For the purpose of this Chapter, the following words and terms, as used herein, are defined to mean the following:
100-YEAR FLOODThe base flood having a one percent (1%) chance of annual occurrence.
ACCESSORY BUILDING OR USEA subordinate building having a use customarily incident to and located on the lot occupied by the main building; or a use customarily incident to the main use of the property. No residential building, tourist cabin or summer colony cottage shall be considered an accessory to any other residential building. Any accessory building or structure attached to a principal building or structure is deemed to be part of such principal building or structure in applying this Chapter to such building or structure.
ACTUARIAL OR RISK PREMIUM RATESThose rates established by the Administrator pursuant to individual community studies and investigations which are undertaken to provide flood insurance in accordance with the Federal Emergency Management Agency (FEMA) and the accepted actuarial principles. "Risk premium rates" include provisions for operating costs and allowances.
ADDITIONAn extension or increase in floor area or height of a building or structure.
AGRICULTURAL USEThe use of a tract of land for the growing of crops, pasturage, nursery or the raising of poultry, including the structures necessary for carrying out farming operations and the residence or residences of those owning or operating the premises, a member of the family thereof or persons employed thereon and the family thereof, but such use shall not include feedlots.
AIRCRAFTAny contrivance now known or hereafter invented for use in or designed for navigation of or flight in air.
AIRPORTAny premises which are used or intended for use for the landing and takeoff of aircraft; and any appurtenant areas which are used or intended for use or airport buildings or other airport structures or right-of-way, together with all airport buildings and structures located thereon.
ALLEYSA public way which affords only secondary access to abutting property.
ALTERATIONSAs applied to a building structure, a change or rearrangement in the supporting members of a building or structure or an enlargement, whether by extending on a side or by increasing in height, or the moving from one location or position to another.
ANIMAL HOSPITALAny building or portion thereof designed or used for the care, observation or treatment of domestic animals.
ANIMATED SIGNA sign with action or motion, or the allusion of action or motion, caused by flashing or color changes accomplished by any force of nature or any electrical or mechanical force.
ANTENNAThe arrangement of wires or metal rods used in the transmission and/or reception of radio frequency systems which shall include, but not be limited to, satellite dishes, but shall not include those antennas commonly found on motor vehicles.
ANTENNA HEIGHTThe overall vertical length of the antenna support structure and the antenna.
ANTENNA SUPPORT STRUCTUREAny structure, mast, pole, tripod or tower utilized for the purpose of supporting an antenna or antennas for the purpose of transmission or receipt.
APARTMENTA room or suite of rooms within an apartment used, arranged, intended or designed for a place of residence of a single-family or group of individuals living together at the single housekeeping unit.
APPEALA request for a review of the interpretation of any provision of this Chapter or a request for a variance.
AREA OF SPECIAL FLOOD HAZARDThe land in the floodplain within a community subject to a one percent (1%) or greater chance of flooding in any given year.
ATTACHED ACCESSORY BUILDINGA building which has at least twenty-five percent (25%) of any of its walls common with the walls of the principal building or is built as an integral part of the principal building.
ATTENTION-ATTRACTING DEVICEAny flasher, blinker, animation, banner, animal or human replica or other object designed or intended to attract the attention of the public to an establishment or to a sign. A time and temperature device shall not be deemed an attention-attracting device.
BABYSITTINGTo hire oneself out for money for the purpose of caring for not more than four (4) children of another.
BACKGROUNDArea upon which copy could be placed, only that face or faces which can be seen from any one (1) direction at one (1) time shall be counted.
BASE FLOODThe flood having a one percent (1%) chance of being equaled or exceeded in any given year.
BASEMENTThe portion of the building that is partly underground which has more than one-half (½) its interior height, measured from floor to finished ceiling, above the average finishing grade of the ground adjoining the building.
BASEMENT HOMESA residential building which is located almost entirely underground and has no decorative facade on the front wall of the building. This definition does not include earth contact homes.
BLOCKA tract of land bounded by streets or by a combination of streets and public parks, cemeteries, railroads, rights-of-way, shore line of waterways or boundary lines of municipalities, other than alleys. In cases where the plotting is incomplete or disconnected, the City Engineer shall determine the outline of the block.
BOARDERAny person who, in exchange for valuable consideration, receives the use of a sleeping room, with or without meals.
BODY PIERCINGThe puncturing of the skin of a person by aid of needles or other instruments designed or used to puncture the skin for the purpose of inserting jewelry or other objects in or through the human body, except puncturing the external lobe of the human ear shall not be included in this definition.
BODY PIERCING FACILITYAny room or building space or any part thereof where body piercing is practiced or where the business of body piercing is conducted. A body piercing facility shall not be operated in conjunction with an adult bookstore, adult entertainment facility, bathhouse, massage shop, nude modeling studio or tattoo parlor as defined in Article
XIV of the Platte City Zoning Code, unless the building, structure or facility containing these joint activities/services is located within the Adult Entertainment Overlay District described in Article
XIV of the Platte City Zoning Code.
BONDAny form of security including a cash deposit, surety bond, collateral, property or instrument of credit in an amount and form satisfactory to the Board of Aldermen. The Board of Aldermen shall approve all bonds wherever a bond is required by this Chapter.
BREEZEWAYA pedestrian connection between two (2) buildings, having permanent roof and floor and having no side walls except that screen wired or lattice having at least fifty percent (50%) open area may be attached in the form of side walls.
BUFFER ZONE OR BUFFER AREAOpen and unobstructed ground area around the perimeter of a tract, landscaped or planted so as to provide an attractive green space in accordance with Article
XV of this Zoning Code, having a grade not exceeding two to one (2:1) and a width of not less than fifteen (15) feet. Parking is not allowed in a buffer zone, except as otherwise provided herein. Each buffer zone shall be maintained by the owner thereof in accordance with applicable laws and codes without expense to the City of Platte City, Missouri.
BUILDINGAny structure built for the support, shelter or enclosure of persons, animals, chattels or movable property of any kind and includes any structure. When divided by other than common or contiguous walls, each portion or section of such building shall be regarded as a separate building, except that two (2) buildings connected by a breezeway having a continuous roof shall be deemed as one (1) building.
