SECTION 2

- Districts and Map.

2.1 Districts: For the purpose of these Regulations, the Town of Southbury is hereby divided into the following classes of districts:

2.1.1 Flood Plain District: The Flood Plain District is a class of district in addition to and overlapping one or more of the other districts. The boundaries of the Flood Plain District and the special requirements applicable therein are as specified in Section 5.

2.1.2 Planned Development District: Each Planned Development District is a class of district established in accordance with the provisions of Section 12.

2.1.3 Center District - Main Street South: The Center District - Main Street South (CD-MSS) is a class of district located in the Southbury Center Area and is in addition to and overlapping one or more other districts. The Center District - Main Street South delineates a section of the Town in which other districts, and uses and standards, are established in a coordinated manner to provide for the following:

a.

The orderly use and development of land and buildings as the primary governmental, community service and retail and office service section of the Town, known as the Main Street South Center Area;

b.

The monitoring and management of motor vehicle traffic generation and patterns so as to promote safety and a convenient level of roadway service; and

c.

The development of a streetscape along Main Street South that enhances the function and character of the Main Street South Center Area as well as safety and convenience of travel.

2.1.4 Center District - Village Green: The Center District - Village Green is a class of district located in the Southbury Center Area and is in addition to and overlapping one or more other districts. The Center District - Village Green defines a section of Town in which other districts are established in a coordinated manner to promote the orderly use and development of land and buildings as the commercial and service focus at Heritage Village.

2.1.5 Residential/Corporate Park R-60C District: The R-60C District is a class of district located adjacent to or close-by an interchange of Interstate #84 and whereby buildings containing offices for the administration and operation of corporations, firms and organizations may be established on a lot of 100 acres or more in locations recommended in any plan of development adopted by the Planning Commission under Chapter 126 of the General Statutes of the State of Connecticut.

2.1.6 Southford District: The Southford District is a class of district located in the Southford section of the Town and is in addition to and overlapping one or more of the other districts. The Southford District defines the center of Southford where other districts are established in a coordinated manner to promote the orderly use and development of land and buildings as a limited, convenience - retail and commercial service location for nearby residential neighborhoods and economic development areas and in a manner supportive of the rural character of Southford.

2.1.6.a. Southford Village District: The Southford Village District is a class of district located in the Southford District section of town which is established under the authority granted by C.G.S. §8-2j. which contains the Special Standards and Design Criteria as referenced in Section 7.2.19 of these Regulations. These Standards supersede the existing Standards in the applicable zones.

2.1.7 Aquifer Protection District: The Aquifer Protection District is a class of district in addition to and overlapping one or more of the other districts. The boundaries of the Aquifer Protection District, including Aquifer Protection District #1 and Aquifer Protection District #2 and the special requirements applicable therein are as specified in Section 5A.

2.2 Zoning Map: The boundaries of the districts specified in Paragraph 2.1 are hereby established as shown on a map entitled "Zoning Map of the Town of Southbury, Connecticut," dated March 22, 1966, including any special maps and boundary descriptions supplementary thereto and any amendments thereof, which map is hereby declared to be a part of these Regulations and is hereinafter referred to as "Zoning Map".

2.2.1 Interpretation of Map: Where a question arises as to exact boundaries of a district, the Zoning Commission shall by resolution determine the location of a boundary, giving due consideration, among other factors, to the indicated location of the boundary on the Zoning Map, the scale of the Zoning Map and the expressed intent and purposes of these Regulations.

2.2.2 Extension of Use: Where the boundary of a district divides a lot, the existence of which lot is evidenced by deed or deeds recorded in the land records of the Town of Southbury on the effective date of these Regulations or on the effective date of any amendment of these Regulations establishing such boundary, the Board of Appeals may grant a SPECIAL EXCEPTION to authorize a use of land, buildings and other structures permitted in one district to be extended into the other district for a distance of not more than 20 feet in accordance with the provisions of Section 6.
