CHAPTER 6

BUSINESS DISTRICTS

10-6-1: INTENT:

Business district regulations govern the development and use of the full range of business and commercial establishments needed to provide service to the citizens of Savanna and its trading area. Regulations in the various business districts provide for the groupings of compatible business and commercial establishments in accordance with their function and extent of service. (1977 Code)

10-6-2: B-1 RETAIL BUSINESS DISTRICT:

   (A)   General Requirements:
      1.   Dwellings and lodging rooms, are permitted only as herein regulated in accordance with R-2 and R-3 districts.
      2.   All business establishments shall be retail trade or service establishments dealing directly with consumers and all goods produced on the premises shall be sold on the premises where produced.
      3.   All business, servicing, or processing shall be conducted within completely enclosed buildings, except for off street parking and loading, and accessory drive-in facilities customarily incidental to the principal use, when permitted as a conditional use, unless the person conducting the business, servicing or processing causes the city to be named as an additional insured under their public liability insurance policy and furnishes continuing proof of such insurance and executes a hold harmless agreement in a form approved and furnished by the city and in favor of the city, and provided that a minimum six foot (6') passageway for pedestrians shall be left open on any public sidewalk involved.
      4.   All activities involving the production, processing, cleaning, servicing, testing, or repair of materials, goods, or products, shall conform at least with the performance standards established for the M manufacturing district, provided that performance standards shall, in every case, be applied at the boundaries of the lot on which such activity takes place.
      5.   Parking of trucks in the open within one hundred fifty feet (150') of a residence district boundary line, shall be limited to vehicles of not over one and one-half (11/2) tons' capacity. Trucks in excess of one and one-half (11/2) tons' capacity used in conjunction with operation of any business permitted in this district shall not be parked in the open within one hundred fifty feet (150') of a residence district, except during normal business hours.
   (B)   Permitted Uses:
      1.   Any of the following uses shall be permitted on a lot in a B-1 district:
Antique shops.
Art and school supply stores.
Art galleries.
Bakeries; retail sales and not more than fifty percent (50%) of the floor area may be devoted to processing of bakery goods.
Banks and financial institutions.
Barbershops.
Beauty parlors.
Bicycle stores; sales, rental and repair.
Boat sales and service including accessory uses such as boat motors, fishing gear, bait, all-terrain vehicles and water cycles. All said items for sale or rent. All service and repair work shall be conducted within enclosed buildings on a lot not less than ten thousand (10,000) square feet in area when accessory open sales facilities are provided.
Book and stationery stores.
Camera and photographic supply stores.
Candy and ice cream stores.
Cannabis business establishments.
Carpet and rug stores.
China and glassware stores.
Clothing and costumer rental stores.
Clothing stores.
Coin and philatelic stores.
Currency exchanges.
Custom dressmaking.
Delicatessens.
Department stores.
Drugstores.
Dry cleaning and laundry receiving establishments; processing to be done elsewhere.
Dry goods stores.
Electrical, gas and other household appliance retail sales stores; including repair and servicing of phonographs, radios and televisions when incidental to the principal use.
Employment agencies.
Florist shops.
Fraternal, philanthropic and eleemosynary institutions, above first floor.
Furniture stores; including upholstering when conducted as part of the retail operation and secondary to the principal use.
Furrier shops; including accessory uses such as storage and conditioning of furs.
Gift shops.
Grocery stores.
Haberdasheries.
Hardware stores.
Hobby shops; for retailing of items to be assembled or used away from the premises.
Hotels; including dining and meeting rooms, provided that hotel lobby, other than entrances, does not occupy space fronting on a street.
Interior decorating shops; including accessory uses such as upholstering, and making of draperies, slipcovers, and other similar articles.
Jewelry stores; including watch repair.
Laboratories; medical and dental.
Launderette, coin operated.
Leather goods and luggage stores.
Libraries, public.
Liquor stores; retail sales, package goods only.
Loan offices.
Locksmith shops.
Mail order service storage.
Meat markets, retail sales only.
Medical and dental clinics.
Millinery shops.
Motels.
Museums.
Music stores; sheet music and phonograph record sales.
Musical instrument retail stores and accessory repairs servicing.
Newspaper offices, but not including printing.
Office supply stores.
Offices; business, professional and public.
Paint and wallpaper stores.
Parking lots or storage garages, for passenger automobile and motor trucks under one and one-half (11/2) tons' capacity.
Pawnshops.
Photography studios, including developing and printing of photographs when conducted on the premises as accessory to conduct of principal use.
Picture framing shops, when conducted on the premises for retail trade.
Post offices.
Radio and television broadcasting studios.
Recording studios, when located above the first floor.
Restaurants, including live entertainment, dancing and cocktail lounges.