BUILDING HEIGHTThe vertical distance measured from the highest of the following three (3) levels:
1. From the street curb level;
2. From the established or mean street grade in case the curb has not been constructed;
3. From the average finished ground level adjoining the building where it sets back from the street line
to the highest point on the roof for flat roofs and to the mean height between eaves and ridge for gable, hip and gambrel roofs of such building (or non-building use), except as specifically exempted in this Chapter. |
BUSINESS OR COMMERCEAn occupation, employment or enterprise which occupies time, attention, labor and materials or where merchandise is exhibited or sold or services are offered.
CAMPGROUNDSAn area of ground, including supporting sanitary and other facilities, for the overnight or temporary parking of recreation vehicles and other modes of camping while traveling by auto.
CELLARThe portion of a building that is partly underground which has more than one-half (½) of its interior height measured from floor to finished ceiling, below the average finished grade of the ground adjoining the building.
CHANGE OF USEAny different way of using the land or improvements.
CHANNELA natural or artificial watercourse of perceptible extent, with a definite bed and banks to confine and conduct continuously or periodically flowing water. "Channel flow" is that water which is flowing within the limits of a defined channel.
CHILD CARE CENTERA building where more than ten (10) children are cared for (which includes the operator's own children), when the children's parents or guardians are employed or otherwise occupied elsewhere.
CITYThe City of Platte City.
COLLECTOR ROADSA street which carries traffic from minor streets to the major system of arterial streets and highways. The principal entrance street to residential development is included. It should be designed so that no residential properties face onto it.
COMMON OPEN SPACEAn area of land or water or combination thereof planned for passive or active recreation which does not include areas utilized for streets, alleys, driveways, private roads, off-street parking or loading areas. However, the area of recreational activities such as swimming pools, tennis courts, shuffleboard courts, etc., may be included as common open space.
CONSTRUCTION PLANThe maps or drawings accompanying a subdivision plat and showing the specific location and design of improvements to be installed in the subdivision in accordance with the requirements of the Planning Commission as a condition of the approval of said plat.
CONVALESCENT HOMEA building where regular nursing care is provided for more than one (1) person not a member of the family, which resides on the premises.
COPY AREAThe area of sign copy applied to any background. Copy area to be computed by drawing straight lines along copy extremities in such a way as to encompass individual letter and words. Copy area is then figured in terms of square inches, feet and meters.
CORNER LOTLot situated at the intersection of two (2) streets, the interior angle of such intersection not exceeding one hundred thirty-five degrees (135°). A corner lot shall be deemed to front on that street on which it has its least dimension, unless otherwise specified by the City Engineer.
COSMETIC TATTOOINGPermanent cosmetic makeup applied to the human body by various methods, wherein colored pigment is deposited into the upper reticular layer of the skin. Also known as "micropigmentation", "micropigment implantation" or "dermagraphics".
COSMETIC TATTOOING AND BODY PIERCING ESTABLISHMENTAn establishment licensed by the Director of Division of Professional Registration of the State of Missouri to perform cosmetic tattooing and body piercing services by a person or persons who are individually licensed by the Division of Professional Registration of the State of Missouri and that operate in conjunction with a beauty salon, barbershop or spa, or in conjunction with a licensed medical practitioner where cosmetic tattooing is regularly conducted whether or not it is in exchange for compensation. A cosmetic tattooing and body piercing establishment shall not be operated in conjunction with an adult bookstore, adult entertainment facility, bathhouse, massage shop, nude modeling studio or tattoo parlor as defined in Article
XIV of the Platte City Zoning Code, unless the building, structure or facility containing these joint activities/services are located within the Adult Entertainment Overlay District described in Article
XIV of the Platte City Zoning Code.
COURTAn open space bounded on three (3) or more sides by exterior buildings, walls or by exterior walls of a building and lot line upon which walls or fences are allowable. An outer court extends to a street or yard and an inner court does not.
CUL-DE-SACA local street with only one (1) outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
CURB LEVELThe level of the top of a curb in front of a building or structure measured at the center of said front. Where no curb level has been established, it shall be deemed to be the established level of the centerline of the street surface in front of a building or structure measured at the centerline of such front.
CURB LINEThe line at the face of the curb nearest to the street or roadway. In the absence of a curb, the curb line shall be established by the City Engineer.
CUSTODIAL CARE LIVING UNITMentally and/or physically handicapped individuals occupying a single housekeeping unit where single kitchen facilities for the purpose of receiving custodial care provided by a not-for-profit agency certified by the State or the court system. Maximum occupancy for each custodial care living unit shall be no more than eight (8) unrelated mentally retarded or physically handicapped persons and two (2) supervisors.
DAY CARE CENTER OR CHILD CARE CENTERA building where more than ten (10) children are cared for (which includes the operator's own children), when the children's parents or guardians are employed or otherwise occupied elsewhere.
DECIBEL OR dbA unit of measurement of the intensity (loudness) of sound. As used in this Chapter, decimal level shall be measured on the "A Scale" and referred to as "db (A)".
DEPTH, LOTThe mean horizontal distance from the front lot line to the rear lot line.
DETACHED SIGNAny sign located on the ground or on a structure located on the ground and not attached to a building.
DEVELOPMENTAny manmade change to improved or unimproved real estate including, but not limited to, buildings or other structures, mining, dredging, filling, grading, paving, excavating or drilling operations.
DISPLAY SURFACEThe area made available by the sign structure for the purpose of displaying the advertising message.
DISTRICTA section or sections of the zoning area for which these regulations governing the use of land, the height of buildings, the size of yards or the intensity of use are uniform.
DOG KENNELA structure used for the harboring of more than two (2) dogs that are more than one (1) year old.
DRIVEA right-of-way which affords a means of vehicular access to or through an area in which it is owned and maintained by the owner of the property it serves.
DRIVE-IN RESTAURANTAny restaurant where the food is normally ordered from and consumed in a vehicle parked on the premises shall be deemed a drive-in for the purpose of this Chapter. Also considered a drive-in establishment is:
1. An establishment that, in addition to allowing the consumption of food or beverages outside the premise, also allows the consumption of food within a completely enclosed structure; and
2. Food vending establishment where the food is not normally consumed within a building or where facilities are provided for eating outside of building.
