26.1 In a residential or apartment district, an accessory building is a subordinate structure, attached or detached from the main building, without separate bath or kitchen facilities, not used for commercial purposes and not rented.
26.2 In other districts, an accessory building is a subordinate building, the use of which is incidental to and used only in conjunction with the main building.
26.3 No accessory building shall exceed twenty-five (25) feet in height, nor shall it be greater in height than the main structure.
26.4 Area Regulations for Accessory Buildings in Residential and Apartment Districts:
A. Size of Yards:
1. Front Yard:
Attached front accessory buildings shall have a front yard not less than the main building or as specified in the particular district. Detached accessory buildings shall be located in the area defined as the rear yard, except that a detached garage may be allowed in the area defined as the side yard and shall have a front yard not less than the main building and shall meet all other setbacks for that district and as provided by this Section.
2. Side Yard:
There shall be a side yard not less than five (5) feet from any lot line, alley line, or easement line, except that adjacent to a side street, the side yard shall never be less than fifteen (15) feet.
3. Rear Yard:
There shall be a rear yard not less than five (5) feet from any lot line, alley line, or easement line. Garages, or other accessory buildings, located within the rear portion of the lot as heretofore described shall not be located closer than five (5) feet to the main building nor nearer than fifteen (15) feet from any street or alley line on which it faces.
4. Any garage constructed in a residential or apartment district shall be set back not less than fifteen (15) feet from any street or alley line on which it faces. Except that any provision of this ordinance requiring a greater setback shall prevail.
26.5 Porte Cocheres and Carports.
A. Attached Porte Cocheres, as defined by this ordinance, or covered paved areas constructed under the same roof structure as the main structure, shall be subject to all regulations applicable to the main structure. Detached Porte Cocheres shall be regulated as accessory structures.
B. Carports, shall be subject to the following provisions:
1. The carport regulations herein are provided to regulate Carports that provide covered vehicle parking that is accessible from an improved driveway, accommodates no more than two (2) vehicles and is used for an existing single-family residence. Carports proposed for any other purpose shall be regulated as accessory structures.
2. Carports shall be designed so materials and colors and placement are aesthetically consistent with the primary structure.
3. Parking areas under carports shall be paved with hot mix asphalt or concrete paving. The building official may approve special alternate materials manufactured for paving purposes such as paver materials, but not including gravel, rock, recycled asphalt or similar materials.
4. Carports shall be open on at least two (2) sides.
5. Carports shall not extend into the required front yard, except when authorized by a variance approved by the City Council. Approval of a variance will be based on lot limitations, and carport design considerations such as proposed materials, aesthetics and potential impacts on neighboring properties.
6. Carports shall have a minimum interior side yard setback of three (3) feet. The eaves/overhang of the carport may extend to a point no closer than 2' from the side property line. On corner lots, carports shall have an exterior yard setback of not less than fifteen (15) feet.
7. Carports may be located in the rear yard and shall be set back a minimum of five (5) feet from any rear lot line or alley line.
8. No portion of the carport shall be located within, or extend over, any easement.
9. Carport vertical supports shall be anchored in or to an approved permanent foundation or footing and have a minimum width of 3-1/2 inches and a maximum width of 6 inches. Carports shall be constructed utilizing no more than 6 vertical support posts.
10. Carports shall be engineered or designed to meet all structural load requirements of the adopted building code (i.e. wind, snow).
11. Carports shall not be temporary, or moveable structures, or be constructed using plastic materials, fabrics or other materials that do not meet the above requirements.
