CHAPTER 1290

Interpretation and Conflict

1290.01 INTERPRETATION.

   In interpreting and applying the provisions of this Zoning Code, the provisions shall be held to be the minimum requirements for the promotion of public safety, health, convenience, comfort, prosperity and general welfare. It is not intended by this Zoning Code to interfere with, abrogate or annul any easements, covenants or restrictions established by other ordinances or statutes, or agreements between private parties. However, where this Zoning Code imposes a greater restriction upon the use of buildings or lots or upon the height of buildings or requires larger open spaces than are imposed or required by any other applicable rule, covenant or law, the provisions of this Zoning Code shall govern.

1290.02 SEVERABILITY.

   Should any Chapter, clause or provision of this Zoning Code be declared by a court of competent jurisdiction to be invalid or unconstitutional, the same shall not affect the validity of this Zoning Code as a whole or any part thereof, other than the particular Chapter, clause or provision thereof so declared to be invalid.
