Sec. 901. - Enforcement.

The provisions of this ordinance shall be administered and enforced by the zoning compliance review board and by a zoning enforcement officer.

The zoning compliance review board is a three-member board composed of one member from each of the following governmental bodies:

(a)

Mayor and board of aldermen.

(b)

Planning commission.

(c)

Board of zoning adjustment.

Each of these governmental bodies shall designate one of their members to serve on this board, and such designation may be on a rotating basis among the members of said governing body. The duties of the zoning compliance review board shall be to review applications for building permits and to issue zoning compliance certificates. Said board will meet each week to review applications, the exact day and time to be determined by the board.

The zoning enforcement officer is designated by the mayor and board of aldermen; and his duties shall include assisting applicants and appellants in the procedures required thereunder, inspecting premises and issuing certificates of occupancy.

Sec. 902. - Building permit required.

A building permit issued by the designated city official is required in advance of the initiation of construction, erection, moving or alteration of any building or structure. No building permit shall be issued by the designated city official except where all the provisions of this ordinance and the city subdivision regulations [appendix A to this Code] have been complied with.

Sec. 903. - Application for a building permit.

All applications for a building permit shall be accompanied by plans in duplicate, drawn to scale, showing the actual dimensions of the lot to be built upon; the width of the street or streets upon which the lot fronts or abuts; the setback lines of buildings on adjoining lots; the exact sizes and locations on the lot of buildings already existing, if any; the location and dimension of the proposed building or alteration; the number of dwelling units the building is designed to accommodate; and such other information as may be necessary to provide for the enforcement of this ordinance.

If the proposed excavation, building, construction or movement as set forth in said plans is in conformity with the provisions of this ordinance and other ordinances of the City of Pass Christian, Mississippi, then in force, the zoning compliance review board shall issue a zoning compliance certificate. Upon evidence of the zoning compliance certificate being issued, the designated city official shall sign and return one copy of the plans to the applicant and shall issue a building permit upon payment of any required fees. The designated city official shall retain one copy of the building permit and one copy of the plans.

903.1.

Time Limitations.

Any building permit issued shall become invalid unless the work authorized by it shall have been commenced within six months of its date of issue, or if the work authorized by it is suspended or abandoned for a period of one year.

Sec. 904. - Certificate of occupancy required.

A certificate of occupancy issued by the zoning enforcement officer is required in advance of occupancy or use of:

904.1.

Any lot or change of use thereof.

904.2.

A building hereafter erected or altered or changed in the use or occupancy of an existing building.

904.3.

Each nonconforming use created by the passage of and subsequent amendment to this ordinance or that is changed, extended, altered, rebuilt thereafter.

The certificate of occupancy will state specifically where the occupancy fails to meet the requirements of occupancy. A record of occupancy permits shall be kept on record in the zoning enforcement officer's office.

Sec. 905. - Remedies.

If the zoning enforcement officer shall find that any of the provisions of this ordinance are being violated, he shall, in writing notify the person responsible for such violations, indicating the nature of the violation and ordering action necessary to correct it; among which he shall order discontinuance of use of land, buildings or structures or of additions, alterations, or structural changes thereto and discontinuance of any work being done. In such instances and under circumstances whereby the zoning enforcement officer is left without any further recourse but to seek police assistance, he may call upon the chief of police to furnish him with the necessary police personnel to fulfill his duties.

In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted, maintained, or any building or land is used in violation of this ordinance, the zoning enforcement officer, or any other appropriate city authority, or any person who would be damaged by such violation, in addition to other remedies, may institute injunction, mandamus, or other appropriate action in proceeding to prevent the violation in the case of each building or use of land.

Sec. 906. - Penalties for violation.

Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction shall be punished for each offense by paying a fine not to exceed $100.00 and/or imprisonment not to exceed the limits according to the state statutes of Mississippi. Each day such violation continues shall be deemed a separate offense.
