BULK REGULATIONS

10-7-1: LOT AREAS AND WIDTHS:

   A.   Lot Areas And Widths Enumerated: In the districts as indicated, no residence is permitted on a zoning lot with an area or width less than that specified in the following table:

   B.   Measurement Of Lot Width: Minimum lot width requirements shall be measured at that portion of a lot line or property line which is coterminous with a dedicated public street, road or highway right of way line. No building permit shall be issued for construction of improvements on any lot which does not have a lot line or property line coterminous with a dedicated street, road or highway right of way line equal to at least that of the minimum lot width requirement in the district under which the property is classified. 10-7-2: YARDS:

   A.   Basic Requirements: Subject to any applicable exceptions, modifications or additional requirements provided in subsections B and C of this section, front, side and rear yards are required as set forth in the following provisions and table:
      1.   Joint Use Of Yard Requirements Prohibited: The minimum yard space required for one building or other structures shall not again be considered as yard space for an adjoining structure on the same or an adjoining zoning lot.
      2.   Maintain Required Yards: No zoning lot, unless otherwise specified, shall be reduced in area so that the yards become less than those required by this title. (1984 Code § 5-4-2)
      3.   Corner Lots: On corner lots where side yards are required, any side yard abutting the street shall be the same depth as the depth of the required front yard. The minimum depth side yard requirement shall apply to all other interior lot lines. (Ord. 1995-8, 6-6-1995)

   Note:
   1.    The terms and provisions shall apply only to lots in subdivisions for which a preliminary plan was not approved prior to November 21, 2000.

   B.   Lots Adjoining Residential District:
      1.   In any business or industrial district where a side lot line coincides with a side lot line or rear lot line in an adjacent residential district, a side yard shall be provided with at least the width set forth in the following table; and in any business or industrial district where a rear lot line coincides with a side lot line or rear lot line in an adjacent residential district, a rear yard shall be provided with at least the depth set forth in the following table: (1984 Code § 5-4-6; amd. 2010 Code)

      2.   No yard required by this subsection shall be used for storage or processing of any kind. No side yard required by this subsection shall be used for accessory off street loading.
      3.   Where a rear lot line abuts an alley, one-half (1/2) of the width of the alley shall be counted as the required rear yard. (1984 Code § 5-4-6)
   C.   Exceptions:
      1.   Architectural features of residential buildings such as windowsills, cornices and roof overhangs may project into the required yard, provided such projection is not more than four feet (4') and does not reach closer than four feet (4') to any lot line.
      2.   Signs, awnings, canopies and marquees are permitted to overhang the sidewalk in the B-1 business district only; provided, that overhanging signs are a minimum of eight feet (8') above the sidewalk at any point and that all other structures are a minimum of six feet eight inches (6'8") above the sidewalk at any point.
      3.   One-story accessory buildings may project into rear yards abutting on an alley or easement, provided such projection extends not closer than five feet (5') to the rear lot line and two feet (2') to a side lot line. (1984 Code § 5-4-5)

10-7-3: MAXIMUM BUILDING HEIGHTS:

   A.   Heights Established:
      1.   Residential Districts: No building shall exceed two (2) stories or thirty feet (30') in height unless each side yard is increased over the required minimum by five feet (5') or fraction thereof of additional building height over thirty feet (30'). In no case shall the building height exceed fifty feet (50').
      2.   Business Districts:
         a.   In the B-1 business district, no building shall exceed two (2) stories or thirty feet (30').
         b.   In the B-2 general business district, no building shall exceed three (3) stories or forty five feet (45').
      3.   Industrial Districts:
         a.   In the I-1 restricted performance manufacturing district, no building shall exceed thirty five feet (35') in height.
         b.   In the I-2 general performance manufacturing district, no building shall exceed forty five feet (45') in height. (1984 Code § 5-4-3)
   B.   Exceptions: The height limitations of this title shall not apply to church spires, belfries, cupolas and domes not intended for human occupancy; monuments, water towers, transmission towers, chimneys, smokestacks, derricks, conveyors, flagpoles, radio towers and masts. 10-7-4: OBSTRUCTIONS TO VISION AT INTERSECTIONS1:

No permitted obstruction is allowed within twenty five feet (25') of a zoning lot corner formed by the intersection of any two (2) street lines unless the obstruction is less than three feet (3') in height above the ground or more than ten feet (10') in height above the ground. Any portion of such a permitted obstruction on a corner lot which is between three feet (3') and ten feet (10') in height above the ground shall not be greater than fourteen inches (14") in diameter. 10-7-5: SMALL LOTS OF RECORD:

For small lots and parcels of land of record existing at the effective date hereof in all residence districts and the agricultural district, notwithstanding the minimum lot area per dwelling unit and the lot width requirements for the district, a single-family detached residence, additions to single-family dwellings, and accessory building may be built upon such lot, provided the following conditions can be met:
   A.   The lot has a width of at least forty feet (40');
   B.   Each side yard shall be at least three feet (3') in width;
   C.   The rear yard shall be at least three feet (3') in width;
   D.   The front yard shall be not less than the average front yard of immediately adjacent buildings facing on the same street; and
   E.   Sanitary sewer and public water are available. (1984 Code § 5-4-8)
