AN ORDINANCE AMENDING TITLE 3 CHAPTER 2
SECTION 3-2-7 OF THE CODE OF ORDINANCES OF
THE CITY OF PLANO INCREASING THE NUMBER
OF CLASS E LIQUOR LICENSES FROM 7 TO 8
(MAJORLUV SOUTHERN DELIGHTS LLC)
 
   WHEREAS, the City of Plano (hereinafter referred to as the “City”) is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois;
 
   WHEREAS, the City has in full force and effect a codified set of ordinances which are of a general and permanent nature, which said codified set is known and designated as the City Code of the City of Plano, as amended;
 
   WHEREAS, the City has the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs that protect the health, safety and welfare of its residents;
 
   WHEREAS, the City continuously monitors and reviews its City Code to ensure that it is properly updated and revised to coincide with any current developments;
 
   WHEREAS, the Corporate Authorities desire to amend its liquor code pertaining to the number of licenses available within a certain liquor code classification; and
 
   WHEREAS, the Corporate Authorities of the City of Plano are of the opinion that that it is in the best interests of the safety, health and welfare of the residents to amend the portions of the City Code as set forth herein.
 
   NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Plano, Kendall County, Illinois in open meeting assembled as follows:
 
Section One – Recitals
 
   The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this ordinance as legislative findings.
 
Section Two – Amendment of Title 3 Chapter 2 Section 3-2-7(C)
 
   Title 3 Chapter 2 Section 3-2-7(C) shall be and the same is hereby amended to increase the number of Class E Liquor Licenses from seven (7) to eight (8).
 
Section Three – Codification
 
   The title, chapter(s) and section(s) adopted by this ordinance shall be numbered and placed in an appropriate title, chapter(s), and sections(s) when and during the codification of the Plano Municipal Code.
 
 
Section Four – Conflict Clause
 
   That all ordinances, parts of ordinances or board actions in conflict with the terms of this ordinance shall be repealed to the extent of said conflict.
 
Section Five – Passage Clause
 
   That this ordinance shall take full force and effect from and after its passage, approval and publication as provided by law.
 
Section Six – Constitutionality Clause
 
   Any part or parts of this ordinance declared by a court of law to be invalid or unconstitutional shall not affect the validity of the remaining provisions of this ordinance or the City of Plano Municipal Code.
 
Section Seven – Publication
 
   This ordinance shall be published in book or pamphlet form as provided by the Illinois Municipal Code.
 
Section Eight – Recording
 
   This ordinance shall be entered into the minutes and upon the journals of the City Council of the City of Plano.

ORDINANCE APPROVING AND AUTHORIZING EXECUTION OF A PURCHASE AND SALE AGREEMENT WITH FEECE OIL COMPANY FOR PURCHASE OF 3031 ELDAMAIN ROAD, PLANO, ILLINOIS 60545 IN AN AMOUNT NOT TO EXCEED ONE MILLION, THREE HUNDRED THOUSAND DOLLARS AND 00/100 CENTS ($1,300,000.00).
 
WHEREAS, the City of Plano (hereinafter referred to as the “City”) is an Illinois Municipal Corporation organized pursuant to the laws of the State of Illinois;
 
WHEREAS, the City of Plano upon approval of the corporate authorities may enter into an Agreement with another party pursuant to Illinois Statute;
 
WHEREAS, pursuant to 65 ILCS 11-76.1-1, the corporate authorities of each municipality having a population of less than 500,000 inhabitants have the power by ordinance adopted by an affirmative vote of two-thirds of the elected corporate authorities then holding office to purchase real or personal property for public purposes pursuant to contracts or leases;
 
WHEREAS, Feece Oil Company (hereinafter referred to as the “Seller”) is the owner of record of certain real estate and personal property located at 3031 Eldamain Road, Plano IL;
 
WHEREAS, the City of Plano Corporate Authorities are of the opinion that it is in the best interests of the health, welfare and safety of the residents of the City of Plano to enter into the attached Purchase and Sale Agreement with the Seller for purchase of 3031 Eldamain Road, Plano, Illinois 60545 in an amount not to exceed one million, three hundred thousand dollars and 00/100 cents ($1,300,000.00) and
 
WHEREAS, the City of Plano will utilize the real estate and personal property located at 3031 Eldamain Road for public purposes.
 