DRIVE-THROUGH ESTABLISHMENTAny restaurant, financial institution or product vending enterprise where business is transacted through a window or other mechanical device with a patron who is in a vehicle.
DUSTLESS SURFACEAt the very minimum, hard surfaced with a ninety-five percent (95%) compacted base that is minimum of four (4) inches of crushed rock and covered with a minimum of four (4) inches of Portland cement concrete or asphaltic concrete. The applicant shall also consult the Missouri Standard Specifications for Highway Construction (1986 and amendments) and the Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981) and if a higher standard is required in either for the construction of the area, this higher standard shall apply. If a lower standard is set forth in either the Missouri Standard Specifications for Highway Construction (1986 and amendments) or Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981), it shall not apply and the applicant shall follow the minimum standards set forth in this paragraph. All construction shall be in accordance with good general engineering practice.
DWELLINGA building or portion thereof intended for occupancy for residential purposes which is permanently affixed to a foundation embedded in the soil, but not to include hotels, motels, house trailers or mobile homes.
One (1) or more rooms constituting all or part of a dwelling in which are arranged, designed, used or intended for use exclusively as a single housekeeping unit for one (1) family and which includes cooking, living, sanitation and sleeping facilities.

1. LOFTA dwelling located above the first floor of a non-residential use such as a store or office
2. MULTIPLE- FAMILYA building or portion thereof arranged, intended or designed for occupancy by three (3) or more families living independently of each other.
3. SINGLE-FAMILYA detached building arranged, intended or designed for occupancy by one (1) family.
4. TWO-FAMILYA building arranged, intended or designed for occupancy by two (2) families.
EARTH CONTACT HOMESA residential building which is partly underground, has a decorative facade on the front exterior wall, does not have a flat roof and which approval as an earth contact home has been obtained from the Planning Commission.
EARTH REMOVAL OR EXCAVATIONThe removal or extraction of any stone, sand, gravel, loam, topsoil or other earth or earth product from a lot or parcel of land, except where such removal is for the purpose of grading a lot upon which a building is to be erected or a roadway to be built.
ELECTRIC SIGNAny sign containing electrical wiring, but not including signs illuminated by an exterior light source.
ESCROWA deposit of cash with the City in lieu of an amount required and still in force on a performance or maintenance bond. The City Treasurer shall deposit such escrow funds.
ESTABLISHED SETBACKThe average setback on each street on which a plot fronts, within the same district and within three hundred (300) feet on each side of such plot along the same side of the street, but not beyond any intersecting street, established by three (3) or more buildings.
EXCAVATION OR EARTH REMOVALThe removal or extraction of any stone, sand, gravel, loam, topsoil or other earth or earth product from a lot or parcel of land, except where such removal is for the purpose of grading a lot upon which a building is to be erected or a roadway to be built.
EXISTING MANUFACTURED HOME PARK OR SUBDIVISIONA manufactured home park or subdivision for which the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including, at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed before the effective date of the floodplain management regulations adopted by a community.
EXPANSION TO AN EXISTING MANUFACTURED HOME PARK OR SUBDIVISIONThe preparation of additional sites by the construction of facilities for servicing the lots on which the manufactured homes are to be affixed (including the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads).
FAMILYOne (1) or more persons who are related by blood, marriage, adoption or part of a custodial program approved by a Probate or Circuit Judge living together and occupying a single housekeeping unit, or a group of not more than five (5) persons (excluding servants) who need not be related by blood or marriage, living together and subsisting in common as a separate non-profit housekeeping unit which provides one (1) kitchen, or a group of eight (8) or fewer unrelated mentally retarded or physically handicapped persons, including two (2) additional persons acting as house parents or guardians who need not be related to each other or to any of the mentally retarded or physically handicapped persons in residence.
FAMILY DAY CARE HOMEA personal residence in which one (1) of the permanent occupants thereof provides child care for compensation for more than four (4), but for no more than ten (10) children not related to the provider for any part of a twenty-four (24) hour day.
FENCEAn unroofed barrier or unroofed enclosing structure including poles, posts and entrance and exit gates.
FLOOD ELEVATION DETERMINATIONA determination of the water surface elevation of the 100-year flood; that is, the level of flooding that has a one percent (1%) chance of occurring in any given year.
FLOOD HAZARD BOUNDARY MAP (FHBM)An official map of a community, issued by the Administrator, where the boundaries of the flood areas having special flood hazards have been designated as unnumbered or numbered A Zones.
FLOOD INSURANCE RATE MAP (FIRM)An official map of a community on which the Administrator has delineated both the special flood hazard areas and the risk premium zones applicable to the community.
FLOOD INSURANCE STUDYThe official report provided by the Federal Emergency Management Agency. The report contains flood profiles, as well as the Flood Boundary Floodway Map, and the water surface elevation of the base flood.
FLOOD OR FLOODINGA general or temporary condition of partial or complete inundation of normally dry land areas from:
1. The overflow of inland or tidal waters,
2. The unusual and rapid accumulation of runoff of surface waters from any source.
FLOODPROOFINGAny combination of structural and non-structural additions, changes or adjustments to structures, including utility and sanitary facilities, which would preclude the entry of water. Structural components shall have the capability of resisting hydrostatic and hydrodynamic loads and the effect of buoyancy.
FLOODWAY FRINGEThat area of the floodplain, outside of the floodway, that on the average is likely to be flooded once every one hundred (100) years (i.e., that has a one percent (1%) chance of flood occurrence in any one (1) year).
FLOODWAY OR REGULATORY FLOODWAYThe channel of a river or other watercourse and the adjacent floodplain that must be reserved in order to discharge the base flood without cumulatively increasing the water surface elevation more than one (1) foot.
FLOOR AREA RATIOThe ratio of the floor area to the lot area is determined by dividing the floor area by the lot area.
FLOOR AREA, TOTALThe sum of the gross horizontal areas of the several stories of the building measured from the exterior faces of the exterior walls or from the centerline of the party walls. Included shall be any basement floor, interior balconies and mezzanines, elevator shafts, stairwells, enclosed porches and basement area, provided however, in residential construction the basement areas shall not be computed unless the same is to be living space nor shall finished attic space unless it has headroom of seven (7) feet, ten (10) inches or more. The floor area of accessory uses and of accessory buildings, including residential garages, shall not be included in the computation of floor area.
