- DEFINITIONS

This section provides definitions for terms in this zoning ordinance that are technical in nature or that otherwise may not reflect a common usage of the term. Interpretations of the definitions and terminology that are either within this section or not included will be made by the town planner.

Above ground pool means above ground swimming pool means any such constructed or fabricated pool used for swimming, wading, diving or bathing which could, when filled, contain a depth of 450mm (18 inches) or more of water at any point, and the top rim of which rises 600mm (two feet) or more above the surrounding soil, or other surface upon which it is placed.

Accessory means an activity, use, building, or structure that is customarily associated with and is appropriately incidental and subordinate to a principal use, building, or structure and located in the same lot.

Accessory building means a subordinate building or structure detached from the principal building, located on the same lot, permanently attached to the ground, and customarily incidental and subordinate to the principal building. Swimming pools are considered accessory buildings.

Accessory residential (above a nonresidential use) means a separate and complete dwelling unit that is located within the same structure as a permitted nonresidential use within a business district.

Accessory residential (with principal residential use) means a second home or dwelling, together with a primary (usually larger) home on the same lot or property (also known as granny flats, carriage houses, secondary dwellings). Such dwellings have a kitchen complete with cooking facilities, at least one bathroom, and sleeping and living arrangements.

Acquired diameter inches means the cumulative diameter of trees in a specified area, with all trees receiving a minimum score of eight, e.g. one 24-inch diameter tree and one four-inch diameter tree in an area would have 32 acquired diameter inches.

Administrative services means private business offices services pertaining to personnel, payroll, property management, benefits, human resource management, financial planning, case docketing and management, contract and subcontract management, facilities management, proposal activities and other similar services.

Adult oriented establishment ("AOE") shall have the same meaning as the term "adult-oriented establishment" as used in T.C.A. § 7-51-1102, and, in construing the term, the definitions contained in T.C.A. § 7-51-1102, subsections (1) through (6) and (9) through (26), are likewise incorporated by reference into and made a part of this chapter; provided that the definition in subsection (1) defining "adult bookstore" shall be amended by deleting "principal and predominate" and replacing it with "significant or substantial;" subsection (2) defining "adult cabaret" shall be amended by deleting "principal use" with "substantial use;" subsection (3) defining "adult entertainment" shall be amended by deleting "principal or predominant theme" and replacing it with "significant or substantial theme;" and subsection (23) defining "sexual encounter center" shall be amended by deleting "primary" and replacing it with "substantial."

Agricultural equipment sales means demonstrates and sells items to farmers and other agricultural workers. Sales of various commercial or agricultural equipment and accessories. Agricultural sales representatives may market and sell goods, such animal feed, garden equipment, seeds or pesticides to farmers.

Agriculture: means as defined by TCA §§ 43-1-113 and 1-3-105, includes the land, buildings, and machinery used in the commercial production of farm products, nursery stock, related recreational, educational, and entertainment activities secondary to farm operations, and the raising of livestock, poultry, equine, bees, fish, similar animals, and cultivation of crops, forage, sod, timber, and ornamental plants.

Agritourism means activities conducted on a farm for the enjoyment, education, or active involvement of visitors, including corn mazes, hayrides, u-pick operations, and farm stays.

Air bed and breakfast—short-term rentals means single-family dwelling, or a portion of a single-family dwelling, that is rented to transient guest occupants for periods of 30 days or less. Short-term rentals are typically marketed through an online hospitality service such as VRBO, Airbnb, and other similar services.

Alternative financial services means a financial service outside traditional banking services which usually preys on low income individuals with little or no credit. Examples include: sub-prime mortgage lenders, non-bank check cashing services, car title loans, rent-to-own agreements, etc.

Amusement and recreation means active or passive commercial recreation services including, but not limited to, theaters, bowling, tennis and other racket sports, miniature golf, swimming and other water-related sports and spectator sports.

Animal boarding facility means a facility used for the commercial boarding of domestic animals such as dogs and cats.

Animal slaughtering and processing means the meat-processing industry consists of establishments primarily engaged in the slaughtering of different animal species, such as deer, cattle, hogs, sheep, lambs, or calves, for obtaining meat to be sold or to be used on the same premises for different purposes. Processing meat involves slaughtering animals, cutting the meat, inspecting it to ensure that it is safe for consumption, packaging it, processing it into other products such as sausage or lunch meats, delivering it to stores, and selling it to customers.

