Shade Trees 1
§ 34-41.1 Prohibited Acts.
[1973 Code § 88-18]
a.
No person shall do or cause to be done any of the following acts without a written permit from the Borough of Rockleigh:
1.
Cut, trim, break, climb with spike, disturb the roots of or otherwise injure, spray with any chemical or remove any living limb or shrub, or injure, misuse or remove any structure or device placed to support or protect such trees or shrubs, on a public highway or park or other public place within the Borough, or attach any rope, wire, sign or other device to any such tree or shrub.
2.
Plant any tree or shrub on a public highway, park or other public place.
3.
Destroy, injure or remove any living tree having a diameter of 12 inches or more in the preparation of a plot for building or for other uses or purposes, in the absence of proven necessity.
b.
For every such living tree that is destroyed or removed, the planting of a new tree at an accepted location within the Borough may be required by the Borough.
c.
At a street intersection, no shrub over 54 inches in height or tree with branches less than 10 feet above the street level, nor bank of earth nor any other object (except trunks of shade trees) shall obstruct the view diagonally across a corner as observed from any point along the street property line within 40 feet from the corner.
