CHAPTER 4

RESIDENCE DISTRICTS

10-4-1: GENERAL REGULATIONS:

   (A)   Conversions: In all general residence districts, the average of the floor areas of all dwelling units secured by the conversion of a residence building shall not exceed five hundred (500) square feet, and an efficiency unit may be counted as seventy five hundredths (0.75) dwelling unit in computing such average. (1977 Code)
   (B)   Lot Area, Lot Width, And Side Yard Regulations Applicable To Lots For Single-Family Detached Dwellings In Subdivision Containing Qualifying Permanent Open Spaces:
      1.   Whenever a landowner, developer, or subdivider has provided qualifying permanent open spaces as a part of a recorded plat of a subdivision containing lots for single-family detached dwellings for which the final plat of such subdivision has received approval for recordation by the planning and zoning board and city council, after the effective date of this title, the lots within such subdivision may have a minimum lot area ten percent (10%) less than herein otherwise required for the district or districts in which such subdivision is located. Moreover, the minimum lot width and the minimum side yard width as otherwise herein required in the applicable district regulations may be reduced by not more than five percent (5%), but no lot shall be reduced to less than fifty feet (50') in width or a side yard reduced to less than four feet (4') in width. When qualifying permanent open space is accessory to private or semipublic school or other approved institutional use, such reductions shall be not more than one-half (1/2) of the reductions referred to above, in all cases.
      2.   Qualifying permanent open spaces shall be land, designated for open spaces in the comprehensive plan of the city, which is located within the subdivision or not more than one thousand three hundred twenty (1,320) linear feet from the nearest exterior boundary line thereof, or when located within the perimeter of a subdivision, may also include land not so designated in the comprehensive plan, but which is recommended by the planning and zoning board and approved by the city council for a specific subdivision. Qualifying permanent open space allocated to any subdivision shall have an area of not less than four (4) acres or ten percent (10%) of the area of the subdivision, exclusive of streets and alleys, whichever is the greater area. Land for qualifying permanent open space shall be: (1977 Code; amd. Ord. 2158, 4-26-2016)
         (a)   Dedicated by the landowner, developer, or subdivider to a public governmental body for use as a site for a public park, public school, or other public use open area;
         (b)   Conveyed for a private recreation area; or (1977 Code)
         (c)   Contributed or sold at not more than one-half (1/2) its appraised value for use as a site for a private or semipublic school or other approved institutional use. Buildings on all such qualifying permanent open spaces, shall not cover more than twenty percent (20%) of such open space area. When title to land is not held by a governmental body, the use of such land for open space shall be perpetuated by recorded covenants accompanying a recorded subdivision plat. The city council, after receiving the recommendation of the planning and zoning board, may approve a qualifying open space that is not located within the perimeter of the final plat of the subdivision when there is an irrevocable commitment by the owner or owners of such abutting or adjacent land to dedicate or convey land for qualifying permanent open space.       3.   One or more qualifying permanent open spaces may apply to any given such subdivision, except when all or a part of a unified open space, as designated on the comprehensive plan, is located within the perimeter of the subdivision, such land shall be designated as all or part of the qualifying permanent open space, and where such open space land has an area in excess of ten percent (10%) of the total area of the subdivision, exclusive of areas devoted to the streets, or in excess of four (4) acres, whichever is the greater, such excess land shall be used for open space use either as a qualifying permanent open space for an adjacent subdivision or reserved for acquisition, or arrangements made by acquisition, by the city or other governmental body for public open space use. 10-4-2: R-1 SINGLE-FAMILY RESIDENCE DISTRICT:

   (A)   Permitted Uses:
Parks and playgrounds, public.
Schools, nonboarding, elementary, junior high, and high: On a lot not less than five (5) acres in area.
Single-family detached dwellings.
Temporary buildings for construction purposes for a period not to exceed such construction.
Accessory uses to the above permitted uses: Including, but not limited to, home occupations, off street parking and off street loading facilities, and signs as regulated. (1977 Code)
   (B)   Conditional Uses:
Churches, temples or synagogues: On a lot not less than one hundred eighty feet (180') in width and not less than forty thousand (40,000) square feet in area.
Clubs or lodges, private, fraternal or veteran organizations where fermented malt beverages and intoxicating liquors may not be sold or served.
Colleges, universities and accessory uses thereto: On a lot not less than twenty (20) acres in area.
Convents, monasteries, and seminaries: On a lot not less than one hundred eighty feet (180') in width and not less than forty thousand (40,000) square feet in area.
Growing of farm, garden, and nursery crops in the open: Provided that no livestock or poultry are kept, and no offensive odors or dusts are created, and further provided that no retail sales are conducted from a store or stand erected or maintained on the premises.
Hospitals: On a lot not less than five (5) acres in area.
Libraries: On a lot not less than one hundred feet (100') in width and fifteen thousand (15,000) square feet in area.
Parks and playgrounds: Private, not for profit.
Planned developments: On a lot not less than forty (40) acres in area.
Public utility and governmental service uses on lots having areas and widths as approved by the city council:
Electric distribution centers.
Fire stations.
Gas regulator stations.
Police stations.
Railroad rights of way.
Telephone exchanges and transmission equipment buildings; microwave relay towers and outdoor telephone booths.
Transit and public transportation facilities, including passenger shelters, and turning and parking areas.
Water filtration plants, pumping stations, and reservoirs.
Accessory uses, customarily incidental to the above allowable special uses; including, but not limited to, off street parking and off street loading.
Schools; boarding, elementary, junior high, or high: On a lot not less than one hundred eighty feet (180') in width and not less than one acre in area.
Two-family detached dwellings only as herein regulated in the R-3 district, except that the lot area minimum shall be two thousand five hundred (2,500) square feet per dwelling unit. (1977 Code; amd. Ord. 1198, 8-12-1980; Ord. 1214, 1-27-1981; Ord. 1349, 3-14-1989)
   (C)   Lot Area:
      1.   Single-family detached dwellings: Not less than twelve thousand (12,000) square feet.
      2.   Nonresidential uses: As herein set forth for each use.
   (D)   Lot Width:
      1.   Single-family detached dwelling: Not less than eighty feet (80').
      2.   Nonresidential uses: As herein set forth for each use.
   (E)   Floor Area Ratio:
      1.   Single-family detached dwellings: Not applicable.
      2.   Nonresidential permitted uses and conditional uses: Not more than 0.3.
   (F)   Building Height:
      1.   Single-family detached dwellings: Not more than two and one- half (21/2) stories or thirty five feet (35'), whichever is less.
      2.   Nonresidential permitted uses and conditional uses: Not more than forty five feet (45').
   (G)   Ground Floor Area Per Dwelling:
      1.   One-story dwellings without cellar: Not less than one thousand three hundred fifty (1,350) square feet.
      2.   One-story dwellings with a cellar: Not less than one thousand two hundred (1,200) square feet.
      3.   Dwellings having more than one story: Not less than nine hundred (900) square feet.
   (H)   Yards: Except as may be otherwise herein required, yards shall be provided on each lot in accordance with the following:
      1.   Front yard: Not less than forty feet (40') in depth.
      2.   Side yards:
         (a)   Two (2) side yards neither of which is less than ten feet (10') in width.
         (b)   Nonresidential permitted uses and special uses: Two (2) side yards, neither of which is less than fifteen feet (15') in width.
         (c)   On corner lots, the side yard abutting a street shall be not less than forty feet (40') in width, except on a corner lot, subdivided and duly recorded on the effective date of this title, having insufficient width to provide such yard of forty feet (40') in width and still maintain a buildable width of thirty five feet (35'), the side yard abutting a street may be reduced in width by the distance necessary to maintain such buildable width of thirty five feet (35'), provided such side yard shall have a width of not less than twenty five percent (25%) of the width of the lot.
      3.   Rear yard: Not less than forty feet (40') in depth.
      4.   Yards, general, nonresidential permitted uses and conditional uses: For buildings more than twenty five feet (25') in height, each front, side and rear yard as required above shall be increased in width or depth by two feet (2') for each additional one foot (1') of building height over twenty five feet (25').
   (I)   Off Street Parking And Off Street Loading: In accordance with applicable regulations set forth herein in chapter 8 of this title. (1977 Code)