Arboretum means a place where trees, shrubs, and sometimes herbaceous plants are cultivated for scientific and educational purposes. An arboretum may be a collection in its own right or a part of a botanical garden.

Assisted living facility and residential care means a building, establishment, complex, or distinct part thereof, housing six or more persons, on a 24-hour basis, who, because of age, mental disability, or other reasons, live in a supervised residential environment which provides personal care and supportive services. The establishment provides, on-site to its residents, room, board, and services with the activities of daily living (bathing, grooming, dressing, toileting, eating, ambulation, medication reminders, etc.) appropriate to the residents' respective needs as determined and licensed by the Tennessee Department of Health, Board of Licensing Health Care Facilities. The establishment shall include individual dwelling units and shall contain common living and dining areas. A dwelling unit for an assisted living facility for seniors shall consist of one or more rooms, designed, occupied, or intended for occupancy as separate living quarters, with sleeping and bathroom facilities provided within the dwelling unit for the exclusive use of a single family.

ATM means automated teller machine.

Auto and truck rental means a company that rents automobiles or trucks for short periods of time, generally ranging from a few hours to a few weeks.

Auto dealerships (new and used) means a building used for the display, sales, storage, servicing and repairing of the new passenger motor vehicles, and of used passenger's motor vehicles as an accessory use. No part of the premises shall be used for a body sheet metal repair shop, nor for the dismantling or storage of wrecked vehicles.

Aviation facility. Examples: airports, heliports and air-craft service facilities.

Awning means a secondary covering attached to the exterior wall of a building. It is typically composed of canvas, cotton, polyester, yarn, or vinyl laminated to polyester fabric that is stretched tightly over a light structure of aluminum, iron, or steel. Location of an awning on a building may be above a window, a door, or above the area along a sidewalk.

Awning valance means a short (less than or equal to 12 inches) extension of an awning extending down from the awning the full width of the awning and made of the same material as the awning.

Bail bond services means an agency or corporation that will act as a surety and pledge money or property as bail for the appearance of a defendant in court.

Bank means an establishment authorized by the state and/or federal government to accept deposits, pay interest, clear checks, make loans, act as an intermediary in financial transactions and provide other financial services to its customers. A bank shall not include a standalone ATM, payday loan, title loan or flexible loan plan establishment.

Bar means an establishment primarily in the business of the sale of alcoholic beverages for on-premises consumption and possessing the appropriate licenses and where the sale of food stuffs and other non-alcohol related sales account for at least 70 percent of the establishment's income. For regulatory purposes the following terms are synonymous with bar: cocktail lounge, nightclub or tavern.

Barber shop means a duly licensed establishment in which hair cutting, shaving, and similar treatments are carried out.

Beauty parlor means a duly licensed establishment in which hairdressing, makeup, and similar cosmetic treatments are carried out.

Bed and breakfast means an owner-occupied detached dwelling in which the owner rents rooms to overnight guests and may offer meals only to those guests.

Billiard parlor means a room in which billiards are played.

Boarding house means a dwelling unit or part thereof in that, for compensation, lodging and meals are provided.

Botanical garden means a controlled and staffed institution for the maintenance of a living collection of plants under scientific management for purposes of education and research, together with such libraries, herbaria, laboratories, and museums as are essential to its particular undertakings.

Boutique manufacturing means a method used for the custom production of certain products in limited quantities by hand or with a restricted level of automation. Products produced this way often include ceramics, furniture, glass blowing, leather goods, jewelry, pewter, pottery and watches, among others.

Brewery means an industrial use that brews ales, beers, and/or similar beverages on site. Breweries are classified as a use that manufactures more than 15,000 barrels of beverage (all beverages combined) annually. In addition, uses that manufacture 15,000 barrels of beverage or less, but which do not meet one or more of the additional requirements needed to be considered microbreweries, are breweries.

Building means any structure constructed or used for residence, business, industry, or other public or private purposes, or accessory thereto, and including tents, dining cars, trailers, manufactured homes, signs, and similar structures whether stationary or movable.