FOOT-CANDLEThe illumination of a surface one (1) foot distance from a source of one (1) candela, equal to one (1) lumen per square foot.
FREESTANDING SIGNA sign which is supported by one (1) or more columns, upright or bases in or upon the ground.
FRONT LOT LINEWhere the road or street right-of-way meets the abutting property.
FRONT YARDAn open space unoccupied by buildings or structures (except as herein before provided) across the full width of the lot extending from the front line of the building to the front street line of the lot.
FRONT YARD DEPTHThe minimum horizontal distance from the front line of the building to the front street line of the lot.
GARAGE, AUTO REPAIRAny building or premises used for the storage, care or repair of motor vehicles, which is operated for commercial purposes.
GARAGE, PRIVATEA structure used for the storage of not more than three (3) personal motor vehicles.
GARAGE, STORAGEA building or portion thereof, except those defined as a private or commercial garage, providing storage for motor vehicles.
GASOLINE SERVICE STATIONAny use of land, including any building or structure thereon, that is used for the supply of gasoline or other fuel for the propulsion of vehicles, including any area, building or structure used for polishing, greasing, washing, spraying, cleaning, servicing or repairing of motor vehicles.
GOVERNING BODYThe Mayor and Board of Aldermen of Platte City, Missouri.
GROUND FLOOR AREAThe lot area covered by a building measured from the exterior faces of exterior walls, but excluding open terraces or open porches, garages or carports.
GROUND SIGNA sign placed at or near ground level not exceeding three (3) feet in height and which is supported by one (1) or more uprights, poles or braces permanently embedded in the ground.
HEALTH FACILITYA business, office or establishment where physical exercise, health management, medicine or other health-related services are performed.
HEIGHT OF BUILDINGThe vertical distance measured from the highest of the following three (3) levels:
1. From the street curb level;
2. From the established or mean street grade in case the curb has not been constructed;
3. From the average finished ground level adjoining the building where it sets back from the street line
to the highest point on the roof for flat roofs and to the mean height between eaves and ridge for gable, hip and gambrel roofs of such building (or non-building use), except as specifically exempted in this Chapter. |
HISTORIC STRUCTUREAny structure that is:
1. Listed individually in the National Register of Historic Places (a listing maintained by the Department of Interior) or preliminarily determined by the Secretary of the Interior as meeting the requirements for individual listing on the National Register;
2. Certified or preliminarily determined by the Secretary of the Interior as contributing to the historical significance of a registered historic district or a district preliminarily determined by the Secretary to qualify as a registered historic district;
3. Individually listed on a State Inventory of Historic Places in States with historic preservation programs which have been approved by the Secretary of the Interior; or
4. Individually listed on the inventory of historic places in communities with historic preservation programs that have been certified either:
a. By an approved State program as determined by the Secretary of the Interior, or
b. Directly by the Secretary of the Interior in States without approved programs.
HOME OCCUPATIONA business, profession, service or trade conducted for gain or support entirely within a residential building.
HOTEL OR MOTELA building occupied or used generally as a temporary place of residence by individuals or groups of individuals who are lodged, with or without meals, in which there are more than ten (10) sleeping rooms and no provision made for cooking in any individual guest room. This includes such establishments as auto courts, tourist cabins, etc.
ILLUMINATED SIGNA sign in which a source of artificial light is used in order to make the message readable. This definition shall include internally and externally lighted signs.
INDIRECTLY ILLUMINATED SIGNAny sign which is partially or completely illuminated at any time by a constant, non-moving light source which is so shielded as to not be visible at eye level.
INDOOR SHOOTING RANGEAn indoor facility in which the supervised discharging of firearms is authorized by City permit along with other related activities such as the sale of legal firearms, legal ammunition and targets and the instruction of the use of firearms.
LEGAL SETBACK LINEA line established by ordinance beyond which no building may be built. A legal setback line may be a property line.
LOCAL ROADA road intended to provide access to other roads from individual properties and to provide right-of-way beneath it for sewer, water and storm drainage pipes.
LOTA tract, plot or portion of a subdivision or other parcel of land occupied by or intended for occupancy by one (1) principal building, unified groups of buildings or principal use and have access to a public street.
LOT AREAThe area of a horizontal plane bounded by the vertical planes through front, side and rear lot lines.
LOT, CORNERA lot situated at the intersection of two (2) streets, the interior angle of such intersection not exceeding one hundred thirty-five degrees (135°). A corner lot shall be deemed to front on that street on which it has its least dimension, unless otherwise specified by the City Engineer.
LOT DEPTHThe mean horizontal distance from the front lot line to the rear lot line.
LOT, DOUBLE FRONTAGEA lot having a frontage on two (2) non-intersecting streets, as distinguished from a corner lot.
LOT LINEA property boundary line of any lot.
LOT LINE, FRONTWhere the road or street right-of-way meets the abutting property.
LOT LINE, REARThat boundary of a lot which is opposite and most distant from and is or is approximately parallel to the front lot line. If the rear lot line is less than ten (10) feet in length or if the lot forms a point at the rear, the rear lot line shall be deemed to be a line sixteen (16) feet in length within the lot, parallel to and at the maximum distance from the front lot line.
LOT LINE, SIDEAny lot boundary lines not a front or rear line thereof. A side line may be a party lot line, a line bordering on an alley or a side street line.
LOT SPACINGA parcel or tract of land used, developed or built upon as a unit under single ownership or control. Said parcel or tract may consist of one (1) or more lots of record, one (1) or more portions of a lot or lots of record or any combination thereof.
LOT WIDTHThe horizontal distances between side lot lines, measured at the front building line.
LOWEST FLOORThe lowest floor of the lowest enclosed area, including basement. An unfinished or flood-resistant enclosure, usable solely for parking of vehicles, building access or storage, in an area other than basement area, is not considered a building's lowest floor, provided that such enclosure is not built so as to render the structure in violation of the applicable floodproofing design requirements of this Chapter.