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Plano, Kendall County, Illinois in open meeting assembled as follows:
 
Section One Recitals
 
The Corporate Authorities hereby find that all of the recitals hereinbefore stated as contained in the preamble to this Ordinance are full, true and correct and do hereby, by reference, incorporate and make them part of this Ordinance as legislative findings.
 
Section Two  Approval of Agreement
 
The City hereby approves the Agreement substantially in the form attached hereto and made a part hereof collectively as Exhibit A.
 
Section Three Authorization and Direction
 
The Mayor is hereby authorized to execute, and the City Clerk is hereby authorized to attest the Agreement, substantially in the form of such agreements attached hereto as Exhibit A, with such changes therein as shall be approved by the City Attorney and the officials of the City executing the same, their execution thereof to constitute exclusive evidence of their approval to any and all changes or revisions therein from and after the execution and delivery of such Agreement. Furthermore, the Mayor or his designee is hereby authorized to execute and deliver all documents required to consummate the purchase of certain real estate and personal property located at 3031 Eldamain Road, Plano IL at closing in connection with the transaction contemplated herein.
 
 
Section Four Other Actions Authorized
 
The officers, employees and/or agents of the City shall take all other actions necessary or reasonably required to carry out and give effect to the intent of this Ordinance and otherwise to consummate the transactions contemplated herein, and shall take all actions necessary in conformity therewith including, without limitation, the execution and delivery of any and all other documents required to be executed and/or delivered in connection with the transaction contemplated herein.
 
Section Five Authorization of Expenditures
 
The Corporate Authorities hereby authorize and direct the expenditure of all costs related to the execution of the agreement, including issuance of $10,000.00 earnest money as part of the price herein specified, and additionally, the City is authorized and directed to allocate and spend all necessary funds to fulfill the requirements of the agreement and of this Ordinance.
 
Section Six Waiver of Bidding Process
 
To the extent that any requirement of bidding would be applicable to the transactions contemplated hereunder, the same is hereby waived.
 
Section Seven  Acts of City Officials
 
That all past, present and future acts and doings of the officials of the City that are in conformity with the purpose and intent of this Ordinance are hereby, in all respects, ratified, approved, authorized and confirmed.
 
Section Eight Conflict Clause
 
That all ordinances, parts of ordinances or board actions in conflict with the terms of this Ordinance shall be repealed to the extent of said conflict.
 
Section Nine Passage Clause
 
That this Ordinance shall take full force and effect from and after its passage, approval and publication as provided by law.
 
Section Ten  Saving Clause
 
If any section, paragraph, clause or provision of this Ordinance is declared by a court of law to be invalid or unconstitutional, the invalidity or unconstitutionality thereof shall not affect the validity of any other provisions of this Ordinance, which are hereby declared to be separable.
 
Section Eleven Effective Date
 
This Ordinance shall be in full force and effect from and after its passage, approval and publication as provided by law.
 
Section Twelve Publication
 
This Ordinance shall be published in book or pamphlet form as provided by the Illinois Municipal Code.
 
Section Thirteen Recording
 
This Ordinance shall be entered into the minutes and upon the journals of the City Council of the City of Plano.

AN ORDINANCE IMPLEMENTING A MUNICIPAL
GROCERY RETAILERS’ OCCUPATION TAX AND A
MUNICIPAL GROCERY SERVICE OCCUPATIONAL TAX
FOR THE CITY OF PLANO
 
   WHEREAS, the Illinois Municipal Code, 65 ILCS 5/1-2-1, provides that the corporate authorities of each municipality may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities, with such fines or penalties as may be deemed proper; and,
 
WHEREAS, the City of Plano (City”) is a non-home rule Illinois municipality pursuant to the Constitution of the State of Illinois of 1970, as amended; and,
 
WHEREAS, Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24) provides that, beginning on January 1, 2026, all Illinois municipalities may impose a tax “upon all persons engaged in the business of selling groceries at retail in the municipality” (the “Municipal Grocery Tax”) (65 ILCS 5/8-11-24); and,
 