Building setback means a line delineating the minimum allowable distance between the property line and a building on a lot, within which no building or other structure shall be placed except as otherwise provided.

Building line means the line delineating the actual distance between the property line and the building or front of proposed building on a lot.

Butcher shop means a retail facility devoted primarily to the sale of common household raw or semi-prepared meat, poultry and seafood products to the general public, but excludes restaurants, mobile vendors, wholesale butchers, mobile butchers, abattoirs, and retail stores.

Business services means work that supports a business. Examples include: accounting, banking, cleaning, design, finance, intellectual technology (I.T.) service(s), maintenance, printing, shipping or temp service.

Canopy tree means a woody plant with a minimum diameter of two inches as measured 12" above the ground that normally achieves an overall height at maturity of greater than 30 feet.

Car wash (not associated with any other business) means a free-standing car washing facility that is not located on the lot of a gas station or convenience store or a self-service car washing facility that is not located on the lot of a gas station or convenience store that is typically coin-operated or token-operated.

Church means a building, together with its accessory buildings and uses that, by design and construction, are primarily intended for conducting organized religious services and associated accessory uses.

Civic use means use typically associated with public or not-for-profit private entities for the promotion of a common cultural or civic objective such as literature, science, music, drama, art, sport or similar objectives.

Clinic means an establishment where patients are admitted for examination and treatment on an outpatient basis by one or more physicians, dentists, other medical personnel, psychologists or social workers and where patients are not usually lodged overnight. (Also see hospital).

Community center, public or private means a building used for recreational, social, educational and cultural activities, open to the public or a designated part of the public, usually owned and operated by a public or nonprofit group or agency.

Convenience store means a retail establishment offering items of everyday consumption such as those offered by food stores and eating places, in which convenience and habit play a more important role in the buying decision than price alone. Gasoline pumps may be allowed as accessories to the primary retail use.

Country club means land area and buildings containing golf courses, recreational facilities, a clubhouse and customary accessory uses, open only to members and their guests.

Cul-de-sac means the turnaround at the end of a dead-end street.

Data processing center means a place where various electronic equipment, computers and other telecommunications equipment are used to process information necessary for a business other than their own.

Deleterious means any use, product, material, or entity that would normally require special precautions during storage, transport, or assembly as a result of being composed of materials that may present a hazard to the public safety and well-being. "Deleterious" should not be confused with "dangerous." For example, a knife could be considered dangerous depending upon usage, but it would not be deleterious. Hydrochloric acid would be considered deleterious. A firearms store would not be considered deleterious, but an ammunition plant would be considered deleterious.

Department store means a retail establishment that offers a variety of unrelated merchandise and services.

Detached accessory dwelling means a detached dwelling unit separate from and subordinate to the principal building.

Diameter at breast height (DBH) means a standard method of documenting tree size by measuring the diameter of a tree approximately 4.5 feet above the ground.

Dry cleaning laundry means an establishment where clothing and similar divisions are washed, ironed or dry cleaned by employees on the premises and including the usual services associated with such an establishment.

Dry cleaning pick-up station means an establishment or business maintained for the pick-up and delivery of dry cleaning and/or laundry without the maintenance or operation of any laundry or dry-cleaning equipment or machinery on the premises.

Duplex means two dwellings under one roof on the same lot occupied as a residence with two separate families, each occupying a single unit.

Dwelling, single-family means a detached residential dwelling unit other than a mobile home, designed for and occupied by one family only.

Educational facility means any facility whose use is primarily educational in nature, either public or private. The educational facility includes school grounds, but does not include facilities used primarily for another purpose and only incidentally as a school or educational facility.

Educational services means established schools including primary, secondary, universities, colleges, junior colleges and various private facilities such as correspondence schools and art, dance and music schools.

Event center means a multi-purpose venue stand-alone facility hosting special events such as graduations, weddings, anniversaries, holiday gatherings, trade, birthday parties, etc., which is located on a property dedicated for that purpose, with dedicated parking and a separate ingress and egress with no party wall.

Farm means as defined by TCA § 2-2-122(c)(2), a farm is a tract of land consisting of at least 15 acres used for agriculture.

