CHAPTER 2

ZONING DISTRICTS AND BOUNDARIES

11-2-1: ZONING DISTRICTS:

In order to carry out the purposes and provisions of this title, the Village is divided into the following zoning districts:
A-1
Agricultural District
E-1
Estate Residential District
R-1
Low Density Residential District
R-2
Single-Family Detached Residential District
R-3
Medium Density Residential District
SR
Senior Residential District
B-1
Community Shopping District
B-2
General Business District
B-3
Regional Business District
BP
Business Park District
OR-2
Office Research District
M-1
Limited Manufacturing District
I-1
Light Industrial District
PDD
Planned Development District

11-2-2: ZONING MAP:

The boundaries of the districts listed above are as shown on the map designated as the "zoning map" for the Village. A copy of this map may be found on file in the office of the zoning official. The zoning map, together with the notations, references and other matters thereon pertaining to zoning district classifications and regulations, shall be as much a part of this title as if such notations, references and other matters were specifically set forth herein in this text. 11-2-3: BOUNDARIES:

Where uncertainty exists with respect to the boundaries of the various districts as shown on the zoning map, the following rules shall apply:
   A.   General Guidelines:
      1.   Boundaries indicated as approximately following the centerlines of streets, highways, or alleys shall be construed to follow such centerlines.
      2.   Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines.
      3.   Boundaries indicated as approximately following Village limits shall be construed as following Village limits.
      4.   Boundaries indicated as following railroad lines shall be construed to follow the railroad right-of-way along one side of the tracks.
      5.   Boundaries indicated as following shorelines shall be construed to follow such shorelines, and in the event of change in the shoreline, shall be construed as moving with the actual shoreline. Boundaries indicated as approximately following the centerlines of streams, rivers, canals, lakes or other bodies of water shall be construed to follow such centerlines.
      6.   Boundaries indicated as parallel to or extensions of features indicated in subsections A1 through A5 of this section, shall be so construed. Distances not specifically indicated on the official zoning map shall be determined by dimensions shown on the map, or in the absence of dimensions, by the scale of the map.
   B.   Streets, Alleys, Public Ways And Railroad Rights-Of-Way:
      1.   All streets, alleys, public ways and railroad rights-of-way, if not otherwise specifically designated, shall be deemed to be in the same zone as the property immediately abutting such alleys, streets, public ways and railroad rights-of-way. The centerline of a street, alley, public way or railroad right-of-way, unless otherwise specifically designated, shall be deemed to be the district boundary.
      2.   Whenever any street, alley or other public way is vacated by official action of the Village Board, the zoning district adjoining each side of such street, alley or public way shall be automatically extended to the center of such vacation, and all area included in the vacation shall then, and henceforth be, subject to all appropriate regulations of the extended districts.
   C.   Lots Of Record: Where district boundaries are not otherwise indicated, and where the property has been divided into blocks and lots of record, the district boundaries shall be construed to be the lot lines of the lots of record.
   D.   Areas Not Subdivided Into Lots And Blocks:
      1.   Wherever a district is indicated as a strip adjacent to and paralleling a major highway, the depth of such strip shall be in accordance with the dimensions shown on the map measured at right angles to the centerline of the street or highway. The length of the frontage of such a strip shall be in accordance with the dimensions shown on the map from section, quarter section, or division lines of centerlines of streets, highways or railroad rights-of-way unless otherwise indicated.
      2.   If a lot held in one ownership on the effective date hereof is divided by a district boundary line, the entire lot shall be construed to be within the more intensively zoned district.
      3.   This shall not apply, however, if it increases the more intensive portion of the lot by more than twenty five percent (25%). If this occurs, the entire lot shall be zoned the least intensive of the two (2) districts, unless otherwise recommended by the Planning Commission/Zoning Board of Appeals at a public hearing, and subsequently approved by the Village Board.
   E.   Interpretation: Where physical or cultural features existing on the ground deviate from those shown on the official zoning map, or in other circumstances not covered by this chapter, the Planning Commission/Zoning Board of Appeals shall interpret the district boundaries.
   F.   Changes: If, by amendment to this chapter, any change is made in any district boundary, or in any other matter shown on the official zoning map, such change shall be indicated on the map promptly after the amendment is adopted. The date of the latest updating of the official zoning map shall be shown on the face of the map. (Ord. 2002-01-15B, 1-15-2002; Ord. 2018-03-20C, 3-20-2018)

11-2-4: ENTIRE AREA ZONED:

It is the intent that the entire area of zoning jurisdiction, including all land and water areas, rivers, streets, alleys, and railroad and other rights-of-way, be included in the districts established by this title. If any area is not shown on the official zoning map as being included in any district, it shall be deemed to be in the R-1, Low Density Residential District. (Ord. 2002-01-15B, 1-15-2002)

11-2-5: ANNEXED TERRITORY:

All territory which is annexed to the Village shall be automatically classified in the E-1, Estate Residential District upon annexation, unless otherwise classified by a map amendment as part of the annexation agreement. (Ord. 2007-08-21A, 8-21-2007)
