Zoning Districts

§ 300-6 Districts designated.

The Town of Salisbury, Massachusetts, is hereby divided into 10 zoning districts to be designated as follows:

These zoning districts are noted on a map titled "Town of Salisbury Zoning" dated May 20, 2024, prepared by the Merrimack Valley Planning Commission, with the boundaries designated thereon, which map is hereby declared to be part of this bylaw and shall be on file in the office of the Building Inspector of Salisbury who shall be responsible for its maintenance and any authorized amendments thereto.[2]
A. 
The following amendments of the Zoning Map were adopted on May 16, 2005:
(1) 
The boundary of the Commercial IV District is noted on a map titled "Proposed Zoning Rabbit Road C-4 District Boundaries" dated April 3, 2006, which is hereby declared to be a part of this bylaw and is on file with the Town Clerk.
(2) 
Map 10, Lot Numbers 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 70, 71, 81, 82, 84, 85, 86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 97, 98, 99, 100, 101, 102, 103, 104, 105, 106, 107, 108, 109, 110, 111, 112, 113, 114, 115, 116, 117, 118, 119, 120, 121, 122, 123, 124, 126, 127, 128, 129, 130, 131, 132, 133, 134, 136, 137, 138, 139, 140, 141, 142, 143, 145, 146, 152, 153, 154, 155, 158, 170, 171, 183, 190, 195, 217, 232, 233, 234, 236, and 282 are included in the Commercial IV District.
(3) 
Map 18, Lot Numbers 2 and 3 are included in the Light Industrial District.
(4) 
Map 18, Lot Numbers 120, 119, 118, 117, and 116 in the area of High Street and Rabbit Road are included in the Commercial District.
(5) 
Map 10, Lot Numbers 1, 143, 145, 236, and 146 are included in the Commercial District.

C. 
The following amendments of the Zoning Map were adopted on October 23, 2006:
(1) 
Village Center District. The boundary of the Village Center District is shown on the map titled "Village Center District," dated August 24, 2006, on file with the Town Clerk, and the Zoning Map is hereby amended to reflect such district. The following parcels are included in the Village Center District: 2-10, 2-11, 2-12, 2-13, 2-14, 2-63, 3-10, 3-12, 3-13, 3-14, 3-15, 3-16, 3-17 (partial), 3-18, 3-19, 3-127, 3-128, 3-129, 3-130, 5-8, 5-15, 5-16, 5-17, 5-18, 5-73, 5-75, 6-11, 6-12, 6-13, 6-14, 6-18, 6-19, 6-20, 6-21, 6-22, 6-24, 6-25, 6-27, 6-28 (A, B, C), 6-29, and 6-62.
(2) 
Village Residential Overlay District. The boundary of the Village Residential Overlay District is shown on the map titled "Village Residential Overlay District," dated August 24, 2006, on file with the Town Clerk, and the Zoning Map is hereby amended to reflect such district. D. 
The following amendments to the Zoning Map were adopted on May 19, 2008:
(1) 
Modify the boundary of the Commercial (C) District in the area of Main Street and Rabbit Road by including Lot Number 50 on Assessor's Map 12 in the Commercial (C) District as shown on a map entitled “Proposed Zoning” dated March 18, 2008, which is on file with the Town Clerk and is hereby declared to be part of the Zoning Bylaw.
(2) 
Modify the boundary of the Commercial (C) District in the area of Old Elm Street and Rabbit Road by including Lot Number 2 on Assessor's Map 10 and the adjacent section of Old Elm Street in the Commercial (C) District as shown on a map entitled "Proposed Zoning Change" dated April 14, 2008 which is on file with the Town Clerk and is hereby declared to be part of the Zoning Bylaw.
E. 
The following amendments to the Zoning Map were adopted on May 18, 2009:
(1) 
Map 10, Lot Numbers 142, 143, 145, 153, 154, 155 and 236 are included in the Commercial District; and to amend the Official Zoning Map of the Town of Salisbury by modifying the boundary of the Commercial District (C) as noted on a map entitled "Proposed Zoning Old Elm Street C District Boundaries," dated April 10, 2009, which is available for review in the Town Clerk's office.
F. 
The following amendments to the Zoning Map were adopted on 10-26-2009:
(1) 
Add a new Water Resource District as an overlay district as shown on the map entitled “Water Resource District Overlay Salisbury, MA,” dated April 10, 2009, and deleting the Water Resource District Map dated May 1987.
(2) 
Add a new Outer Village Residential Overlay District, as shown on the map entitled “Outer Village Residential Overlay District,” dated August 26, 2009, which is on file with the Town Clerk.
G. 
The following amendments to the Zoning Map were adopted on 5-16-2011:
(1) 
Modify the boundary of the Light Industrial (I) District in the area of Rabbit Road by including Lot Number 30 on Assessor's Map 10 in the Light Industrial (I) District as shown on a map entitled “Proposed Zoning,” dated April 13, 2011, which is on file with the Town Clerk and is hereby declared to be part of the Zoning Bylaw.
H. 
The following amendments to the Zoning Map were adopted on 5-19-2014:
(1) 
Establish a Medical Marijuana Overlay District (MMOD) in all land of the Commercial 3, Commercial 4 and Light Industrial Zoning Districts and portions of the Commercial and Commercial 2 Zoning Districts. The Medical Marijuana Overlay District does not include any portion of any parcel as follows: Assessor’s Map-Lot 36-32, 36-34, 36-36, 36-37, 36-38, 36-40, 36-42, 36-185, 36-186, and 36-187, nor any portion of any parcel located on Joy Road in the Commercial 2 Zoning District.
I. 
The following amendment to the Zoning Map was adopted on 5-16-2016:
(1) 
Modify the boundary of the Commercial (C) District in the area of Main Street, as shown on a map entitled “Proposed Commercial District Zoning,” dated April, 2016, which is on file with the Town Clerk and is hereby declared to be part of the Zoning Bylaw.
J. 
The following amendments to the Zoning Map were adopted on 5-14-2018:
(1) 
To include the Recreational Marijuana Overlay District.
(2) 
Lot 38 on Assessor's Map 6 is included in the Village Center District (VC).
(3) 
To modify the Town of Salisbury Official Zoning Map to reflect the new zoning amendments as well as to update the zoning as it currently exists.[4]

K. 
Expanding the commercial district in the area of Elm Street as shown on the Map entitled " Town of Salisbury Commercial 1" dated March 29, 2022.[5]

L. 
Changing the following parcels on Assessors Map 28 from the Beach Commercial Zone (BC) to Residential 2 Zone (R-2): Parcels 28-1, 28-4, 28-5, 28-10, 28-11, 28-12, 28-14, 28-15, 28-16, 28-20, 28-22, 28-24, 28-25, 28-26, 28-27, 28-28, 28-99, 28-117, 28-118, 28-119, 28-120, 28-121, 28-122, 28-123, Jackson Street, as shown on the map called "2023 Zoning Map Change."[6]

M. 
On May 20, 2024, the Upper Lafayette Road and Bridge Road subdistricts, as shown on a map entitled “MBTA Communities Multi-Family Overlay District Salisbury,” dated May 3, 2024, were added to the Zoning Map.

§ 300-8 Boundaries of districts.

Any boundary designated on the map as a street, railroad or water body shall be construed to mean the center line thereof. Any distance shown on the map shall be measured from the center line of the boundary as indicated above. Unless otherwise indicated, all district boundaries parallel to a street shall be 400 feet deep therefrom or from any intervening parallel district boundary line. The application of the district boundary lines shall be the responsibility of the Building Inspector.