Farmer's market means an establishment providing for the retail sale of agricultural products, primarily involving the sale of fresh produce, such as fruits and vegetables, but also including such products and services that are customarily provided in rural or agricultural areas.

Finance means the system that includes the circulation of money, the granting of credit, the making of investments and the provision of banking facilities which includes activities like investing, borrowing, lending, budgeting, calculating and filing taxes, insurance, saving, and forecasting.

Flea market (indoor or outdoor permanent business) means any premises where the principal use is the sale of new and used household goods, personal effects, tools, art work, small household appliances, and similar merchandise, objects, or equipment, in small quantities, in broken lots, not in bulk, for use or consumption by the immediate purchaser, in open air or partly enclosed booths or stalls which may or may not be within a wholly enclosed building.

Freight transportation arrangement means a transportation facility furnishing services incidental to air, motor freight, and rail transportation. Examples of these facilities include: freight forwarding services; freight terminal facilities; joint terminal and service facilities; overnight mail processing facilities; packing, crating, inspection and weighing services; postal service bulk mailing distribution centers; transportation arrangement services; trucking facilities, including transfer and storage.

Funeral home means a building used for the preparation of the deceased for burial and the display of the deceased and rituals connected therewith before burial or cremation.

Gas station means an establishment next to a road selling fuel for motor vehicles.

Greenhouse business means a business which sells plants, flowers, produce, and other gardening and landscaping items to customers.

Hardware stores means a facility primarily engaged in the retail sale of various basic hardware lines, including, but not limited to, tools, builders' hardware, plumbing and electrical supplies, paint and glass, housewares and household appliance, garden supplies and cutlery.

Health clinic means a facility or institution, whether public or private, principally engaged in providing services for health maintenance and treatment of mental or physical conditions (The New Illustrated Book of Development Definitions).

Health club or spa means an establishment that provides facilities for aerobic exercises, running and jogging, exercise equipment, game courts, swimming facilities, saunas, showers, massage rooms, and lockers. Health clubs may also include a pro shop selling a variety of sports equipment and clothing.

Heavy equipment rental and leasing means the renting or leasing heavy equipment without operators that may be used for construction, mining, or forestry, such as bulldozers, earthmoving equipment, well-drilling machinery and equipment, or cranes.

Heavy industrial means an industrial use that, due to materials or processes utilized or products produced, has the potential for negative impacts on the environment or on surrounding uses in terms of noise, glare, vibration, smoke, vapors, odors, fire or explosive hazards or an industrial use where more than 20 percent of the use, measured as a percentage of the gross floor area of all buildings on the lot, is conducted outside of an enclosed building. This definition specifically excludes other separately defined uses referenced in these regulations, such as, but not limited to, mining, salvage yards, and solid waste disposal facilities.

Horse boarding/stabling means the housing and maintenance of three or more horses for the purpose of work or pleasure riding. This definition shall include both the private and for-profit housing of horses and all associated uses and structures.

Horticulture means the art and science of growing fruits, vegetables, flowers or ornamental plants.

Hospital means an institution providing primary health services and medical or surgical care to persons, primarily in-patients, suffering from illness, disease, injury, deformity and other abnormal physical or mental conditions and including, as an integral part of the institution, related facilities, such as laboratories, out-patient facilities, training facilities, medical offices and staff residences.

Hotel means a building in which lodging is provided and offered to the public for compensation, and in which ingress and egress (not including emergency exits) to and from all rooms are made through an interior corridor or lobby supervised by a person in charge at all hours (i.e. individual rooms are not accessible from exterior corridor).

Impermeable surface means any surface that cannot be easily penetrated by water, mainly composed of artificial coverings such as pavement, buildings, driveways, stone, wood, or concrete.

Incidental home business means a business, profession, occupation or trade conducted for gain or support entirely within a residential building which is incidental and secondary to the use of such building for dwelling purposes and which does not change the essential residential character of such building.

Industrial use means the manufacture, warehousing, assembly, packaging, processing, fabrication, storage or distribution of goods and materials, publishing, and the research and development of pharmaceutical products.

