means a portable temporary advertising device which is commonly in the shape of an "A," or some variation thereof, is located on the ground, is easily movable, and is usually two-sided.

means the cessation of or suspension from developing or maintaining a building or use for a stated period of time.

means a business or activity with no reported sales or production for a period of at least one hundred eighty days. Exceptions are temporary closures for repairs, alterations or similar situations.

means a parcel of land having a common boundary with another parcel of land including parcels which have no common boundary other than a common corner.

means safe, adequate and usable ingress or egress to a property in use.

means a building or structure detached from, on the same lot as, and customarily incidental and subordinate to the principal building.

has the same meaning ascribed in Government Code Section 65852.2, as the same may be amended from time to time. "Accessory dwelling unit" includes an "efficiency unit" as defined in Health and Safety Code Section 17958.1 and a "manufactured home" as defined in Health and Safety Code Section 18007.

means a use of land or of a building or portion thereof customarily incidental and subordinate to the principal use of the land or building and located on the same lot with such principal use.

"Gross acreage" means the total area within the lot lines of a lot or parcel of land before public streets, easements or other areas to be dedicated or reserved for public use are deducted from such lot or parcel, and do not include adjacent lands already dedicated for such purposes.

"Net acreage" means the gross project or lot area, less that portion of the site to be used for arterial and collector roads and/or the floodway portion of a flood plain.

means any construction that is attached to an existing building and which increases the size of a building or facility in terms of site coverage, height, length, width or gross floor area.

means any person showing written verification that he or she is acting for, and with the knowledge and consent of, a property owner.

means housing for agricultural workers that may include, but is not limited to, conventionally constructed units and manufactured housing consisting of no more than thirty-six beds in group quarters (or twelve units or less) designed for use by a single family or household.

means land with a minimum lot size of five acres that is used for the purpose of producing an agricultural commodity for commercial purposes. "Agricultural commodity" means any and all plant and animal products produced in this state for commercial purposes. An agricultural use can occur wholly, or in part, in a greenhouse.

means the use of land for the production of food and fiber, including the growing of crops and/or the grazing of animals on natural prime or improved pasture land.

means any area which is used or intended to be used for the taking off and landing of aircraft, including helicopters, and any appurtenant areas which are used or are intended to be used for airport buildings or facilities, including open spaces, taxiways and tie-down areas.

means an establishment that produces or manufactures alcoholic beverages and is licensed by the Department of Alcoholic Beverage Control of the State of California. These type of establishments may: (1) sell alcohol that is produced or manufactured on the alcoholic beverage manufacturer's licensed premises for on-sale or off-sale consumption; (2) include accessory uses such as tours, specialty dinners, food pairings, retail sales, and/or on-site consumption; and (3) include tasting rooms. Typical uses include breweries, distilleries and wineries.

Accessory uses may include one "mobile food facility," sometimes referred to as a "food truck," as defined by Riverside County Ordinance 580, as may be amended from time to time. Said mobile food facility shall be subject to and required to comply with the provisions of all city, county, state, and federal regulations applicable to mobile food facilities and maintain all current licenses, insurance, permits and/or approvals required from such regulations and presented to law enforcement or city staff upon request.

means any premises, place or building which is maintained and operated exclusively to provide twenty-four hour residential nonmedical services to adults, which may include, but need not be limited to, emancipated minors who are mothers under eighteen years of age and their children, who are recovering from problems related to alcohol, drug, or drug and alcohol misuse or abuse and who need alcohol, drug or drug and alcohol recovery treatment or detoxification services.

means a narrow service way, either public or private, which provides a permanently reserved but secondary means of public access not intended for general traffic circulation. Alleys typically are located along rear property lines.

means any change or rearrangement in the supporting members of an existing building, such as bearing walls, columns, beams, girders or interior partitions, as well as any change in doors or windows, or any enlargement to or diminution of a building or structure, whether horizontally or vertically, or the moving of a building or structure from one location to another. Alternation for signs include any change of face, color, material, size, shape, illumination, position, location, construction, or support of any sign or advertising device.

means a balloon, supported by forced air (non-helium), construction of fabric materials, affixed to the ground or roof top using steel cable anchoring systems, and often containing advertising messages.

means a natural or man-made feature which enhances a particular property.