10-4-3: R-2 SINGLE-FAMILY RESIDENCE DISTRICT:

   (A)   Permitted Uses: Same as those uses permitted in the R-1 district.
   (B)   Conditional Uses: Same as those uses permitted in the R-1 district.
   (C)   Lot Area:
      1.   Single-family detached dwelling: Not less than five thousand (5,000) square feet.
      2.   Nonresidential uses: As herein set forth for each use.
   (D)   Lot Width:
      1.   Single-family detached dwelling: Not less than fifty feet (50').
      2.   Nonresidential uses: As herein set forth for each use.
   (E)   Floor Area Ratio:
      1.   Single-family detached dwellings: Not applicable.
      2.   Nonresidential permitted uses and conditional uses: Not more than thirty five feet (35').
   (F)   Ground Floor Area Per Dwelling:
      1.   One-story dwellings without cellar: Not less than nine hundred (900) square feet.
      2.   One-story dwelling with cellar: Not less than eight hundred twenty (820) square feet.
      3.   Dwellings having more than one story:
         (a)   Not less than eight hundred (800) square feet for a one and one-half (11/2) story building.
         (b)   Not less than six hundred fifty (650) square feet for two- story buildings.
   (G)   Yards: Except as may herein otherwise be required or required by the city council for a conditional use, yards shall be provided in each lot in accordance with the following:
      1.   Front yards: Not less than twenty feet (20') in depth.
      2.   Side yards:
         (a)   Two (2) side yards, neither of which is less than six feet (6') in width.
         (b)   Nonresidential permitted uses and conditional uses: Two (2) side yards, neither of which is less than fifteen feet (15') in width.
         (c)   On corner lots the side yard abutting a street: Not less than twenty five feet (25') in width, except on a corner lot, subdivided and duly recorded on the effective date of this title, having insufficient width to provide such yard of twenty five feet (25') in width and still maintain a buildable width of thirty feet (30'), the side yard abutting a street may be reduced in width by the distance necessary to maintain such buildable width of thirty feet (30') provided such side yard shall have a width of not less than twenty five percent (25%) of the width of the lot.
      3.   Rear yard: Not less than twenty feet (25') in depth, except on a corner lot; not less than twenty five feet (25') in depth.
      4.   Yards, general: Nonresidential permitted uses and special uses: For buildings more than forty five feet (45') in height, each front, side and rear yard as required above shall be increased in width or depth by two feet (2') for each additional one foot (1') of building over forty five feet (45').
   (H)   Off Street Parking And Off Street Loading: In accordance with applicable regulations set forth herein in chapter 8 of this title. (1977 Code)

10-4-4: R-3 GENERAL RESIDENCE DISTRICT:

   (A)   Permitted Uses:
Libraries.
Multi-family dwellings, but not more than six (6) dwelling units in a building, except as approved by the city council after receiving written recommendations from the building official.
Parks and playgrounds, public.
Schools, nursery, elementary, junior high, and high: Nonboarding.
Single-family detached buildings.
Single-family semidetached dwellings.
Temporary buildings for construction purposes for a period not to exceed such construction.
Two-family semidetached dwellings.
Accessory uses to the above permitted uses, including, but not limited to, home occupations, off street parking and off street loading facilities, and signs as regulated. (1977 Code; amd. Ord. 1158, 2-13-1979)
   (B)   Conditional Permitted Uses:
Conditional uses allowed in the R-2 district.
Institutions for the care of the aged and for children: On a lot not less than one hundred fifty feet (150') in width and forty thousand (40,000) square feet in area.
Lodging houses: On a lot not less than seventy five feet (75') in width and ten thousand (10,000) square feet in area.
Nursing homes: On a lot not less than one hundred feet (100') in width and twenty thousand (20,000) square feet in area.
Planned developments: On a lot not less than ten (10) acres in area.
Accessory uses to the above allowable special uses, including, but not limited to, off street parking and off street loading. (1977 Code)

   (D)   Lot Width:

      4.   Multiple-family dwelling: Not less than eighty feet (80').
   (E)   Floor Area Ratio:
      1.   Not applicable to single-family and two-family detached dwellings.
      2.   Multiple-family dwellings and nonresidential permitted uses and conditional uses: Not more than 0.5.
      3.   Nonresidential use: As in the R-2 district.
   (F)   Building Height:
      1.   All dwelling types: Not more than thirty feet (30') or two and one-half (21/2) stories, whichever is lower.
      2.   Nonresidential permitted uses and conditional uses: Not more than fifty feet (50').
   (G)   Ground Floor Area Per Dwelling:
      1.   Single-family detached dwellings: As in the R-2 district.
      2.   Single-family semidetached dwellings:
         (a)   One-story dwelling: Not less than eight hundred fifty (850) square feet; and
         (b)   Two-story dwelling: Not less than six hundred (600) square feet.
      3.   Two-family detached dwelling: Not less than eight hundred fifty (850) square feet.
   (H)   Yards: Except as may herein otherwise be required or required by the city council for a conditional use, yards shall be provided in each lot in accordance with the following:
      1.   Front yard: Not less than twenty feet (20') in depth.
      2.   Side yards:
         (a)   Two (2) side yards, neither of which is less than five feet (5') in width except;
            (1)   As in the R-2 districts for single-family detached dwellings on lots of record in subdivisions recorded prior to the effective date of this title and such lots have widths less than otherwise herein required;
            (2)   For multiple-family dwellings: Two (2) side yards neither of which is less than nine feet (9') in width.
         (b)   Nonresidential permitted uses and conditional uses: Two (2) side yards, neither of which is less than fifteen feet (15') in width.
         (c)   On corner lots, the side yard abutting a street for all uses shall be not less than ten feet (10') in width.
      3.   Rear yard: Not less than twenty feet (20') in depth, except where the rear lot line abuts on an alley, or service drive not less than twenty eight feet (28') when measured from the centerline of the alley or service drive.
      4.   Yards, general: Residential permitted and special uses: For buildings more than thirty feet (30') in height, each front, side and rear yard as required above shall be increased in width or depth by one foot (1') for each additional one foot (1') of building height over thirty feet (30').
   (I)   Spacing Between Buildings: When two (2) or more multiple- family dwelling buildings are on a lot or on contiguous lots, initially under single ownership or control, the distance between the building walls shall be as follows:
      1.   When the front wall of a building faces the front wall or rear wall of the nearest building, the distance between the two (2) building walls shall be not less than fifty feet (50').
      2.   When the rear wall of a building faces the rear wall of the nearest building, the distance between the two (2) building walls shall be not less than forty feet (40').
      3.   When the side wall of a building faces the front or rear wall of the nearest building, the distance between the two (2) building walls shall be not less than thirty feet (30'), except when the side wall contains more than four (4) windows on a floor, two (2) or more of which are not from bathrooms or storage rooms, such distance between buildings shall be not less than forty feet (40'), or fifty feet (50') if main entrance doorways are in such side walls.
      4.   When the side wall, which contains not more than four (4) windows, on a floor, and two (2) or more of which are from bathrooms or storage rooms, faces such side wall of the nearest building, the distance between the two (2) building walls shall be not less than ten feet (10'). When the facing side walls of either of such buildings contain more than two (2) window openings on each floor from rooms that are not bathrooms or storage rooms, the distance between walls shall be not less than forty feet (40'), except when the side wall contains a main entrance doorway such distance shall be not less than fifty feet (50').
      5.   A wall of a detached building forming the end of a court shall be not less than ten feet (10') from the nearest wall of a building forming the sides of the court and a building forming the end of the court may be attached to one or both of the buildings forming the sides of the court, provided the distance between facing walls of the buildings forming the sides of the court is not less than the applicable requirements as set forth above.
      6.   When any wall or part thereof which contains no windows or doorways faces such a wall or part thereof, of the nearest building, the distance between such two (2) building walls may be not less than ten feet (10').
   (J)   Off Street Parking And Off Street Loading: In accordance with applicable regulations set forth herein in chapter 8 of this title. (1977 Code)