Institutional use means a nonprofit, religious, or public use, including but not limited to a place of worship, public or private school, day care center, library, hospital, nursing home, adult care center, cemetery, funeral home, community center, country club, golf course, stables, park, or other government owned or operated building, structure, or land used for a public purpose.

Junk yard means a field where junk is collected for resale. Also scrap yard.

Landscaping business means a business which constructs, installs and maintains lawns, trees, yards, shrubs, gardens, patios, related grounds and other outdoor areas which are owned by others.

Light industrial means industrial uses such as manufacturing, assembling and processing materials that are in "refined form." Light industrial does not create smoke, gas, odor, dust, vibrations or bright light that would be offensive when measured at the property line.

Liquor store means a retail shop that predominantly sells prepackaged alcoholic beverages, typically in bottles or cans, intended to be consumed off the store's premises.

Lumber yard or wood products means a business engaged in the wholesale or retail sale of various materials used in construction.

Manufactured or modular home means a structure consisting of pre-made and unit modules, in total or in part, that are assembled together on site. Modules are often pre-wired with switches and outlets already in place. T.C.A. § 13-24-201.

Manufacturing means the mechanical or chemical transformation of materials or substances into new products, including the assembly or manipulation of component parts, the creation of products, and the blending of materials, such as lubricating oils, plastics, resins, or liquors.

May means permissive.

Medical services means a service that provides medical treatment and care. Examples include: chiropractic service, dentist, doctor, mental health service, optometrist or ophthalmologist, therapy, veterinarian, etc.

Microbrewery means an eating place that includes the brewing of beer as an accessory use. The brewing operation processes water, malt, hops, and yeast into the beer or ale by mashing, cooking, and fermenting. The area used for brewing, including bottling and kegging, shall not exceed 25 percent of the total floor area of the commercial space.

Mobile food preparation vehicle means a mobile food preparation vehicle is any motorized vehicle that includes a self-contained or attached trailer kitchen in which food is prepared, processed or stored and used to sell and dispense food to the ultimate consumer. Mobile units must be mobile at all times during operation. The unit must be on wheels (excluding boats) at all times. Any mobile food unit that removes such wheels or becomes stationary must meet Tennessee Department of Health Regulations 1200-23-1 et. seq. in their entirety. This definition does not include pushcarts as regulated by town codes and prohibited from selling potentially hazardous foods by the Tennessee Department of Health, nor vehicles from which only ice cream and other frozen non-hazardous food products are sold, nor vehicles operating under a special event permit.

Mobile home means a type of prefabricated housing which is primarily assembled in factories and designed to be a self-contained home.

Mobile and prefabricated home sales means a large lot containing model mobile and prefabricated homes to sell to the public. Usually containing an office for the design and sale of mobile and prefabricated homes.

Monument sales means a building or lot where monuments are displayed to sell for burial plots or commercial signage.

Motel means a building in which lodging or boarding and lodging are provided and offered to the public for compensation and in which at least a portion of the rooms are directly accessible from a public or private right-of-way, from a parking lot or space or from the exterior of the building. As such, it is open to the public in contradistinction to a boarding house or apartment.

Multifamily residential means a classification of housing where more than two separate housing units for residential inhabitants are contained within one building or several buildings within one complex. Examples include apartment complexes and townhouses.

Museum means a nonprofit, noncommercial establishment operated as a repository or a collection of nature, scientific, or literary curiosities or objects of interest or works of art, not including the regular sale or distribution of the objects collected.

Nonconforming use means the lawful use of a building or structure or of a tract of land which does not conform to any one or more of the applicable use regulations of the district in which it is located, but which did conform to the applicable use regulations when the use was initiated.

Non-farm parcel means a parcel of land used for residential or non-commercial purposes, regardless of size, that does not meet the 15-acre threshold for the statutory definition of a farm.

Non-stock retailer means a store which does not carry inventory for resale. Examples include: travel agencies and other service oriented retail businesses.

Non-store retailer means:

(1)

The selling of goods and services outside the confines of a retail facility.

(2)

Retailing that takes place outside a traditional bricks and mortar or physical location; an online business like Amazon.

Nursery business means plant nurseries and landscape services. Establishment providing for the retail or wholesale sale of flowers, plants, shrubs and trees, products related to landscaping such as, but not limited to, soil, fertilizer, and potting materials, and landscape consultative services.