Restricted production and repair limited to the following: art needlework, clothing, custom manufacturing and alterations for retail only of jewelry from precious metals and watches; when located above the first floor or on the first floor, not less than fifty feet (50') from the front building line.
Sewing machine sales and service stores, household machines only.
Shoe and hat repair stores.
Shoe stores.
Sporting goods stores.
Tailor shops.
Taverns and cocktail lounges.
Telegraph offices.
Temporary buildings for construction purposes for a period not to exceed the duration of such construction.
Tobacco shops, retail sales.
Toy shops.
Travel bureaus and transportation ticket offices.
Typewriter and adding machine sales establishments, including accessory uses such as repair and service.
Variety stores.
Wearing apparel shops.
Accessory uses customarily incidental to the above permitted uses, including, but not limited to, off street parking, off street loading and business signs as herein regulated.
   (C)   Conditional Uses (As Approved By The City Council After Receiving Recommendations From The Planning And Zoning Board): Any of the following uses shall be permitted on a lot in a B-1 district located within the central business district or on a lot in a B-1 district abutting a lot in the central business district designated in a B-1 or B-2 business district, or within a planned development containing three (3) acres or more of area in any B-1 district:
Auction rooms.
Automobile accessory stores when there are no driveways across the street sidewalk into the principal or accessory building.
Automobile service stations on a lot not less than ten thousand (10,000) square feet in area.
Catering establishments.
Churches, temples and synagogues on a lot not less than twelve thousand (12,000) square feet in area.
Frozen food shops, including also locker rental.
Golf courses, miniature or par 3. The site lighting shall not be illuminated between the hours of eleven o'clock (11:00) P.M. and seven o'clock (7:00) A.M. and shall be directed away from residential properties in such a way as not to create a nuisance.
Job printing shops.
Meat markets, including processing but not slaughtering, and sale of meat and meat products and poultry to restaurants, hotels, clubs and other similar establishments when conducted as part of the retail business on the premises and such processing is conducted within the principal building not less than twenty feet (20') from the front building line.
Meeting halls.
Orthopedic and medical appliance stores, including the assembly or manufacture of such articles.
Planned developments, on a tract of land not less than three (3) acres in area.
Plumbing, heating, lighting, and air conditioning stores for retail sales of fixtures, equipment and supplies and accessory shops.
Public utility and governmental service uses. The location, width, and area of the lot for each of the following uses shall be as approved by the planning and zoning board:
Bus stations.
Electric substations.
Gas regulator stations.
Parks, recreation buildings and community centers, public.
Post offices.
Railroad rights of way.
Telephone transmission equipment buildings and microwave relay towers.
Schools, commercial or trade, including those teaching music, dancing, business, commercial, or technical subjects when operations do not involve danger of fire and explosion, and objectionable noise, vibration, smoke, dust, odor, glare, heat, or other similar influences.
Theaters, not including outdoor theaters; provided that only the entrance doorways and outer lobby have frontage on a street.
Warehouse, storage facilities.
Accessory uses customarily incidental to the above conditional uses including, but not limited to, off street parking, off street loading and signs as regulated, and dwelling units or lodging rooms customarily accessory to religious institutional uses and clubs and lodges.
   (D)   Floor Area Ratio:
      1.   For buildings on lots within or abutting the central business district: Not more than 2.0.
      2.   For buildings in a planned development: Not more than 0.6.
      3.   For buildings on lots at other locations: Not more than 0.75 except no building or part thereof for occupancy by one principal use shall have more than five thousand (5,000) square feet of floor area.
   (E)   Yards: Except as may be otherwise required for a planned development, yards shall be provided as follows:
      1.   Front Yard: No front yard shall be required, except when a B-1 district occupies a part of the frontage along one side of a street within a block and the remainder of the block is in a residence district or when a B-1 district is across the street from a residence district a yard having a depth as herein required for the residence district shall be required.
      2.   Side Yards:
         (a)   No interior side yards shall be required, except if a side yard is provided on one or both sides of a building, each side yard shall be not less than five feet (5') in width.
         (b)   A side yard not less than five feet (5') in width shall be provided along a side lot line that adjoins or is across an alley from a lot in any residence district.
         (c)   On a corner lot, regulations set forth above for a front yard shall apply for a side yard adjoining a street.
      3.   Rear Yard: No rear yard setback shall be required provided that the construction of a building or structure at the lot line does not constitute a danger to pedestrians or vehicular traffic.
   (F)   Off Street Parking And Off Street Loading: In accordance with applicable regulations herein set forth in chapter 8 of this title. (1977 Code; amd. Ord. 1118, 5-10-1977; amd. 10-6-3: B-2 GENERAL BUSINESS DISTRICT:

