CHAPTER 9

NONCONFORMING USES

§ 9.001

A business which is in existence at the time of passage of this ordinance shall be allowed to remain in operation, even though it is not in compliance with the ordinance. The nature of the business as it exists at the time of adoption of the ordinance can not be changed or altered. If the business should later be sold or change ownership, any other use must comply with the conforming uses of the ordinance as approved, unless otherwise approved by the Board of Adjustments.
(a) 
Nonconforming structures which are destroyed, or which become dilapidated as defined in appropriate city ordinances, may only be replaced or rebuilt with structures which conform to the provisions of this ordinance, unless destruction of the nonconforming structures is caused from an “Act of God,” i.e., tornado, flood, lightning, etc., as determined by the Board of Adjustment.