unless otherwise stated, means and includes birds, fish, mammals and reptiles.

means uses such as frog farms; worm farms; the keeping and raising of more than four chinchillas, nutria, hamsters, guinea pigs, cavy, rabbits and similar small animals; and the keeping and raising of exotic animals, including the keeping of exotic animals as pets.

means any system of wires, poles, rods, reflecting discs, or similar devices used for the transmission or reception of electromagnetic waves when such system is either external to or attached to the exterior of a structure. Antennas shall include devices having active elements extending in any direction, and directional beam-type arrays having elements carried by and disposed from a generally horizontal boom that may be mounted upon and rotated through a vertical mast or tower interconnecting the boom and antenna support, all of which elements are deemed to be a part of the antenna. Antennas shall include cellular on wheels (COWs) and cellular on light trucks (COLTs) facilities; as well as dispatch carriers for specialized mobile radio (SMR) services and enhanced SMR (ESMR).

means one or more rooms with a private bath and kitchen facilities comprising an independent self-contained dwelling unit in a building containing more than two dwelling units.

means a structure containing three or more apartment units which is intended for rental purposes.

means a person who requests in writing the approval of a lease, permit, license, certificate or other entitlement from public agencies.

means the form and information submitted by an applicant for purposes of requesting an entitlement to use or develop property.

"Complete application" means a development request or application that provides all the required and necessary materials for effectively reviewing the permit request. The planning director shall have the authority to determine if an application, as submitted, is complete.

means an integrated component of the design of a building, including walls, windows, entryways, rafters, roofs and other typical components.

means a field established for non-professional recreational activities such as youth sports and adult recreational leagues.

means any structure that has an interior wall or roof in common with another structure.

means a temporary sign which is mounted, placed or attached only to the permanent building where the business activity is conducted.

means an establishment which performs hand-washing, waxing and interior cleaning of passenger vehicles.

means an area with multiple automobile/truck dealers which sells new and used automobiles and/or trucks of one ton or less capacity, including the repairing of same, in a planned area of ten acres or greater. The definition does not limit the ability to subdivide parcels in a planned auto mall in accordance with the city's development standards.

means the existing freeway oriented auto mall center identification sign including the electronic message board, located on 26631 Ynez Road.

means a retail place of business engaged primarily in the sale of petroleum products, goods and services required in the operation and maintenance of motor vehicles under one and one-half ton capacity as the same is defined by the Vehicle Code by the state and in which maintenance, minor repairs, washing, and lubrication services are conducted wholly within the service station building.

means the dismantling or wrecking of one or more used motor vehicles or trailers; or storage, sale or dumping of one or more dismantled, partially dismantled, obsolete or wrecked vehicles or their parts.

means the use of any building, land area or other premises for the display and sale of new or used automobiles, panel trucks, vans, trailers or recreation vehicles including any repair service conducted as an accessory service.

means a facility which sells automobiles and/or trucks of one ton or less capacity, both new and used, including the repairing of same. Trucks of more than one-ton capacity shall not be included in this term.

means an operation or business that buys, stores, and/or sells used vehicles and/or their parts. This includes dismantling vehicles and machines to sell parts as used car parts or scrap metal, to include refurbishment of parts.

means a painted or silkscreened, non-electric sign attached to an awning or canopy attached to the exterior of a building.

means any bunting, plastic, paper or similar material used for advertising purposes that is attached to any structure, staff, pole, line, framing, vehicles or any other similar object.

means the flood having a one percent chance of being equaled or exceeded in any given year, a.k.a. one-hundred-year flood.

means a space wholly or partly underground and having more than one-half of its height, measuring from its floor to its ceiling, below the average adjoining grade; if the finished floor level directly above a basement is more than six feet above grade, such basement shall be considered a story.

means usually a dwelling unit, but sometimes a small hotel, which provides lodging and breakfast for temporary overnight occupants for compensation.

means any habitable room other than a bathroom, kitchen, dining room or living room.

means a retail market that specializes in the sale of beer and wine for off-sale consumption as regulated by the state of California Alcohol Beverage Control Type 20 license. The sale of beer and wine products is the predominant product sold in such facility and the sale of other goods and services is not required. There are no size criteria or limitations on such facilities.

