Perrysburg City Zoning Code

CHAPTER 1270

Municipal Planning Commission

1270.01 COMPOSITION AND TERM.

The Planning Commission shall consist of the Mayor and six (6) electors of the City not holding other City office. The members of such Commission shall be appointed by the Mayor, subject to confirmation by a majority of the members of City Council. The terms of the members of the Planning Commission, other than the Mayor, shall be appointed for a term of four (4) years and shall terminate on December 31st. A vacancy occurring during the term of any member of such Planning Commission shall be filled for the unexpired term in the manner authorized for an original appointment. No member shall be appointed for more than two (2) consecutive full terms. Any member who misses more than three (3) consecutive meetings or more than one-half (1/2) of the meetings in any calendar year shall be deemed to have vacated his or her position and shall be replaced. (Ord. 30-2006. Passed 3-7-06.)

1270.02 JURISDICTION OF THE PLANNING COMMISSION.

The Planning Commission shall have the powers and duties conferred upon it by the Charter of the City of Perrysburg and by ordinances of the City Council enacted pursuant thereto. In addition, it shall have such powers as may now or hereafter be granted by the laws of the State of Ohio. It shall adopt and recommend to the City Council a Comprehensive Plan for the physical development of the City and the redevelopment of any area or district therein. The Comprehensive Plan shall include the location of public ways, property, bridges, schools, utilities, buildings, parks, playgrounds and recreation areas and the reservation and acquisition of lands therefore. It shall prepare and recommend to the City Council ordinances creating areas, zones and districts of permitted and excluded uses, including rules, regulations, restrictions and limitations governing the plan, design, height, floor area, number of stories, open spaces, locations, use and occupancy of public and private buildings, structures and land uses or purposes, both public and private, pertaining to each as will promote the general welfare of the City and its inhabitants. It shall have control over the platting and subdivision of lands and the improvement or development thereof, including the construction of streets, sewers and utilities therein.
(Ord. 30-2006. Passed 3-7-06.)

1270.03 GENERAL PLAN AND ZONING ORDINANCES.

City Council shall by ordinance adopt a Comprehensive Plan for the orderly development of the City and plans for the redevelopment of areas or districts therein, provided, however, that part thereof may be adopted or amended from time to time, by creating areas, zones, and districts of permitted and excluded uses of such numbers or classifications and rules, regulations, limitations and restrictions pertaining to each as will promote the general welfare of the City and its inhabitants. City Council shall have full legislative authority to accomplish those matters over which the Planning Commission is given power of recommendation, provided, however, any such matter shall be first submitted to the Planning Commission, and the action of the City Council, whether approving or disapproving the recommendation of said Planning Commission, shall require a vote of the majority of the members of City Council.
(Ord. 30-2006. Passed 3-7-06.)

1270.04 NOTICE AND HEARINGS.

   (a)   The Planning Commission in procedure for enactment of zoning legislation or regulations respecting the platting or subdivision of lands, may provide by ordinance for such public hearings and notices and for the form and manner of publications or delivery of notices as it deems necessary and in the public interest and as may be in conformity with the City Charter, regardless of the provisions of the statutes of the State of Ohio in regarding thereto.
(Ord. 30-2006. Passed 3-7-06.)
   (b)   Applications shall be submitted to the Planning and Zoning Administrator at least thirty (30) days prior to transmittal to the Planning Commission. Upon receipt of an application for a Special Approval Use, an Open Space Plan, a Planned Unit Development, a single-family cluster approval or any other land use approval which requires a decision on discretional grounds, one (1) notice that a request has been received shall be published in a newspaper of general circulation in the City and shall be sent by mail or personal delivery to the owners of property for which approval is being considered, to all persons to whom real property is assessed within two hundred (200) feet of the boundary of the property in question and to the occupants of all structures within two hundred (200) feet, except that the notice shall be given at least fifteen (15) days before the application will be considered. If the name of the occupant is not known, the term “occupant” may be used in making notification. Notification need not be given to more than one (1) occupant of a structure, except that if a structure contains more than one (1) dwelling unit or spatial area owned or leased by different individuals, partnerships, businesses or organizations, one (1) occupant of each unit of spatial area shall receive notice.
(Ord. 116-2011. Passed 6-21-11.)

1270.05 MEMBERSHIP, MEETINGS AND DUTIES.

   (a)   The Planning Commission, which is created by the City Charter, shall annually elect one (1) of its members to serve as Chair. Provisions shall be made for the hiring of a Secretary for all meetings and public hearings. The Planning Commission shall designate the Planning and Zoning Administrator as receiving clerk for matters sought to be brought to its attention.
   (b)   Meetings of the Planning Commission shall normally be held at least monthly. There shall be a fixed place of meeting and all meetings shall be open to the public.
   (c)   The Planning Commission shall adopt its own rules and procedure, consistent with the provisions of the Charter and this Chapter, and a record shall be kept of its proceedings, showing the attendance of members, action of the Planning Commission and the vote of each member on each question considered. The presence of four (4) members is necessary to constitute a quorum. The Planning Commission shall act by resolution in which a simple majority must concur. The Planning Commission may adopt, from time to time, such regulations and rules, consistent with the provisions of this Chapter, as may be deemed necessary to carry into effect the provisions of this Zoning Code.
   (d)   The Charter specifically grants the Planning Commission control over the platting and subdivision of lands, with the power of recommendation relative to zoning matters. Prior to City Council consideration, zoning matters are referred to the Planning Commission for recommendation. Any City Council action overruling such recommendations requires a majority of the members of City Council. Any other vote shall confirm the recommendation of the Planning Commission. (Ord. 30-2006. Passed 3-7-06.)
