.
615.3.5.
Public district, to include municipal functions and services such as city hall, county courthouse, fire department, police department, post office, public utilities, public parking complexes, and other closely related and compatible uses.
615.3.6.
Housing district, to include such residential uses as single- and two-family residences, garden apartments, townhouses and high-density development. Any use, service or function (for example, as related to the educational district—bookstore, grill, post office, washeteria, etc.) directly related to the specific intent of the special use district will be permitted, provided [if], in the opinion of the planning commission, there are no existing services or functions conveniently located and adequate to serve the proposed development.
615.3.7.
Gaming district, to include such uses as would require a license from the State of Mississippi to operate a dockside gaming establishment.
615.4.
General procedures.
In applying for a special use district, or an amendment to such a district, an overall development plan shall be submitted to the planning commission along with a report showing the need of such a district and its effect on adjacent and surrounding uses. This overall development plan shall include, but not be limited to:
615.4.1.
Plans showing location and design of structures, delivery points, loading and storage areas, walls, fences, screen planting, signs, lighting devices and pedestrian walks.
615.4.2.
Plans illustrating adequate off-street parking according to standards established in this ordinance.
615.4.3.
Plans showing entrance and exits to the area and the traffic routing system so designed as to minimize nuisance effects due to the generation of traffic to and from the area.
615.4.4.
Any other information the planning commission may need to adequately consider the effects the proposed uses may have upon the cost of providing adequate services to the area.
The commission may attach reasonable special conditions to the approval of such district or amendments to ensure that there will be no departure from the intent of this zoning ordinance.
All proposed special use districts shall follow the procedures for subdivision approval even though the ownership of land may not be divided. A preliminary and final plat, both approved by the planning commission, shall be required for every special use district. The planning commission may establish a schedule of reasonable fees to be charged for plat review. The district shall be developed according to the approval of the final plat. Building permits and certificates of occupancy shall be required for each building according to the existing codes and regulations.
615.5.
General Regulations.
All special use districts shall:
615.5.1.
Contain a minimum of five acres, except for an expansion of an existing special use district. If the existing special use district does not contain five acres, then the additional acreage shall contain at least the amount needed to bring the total land area to five acres.
615.5.2.
Be compatible with adjacent land use, if not, adequate buffers and screening shall be required.
615.5.3.
Start construction within one year after approval of final plat. If initial construction (for example footings, foundations) does not begin within one year, all land shall revert to the original zoning. In any case, where there was no original zoning, all land will be rezoned to conform with adjacent uses.
615.5.4.
Conform to established regulations. Even though this district will have mixed uses, each separate use will meet the requirements of similar uses in other districts. For example, all residential uses in this district will comply with the applicable residential regulations as set forth in this zoning ordinance.
615.5.5.
Since a mixture of uses are permitted within this district, no building, structure, land or premises shall be used and no building or structure shall be hereinafter erected, constructed, reconstructed or altered until such use, erection, construction, reconstruction or alteration shall have been specified [specifically] authorized by the governing body after study and recommendation by the planning commission.
615.5.6.
Be binding upon the applicant or applicants, their successors and assigns, and shall limit the development to all conditions and limitations established in such plans.
615.5.7.
Proposed expansions or revisions to any originally approved special use district shall be submitted to the planning commission. Upon receiving this request, the planning commission shall follow the general procedures and regulations as previously set forth.

This ordinance is a permissive ordinance, not a prohibitive ordinance. Uses not listed in any district are prohibited in all districts. In the case of a use not provided for in any zone under the provisions of this ordinance, the application for a building permit or certificate of occupancy shall be referred to the Planning Commission. The Planning Commission in such cases shall make recommendations to the Mayor and Board of Aldermen within sixty (60) days to insert the proposed use in an appropriate zoning district.