Nursing home residential care facility means a residential arrangement designed to house the aged or other persons with chronic or debilitating conditions where the residents require assistance with daily activities. The assistance provided may include housekeeping, centralized cooking or dining, personal care, nursing care, and counseling.

Parks, play fields and playgrounds means public parks and recreation areas operated by a public or private not-for-profit entity where the primary goal is the preservation of land in its natural state for public enjoyment or where the primary goal is the provision of facilities for active public recreation, such as, but not limited to, tennis courts, ball fields, and picnic areas.

Pawn shop means a business that offers monetary loans in exchange for an item of value.

Permeable surface means any surface that allows easy infiltration of water into the sub-soil. "Permeable surfaces" include such materials as exposed non-compacted soil, vegetation, non-compacted gravel without aggregate, or any other material that allows passage of water through said material.

Personal services means establishments which provide services to persons or households, excluding funeral and crematory services and cemeteries.

Pet food specialty store means a retail establishment which primarily sells pet food and other supplies for pets which does not sell live animals.

Pet store/birds/aquarium means a retail establishment which sells live small animals or fish which may also sell pet food and other supplies for pets.

Portable on-demand storage container means a large, storage container used to temporarily store goods for moving purposes.

Predatory lending services means any lending practice that imposes unfair or abusive loan terms. Examples include: check cashing services, certain home or car loan services, etc.

Principal building means a building that contains the principal activity or use located on a lot.

Privacy fence means a visually obstructive solid fence, higher than four feet.

Profession (professional office), as used in this chapter, is limited in its application to physicians and surgeons, lawyers, members of the clergy, architects and engineers or other persons holding advanced degrees from institutions of higher learning in the field in which they practice. The term is not intended to include insurance agents, insurance adjusters, realtors, photo studios, beauty parlors, barber shops, dance schools, business schools or any persons engaged in sales or trade.

Public means government-owned or related.

Public administration means the implementation of government policies.

Rear lot line, for the purposes of defining the rear setback, means the rear lot line is defined as one line. In the case of a rectangular lot, the rear lot line is defined as the line parallel to the front lot line, and furthest away from the front lot line. With regard to cove lots, irregularly shaped lots, or lots with five or more lot lines, the rear lot line (for purposes of defining the rear setback only), is a ten-foot-long line parallel to a line through both front corner markers, and as far away from the front of the lot as possible while still being contained within the lot.

Recreational vehicle or (RV) means a motor vehicle or trailer for recreational dwelling purposes; a motor home or other vehicle with a motor home body style which has its own motor power or is towed by another vehicle.

Recycling collection facility means a small collection facility where recyclable materials are purchased or accepted from the public. Typical uses include neighborhood recycling stations and thrift store collection trucks.

Repair services means establishments which fix, mend or overhaul merchandise for households or businesses, not to include automobile body shops.

Required yard means the area on a lot located between the property line and the minimum setback line required for each yard (front, side, rear) per the zoning district in which the lot is located.

Research and development center means research, development, and testing laboratories that do not involve the mass manufacture, fabrication, processing or sale of products. Such uses shall not violate any odor, dust, smoke, gas, noise, radiation, vibration, or similar pollution standards.

Restaurant means any public place at a fixed location kept, used, maintained, advertised and held out to the public as a place where food and drink are prepared and served to the public for consumption on or off the premises pursuant to the required licenses. Such establishments include, but are not limited to, restaurants, bars, lounges, coffee shops, and cafeterias, dining rooms, eating houses, short order cafes, luncheonettes, grills, tearooms and sandwich shops. (To ensure compliance with the Tennessee Food Safety Act*, every food service establishment is inspected between one and four times per year, depending on various factors such as the complexity of the food operation and level of active managerial control over foodborne illness risk factors to ensure compliance with the Tennessee Food Safety Act. Current food permits and the most recent inspection report must be displayed in a prominent location for the public to view.)

Restaurant, drive-in means an establishment where food is served in disposable containers and which by design of facilities or by the type of service and packaging permits or encourages the purchase of prepared, ready-to-eat food for consumption on the premises in motor vehicles.