WHEREAS, the Municipal Grocery Retailers’ Occupation Tax may be imposed “at the rate of 1% of the gross receipts from these sales” (65 ILCS 5/8-11-24); and,
 
WHEREAS, any Municipal Grocery Retailers’ Occupation Tax shall be administered, collected and enforced by the Illinois Department of Revenue; and,
 
WHEREAS, Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24) requires any municipality imposing a Municipal Grocery Retailers’ Occupation Tax under Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24) to also impose a Service Occupation Tax at the same rate, “upon all persons engaged, in the municipality, in the business of making sales of service, who, as an incident to making those sales of service, transfer groceries” as “an incident to a sale of service” (the “Municipal Grocery Service Occupation Tax”) (65 ILCS 5/8-11-24); and,
 
WHEREAS, any Municipal Grocery Service Occupation Tax shall be administered, collected and enforced by the Illinois Department of Revenue; and,
 
WHEREAS, the City Council believe that it is appropriate, necessary and in the best interests of the City and its residents, that the City levy a Municipal Grocery Retailers’ Occupation Tax as permitted by Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24); and,
 
WHEREAS, the City Council believe that it is appropriate, necessary and in the best interests of the City and its residents, that the City levy a Municipal Grocery Service Occupation Tax as permitted by Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24); and,
 
   NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the City of Plano, Kendall County, Illinois as follows:
 
Section 1. Incorporation of Recitals. The foregoing recitals shall be and are hereby incorporated as findings of fact as if said recitals were fully set forth herein.
 
Section 2. Municipal Grocery Retailers’ Occupation Tax Imposed. A tax is hereby imposed upon all persons engaged in the business of selling groceries at retail in this municipality at the rate of 1% of the gross receipts from such sales made in the course of such business while this Ordinance is in effect. The imposition of this tax is in accordance with and subject to the provisions of Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24).
 
Section 3. Municipal Grocery Service Occupation Tax. A tax is hereby imposed upon all persons engaged in this municipality in the business of making sales of service, who, as an incident to making those sales of service, transfer groceries as an incident to a sale of service. The rate of this tax shall be the same rate identified in Section 2, above. The imposition of this tax is in accordance with and subject to the provisions of Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24).
 
Section 4. Illinois Department of Revenue to Administer Both Taxes. The taxes hereby imposed, and all civil penalties that may be assessed as an incident thereto, shall be collected and enforced by the Department of Revenue of the State of Illinois. The Illinois Department of Revenue shall have full power to administer and enforce the provisions of this Ordinance.
 
Section 5. Clerk to file Ordinance with Illinois Department of Revenue. As required under Section 8-11-24 of the Illinois Municipal Code (65 ILCS 5/8-11-24), the Clerk is hereby directed to file a certified copy of this Ordinance with the Illinois Department of Revenue on or before October 1, 2025.
 
Section 6. Effective Date. The taxes imposed by this Ordinance shall take effect on the later of: (i) January 1, 2026; (ii) the first day of July next following the adoption and filing of this Ordinance with the Department of Revenue, if filed on or before the preceding April 1st; or, (iii) the first day of January next following the adoption and filing of this Ordinance with the Department of Revenue, if filed on or before the preceding October 1st.
 
Section 7. Repeal of Conflicting Provisions. All ordinances, resolutions and policies or parts thereof, in conflict with the provisions of this Ordinance are, to the extent of the conflict, expressly repealed on the effective date of this Ordinance.
 
Section 8. Severability. If any provision of this Ordinance or application thereof to any person or circumstances is ruled unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this Ordinance is severable.
 
Section 9. Headings/Captions. The headings/captions identifying the various sections and subsections of this Ordinance are for reference only and do not define, modify, expand or limit any of the terms or provisions of the Ordinance.
 
Section 10. Publication. The Clerk is directed by the corporate authorities to publish this Ordinance in pamphlet form. This Ordinance shall be in full force and effect after its passage and publication in accordance with 65 ILCS 5/1-2-4.

