ARTICLE IV

Residence B Districts

§ 176-16 Applicability.

In a Residence B District the following regulations shall apply.

§ 176-17 Permitted uses.

No building may be erected, altered or used and no lot or premises may be used except for one or more of the purposes set forth in § 176-6 of Article III of this chapter.

§ 176-18 Lot area requirements.

No building shall be constructed on a lot of an area less than 5,000 square feet, unless authorized by the Board of Appeals pursuant to Article XIII, § 176-147A.

§ 176-19 Building area requirements.

The building area shall not exceed 35% of the lot area.

§ 176-20 Front yard requirements.

There shall be a front yard the depth of which shall not be less than 20 feet.

§ 176-21 Rear yard requirements.

There shall be a rear yard the depth of which shall not be less than 25 feet.

§ 176-22 Side and rear yard requirements for single-family dwellings.

In case of a single-family dwelling there shall be side yards of at least 12 feet. Neither side yard shall be less than five feet; provided, however, that in case of a lot held in single and separate ownership at the effective date of this chapter and of a width less than 50 feet or a depth less than 100 feet, six inches may be deducted from the aggregate width of the side yards for each foot in width such lot shall lack of the said 50 feet, but no side yard shall be less than four feet wide; six inches may be deducted from the required depth of the rear yard for each foot in depth such lot shall lack of the said 100 feet, but the depth of such rear yard shall in no case be reduced thereby to less than 15 feet.

§ 176-23 Building height.

No building shall exceed 2 1/2 stories or 31 feet in height.

§ 176-24 General requirements for side yards.

All buildings, other than buildings being used as detached one-family or detached two-family dwellings, shall have side yards of at least 15 feet. Notwithstanding the foregoing, any existing nonconforming building in excess of 31 feet in height shall have side yards of at least 20 feet.

§ 176-25 Corner lots.

In case of a corner lot, a building shall be required to comply with the front yard restrictions only on the narrower street front. The depth of yard from the other street lines shall be 20% of the width of the lot, but need not be more than 20 feet.

§ 176-26 Street frontage and front yard width.

The minimum street frontage and front yard width shall be 50 feet.

§ 176-27 Additional restrictions.

A. 
For the purpose of preserving the comprehensive zoning plan set forth in this chapter and the character of the residential neighborhood which has developed in accordance with that plan and for the purpose of protecting the lives and property of residents living in that area of the Village's Residence B District and Residence A-1 District where there are extreme changes in the elevation of the terrain, the additional restrictions are imposed on certain lands in the Residence B District and Residence A-1 District.
B. 
Not more than one detached single-family dwelling may be built on any one of the lots hereinafter listed in Subsection C hereof and the sole vehicular access to said lots shall be from Soundview Drive.
C. 
The lots which are subject to the limitations set forth in Subsection B of this section are known and designated as:
Lots 11, 12, 19 and 20 in Block 115, on a certain map entitled "Map of Soundview Village, Section 2," filed in the Nassau County Clerk's Office on 11/16/1959, File No. 7244.
Lots 21 through 25, inclusive, in Block 115, on a certain map entitled "Map of Soundview Village, Section 6," filed in the Nassau County Clerk's Office on 9/27/1961, File No. 7492.
Lots 50 through 58, inclusive, in Block 115, on a certain map entitled "Map of Soundview Village, Section 15," filed in the Nassau County Clerk's Office on 4/26/1968, File No. 8145.
Lots 59 through 77, inclusive, in Block 115, on a certain map entitled "Map of Soundvillage, Section 16," filed in the Nassau County Clerk's Office on 4/26/1968, File No. 8146.
Lots 28 through 30, inclusive, in Block 137, on a certain map entitled "Map of Soundview Village, Section 21," filed in the Nassau County Clerk's Office on 10/23/1974, File No. 8544.
