South Daytona City Zoning Code

Sec. 5.2

Establishment of districts and official zoning map.

A.

Establishment of districts. The City of South Daytona, Florida, is hereby divided into zoning districts as specified in this article and shown on the official zoning map of the city which, together with all explanatory material therein, is hereby adopted by reference and declared to be a part of these zoning regulations.

B.

Official zoning map.

1.

Identification of official map: The official zoning map shall be identified by the signature of the mayor of the City of South Daytona, be attested by the city clerk, and bear the seal of the city under the following words: "This is to certify that this is the Official Zoning Map referred to in the Zoning Regulations of the City of South Daytona, Florida."

2.

Changes in district boundaries: If, in accordance with provisions of this article, changes are made in district boundaries or other matter on the official zoning map, such changes shall be recorded promptly on the map by inserting the date when the amendment was adopted, the ordinance number adopting the amendment, and the mayor's signature attested by the city clerk, in the spaces provided for such entries.

3.

Official map final authority: Regardless of the existence of so-called "versions" and copies of the city zoning map which may from time-to-time be made or published, the official zoning map, which shall be kept under the responsible charge of the city clerk, shall be the final graphic authority as to the current zoning status of land and water areas, buildings, and other structures within the city limits. However, the legal description of all zoning ordinances shall be the final legal authority as to the zoning status of land.

4.

Retention of earlier zoning maps: All zoning maps or remaining portions thereof which have had official force and effect in the city prior to the effective date of these zoning regulations shall be retained as a public record and as a guide to the zoning status of lands and water under the jurisdiction of the city prior to the adoption of this Code.

5.

Replacement of official zoning map: In the event that the official zoning map becomes damaged, destroyed, lost, or difficult to interpret because of the nature or number of changes and additions, or because of deterioration, the city council shall act to replace the prior official zoning map. The new official zoning map may correct drafting or other errors or omissions in the prior official zoning map, but no such correction shall have the effect of amending the original official zoning map or any subsequent amendment thereof. The new official zoning map shall be identified by the signature of the mayor of the City of South Daytona, attested by the city clerk, and bear the seal of the city under the following words: "This is to certify that this Official Zoning Map supersedes and replaces the Official Zoning Map adopted on the ________ day of _______, by Ordinance No. _____ of South Daytona, Florida." (Insert date map was replaced). Unless the prior Official Zoning Map has been lost or totally destroyed, the prior map or any significant parts thereof remaining shall be preserved together with all available records pertaining to its adoption or amendment.

6.

Updating zoning base maps: No revision of zoning boundaries is permitted except by ordinance. However, from time-to-time the zoning base map may be updated to reflect new annexations and streets and subdivisions formally approved by the city council without further official action by that body.
