CHAPTER 1225

Use Regulations

1225.01 LAND USE AND ZONING DISTRICT TABLE.

   The Use Table in this Chapter lists by Land Use Type (i.e. residential, commercial, etc.) where a particular land use is allowed in a respective base zoning district.

1225.02 PERMITTED USES (P).

   If a land use is permitted by-right in a Base Zoning District, it is identified by the symbol “P.” (Ord. 43-2006. Passed 3-7-06.)

1225.03 SPECIAL APPROVAL USE (S).

   The symbol “S” is noted if a land use is permitted after review and approval as a Special Approval Use in accordance with this Zoning Code.

1225.04 USES NOT ALLOWED.

   If a land use type is not allowed in a Base Zoning District it is shaded and without a “P” or “S.” (Ord. 43-2006. Passed 3-7-06.)

1225.05 SITE-SPECIFIC STANDARDS.

   Land use types, that are further regulated with site-specific standards are identified in Chapter 1235, Special Approval Uses.

1225.06 UNLISTED USES.

   If an application is submitted for a use type that is not classified in the Land Use Table of this Chapter, the Planning Commission is authorized to classify the new or unlisted use type into an existing land use category that most closely fits the new or unlisted use. If no similar use determination can be made, the Planning Commission may initiate an amendment to the text of the Zoning Code. (Ord. 43-2006. Passed 3-7-06.)

1225.07 LAND USE TYPE.

   Land use types listed in the Land Use and Base Zoning District Table are defined in Definition Chapter 1215 of this Zoning Code.

1225.09 AGRICULTURAL USES.

   Agricultural uses in existence at the time of adoption or amendment of the Zoning Code (Ordinance 25-65, passed November 9, 1965) may be continued in any district provided that buildings, structures, enclosures or fenced areas, except areas for grazing and/or used for the raising and care of livestock and poultry shall not be maintained closer than two hundred (200) feet to any residence on an adjacent lot or property.

1225.10 NUISANCE FACTORS.

   No activity or use shall be permitted in any single-family residential district which becomes or constitutes a nuisance factor as defined in Chapter 1215.02.