MAIN FLOORThe floor level of a residential structure designed for use for general living purposes. The main floor shall be the ground level finished floor of a family dwelling excluding basements and garage.
MAJOR SHOPPING CENTERA tract of ground not less than five (5) acres in size, developed as a unified retail shopping center consisting of one (1) or more retail stores or shops.
MANSARDFor purposes of this regulation, a mansard having a pitch not exceeding one (1) foot horizontal and three (3) feet vertical shall be deemed a wall. A mansard having a less vertical slope shall be deemed as a roof.
MANUFACTURED HOMEA structure, transportable in one (1) or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when connected to the required utilities. For floodplain management purposes, the term "manufactured home" also includes park trailers, travel trailers and other similar vehicles placed on a site for greater than one hundred eighty (180) consecutive days. For insurance purposes, the term "manufactured home" does not include park trailers, travel trailers and other similar vehicles.
MARQUEEA permanent roofed structure attached to and supported by the building and projecting over public property.
MARQUEE SIGNAny sign attached to or constructed in a marquee.
MASSAGE THERAPISTA health care practitioner who provides or offers to provide massage therapy, as provided in Sections 324.240 to 324.275, RSMo., to any person at no cost or for a fee, monetary or otherwise, implying that the massage therapist is trained, experienced and licensed in massage therapy, and who holds a current, valid license to practice massage therapy.
MASSAGE THERAPYA health care profession which involves the treatment of the body's tonus system through the scientific or skillful touching, rubbing, pressing or other movements of the soft tissues of the body with the hands, forearms, elbows, or feet, or with the aid of mechanical apparatus, for relaxation, therapeutic, remedial or health maintenance purposes to enhance the mental and physical well-being of the client, but does not include the prescription of medication, spinal or joint manipulation, the diagnosis of illness or disease, or any service or procedure for which a license to practice medicine, chiropractic, physical therapy, or podiatry is required by law, or to those occupations defined in Chapter 329, RSMo.
MEAN SEA LEVELThe average height of the sea for all stages of the tide.
MOBILE HOME DWELLING OR TRAILER HOUSEAny vehicle, trailer or similar portable structure mounted or designed for mounting on wheels, used or intended for use for single-family dwelling purposes only, including structural additions, except parked or unoccupied camping-type trailers. Any such vehicle, trailer or structure shall be deemed to be a mobile home whether or not resting upon a temporary or permanent foundation. A manufactured home shall be deemed a mobile home for the purpose of this Chapter. A mobile home dwelling shall be located solely in an authorized mobile home park by conditional permit of the Board of Aldermen.
MOBILE HOME PARKPlot where two (2) or more mobile home dwellings are located or which is held out or used for the purposes of supplying to the public parking space for two (2) or more mobile homes and shall include all buildings, structures, land uses and equipment utilized for such park.
MOBILE HOME SITEA plot of ground within a mobile home park designed for accommodation of one (1) mobile home.
MONUMENT SIGNA permanent detached sign of generally horizontal shape constructed of stone, masonry materials, concrete, metal, sand blasted or routed wood planks or beams or plastic and which is mounted on a base or columns of similar material.
MOTEL OR HOTELA building occupied or used generally as a temporary place of residence by individuals or groups of individuals who are lodged, with or without meals, in which there are more than ten (10) sleeping rooms and no provision made for cooking in any individual guest room. This includes such establishments as auto courts, tourist cabins, etc.
MOTOR VEHICLEAny self-propelled vehicle designed primarily for transportation of persons or goods along public street or alleys or other public ways.
MULTIPLE COPY SIGNA sign on which advertises other than the name of the business and the principal product or service.
NATIONAL ELECTRICAL CODEThe edition currently adopted by the City as published by the International Conference of Building Officials.
NEW CONSTRUCTIONStructures for which the "start of construction" or "substantial improvement" is commenced on or after the effective date of the Federal Insurance Rate Map.
NEW MANUFACTURED HOME PARK OR SUBDIVISIONA manufactured home park or subdivision for which the construction of facilities for servicing the lot on which the manufactured homes are to be affixed (including at a minimum, the installation of utilities, the construction of streets, and either final site grading or the pouring of concrete pads) is completed on or after the effective date of floodplain management regulations adopted by the community.
NOXIOUS MATTERMaterial which is capable of causing injury or physical discomfort to living organisms by chemical reaction or is capable of causing detrimental effects upon the health or the psychological, social or economic well-being of human beings.
NUDE MODELING STUDIOA fixed place of business where there is carried on the occupation of maintaining, operating and offering services for any compensation whatsoever of modeling for the purpose of reproducing the human body wholly or partially in the nude by means of photography, painting, sketching, drawing or otherwise; to be included within this definition is the occupation or practice for any compensation whatsoever of offering one's body wholly or partially in the nude for the purpose of having designs or whatever nature applied thereto by whatever process or technique with any kind of substance whether it be transparent or non-transparent.
NURSERYAny land used to raise trees, shrubs, flowers and other plants for sale or for transporting.
NURSING HOMEAn establishment or agency licensed by the State for the board and care or treatment of three (3) or more unrelated individuals.
OFF-PREMISES OUTDOOR ADVERTISING SIGNA sign, including the type commonly known as a billboard, which directs attention to a business, commodity, service, entertainment or attraction conducted, sold, offered or existing:
1. Elsewhere than upon the same plot where such sign is displayed; or
2. Not for the principal use of such plot.
OFF-SITEAny premises not located within the area of the property to be subdivided whether or not in the same ownership of the application for subdivision approval.
ON-PREMISES SIGNA sign which carries only advertisements strictly incidental to a lawful use of the premises on which it is located, including signs or sign devices indicating the business transacted, services rendered, goods sold or produced on the premises, name of the business, name of the person, firm or corporation occupying the premises.
OPERATOR - BODY PIERCING/COSMETIC TATTOOING ESTABLISHMENTAny individual, firm, company, corporation or association that owns or operates an establishment where tattooing, cosmetic tattooing or body piercing is performed and/or any individual who performs or practices the art of tattooing, cosmetic tattooing or body piercing on the person of another.
