ARTICLE IX

C-1 Neighborhood Commercial District

§ 245-54 Purpose.

The purpose of this district is to provide retail shopping and service facilities, to serve immediate household needs, that are of a limited type and size appropriate to smaller properties, that do not generate large amounts of traffic and that do not adversely impact neighboring residential uses.

§ 245-55 Authorized uses.

In the C-1 Neighborhood Commercial District, only the following uses are authorized:
A. 
Permitted uses:
(1) 
Principal uses:
(a) 
Essential services.
(b) 
Forestry, subject to § 245-179.
(c) 
Oil and gas drilling subsurface facilities.

(2) 
Accessory uses:
(a) 
Fences, subject to § 245-172.
(b) 
No-impact home-based business in a dwelling that is a nonconforming use.
(c) 
Off-street parking and loading, subject to Article XVII.
(d) 
Portable on-demand storage (PODS®) units and temporary storage trailers or containers, subject to § 245-178.
(e) 
Signs, subject to Article XVIII.
(f) 
Temporary construction trailer or sales office, subject to § 245-176.
(g) 
Other accessory uses customarily incidental to and on the same lot with any permitted use, conditional use or use by special exception authorized in this district.
B. 
Conditional uses:
(1) 
Principal uses:
(a) 
Automobile service station, subject to § 245-111.
(b) 
Day-care center, subject to § 245-124.
(c) 
Limited commercial uses, including and limited to the following, subject to § 245-138, provided there are no more than six employees on peak shift, and the gross floor area of any single business establishment does not exceed 5,000 square feet:

Business or professional offices.
[2] 
Carry-out restaurant.
[3] 
Catering service, excluding a rental hall.
[4] 
Convenience store.
[5] 
Delicatessen.
[6] 
Dry-cleaning pickup store.
[7] 
Financial institution.
[8] 
Food store.
[9] 
Medical offices.
[10] 
Personal services.
[11] 
Pet grooming.
[12] 
Retail businesses.
[13] 
Self-service laundromat.
[14] 
Video store, excluding adult video store.[1]

Home occupation in a dwelling that is a nonconforming use, subject to § 245-129.

Uses by special exception:

Principal uses:
(a) 
Communications antenna mounted on an existing building or on an existing public utility storage or transmission structure, subject to § 245-119.
(b) 
Comparable uses not specifically listed, subject to § 245-121.
(c) 
Public utility building or structure, subject to § 245-153.

§ 245-56 Area and bulk regulations.

In the C-1 Neighborhood Commercial District, all uses shall be subject to the following regulations, except as they may be modified by the express standards and criteria for the specific conditional uses and uses by special exception contained in Article XV:
A. 
Minimum lot area:
(1) 
Without public sewers: one acre (43,560 square feet).
(2) 
With public sewers: 0.5 acre (21,780 square feet).
B. 
Maximum lot area: one acre (43,560 square feet).
C. 
Minimum lot width: 150 feet.
D. 
Maximum lot width: 200 feet.
E. 
Maximum lot coverage: 40%.
F. 
Minimum front yard: 50 feet.
G. 
Minimum rear yard:
(1) 
All principal and accessory structures: 40 feet.
H. 
Minimum side yard:
(1) 
All principal and accessory structures:
(a) 
Adjoining any R District: 40 feet.
(b) 
Adjoining all other districts: 20 feet.
I. 
Special yard requirements: See § 245-172.
J. 
Permitted projections into required yards: See § 245-173.
K. 
Maximum height:
(1) 
All principal structures: two stories, but no more than 25 feet.
(2) 
All accessory structures: one story, but no more than 20 feet.
