CHAPTER 17

52. - C-2 HIGHWAY COMMERCIAL DISTRICT

Sec. 17.52.010. - Purpose.

The purpose of this zoning district is to provide for commercial uses and services generally maintained in central business district fringe areas where the density of traffic and building area is not conducive to desirable residential living. This district encourages heavier commercial establishments intended for highway locations.

Sec. 17.52.020. - Use requirements; permitted uses.

Permitted uses include:

A.

Uses permitted in the C-1 zoning district;

B.

Art metal and ornamental iron shops;

C.

Automobile, trailer, boat, airplane and parts, sales rooms and lost;

D.

Bowling alley, pool, billiard rooms;

E.

Cabinet, carpenter, upholstery establishments;

F.

Car washes;

G.

Ceramics;

H.

Drive-in theaters;

I.

Dwellings, when located above the ground floor, provided the ground floor is designed and used exclusively for a commercial purpose permitted in the zone;

J.

Farm equipment and heavy machinery;

K.

Feed stores;

L.

Garments, fabric, carpet, furniture cleaning and dyeing, but all solvents, shampoos, detergents and other agents shall be noncombustible and nonexplosive having a rating of five or under by the underwriters laboratories;

M.

Glazing, picture framing establishments;

N.

Hospitals and clinics for animals, subject to the following:

1.

Minimum lot size is five acres.

2.

Barns and corrals shall be set back a minimum distance of not less than 20 feet from all exterior property boundaries.

3.

Kennels are permitted in association with hospitals and clinics for animals. All buildings associated with a kennel shall be set back a minimum distance of not less than 20 feet from all exterior property boundaries.

4.

Stables are permitted in association with hospitals and clinics for animals. All buildings associated with a stable shall be set back a minimum distance of not less than 20 feet from all exterior property boundaries.

Medical marijuana dispensaries, subject to the requirements found in section 17.12.240;

New and used car sales, service and rentals;

Newspaper and printing offices;

Y.

Nightclubs, subject to the approval of a conditional use permit;

Z.

Nurseries and greenhouses;

AA.

Nursing homes;

BB.

Pet shops;

CC.

Plumbing, heating, ventilating, refrigeration establishments;

DD.

Practice golf driving tees and putting ranges;

EE.

Public auctions in enclosed building (livestock not included);

FF.

Public garages and parking;

GG.

Restaurants including restaurants with drive-up windows and outdoor dining;

HH.

Retail and wholesale stores;

II.

Secondhand goods;

JJ.

Service shops: shoe or bicycle repair, tool or cutlery;

KK.

Service stations, automobile and truck repair with body and fender and paint shops if confined to a closed building;

LL.

Sheet metal, tinsmiths;

MM.

Shelter facilities, subject to the approval of a conditional use permit, and subject to the following limitations:

1.

The agency or organization operating the shelter facility shall comply with the following requirements:

a.

The provider shall have a written management plan including, as applicable, provisions for staff training, neighborhood outreach, security, screening of residents to ensure compatibility with services provided at the facility, and services such as training and counseling for residents;

b.

On-site management and on-site security shall be provided during hours when the shelter facility is in operation;

c.

Staff and services shall be provided to assist residents in obtaining permanent shelter and income;

d.

The shelter facility shall house no more than 15 persons.

2.

No such shelter facility shall be located on a lot that is within 1,320 feet of the lot of another shelter facility.

3.

When adjacent to a residential zoning district or a residential use, a minimum 20-foot rear yard and 20-foot side yard setback shall be maintained.

4.

The shelter facility shall maintain good standing with city and/or state licenses for the owner, operator, and/or staff on the proposed shelter facility;

Swap meets;

PP.

Tire recapping if confined to a closed building;

QQ.

Trade schools with outdoor welding;

RR.

Travel trailer parks subject to the approval of a conditional use permit and development in accordance with the requirements in section 17.72.190;

SS.

Warehouses confined to closed building;

TT.

Other like businesses when approved by the zoning administrator. The zoning administrator's decision may be appealed to the board of adjustment.

Sec. 17.52.030. - Specific requirements.

A.

The maximum building height shall be as provided in section 17.68.010.

B.

The minimum lot area shall be as provided in section 17.68.010.

C.

All outdoor lighting shall be hooded or shielded to deflect source of light away from residential districts and shall comply with all of the requirements of the outdoor lighting code which is chapter 15.32.

D.

Nonconforming single-family dwellings, uses, and accessory buildings shall be allowed to be increased or expanded provided that the R-2 Multiple-Family Residential District requirements pertaining to setbacks, maximum lot coverage, building height in feet and building height in stories are followed.

E.

Any new commercial development on property adjoining a residential zone shall provide a sight-obscuring fence, five to six feet in height or other satisfactory buffer to protect the neighboring residential zone. The buffer which the developer proposes shall be clearly indicated on the building permit application. Nonconforming single-family dwellings and uses shall comply with the requirements of section 17.28.020 for animals which are considered customary household pets.

Sec. 17.52.040. - Other requirements.

A.

Requirements and restrictions pertaining to area and width of lots, the location of buildings and structures, the size of yards and open space, the height and size of buildings and the percentage of the lot that may be occupied shall be as set forth in chapter 17.68 relating to the C-2 zone.

B.

All windows and doors of a vacant structure shall provide a window display or covering that is aesthetically pleasing and belies the fact that the building is vacant.

C.

Windows that are boarded up or have security shutters shall be decorated in a manner that is consistent with the character of those surrounding buildings that are not boarded up. Expanded metal is not an acceptable material.

D.

Upon receipt of a notice of noncompliance with this section, the property owner shall have 90 days in which to provide the window display or covering.