OPERATOR - INDOOR SHOOTING RANGEA person who, on a regular basis, provides an indoor premises for the purpose of discharging legal firearms including, but not limited to, pistols, rifles, shotguns and archery for target practice under permit by the City and who may also offer for sale legal firearms, legal ammunition and targets incidental thereto if properly authorized and permitted to do so by the State and Federal Governments and who may also offer licensed instruction on the use of firearms on the permitted premises.
PARKING LOT (FOR OFF-STREET PARKING, LOADING, AISLES FOR MANEUVERING, ENTRANCE AND EXITS)All off-street parking, loading, aisles for maneuvering, entrance and exits shall be at the very minimum hard surfaced with ninety-five percent (95%) compacted base that is a minimum of four (4) inches of crushed rock and covered with a minimum of four (4) inches of Portland cement concrete or asphaltic concrete. The applicant shall also consult the Missouri Standard Specifications for Highway Construction (1986 and amendments) and the Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981) and if a higher standard is required in either for the construction of the area, this higher standard shall apply. If a lower standard is set forth in either the Missouri Standard Specifications for Highway Construction (1986 and amendments) or Division II Construction and Material Specs, Grading and Site Preparation, Paving, Incidental Construction and Seeding and Sodding (APWA Specs Section 2000 through 2400, 1981), it shall not apply and the applicant shall follow the minimum standards set forth in this paragraph. All construction shall be in accordance with good general engineering practice.
PLANNING COMMISSIONThe duly appointed advisory board having duties and jurisdiction in the City of Platte City as set out in Missouri Statutes and local ordinances and which board may be referred to herein as the "Planning Commission".
PLOTOne (1) or more contiguous parcels of land under single ownership or control designated by its owner, at the time of filing an application for a building permit, as a tract to be used, developed or built upon as a unit. It may or may not coincide with the deed description thereof or the boundaries of the same as shown on a map thereof filed for record or otherwise and it may be subsequently subdivided into two (2) or more plots, provided all such plots conform to all the regulations of the district. The boundaries of any plot for which a building permit or certificate of occupancy is requested shall be accurately drawn on the application therefore.
POLE SIGNA sign wholly supported by a sign structure in the ground with at least six (6) feet of clearance from ground to the lowest point of the sign which directs your attention to a business, commodity, service, entertainment or attraction conducted, sold, offered or existing upon the same plot where such sign is displayed.
POLITICAL SIGNSAny sign of any kind promoting, supporting or opposing any candidate, office, issue or proposition to be voted upon at any public election.
PORTABLE DISPLAY SURFACEA display surface temporarily fixed to a standardized advertising structure, which is regularly moved from structure to structure at periodic intervals.
PRINCIPALLY ABOVE GROUNDAt least fifty-one percent (51%) of the actual cash value of the structure, less land value, is above ground.
PROJECTING SIGNAny sign extending more than one (1) foot from the face of the building to which it is attached or any sign mounted under a canopy or on a wall and having its face approximately at right angles to the face of the building. A time and temperature instrument mounted on the face of a building shall be included in this definition.
PROJECTIONThe distance by which a sign extends beyond the building line.
PROPERTY LINESThe dividing line between the street and the lot or the line separating two (2) adjacent properties.
PUBLIC BUILDINGAny building held, used or controlled exclusively for public purposes by any department or branch of government, State, County or municipal, without reference to the ownership of the building or of the realty upon which it is situated.
PUBLIC IMPROVEMENTAny drainage ditch, roadway, parkway, sidewalk, pedestrian way, tree, lawn, off-street parking area, lot improvement or other facility for which the City may ultimately assume the responsibility for maintenance and operation or which may affect an improvement for which City responsibility is established. All such improvements shall be properly bounded.
REAR LOT LINEThe boundary line which is opposite and most distance from the front street line; except that in the case of uncertainty, the City Engineer shall determine the rear line.
RECREATIONAL VEHICLEA vehicle which is:
1. Built on a single chassis;
2. Four hundred (400) square feet or less when measured at the largest horizontal projections;
3. Designed to be self-propelled or permanently towable by a light-duty truck; and
4. Designed primarily not for use as a permanent dwelling but as temporary living quarters for recreational, camping, travel or seasonal use.
REPAIRAny alterations, reconstruction or conversion of a building.
RESIDENCEOne (1) or more rooms constituting all or part of a dwelling in which are arranged, designed, used or intended for use exclusively as a single housekeeping unit for one (1) family and which includes cooking, living, sanitation and sleeping facilities.
RESIDENTIAL ACCESSORY SELF-STORAGEA facility designed for secured private secondary storage of an individual's own furniture, fixtures, toys, recreational equipment and vehicles, clothing and other goods.
RETIREMENT HOMEA residential building having accommodations for and occupied exclusively by residents who are senior citizens.
RIGHT-OF-WAYA strip of land occupied or intended to be occupied by a street, crosswalk, railroad, road, electric transmission line, oil or gas pipeline, water main, sanitary or storm sewer main or for another conditional use. The usage of the term "right-of-way" for land platting purposes shall mean that every right-of-way hereafter established and shown on a final plat is to be separate and distinct from the lots or parcels adjoining such right-of-way and not included within the dimensions or areas of such lots or parcels. Rights-of-way intended for streets, crosswalks, water mains, sanitary sewers, storm drains or any other use involving maintenance by a public agency shall be dedicated to public use by the maker of the plat on which such right-of-way is established. (See also FRONT LOT LINE).
RINGLEMANN CHARTA chart which is described in the U.S. Bureau of Mines Information Circular 6888 and on which are illustrated graduated shades of gray for use in estimating the light-obscuring capacity of smoke.
ROADSIDE STANDSAny structure (including temporary) used for the temporary sale of products or services.
ROOF SIGNA sign erected upon or above a roof or parapet wall of a building and which is wholly or partially supported by said building.
SAME OWNERSHIPOwnership by the same person, corporation, firm, entity, partnership or unincorporated association; or ownership by different corporations, firms, partnerships, entities or unincorporated associations, in which a stockholder, partner or associate or a member of his/her family owns a substantial interest in each corporation, firm, partnership, entity or unincorporated association.
SCHOOL, PRIMARYAn educational facility comprising of grades Kindergarten through eighth (8th) grade.