means a mound or embankment of earth, usually two to six feet in height.

means a corridor expressly reserved for bicycles, existing on a street or roadway in addition to any lanes for use by motorized vehicles.

means a paved route not on a street or roadway and expressly reserved for bicycles traversing an otherwise unpaved area. Bicycle paths may parallel roads but typically are separated from them by landscaping.

means a facility shared with motorists and identified only by signs; a bicycle route has no pavement markings or lane stripes.

means a term that encompasses bicycle lanes, bicycle paths and bicycle routes.

means a sign which directs attention to a business, commodity, service or entertainment conducted, sold or offered at a location other than the premises on which the sign is located.

means a unit of land bounded by streets or by a combination of streets and public land, railroad rights-of-way, waterways or any other barrier to the continuity to development.

means the individual or group duly authorized to grant changes to, relief from or special consideration under this development code.

means an establishment that is used for the regular service of meals to patrons. The establishment shall have suitable kitchen facilities and provide an assortment of foods commonly ordered at various hours of the day.

means an area of land separating two distinct land uses that acts to soften, mitigate or protect the effects of one land use on the other.

"Minimum buildable area" means the area within the lot lines that remains after subtracting the front, side and rear setback areas.

means any structure used or intended for supporting or sheltering any use or occupancy.

means the percentage of the net lot area which is covered by all the buildings on a lot as seen from a plan view.

means the length of the building elevation(s) which fronts on a public street, public parking lot or major pedestrian walkway.

means the vertical distance by which a building extends above the pre-existing grade, finished grade or floor protection elevation, whichever is lower, to the highest point of the coping of a flat roof, or to the deck line of a mansard roof, or to the average point of the highest and lowest points of a gable, hip or gambrel roof. Screened mechanical and electrical towers, chimneys, and other integral parts of the building or structure occupying no more than five percent of the roof area shall be excluded from the measurement.

"Historic building" means a building listed individually on the National Register of Historic places, or by a state or county agency charged with recognition or preservation of historic structures, or by resolution of the city council as having significant local or regional historical importance and value to the community.

"Main building" means a building within which is conducted the principal use permitted on the lot as provided by this development code.

means the building official of the city of Temecula or the authorized representative.

means the level or graded area of a lot designated for the placement of the primary building or use and all accessory structures and uses.

means a lot or contiguous lots of land in single, multiple or joint ownership, which provides the area and open spaces required for construction of a building or buildings, and which abuts a public or private street, alley or easement.

means a group of three or more industrial establishments planned, constructed, and managed as a total entity with customer and employee parking provided on-site, provision for goods delivery separated from customer access, aesthetic considerations and protection from the elements.

means a paved indentation in the curb of a roadway designed to allow buses to stop while picking up and dropping off passengers.

Sometimes referred to as cabinet signs, a sign that is shaped like a box to enclose the source of illumination (internally illuminated) so that the light shines through the translucent portions of the sign's copy panel(s). Logo boxes are not considered can signs.

means a roofed structure providing space for the parking or storage of motor vehicles and enclosed on not more than one side.

means property, including mausoleums, which is used for the interring of the deceased.

means a sign that identifies the name of a center and is located at a center entrance.

of a street as referred to in this development code means the right-of-way centerline as established by the county engineer of the county, by the city engineer of the city, by the State Division of Highways of the state; in any case in which the foregoing definition is not applicable, the planning commission shall designate the centerline.

means a document issued by the director of building inspection allowing the occupancy or use of a building and certifying that the structure or use has been constructed or will be used in compliance with all the applicable municipal codes and ordinances.

mean individual three-dimensional letters or figures that are affixed to a building or a freestanding sign structure.

means an assemblage of people for worship or an institution facilitating worship, including personal counseling and education and the building or buildings where such activities take place.

means the city of Temecula.

means development in which a number of dwelling units are placed in closer proximity than usual, or are attached, with the purpose of retaining an open space area.

means any building, structure, enclosure, or premises whereupon, or within which, five or more cats four months of age or older are kept or maintained, for financial profit for the purpose of boarding, breeding, training, marketing, hire or any other similar purpose.

include neighborhood, community, highway/tourist, and service commercial zoning designations or their equivalent specific plan zoning designation.