   (A)   General Requirements:
      1.   Dwelling units and lodging rooms are permitted only as herein regulated as an accessory use and as lodging rooms in a hotel.
      2.   All business establishments shall be retail trade or service establishments dealing directly with consumers and all goods produced on the premises shall be sold on the premises where produced.
      3.   Multi-family dwelling units are permitted as approved by the city council after receiving recommendations from the planning and zoning board and regulated in the R-3 zoning requirements.
      4.   Except as otherwise herein allowed for specific uses and for off street parking or loading, all business, servicing, processing, or storage shall be conducted within completely enclosed buildings.
      5.   Drive-in type of operations, commercial recreation establishments customarily operated in the open, and open sales lots conducted as all or a part of the operation of a permitted use or conditional use in this district shall be allowed only as a conditional use.
      6.   All activities involving the production, processing, cleaning, servicing, testing, or repair of materials, goods, or products shall conform at least with the performance standards herein set forth for the M manufacturing district, provided that performance standards shall, in every case, be applied at the boundaries of the lot on which such activity takes place.
      7.   Trucks used in conjunction with any use permitted in this district may be parked in the open only during normal business hours. This does not apply to trucks engaged in pick up and delivery of goods and merchandise after normal business hours.
   (B)   Permitted Uses: The following uses are permitted at any location in this district:
As permitted in the B-1 district.
Amusement establishments including bowling alleys, pool halls, dance halls, gymnasiums, swimming pools and ice skating rinks.
Auction rooms.
Automobile accessory stores.
Automobile sales establishments on a lot not less than ten thousand (10,000) square feet.
Blueprinting and photostating establishments.
Building material sales and production, with outdoor storage, provided the performance standards for the M manufacturing district shall be applied; and provided the area for outside storage is completely surrounded by a uniformly constructed solid fence or wall not over eight feet (8') in height; and provided no storage shall project higher than the height of the fence; and situated on a lot not less than ten thousand (10,000) square feet in area.
Building material sales with outdoor storage, when the area for outside storage is completely surrounded by a uniformly painted solid fence or wall not over eight feet (8') in height and no storage shall project higher than the height of the fence or wall.
Cabins situated on a single parcel of land not less than five (5) acres in area or as approved by the city council only after receiving recommendations from the planning and zoning board of the city of Savanna.
Campgrounds provided the premises are on a contiguous tract of land of not less than one acre. All campgrounds must be operated in accordance with applicable Illinois, county and municipal statutes and ordinances.
Applications for campgrounds shall be made to the mayor, in writing, signed by the applicant. The application shall identify the name, age and address of the applicant in the case of an individual; in the name of a copartnership, the names, ages and addresses of each copartner; in the name of a corporation or limited liability company, the names and addresses of the officers and directors.
Cannabis business establishments on a lot with an area of not less than ten thousand (10,000) square feet, and no closer than one thousand feet (1,000') from a school property boundary.
Car wash.
Catering establishments.
Clubs and lodges, nonprofit.
Contractor's offices and shops with no outside storage.
Dry cleaning establishments.
Electrical and gas fixtures and equipment, sales and shops.
Exhibition halls and meeting halls.
Exterminating shops.
Fraternal, philanthropic, and eleemosynary institutions.
Frozen food stores and lockers.
Garages, public.
Greenhouses, retail.
Importers and distributors.
Laboratories, medical, dental or optical.
Launderette, coin operated.
Laundries.
Mail order houses, order and service centers.
Motor vehicle sales, provided that repair and servicing of motor vehicles are within enclosed buildings located on a lot not less than ten thousand (10,000) square feet.
Newspaper distribution agencies, for home delivery and retail trade.
Newspaper offices including printing.
Orthopedic and medical appliance stores, including the assembly or manufacture of such articles.
Parking lots and storage garages for motor vehicles.
Pawnshops.
Pet service, domestic.
Pet shops.
Plumbing, heating and ventilating establishments; retail sales and shops.
Printing and publishing establishments.
Radio, television and household appliance service and repair shops.
Recording studios.
Religious institutions; churches, chapels, temples and synagogues, convents, monasteries and theological schools.
Restricted production and repair, limited to the following: needlework, clothing, such as custom manufacturing and alterations; jewelry from precious metals; watches; dentures; optical lenses; and upholstering.
Schools; music, dance, business or trade, when operations conform with applicable requirements herein in the B-1 district conditional uses.
Secondhand stores and rummage shops.
Self-service stores; coin operated vending machines.
Taxidermists.
Telegraph service stations.
Theaters, indoor.
Undertaking establishments and funeral parlors.
Accessory uses customarily incidental to the above permitted uses including, but not limited to, off street parking, off street loading and signs as regulated and dwelling units or lodging rooms customarily accessory to religious institutional uses and clubs and lodges.
   (C)   Conditional Uses (As Approved By The City Council After Receiving Recommendations From The Planning And Zoning Board):
Automobile service stations on a lot not less than ten thousand (10,000) square feet in area.
Boat sales establishments on a lot not less than ten thousand (10,000) square feet in area when accessory open sales facilities are provided.
Drive-in establishments including banks, restaurants and other uses customarily providing drive-in facilities, except theaters; location of vehicular ingress and egress and number and location of spaces for parking of automobiles of customers being served or waiting to be served shall be as approved by the planning and zoning board.
Health centers, public; on a lot having a width and area as approved by the planning and zoning board.
Open sales lots; as a principal use or when a customary accessory use to a permitted use in this district.
Parks and recreational buildings, private or semipublic; not operated for profit on a lot not less than one acre and over and when development plans and types and operation of uses therein are approved by the planning and zoning board.
Planned developments, business; on a lot not less than five (5) acres in area.
Public utility transportation and governmental service uses as follows. Location, width and area of lot for each use, as approved by the planning and zoning board.
Bus stations.
Fire stations.
Gas regulator stations.
Parks, recreation buildings and community centers; public.
Passenger railroad stations.
Police stations.
Railroad rights of way.
Taxi stands.
Telephone exchanges and telephone transmission equipment buildings and microwave relay towers.
Accessory uses customarily incidental to the above conditional uses including, but not limited to, off street parking, off street loading and signs as regulated.
   (D)   Floor Area Ratio: As in the B-1 district.
   (E)   Yards:
      1.   Side Yards:
         (a)   No interior side yards shall be required, except if a side yard is provided on one or both sides of a building; each side yard shall be not less than five feet (5') in width.
         (b)   A side yard not less than five feet (5') in width shall be provided along a side lot line that adjoins or is across an alley from a lot in any residence district.
         (c)   On a corner lot, regulations set forth above for a front yard shall apply for a side yard adjoining a street.
      2.   Rear Yards: Not less than twenty five feet (25') in depth or twenty percent (20%) of the depth of the lot, whichever is less.
   (F)   Off Street Parking And Off Street Loading: In accordance with applicable regulations herein set forth in chapter 8 of this title. (1977 Code; amd. Ord. 1249, 3-8-1983; amd. 10-6-4: B-3 SERVICE BUSINESS DISTRICT:

This service business district classification is established to accommodate a wide range of specialized commercial and business uses including highway oriented service and commercial recreation types of establishments to serve a trade area embracing a large segment of an urban region.
   (A)   General Requirements: Dwellings and lodging rooms are permitted, only as herein regulated in accordance with the R-2 single-family residence district.
      1.   All establishments shall be for service directly to consumers.
      2.   All business, servicing, or processing shall be conducted within completely enclosed buildings except for off street parking or loading.
      3.   Parking of trucks in the open within one hundred fifty feet (150') of a residence district boundary line shall be limited to vehicles of not over one and one-half (11/2) tons' capacity. Trucks in excess of one and one-half (11/2) tons' capacity used in conjunction with operation of any business permitted in this district shall not be parked in the open within one hundred fifty feet (150') of a residence district boundary line, except during normal business hours or during periods beyond when parked for pick up and delivery operations.    (B)   Permitted Uses: The planning and zoning board shall approve, prior to issuance of a permit, the location with respect to distance from a residence district boundary line and development and operation plans for the following principal uses and accessory uses except off street parking and signs that are not conducted in an enclosed building:
Blueprinting and photocopying establishments.
Contractors' offices and shops with no outside storage.
Laboratories; medical, dental or optical.
Medical or dental clinics or offices.
Offices, general or professional, private.
Printing, publishing, lithography establishments.
Research laboratories.
Undertaking establishments and funeral parlors.
   (C)   Conditional Uses (As Approved By The City Council After Receiving The Recommendations From The Planning And Zoning Board):
Banks, drive-in, when distance from nearest street intersection and location of vehicular ingress and egress are approved by the planning and zoning board.
Churches, temples and synagogues; as herein regulated as a conditional use in the B-1 district.
Convents, monasteries and theological schools as herein regulated as a conditional use in the B-1 district.
Planned development on a tract of land not less than five (5) acres in area. (1977 Code; amd. Ord. 2158, 4-26-2016)
   (D)   Floor Area Ratio: Not more than 0.75. (1977 Code)
   (E)   Yards:
      1.   Side Yards:
         (a)   No interior side yards shall be required, except if a side yard is provided on one or both sides of a building; each side yard shall be not less than five feet (5') in width.