Salvage yard means a place for saving abandoned, condemned, damaged, deteriorated, discarded, incomplete, obsolete or worn property, recycling, re-fabrication, restoration, reuse or scrapping.

Service station means a facility used for dispensing or sale at retail of any motor vehicle fuels.

Setback means the minimum horizontal distance by which any building or structure must be separated from a lot line, or in the case of street frontage, the distance from the right-of-way of the street.

Shall means mandatory.

Shipping container means a large, strong container, usually of metal, used to store goods in during shipment.

Shooting range (indoor) means a facility, entirely enclosed in a building, designed for the safe discharge of firearms at targets.

Shooting range (outdoor) means an open-air facility designed for the safe discharge of firearms from a fixed firing position at targets including rifle, skeet and trap ranges.

Shopping center means a grouping of retail businesses and service uses on a single development site with common parking.

Shrub means a woody plant that normally has several trunks and rarely achieves an overall height at maturity of greater than 15 feet.

Sign means any object, device, graphic design or part thereof, situated outdoors or indoors and which object, device, graphic design or the effect produced is used to advertise, announce, identify, declare, demonstrate, display, instruct, direct or attract attention by any means including words, letters, figures, designs, fixtures, colors, motion, illumination, sound and projecting images. Any sign requiring a permit is considered to be a structure. The following types of signs are recognized and specifically defined within this zoning ordinance:

Abandoned sign means any sign which identifies or advertises an entity which is no longer available at the indicated location or no longer available on the premises or for which no legal owner can be found.

Attached sign means any permanent sign which is affixed directly to or otherwise inscribed or painted on a wall, parapet, awning, canopy, or similar attached device of any building with the exposed face of the sign in a plane approximately parallel to the plane of such wall or device and extending therefrom less than 12 inches.

Awning sign means a permanent sign painted on, printed on, or attached flat against the surface of an awning or canopy projecting from and supported by the exterior wall of a building. An awning sign is a type of attached sign.

Banner sign means a temporary sign made of vinyl, fabric or other generally flexible material and attached to a frame on more than one side.

Billboard means any off-premise sign that is greater than 125 feet square and the bottom of the sign is higher than eight feet above the ground.

Campaign sign means a sign that is designed to influence issues subject to public voting.

Canopy sign means the same as awning sign.

Incidental home business sign means any sign advertising an incidental home business.

Marquee sign means an awning, canopy, or roof-like projected permanent sign that stands perpendicular to the ground and is normally anchored at its base. A marquee sign is a type of attached sign.

Mobile sign means any sign mounted on wheels or chassis or similarly constructed in a manner that would allow easy relocation to an alternate site.

Obsolete sign means the same as abandoned sign.

Off-premise sign means a sign not located on the property that it advertises.

On-premise sign means a permanent sign located on the subject property, but not attached to the building that it advertises.

Pennant sign means a temporary sign made with flexible material and attached on one side only with a frame, allowing movement in the wind.

Permanent sign means a sign permanently anchored to a building or support structure, or attached to the ground utilizing a footing. Permanent signs shall not be made of canvas, vinyl, paper products, or other flexible material that may move or wave in the wind.

Portable sidewalk sign means a portable, light sign, normally constructed in a "sandwich-type" manner that may be placed in front of a business during working hours.

Projecting sign means a permanent sign which is attached to and projects perpendicular from a building.

Real estate sign means a temporary sign used for the sole purpose of displaying information regarding the sale, rental or lease of any real property.

Suspended awning sign means a sign suspended from an awning or canopy, displayed perpendicular to the plane of the building and being a minimum of eight feet above the ground.

Temporary sign means a sign affixed to the ground without a prepared footing, or affixed to a permanent structure by temporary means, such as rope, wire, or other easily removable support and includes all signs made of flexible material such as canvas, vinyl or various paper products allowing some movement with the wind.

Vehicular sign means any sign painted or attached onto a vehicle not in operable condition and parked continuously in one location with the purpose of advertisement of any sort.

Social services means a public or private service that provides social well-being and organized philanthropic assistance such as counselling, job training, financial support, food subsidies, etc.

Stables or horse boarding means the housing and maintenance of three or more horses for the purpose of work or pleasure riding. This definition shall include both the private and for-profit housing of horses and all associated uses and structures.