means any building, structure, enclosure, or premises whereupon, or within, five or more dogs four months of age or older are kept or maintained, for financial profit for the purpose of boarding, breeding, training, marketing, hire or any other similar purpose.

means any sign structure advertising an establishment, merchandise or entertainment, which is not sold, produced, manufactured or furnished at the property on which the sign is located. Commercial off-premises signs are commonly known or referred to as billboards.

means an activity, which includes the buying and selling of commodities and services.

means land in a residential, commercial, industrial or similar development held in common and/or single ownership which is available for use by all owners and tenants and guests and invitees thereof, and which is not reserved for the exclusive use or benefit of an individual tenant or owner.

means any facility, place or building which is maintained and operated to provide nonmedical residential care, day treatment, adult day care or foster family agency services for children, adults, or children and adults, including, but not limited to, the physically disabled, mentally impaired, incompetent persons, and abused or neglected children, and includes residential facilities, adult day care facilities, day treatment facilities, foster family homes, small family homes, social rehabilitation facilities, community treatment facilities, and social day care facilities.

means a facility operated by the city which provides recreational, cultural or other similar activities.

means a design feature combining landscaping, hardscaping, architectural features, public art, signs, or any other creative feature that can be considered a special and unique design for locations that are considered major intersections or highly visible locations within the city.

identifies the name and/or logo of a specific plan. A neighborhood identification sign identifies the name and/or logo of a subdivision, mobile home park or multifamily complex.

means a use permitted in a particular zoning district only upon showing that such use in a specified location will comply with all the conditions and standards for the location or operation of such use as specified in this development code and authorized by the planning commission.

means a discretionary entitlement which may be granted under the provisions of this development code and which, when granted, authorizes a specific use on a specific property subject to special terms and conditions.

means apartment housing, usually for senior citizens, or for the disabled in accordance with Health and Safety Code Section 50062.5 which is arranged in a group setting that includes independent living and sleeping accommodations in conjunction with shared dining and recreational facilities.

means a facility with a noninstitutional, home-like environment which provides inpatient care, including the following basic services: medical supervision, twenty-four hour skilled nursing and supportive care, pharmacy, dietary, social recreational, and at least one type of service specified in the Health and Safety Code. The primary need of congregate living health facility residents shall be for availability of skilled nursing care on a recurring, intermittent, extended or continuous basis. This care is generally less intense than that provided in general acute care hospitals but more intense than that provided in skilled nursing facilities.

means a temporary sign which states the name of the individual(s) and/or firms connected with the construction or financing of a project.

means a state-licensed facility which provides long-term nursing, dietary and other medical services except surgery or primary treatments customarily provided in a hospital, to convalescents or invalids.

means a retail food market providing goods and other services on an extended-hour basis. The sale of beer and wine is allowed with an approved conditional use permit. Such stores are located in smaller commercial centers or along major roadways with easy accessibility.

means a flag of a nationally recognized corporation or company. Individual businesses with franchise agreements or individually operated business of larger company are not be included in this definition.

means any open space, unobstructed from ground to sky, other than a yard, that is on the same lot with and bounded on two or more sides by the walls of a building.

means an entrance used by customers and patrons excluding loading entrances.

means any child day care facility other than a family day care home but including infant centers, preschools and extended day care facilities.

means bright fluorescent appearing colors, excluding signs illuminated by neon.

means consecutive calendar days, unless otherwise specified.

means a unit used to express the intensity of a sound wave.

means a flag or banner attached to light poles or other objects in a shopping center that provides a festive atmosphere to the center by colors, graphics, etc., and does not provide advertising space.

means the conveyance by an owner or developer of private land for public use, and the acceptance of land for such use by the governmental agency having jurisdiction over the public function for which it will be used.

means to remove more than seventy-five percent of the exterior walls of an existing building or structure, as measured by the linear length of the walls.

means the number of residential dwelling units per net acre of land.

means the density increase over the otherwise maximum allowable gross residential density as of the date of application by the applicant, or, if elected by the applicant, a lesser percentage of density increase, including, but not limited to, no increase in density. The amount of density increase to which the applicant is entitled shall vary according to the amount by which the percentage of affordable housing units exceeds the percentage established in subdivision (b) of California Government Code Section 65915.

