ARTICLE VIII

HARDSHIP RELIEF

8.00.00.- PURPOSE

The purpose of this Article is to provide mechanisms for obtaining relief from the provisions of this Code where hardship would otherwise occur.

8.02.00. - VARIANCES [RESERVED.]

Editor's note— Ord. No. 93-4, §§ 2, 3, provided for the deletion of sections 8.02.01 and 8.02.02, respectively, whereby the Village Council had the authority to grant variances.

8.01.01. - Existing Buildings.

The lawful use of a building, prior to the enactment hereof, may be continued although such use does not conform to the provisions of this Section. Such use may be extended throughout the building, provided no structural alterations except those required by law or ordered by an authorized officer to assure the safety of the building, are made therein. No such use shall be extended to occupy any land outside such building. If such nonconforming building is removed, or the nonconforming use of such building is discontinued for a continuous period of 180 days, every future use of such premises shall be in conformity with the provisions of this Section.

An existing frame multiple residence building on the commercial property is hereby declared to be a nonconforming use. Its continued user shall be subject to such terms and conditions as the Village Council shall approve, from time to time, particularly in the case of dormitory or living quarter use. All nonconforming uses shall be vacated and ultimately removed from the premises at the expense of the property owner concerned.

8.01.02. - Lands.

The lawful use of land, except such use permitted under temporary nonconforming permits, existing prior to the enactment hereof, may be continued; provided, however, that no such nonconforming use may be enlarged or increased, nor shall any nonconforming use be extended to occupy a greater area of land than that occupied by such use prior to the enactment hereof. If such nonconforming use is discontinued for a continuous period of 180 days, any future use of the land shall be in conformity with the provisions of this Code.
