CHAPTER 1125

Districts and Map

1125.01 INTENT.

   Except as hereinafter provided, no building or land or part thereof located in the City shall be used, altered, constructed, reconstructed, moved within or into the City except in conformity with the provisions of this Zoning Code which apply to the district in which it is located.

1125.02 DIVISION INTO DISTRICTS.

   For the purpose of this Zoning Code the City is hereby divided into the following zoning districts:

   The above classification of districts shall not be construed as an enumeration of the most restrictive to least restrictive districts except for the specific applications set forth in this Zoning Code.

1125.03 ZONE MAP.

   The districts and abbreviations designated in Section 1125.02 and the locations and boundaries of the districts are established on a map entitled “Zone Map of the City of Richmond Heights, Ohio”, dated June, 1972. The map and all notations, references, schedules and other information shown thereon are hereby made a part of this Zoning Code as if the matters and information set forth by the Map were all fully set forth and described herein.

1125.04 DISTRICT BOUNDARY LINES.

   The district boundary lines of the Zone Map unless shown otherwise, are recorded lot lines, the center lines of streets or such lines extended and the limits of the City, provided, however:
   (a)   Where the district boundary line is shown by dimension or relationship as being located a specific distance from and/or parallel to a street line, the distance shall control; or
   (b)   Where a district boundary line divides a parcel of land, the location of such boundary, unless related to fixed points on the property boundary, shall be determined by scale and each part of the parcel shall comply with the regulations of the district in which it is located; or
   (c)   Where a district boundary line does not coincide with any of the aforesaid lines and where it is not located by dimensions or fixed points shown on the Map, it shall be determined by the scale appearing thereon and in cases of other uncertainties, Council shall approve the exact location after application to and recommendation of the Planning and Zoning Commission.

1125.05 PUBLIC UTILITY FACILITIES.

   In all zoning districts except industrial, public utility facilities and uses (without storage yards) when operating requirements necessitate the locating of such buildings and facilities within the district in order to serve the immediate vicinity, shall be permitted after review and approval of the site plan and upon a finding by the Planning and Zoning Commission that the use will not be injurious to the surrounding neighborhood and not contrary to the spirit and purpose of this Zoning Code.

1125.06 ACCESS TO STRUCTURES.

   Every building or structure hereafter erected or moved shall be on a lot abutting a public street or permanent easement having a right of way not less than sixty feet in width.

1125.07 MOVING OF STRUCTURES.

   All structures or parts of structures to be moved within or into the City shall require approval from the Planning and Zoning Commission and the Architectural Board of Review. Any application for a permit to move a building or structure within or into the City shall designate the proposed location of the building or structure and the secretary for the Planning and Zoning Commission of the City shall notify the abutting residents and those within five building lots on each side of the property, upon both sides of the street, of the date, time and place at which the Planning and Zoning Commission and the Architectural Board of Review shall review the application for approval to move the building or structure to the proposed location. In the event the proposed location is a corner lot, notification shall be given to all residents within five building lots of the intersection for each street forming the intersection. Such notice shall be in writing and delivered by first class mail or personal service at least fourteen days prior to the date of the hearing at which the application for moving shall be considered. Approval of the location of the building or structure shall be based upon a specific finding in writing that the structure or part of the structure will not be injurious to the surrounding neighborhood and not contrary to the spirit and purpose of this Zoning Code.

1125.08 EASEMENT USE .

   Erection of permanent structures on easements for public utilities is prohibited. "Permanent structure" means and includes a garage or other building but shall not include a fence, retaining wall, free-standing wall, concrete walk, paving or any similar object which will prevent or interfere with the free right or opportunity to use or make the easement accessible for essential services.

1125.09 PROHIBITED USES.

   No junk yards and no automobile trailer camps or tourist cabins shall be established in any zoning district. Automobile trailers, recreational vehicles, tourist cabins, similar portable dwellings or tents shall not be permitted to be used or occupied as dwellings in any zoning district.

1125.10 ZONING OF VACATED AREAS.

   Whenever any street or portion thereof is vacated, such street or portion thereof shall automatically be classified in the same zoning district as the property to which it is attached.

1125.11 SHORT-TERM RENTAL PROHIBITION IN RESIDENTIAL DISTRICTS.

   (a)    No person shall operate, let, rent, list, advertise, or otherwise make available, any rental dwelling in a residential district in the Municipality for the purpose of a short-term rental.
   (b)    Definitions.
      (1)    "Short-term rental" shall be defined as the right to use, occupy or possess, or the actual use, occupancy or possession, of a rental dwelling through a rental for temporary, transient occupancy for dwelling, sleeping, lodging, or entertaining others for a period of less than thirty (30) continuous days.
      (2)    "Municipality" shall mean the City of Richmond Heights, Ohio.
   (c)    Upon reasonable suspicion of a violation of this section and a demand by a police officer or building inspector of the Municipality, the occupant and/or person in charge of a rental dwelling shall be required to immediately produce a copy of the rental agreement or lease for any rental dwelling in a residential zoning district in the Municipality.
   (d)    Penalty. Violation of this section shall be a misdemeanor of the first degree.