means a method of retaining open space by concentrating densities in compact areas adjacent to existing urbanization and utilities while leaving historic, sensitive or hazardous areas unchanged.

means a building which does not have a wall of four feet or more in length in common with another building.

means a temporary sign which is partially attached to a permanent building, or is attached to a temporary structure such as a pole or pipe, or any combination of the above. Detached temporary signs do not include portable or vehicle mounted signs.

means an individual or business that prepares new land for the construction of buildings or causes physical building space to be built for use primarily by others, and in which the preparation of the land or the circulation of the building space is, in itself, a business and is not incidental to another business or activity.

means the physical extension and/or construction of urban land uses on land, in or under water. Development activities include: subdivision of land; construction or alteration of structures, roads, utilities and other facilities; installation of septic systems; grading; deposit of refuse, debris or fill materials; and clearing of natural vegetative cover.

means a unified text incorporating those areas of regulation more typically presented in separate zoning and subdivision ordinances and related chapters, hereafter referenced as the "development code."

means a map or maps along with supporting text, data, statistics or tables which describe the entitlement and its associated conditions which are authorized for a described parcel of land.

means the comprehensive evaluation of a development and its impact on neighboring property and the community as a whole, from the standpoint of site and landscape design, architecture, materials, colors, lighting, and signs, in accordance with a set of adopted criteria and standards.

means any of the uses, activities or structures listed under the definition of "development" when carried out, undertaken or established individually or independently of any other such use, activity or structure; or any group or combination of the listed uses, activities or structures which combine to form, or are a component part of an integrated project.

means the director of community development of the city of Temecula or authorized representative.

means a freestanding, multiple-sided, sign structure whose main purpose is to display signs or information.

means any housing which is designed and constructed to accommodate physically disabled persons.

means the cessation or suspension of the use of property for a stated period.

means a store advertising a wide variety of merchandise for sale at less-than-retail cost.

means a use engaged primarily in storage wholesale and distribution of manufactured products, supplies, and equipment, including incidental storage and sales activities, but excluding bulk storage of materials which are flammable or explosive.

means a private roadway providing vehicular access to parking space, garage, dwelling or other structure.

means a structure or portion thereof which is used exclusively for permanent human habitation.

"Duplex dwelling" means a detached building that is designed for occupation as the residence of two families living separate from each other.

"Multifamily dwelling" means a building or portion thereof and/or designed as a residence with two or more separate dwelling units.

"Single-family attached dwelling" means a dwelling unit occupied or intended for occupancy by only one household that is structurally connected with at least one other such dwelling unit (examples, townhouse or condominium).

"Single-family detached dwelling" means a detached building on a separate lot containing no more than one kitchen which, regardless of form of ownership, is designed and/or used to house not more than one family including all domestic employees of such family.

"Stacked dwelling" means an attached multiple-family building that is two stories or more in height. Individual dwelling units occupy a single floor and are located above or below another dwelling unit.

"Townhouse dwelling" means an attached dwelling, typically two stories in height, which is designed as a single-family residence. The dwelling units are to be attached by common walls to three or more similar dwellings.

"Triplex dwelling" means a detached building that is designed for occupation as a residence for three families living separately from each other with separate kitchens, baths, and living and sleeping areas, and entrances.

"Patio home dwelling" means a single-family unit on a separate lot which may be detached or attached on individual lots. One side of the dwelling may be located with a zero lot line setback on one side. Houses may be attached or the garage structures may be connected along this zero lot line setback.

means a group of three or more detached buildings used as one-family, two-family or multiple-family dwellings located on a single lot, together with all of the open spaces required by this development code but not including tourist courts, motor courts, or motels or any other commercial uses.

means a self-contained group of interconnected rooms designed, occupied or intended for occupancy as separate living quarters, with cooking, sleeping and sanitary facilities provided within the dwelling unit for the exclusive use of a single family maintaining a household.

means a grant of one or more of the property rights by the property owner to and/or for the use of the public, a corporation or another person or entity.

means that part of the roof which projects over or meets the wall.

means a private or public kindergarten through grade twelve school, or college or university, to give general academic instruction.

means any residential building containing five or more individual secure rooms intended or designed to be used, or which are used, rented, or hired out, to be occupied for sleeping purposes by residents as their primary residence.