TAX LEVY ORDINANCE
 
 
   WHEREAS, the City Council of the CITY OF PLANO, Kendall County, Illinois, did, on the 28th day of April, 2025, adopt and approve the annual budget (Appropriations Ordinance) of the CITY OF PLANO for the fiscal year commencing on the 1st day of May, 2025, and ending on the 30th day of April, 2026, the amount of which was ascertained to be in the aggregate sum of SEVENTEEN MILLION SIX HUNDRED FORTY THOUSAND SEVEN HUNDRED SIXTY SIX and 00/100 ($17,640,766.00) DOLLARS, which said budget was adopted by the CITY OF PLANO in the manner prescribed by law; and
 
   WHEREAS, the annual budget was thereafter amended, and on the 27th day of October, 2025, the City Council of the CITY OF PLANO did adopt and approve a Comprehensive Amendment to the Budget Ordinance of the CITY OF PLANO amending Ordinance 2025-07, the amount of which was ascertained to be in the aggregate sum of NINETEEN MILLION FOUR HUNDRED SIXTY FOUR THOUSAND SIX HUNDRED THIRTY EIGHT and 00/100 ($19,464,638.00) DOLLARS, which said Amended Budget was adopted by the City Council of the CITY OF PLANO in the manner provided by law.
 
   NOW, THEREFORE, an Ordinance is required for the levy and assessment of taxes upon all of the taxable property in the CITY OF PLANO, Kendall County, Illinois, subject to taxation for the current year, the specific amount as levied for the various funds hereafter named being included herein by being placed in separate columns under the heading “TO BE RAISED BY TAX LEVY” which appears over the same.
 
   BE IT ORDAINED by the City Council of the CITY OF PLANO, Kendall County, Illinois:
 
Section 1.    That there is hereby levied upon all the taxable property within the corporate limits of the CITY OF PLANO, Kendall County, Illinois, subject to taxation, for the year 2025, for the purpose of defraying all of the necessary expenses and liabilities of the said City for the fiscal year beginning May 1, 2025, and ending April 30, 2026, a tax in the sum of TWO MILLION FIVE HUNDRED NINETY-THREE THOUSAND EIGHT HUNDRED FOUR and 00/100 ($2,593,804.00) DOLLARS for the following specific purposes as set forth in the budget for the CITY OF PLANO heretofore adopted, and in the respective sums as follows:

Section 2.   That the total amount of TWO MILLION FIVE HUNDRED NINETY-THREE THOUSAND EIGHT HUNDRED FOUR and 00/100 ($2,593,804.00) DOLLARS ascertained as aforesaid, be and the same is hereby levied and assessed on all property subject to taxation within the CITY OF PLANO, Kendall County, Illinois, according to the value of said property as the same is assessed and equalized for state and county purposes for the current year.
 
Section 3.    This Tax Levy Ordinance is adopted pursuant to the procedures as set forth in the Illinois Municipal Code.
 
Section 4.      That there is hereby certified to the County Clerk of Kendall County, Illinois, the several sums aforesaid, constituting said total amount and the said total amount of TWO MILLION FIVE HUNDRED NINETY-THREE THOUSAND EIGHT HUNDRED FOUR and 00/100 ($2,593,804.00) DOLLARS, which said total amount the CITY OF PLANO requires to be raised by taxation for the current fiscal year of said City, and the City Clerk of the CITY OF PLANO, Kendall County, Illinois, is hereby ordered and directed to file with the County Clerk of said County, on or before the time required by law, a certified copy of this Ordinance.
 
Section 5.      This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.

   I do further certify that the deliberations of the Council on the adoption of said ordinance were conducted openly, that the vote on the adoption of said ordinance was taken openly, that said meeting was called and held at a specified time and place convenient to the public, that notice of said meeting was duly given to all of the news media requesting such notice, that said meeting was called and held in strict compliance with the provisions of the Open Meetings Act of the State of Illinois, as amended, and with the provisions of the City Code of the City of Plano, as amended, and that the Council has complied with all of the provisions of said Act and said Code and with all of the procedural rules of the Council.
 
   I further state that this Certification is issued under my hand and the seal of the City of Plano as required in the Illinois Compiled Statues 65 ILCS 5/1-2-4.