Storage facility means a facility designed and used for the purpose of renting or leasing individual storage space to occupants who are to have access to such space for the purpose of storing and removing personal property which shall not include any facility used for residential purposes.

Storage shed means a small detached building of light construction used for storage customarily delivered and set on site and not permanently attached to the ground. A storage shed is an accessory building.

Street setback means the minimum horizontal distance by which any building or structure must be separated from the closest street frontage as measured from the edge of pavement.

Structure means anything constructed or erected, the use of which requires a permanent location on the ground or attachment to something having a permanent attachment to the ground.

Tattoo and body piercing means an establishment and/or tattoo studio shall mean any facility, building, room or place on a fixed foundation where the tattooing of humans is practiced or where body piercing is practiced or where the business of tattooing and/or body piercing is practiced or conducted or any part thereof.

Taxidermy service means a business that prepares, stuffs or mounts the skins of animals, but does not include the slaughtering or tanning of hides on-site.

Telecommunications tower means a tower which sole purpose is to provide mobile and fixed wireless telecommunication services to the public, including, but not limited to, cellular, pager, air to ground, personal communication services, local multipoint distribution services, specialized mobile radio services, etc.

Towing companies/wrecker service means a person or company operating, or conducting the business of recovery and towing of disabled, abandoned, or recovered vehicles at the request of the department or at the request of the operator or owner of the vehicle.

Townhouse means a single-family home that shares one or more walls with other independently-owned units. They are often rows of uniform homes, two stories or taller. Residents own their interior and exterior walls, lawn, and roof, as well as the insurance for both their home and property.

Trampoline means a gymnastic and recreational device consisting of a piece of taut, strong fabric stretched over a steel frame using many coiled springs as anchors.

Tree means a woody plant with a minimum diameter of two inches as measured 12 inches above the ground that normally achieves an overall height at maturity of greater than 15 feet.

Truck and heavy equipment sales (sales, rental, leasing, fueling and service of) means a motorized vehicle of greater than one-ton carrying capacity with two or more axles, including tractor-trailer combinations and buses; or any vehicle equipped with a body designed to carry property over the public highways and generally and commonly used for such transport of cargo rather than passengers. This term shall also include truck-tractors, trailers, semi-trailers when used in combination; also included is any property on which a business involving the maintenance, parking, servicing, storage or repair of commercial vehicles of greater than 15,000 gross vehicle weight (GVW) or similar heavy commercial vehicles is conducted, including the dispensing of motor fuel or other petroleum products directly into motor vehicles; and the sale of accessories or equipment for such commercial vehicles. May also include overnight accommodations and restaurant facilities.

Truck yard means a yard where trucks are parked or kept for loading and unloading.

Understory tree means a woody plant with a minimum diameter of two inches as measured 12 inches above the ground that normally has a single trunk and achieves an overall height at maturity of 15 to 30 feet.

Use means the purpose for which land, water, or a structure thereon is designed, arranged and intended to be occupied or utilized or for which it is occupied or maintained.

Use by right means any use that is listed as permissible within the applicable district.

Vending machine means a machine that dispenses merchandise when a coin, bill, token, or credit card is inserted.

Veterinary hospital means a place where animals are given medical care and the boarding of animals is limited to short-term care incidental to the hospital use.

Wild game processing facility means any establishment used for the purpose of dressing and/or cutting up wild game, the meat derived from which is intended for human consumption.

Writ of certiorari means a form of judicial review whereby a court is asked to consider a legal decision made by a governmental entity and decide if the decision was regular and complete, if there has been an error of law, if the entity had the power to make the decision complained of, or whether the entity exceeded its powers in issuing said decision.

Yard description:

A.

Front yard: The area extending across the full width of the lot located between the front property line and the front facade(s) of the principal structure.

B.

Rear yard: The area extending across the full width of a lot located between the rear property line and the rear facade of the principal structure.

C.

Side yard: The area on a lot located between the side property line and the side facade of the principal structure.

Zoo means a facility with usually indoor and outdoor settings where living, typically wild animals are kept especially for public exhibition. Also called a zoological garden or zoological park.