means a scale drawing of the front, rear, or side of a building or structure.

means a facility that provides immediate and short-term housing and supplemental services for the homeless. Supplemental services may include food, counseling and access to other social programs.

has the same meaning as set forth in Health and Safety Code Section 17008.

means a sign that advertises the availability of an employment position within commercial, industrial, office or residential districts where nonresidential uses are permitted.

means any single event, a series of events, or an ongoing activity or business, occurring alone or as part of another business, to which the public is invited or allowed to watch, listen, or participate in, or is conducted for the purposes of holding the attention of, gaining the attention of, or diverting or amusing patrons, including, but not limited to:

means a detailed statement setting forth the environmental effects and considerations pertaining to a project as specified in Section 21100 of the California Environmental Quality Act, and may mean either a draft or a final EIR.

means any area in which plant or animal life or their habitats are either rare or endangered.

means a structure or area, the use of which is devoted to activities involving horses, including mules, donkeys and jackasses.

means a natural surfaced path for equestrian use.

means the use of a lot or structure at the time of the enactment of the ordinance codified in this development code.

means a building's exterior wall which is exposed to public view.

means one or more persons living together as a single housekeeping unit in a single dwelling unit. Family also means the persons living together in a licensed residential facility, as that term is defined in California Health and Safety Code Section 1502(a)(1) serving six or fewer persons, excluding the licensee, the members of the licensee's family, and persons employed as facility staff who reside at the facility.

means a home (a detached single-family dwelling, a townhouse, a dwelling unit within a dwelling, or a dwelling unit within a multifamily dwelling in which the underlying zoning allows residential uses) which regularly provides care, protection, and supervision of fourteen or fewer children, in the provider's own home, whether the home is rented, leased or owned, for periods of less than twenty-four hours per day, while the parents or guardians are away. This includes large family day care homes and small family day care homes.

"Small family day care home" means a home which provides family day care to eight or fewer children, including children under the age of ten years who reside in the home, as defined in Chapter 3.4, Division 2 of the California Health and Safety Code.

"Large family day care home" means a home which provides family day care to seven to fourteen children, including children under the age of ten years who reside in the home, as defined in Chapter 3.4, Division 2 of the California Health and Safety Code.

means an establishment or facility for the custody, loan, exchange or issue of money; for the extension of credit; and for facilitating the transmission of funds.

means the factors that the approving authority must consider as a part of approving or denying a development permit. Statements of findings shall be included in the record of actions taken by the approving authority.

means any sign, except time and temperature displays that do not include advertising, which contains or is illuminated by lights which are intermittently on and off, which change intensity or color, or which create the illusion of motion in any manner, including animated signs which manifest a physical movement or rotation in one or more planes or the optical illusion of action or motion.

means a general and temporary condition of partial or complete inundation of land areas from the overflow of inland and tidal waters, and the rapid accumulation of runoff of surface waters from any source and mudslides (i.e., mudflows) which are proximately caused or precipitated by accumulations of water on or under the ground.

"One-hundred-year flood" means the magnitude of a flood expected to occur on the average every one hundred years, based on historical data. The one-hundred-year flood has a one to one hundred, or one percent, chance of occurring in any given year.

means the official maps on which the Federal Insurance Administration has delineated the areas of special flood hazard, the risk premium zones and the floodways applicable to the community.

means the relatively level land area on either side of the banks of a stream regularly subject to flooding. That part of the floodplain subject to a one percent chance of flooding in any given year is designated as an "area of special flood hazard" by the Federal Insurance Administration.

means all land between the floodway and the upper elevation of the one-hundred-year flood.

means any combination of structural and nonstructural additions, changes or adjustments to structures which reduce or eliminate flood damage to real estate or improved real property, water and sanitary facilities, structures and their contents.

means the channel of a river or other watercourse and the adjacent land area that must be reserved in order to discharge a one-hundred-year flood without cumulatively increasing the water surface elevation more than one foot. No development is allowed in floodways.

means the gross floor area of all buildings on a lot divided by the gross lot area.

"Gross floor area" means the total horizontal area of a building, in square feet, including the exterior walls of all floors.

"Gross usable floor area" means the gross floor area minus the primary entrance lobby to a building, utility or mechanical equipment rooms, elevator cores, stairwells and bathrooms.