10-6-5: B-4 GENERAL BUSINESS DISTRICT:

   (A)   General Requirements:
      1.   Dwellings and lodging rooms are permitted only as herein regulated in accordance with R-2 and R-3 districts.
      2.   Except as otherwise herein allowed for specific uses and for off street parking or loading, all business, servicing, processing, or storage shall be conducted within a completely enclosed building.
      3.   All business establishments shall be retail trade or service establishments dealing directly with consumers and all goods produced on the premises shall be sold on the premises where produced.
      4.   Multi-family dwelling units are permitted only as herein regulated in accordance with R-3 districts.

   (C)   Conditional Uses (As Approved By The City Council After Receiving Recommendations From The Planning And Zoning Board):
Auction rooms.
Automobile service stations with grocery sales, bakery, pizza shop, including retail sale of beer and wine only for the consumption off the premises, on a lot not less than ten thousand (10,000) square feet in area.
Building material sales with outdoor storage, when the area for outside storage is completely surrounded by a uniformly painted solid fence or wall not over eight feet (8') in height, and no storage shall project higher than the height of the fence or wall.
Health centers, public; on a lot having a width and area as approved by the planning and zoning board.
Plumbing, heating, lighting, and air conditioning stores for retail sales of fixtures, equipment and supplies, and accessory shops.
Public utility and governmental service uses. The location, width, and area of the lot for each of the following uses shall be as approved by the planning and zoning board:

Accessory uses customarily incidental to the above conditional uses including, but not limited to, off street parking, off street loading and signs as regulated. (Ord. 1483, 3-22-1994; amd. Ord. 2158, 4-26-2016)
   (D)   Floor Area Ratio: Floor area ratio is not more than 2.0.
   (E)   Yards: Except as may be otherwise required for a planned development, yards shall be provided as follows:
      1.   Front Yard: No front yard shall be required, except when a B-4 district occupies a part of the frontage along one side of a street within a block and the remainder of the block is in a residence district, or when a B-4 district is across the street from a residence district, a yard having a depth as herein required for the residence district shall be required.
      2.   Side Yards:
         (a)   No interior side yards shall be required, except if a side yard is provided on one or both sides of a building, each side yard shall be not less than five feet (5') in width.
         (b)   A side yard not less than five feet (5') in width shall be provided along a side lot line that adjoins or is across an alley from a lot in any residence district.
      3.   Rear Yard: Rear yards not less than twenty five feet (25') in depth or twenty percent (20%) of the depth of the lot, whichever is less.
      4.   Corner Lot: Regulations set forth above for a front yard shall apply for a side yard adjoining a street for a corner lot.
   (F)   Lot Size: Minimum ten thousand (10,000) square feet.
   (G)   Lot Width: Minimum lot frontage, seventy five feet (75').
   (H)   Off Street Parking And Off Street Loading: In accordance with applicable regulations herein set forth in chapter 8 of this title.
   (I)   Retail Business Operational Hours: Except as permitted under the conditional uses at subsection (C) of this section, hours of retail business operations shall be restricted to the period from five o'clock (5:00) A.M. to twelve o'clock (12:00) midnight. (Ord. 1365, 11-28-1989)