SCHOOL, SECONDARYAn educational facility comprising of grades ninth (9th) through twelfth (12th) grade.
SEMI-ILLUMINATED SIGNAny sign located on a building which building face is uniformly illuminated over its entire area, including the area of the sign, by use of electricity or other artificial light.
SETBACKThe distance between a building and the street line nearest thereof.
SEXUAL OR GENITAL AREAThe genitals, pubic area, buttocks, anus or perineum of any person and the vulva or breasts of a female.
SHOPPING CENTER, PARK OFFICE, BUSINESS PARK OR INDUSTRIAL PARKA development of one (1) or more buildings on a site planned as an integrated unit or a cluster on property under one (1) ownership or single control at the time the zoning was approved by the Board of Aldermen. The sale, subdivision or other partition of the site after zoning approval does not exempt the project or businesses thereon from compliance with development standards, architectural quality and harmony, sign design and other conditions that were committed to at the time of rezoning.
SIDE LOT LINEAny lot boundary not a front or rear line thereof. A side line may be a party lot line, a line bordering on an alley or a side street line.
SIGNAny medium, including its structure and component parts, which is used or intended to be used to attract attention to the subject matter for advertising purposes.
SIGN AREAThe area of each surface or face of the sign. Such signs as projecting, detached and outdoor advertising panels may have more than one (1) face, in which case the maximum area allowed herein shall apply to each face or surface. The area of the sign, for purposes of these regulations, shall be computed from the dimensions of the entire surface upon the letters, logo, etc., are placed, except that when the individual letters, logo, etc., are mounted individually and directly upon a building wall surface without change in the color or appearance of the wall, the area of the sign shall be deemed to be the rectangle or other geometric form that encompasses the letters, logo, etc. When some question exists as to the area of signs, the method of computing the same shall be determined by the zoning enforcement person (who may seek the assistance of the City Engineer).
SIGN STRUCTUREAny structure which supports or is capable of supporting any sign as defined in this Chapter. A sign structure may be a single pole and may or may not be an integral part of the building.
SITE DEVELOPMENT PLANA plan drawn to scale showing property boundary lines, location of proposed buildings or improvements and showing with particularity the same improvements proposed (See Article
XXIV) and complete building plans where applicable to a building permit.
SPLIT LEVEL HOMEA dwelling designed with adjoining levels of living space separated by approximately one-half (½) story of steps, but in any event not more than five (5) feet of difference in levels of the adjoining living space.
STANDARD POSTER PANELAny sign of material such as cardboard, paper, pressed wood, plastic or metal which is attached to a fence, tree or temporary structure or to wheels (including motor vehicles) or skids or any sign which is not securely fastened to a building or firmly anchored to the ground.
START OF CONSTRUCTIONIncludes substantial improvements and means the date the building permit was issued, provided the actual start of construction, repair, reconstruction, rehabilitation, addition placement or other improvements were within one hundred eighty (180) days of the permit date. The "actual start" means either the first (1st) placement of permanent construction of a structure on a site such as the pouring of slabs or footing, the installation of piles, the construction of columns, any work beyond the stage of excavation or the placement of manufactured homes on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling, the installation of streets and/or walkways, excavation for a basement, footings, piers,foundations, the erection of temporary forms, nor installation on the property of accessory structures such as garages or sheds not occupied as dwelling units or not part of the main structure. For a "substantial improvement", the "actual start of construction" means the first (1st) alteration of a wall, ceiling, floor or other structural part of a building, whether or not that alteration affects the external dimensions of the building.
STORAGE, STORED, STOREThe keeping of materials, equipment or products of the following nature:
1. In residential districts the keeping of building materials, industrial equipment, semi-trailers, trucks, recreational vehicles and equipment and similar items for a period of time longer than would normally be involved in the day-to-day use or consumption of the same. The keeping of motor passenger cars, pickup trucks and similar vehicles used for daily transportation by occupants of the premises and construction materials and equipment which are being used for construction on the premises shall not be considered storage.
2. In commercial and industrial districts the keeping of merchandise, raw materials, products or equipment.
STORYThat portion of a building included between the surface of any floor and the floor or the ceiling next above. A basement shall be counted as a story and a cellar shall not be counted as a story.
STORY, HALFA top story attic is a half story, when the main line of the eaves is not above the middle of the interior height of such story. The first (1st) story is a half story when between fifty percent (50%) and seventy-five percent (75%) of its exterior walls are exposed to outside light and air entirely above grade and which exterior walls contain windows or doors permitting the entrance of daylight and outside air.
STREETA right-of-way which affords primary means of access to an abutting property.
STREET LINEThe dividing line between the street and the abutting property.
STREET NETWORK1. ARTERIALA street, which provides for through traffic movement between and around areas with direct access to abutting property, subject to necessary control of entrances, exits and curb uses.
2. COLLECTOR: A street which provides for traffic movement between arterial and local streets with direct access to abutting property.
3. EXPRESSWAY: A street which provides fast and efficient movement of large volumes of traffic between areas.
4. LOCAL: A street which provides direct access to abutting land and local traffic movement whether in business, industrial or residential areas.
STREET, PRIVATEA roadway or street used for internal vehicular circulation within a development, which has been identified as such on the final plat and which is located within the access easement recorded on the plat. Private streets shall be considered "streets" for purposes of this Code where applicable.
STRUCTURAL ALTERATIONSAny change in the supporting members of a building, such as bearing walls or partitions, columns, beams or girders or any complete rebuilding of the roof or the exterior walls. For the purpose of this regulation, the following shall not be considered a structural alteration:
1. Attachment of a new front where structural supports are not changed.
2. Addition of fire escapes where structural supports are not changed.
3. New windows where lintels and support walls are not materially changed.
4. Repair or replacement of non-structural members.
STRUCTUREAnything erected, the use of which requires more or less permanent location on the ground or attached to something having permanent location on the ground including, but without limitation to, buildings, factories, sheds, cabins, manufactured homes, mobile homes and other similar uses.
SUBDIVISIONAny land, vacant or improved, which is divided or proposed to be divided into three (3) or more lots, parcels, sites, units, plots or interests from the purpose of offer, sale, lease or development, either on the installment plan or upon any and all other plans, terms and conditions, including resubdivision. "Subdivision" includes the division or development of residential and non-residential zoned land whether by deed, metes and bound description, map, plat or other recorded instrument.
