ARTICLE I

Scope; Enforcement

§ 210-1 Objectives and scope.

In order to achieve the purposes hereinafter set forth, this chapter defines and establishes the rights, duties and limitations attendant upon the uses of lands and buildings in the Village, and prescribes procedures to be followed in the observance thereof. It shall be read and construed in combination with and not in lieu of all other pertinent and related laws and ordinances affecting the Village and the uses of lands and buildings therein, except that if there be a clear conflict between any provision of this chapter and that of any other ordinance of the Village, the provisions of this chapter shall control.

§ 210-2 Short title.

This chapter shall be known and may be cited as the "Zoning Ordinance."

§ 210-3 Purpose and interpretation.

A. 
It is the intent of the Village and the purpose of the Zoning Chapter:
(1) 
To guide its future growth and development in accordance with a plan of land use and population density that represents the most beneficial and convenient relationships among the residential, nonresidential and public areas within the Village, considering the suitability of each area for such uses as indicated by existing conditions, trends in population and mode of living, and future requirements within the Village and in relationship to areas outside thereof.
(2) 
To protect the character and the social and economic stability of all parts of the Village; to encourage the orderly and beneficial development of all parts of the Village, and to protect and conserve the value of land and buildings appropriate to the various districts established by this chapter.
(3) 
To promote the most beneficial relationship between the uses of land and building uses in relationship to the traffic capacity of the having particular regard for the potential amount and intensity of such land and buildings uses in relationship to the traffic capacity of the street system so as to avoid, minimize and reduce congestion in the streets; and to promote safe and convenient vehicular and pedestrian traffic movements appropriate to the various uses of land and buildings throughout the Village.
(4) 
To provide adequate light, air and privacy; to secure safety from fire and other danger and to prevent overcrowding of the land and undue congestion of population.
(5) 
To enhance the appearance of the Village as a whole and in its parts.
(6) 
To bring about the gradual conformity of the uses of land and buildings throughout the Village to the chapter set forth herein, and to minimize conflicts among the uses of land and building.
(7) 
To provide a guide for public action in the orderly and efficient provision of public facilities and services, and for private enterprise in building development, investment and other economic activity relating to uses of land and buildings throughout the Village.
(8) 
To protect the open space environmental character of the Village and to provide for the continuation of existing recreational and open space uses in an efficient and economic manner.
(9) 
To enhance the commercial character of the commercial and business areas; to preserve and upgrade the commercial buildings considered architecturally unique; to encourage a variety of compatible land uses which can be integrated into the existing Pelham Manor business community; to assure that new commercial construction is compatible with existing development; to provide local employment opportunities; to make productive use of existing commercial and industrial facilities; to encourage pedestrian activity in commercial areas; to broaden commercial opportunities; to stabilize existing businesses; to ensure that adequate buffers are provided between commercial and residential development; to help meet the needs of the community for business uses; to improve parking and traffic conditions; and to improve business area aesthetics.

B. 
The Zoning Chapter shall be further interpreted as follows:
(1) 
Minimum requirements: in their interpretation and application, the provisions of this chapter shall be held to be minimum requirements for the promotion of the health, safety, morals, convenience and general welfare.
(2) 
Provisions controlling: where this chapter imposes greater restrictions upon the use of buildings or land, or upon the height of buildings, or requires larger yards or other open spaces than are imposed or required by existing provisions of law or ordinance or by other rules, regulations or permits adopted or issued at any time, the provisions of this chapter shall control.