SUBSTANTIAL DAMAGEDamage of any origin sustained by a structure whereby the cost of restoring the structure to pre-damaged condition would equal or exceed fifty percent (50%) of the market value of the structure before the damage occurred.
SUBSTANTIAL IMPROVEMENT (THIS DEFINITION SHALL APPLY EXCLUSIVELY FOR DEFINING ARTICLE XXV "FLOODPLAIN REGULATIONS")Any repair, reconstruction or improvement of a structure, the cost of which equals or exceeds fifty percent (50%) of the market value of the structure either:
1. Before the improvement or repair is started, or
2. If the structure has been damaged and is being restored, before the damage occurred.
For the purpose of this definition, "substantial improvement" is considered to occur in the first (1st) alteration of any wall, ceiling, floor or other structural part of the building commences, whether or not that alteration affects the external dimensions of the structure. The term does not, however, include either: |
1. | Any project or improvement of a structure to comply with existing, State or local health, sanitary or safety code specifications which are solely necessary to assure safe living conditions, or |
2. | Any alteration of the structure listed on the National Register of the Historic Places. |

SWIMMING CLUBA pool operated for members and their guests, whether or not operated for gain.
SWIMMING POOL, PRIVATEA pool which is an accessory use to a residence and for the exclusive use of the occupants of the residential building and their guests.
TATTOOOne (1) or more of the following:
1. An indelible mark made on the body of another person by the insertion of a pigment under the skin; or
2. An indelible design made on the body of another person by production of scars other than by branding.
TATTOO PARLORAny place where, for consideration, persons are tattooed, received a tattoo or where tattooing services are rendered in any other manner other than cosmetic tattooing or body piercing.
TAVERNAn establishment in which the primary function is the public sale and serving of alcoholic and cereal malt beverages for consumption on the premises, including establishments, commonly known as cocktail lounges and nightclubs.
TEMPORARYA time period not to exceed six (6) months unless elsewhere listed within this Code.
TEMPORARY SIGNSAny sign or advertising display designed so that the same may be moved from place to place or intended for use for a limited period of time or which is not permanently affixed to a building or to a supporting structure that is permanently installed in the ground.
TOOL SHEDAn accessory building used for storage purposes which shall not exceed one hundred twenty (120) square feet of floor area.
TOWN HOUSEA single-family dwelling constructed as part of a series of dwellings, all of which are either attached to the adjacent dwelling or dwellings by party walls or are located immediately adjacent thereto with no visible separation between walls or roofs.
TRAVEL TRAILER OR RECREATION VEHICLEA portable vehicular unit mounted on wheels designed to provide temporary living space for recreational, camping or travel use and of such size or weight as not to require a special highway movement permit when drawn by a motorized vehicle. Such units commonly described as travel trailers, campers, motor homes, converted buses or other similar units, whether they are self-propelled, pulled or can be hauled without a conditional permit, would be considered examples of travel trailers.
TRUCKIncludes tractor and trailer trucks or any motor vehicle which carries a truck license.
TRUCK GARDENTo sell fruits, vegetables or other homegrown or produced edible items from a truck.
USEThe purpose or activity for which the land or building thereon is designed, arranged or intended or for which it is occupied or maintained.
USE, ACCESSORYA subordinate or secondary use which is clearly and customarily incidental to the principal use of a building or premises and which is located on the same lot as the principal building or use.
USE, PERMITTEDAny building, structure or use which, on the effective date of this Chapter, complies with the applicable regulations governing permitted uses of the zoning district in which such building, structure or use is located.
USE, PRINCIPALThe main use of land or building as distinguished from a subordinate or accessory use.
USEABLE OPEN SPACEThat part of the ground area or a plot for a multi-family residence, a one-family attached residence or a residence in a building which also contains non-residential uses, which is:
1. Devoted to outdoor recreational space, greenery and service space for household activities (such as clothes drying) which are normally carried on outdoors.
2. Not devoted to private roadways, open to vehicular transportation, accessory off-street parking spaces or accessory off-street loading berths.
3. Unobstructed except as permitted within this Zoning Code.
4. Accessible and available to all occupants of dwelling units for whose use the space is required.
VARIANCERelief from one (1) of the provisions of this Chapter, as applied to a specific piece of property or permitting a use other than one (1) of those prescribed by the zoning ordinance in the particular district.
VIOLATIONThe failure of a structure or other development without the elevation certificate, other certifications, or other evidence of compliance required by the Floodplain Regulations is presumed to be in violation until such time as that documentation is provided
WALL SIGNSAny sign which is in any manner affixed to any exterior wall of a building or structure and which projects not more than eighteen (18) inches from the building or structure wall and which does not extend more than six (6) feet above the parapet, caves or building facade of the building on which it is located.
YARDAn open space at grade between a building and the adjoining lot lines, unoccupied and unobstructed by any portion of a structure from the ground upward except as otherwise provided. In measuring a yard for the purpose of determining the width of a side yard, the depth of a front yard or the depth of a rear yard, the least horizontal distance between the lot line and the main building shall be used. The yards within the "C-1", "M-1" and "M-2" Districts can be paved.
YARD, FRONTA yard across the full width of the lot extending from the front line of the main building to the front lot line.
YARD, REARA yard between the rear lot line and the rear line of the main building and the side lot lines.
YARD, SIDEA yard between the main building and the adjacent side line of the lot and extending entirely from a front yard to the rear yard thereof.
ZONE OR DISTRICTA section of the zoning area for which uniform regulations governing the use, height, area, size and intensity of use of buildings, land and open space are herein established.
ZONING ADMINISTRATORThe person or persons authorized and empowered by the Governing Body having jurisdiction to administer the requirements of these zoning regulations.
ZONING AREAThe area to be zoned as set out on the official Zoning Map filed of record.
ZONING ENFORCEMENT PERSONThe person charged with the administration and enforcement of this Zoning Code or his/her duly authorized appointee.
ZONING ORDINANCEThe official zoning ordinance of the City together with any and all amendments hereto, adopted pursuant to Chapter 89, RSMo.