"Net floor area" means the total of all floor areas of a building, excluding stairwells and elevator shafts, equipment rooms, interior vehicular parking or loading; and all floors below the first or ground floor, except when used or intended to be used for human habitation or service to the public.

means permanent signs in multifamily complexes to identify availability of rental units.

means any residential facility providing twenty-four hour care for six or fewer foster children which is owned, leased or rented and is the residence of the foster parents, including their family, in whose care the foster children have been placed.

means a sign permanently supported by one or more uprights, braces, poles or other similar structural components, and attached to the ground or foundation set in the ground.

means the boundary of a parcel abutting an interstate freeway.

means a sign located on a parcel with freeway frontage that is oriented toward the freeway.

Occasionally, a lot fronts on more than one street. In such cases, requirements shall be observed in identifying the front lot line. The lot line fronting the street providing primary access to the lot shall be the front lot line. If the lot in question is a corner lot classification, the narrower of the two frontages shall be designated as the front lot line.

means the boundary of a building, parcel or site along public streets including freeways, parking lots or pedestrian malls.

means a hotel which provides lodging facilities and full service on-site restaurant facilities and meeting space, such as a ballroom; along with additional ancillary services within the facility, which may include health club/spa services, concierge services, room service, valet service, or similar hospitality related amenities, as determined by the director of planning.

means a temporary sign which identifies a future use of a site or building(s).

means a building or enclosed structure, or part thereof, used or intended to be used for the parking and storage of vehicles.

means a compendium of city policies regarding long-term development in the form of maps and accompanying text. The general plan is a legal document required of each local agency by the state of California Government Code Section 65301 and adopted by the city council. In California, the general plan has seven mandatory elements and may include any number of optional elements.

means the average of the finished ground level (finished grade) at the center of all walls of a building or, where such walls are parallel to and within five feet of a sidewalk, the average of the finished ground level at the sidewalk.

"Natural grade" means the elevation of the ground surface in its natural state, before man-made alterations.

"Pre-existing grade" means the elevation of the ground which exists prior to the start of any site preparation, grading or construction related to the project being proposed.

"Contour grading" means a grading concept designed to result in earthforms and contours which resemble natural terrain characteristics, with generally curving, nonlinear slope banks having variations in the slope ratios of the horizontal and vertical curves.

means an open area, cultivated or maintained in a natural state, which surrounds development, serves as a buffer between land uses, or marks the edge of an urban or developed area.

means any residential care facility for six or fewer persons which is licensed by the state.

shall have the same definition as "Accessory dwelling unit" or "ADU."

means parking spaces provided with a residential unit for intermittent use by visitors.

means any rented or leased room which is used or designed to provide sleeping accommodations for one or more guests in apartments, hotels, motels, private clubs, lodges and fraternal organizations.

means fitness centers, gymnasiums, health and athletic facilities which charge a membership fee for access that may include indoor sauna or hot tub facilities.

means a facility or institution, public or private principally engaged in providing a wide range of outpatient medical services, for health maintenance and the treatment of medical and physical conditions, and may include laboratory and pharmaceutical uses as secondary or supporting uses.

means a rotary wing aircraft which depends for its support and motion in the air principally upon the lift generated by one or more power-driven rotors that rotate on a substantially vertical access.

means a retail service engaged in providing retail sale, rental, service or repair and installation of home improvement products, including building materials, paint and wallpaper, carpeting and floor covering, decorating, heating, air conditioning, electrical, plumbing, and mechanical equipment, roofing, yard and garden supplies, home appliances, and similar home improvement products.

means a commercial activity conducted solely by the owners and/or occupants of a particular dwelling unit in a manner incidental to residential occupancy.

means a community association conducted solely by the owners and/or occupants of a particular residential development in a manner incidental to residential occupancy.

means a residential building containing six or more guest rooms or suites of rooms which do not contain cooking facilities and which are directly accessed through the lobby area.

means the addition of one or more structures or utilities on parcel of land.

means a small sign, emblem or decal informing the public of incidental information relating to the buildings on premises (i.e., name of business, telephone numbers, open, closed, hours of operation, credit cards, etc.).

include business park and light industrial zoning districts or any equivalent specific plan zoning designation.

means development of vacant land located within areas that are already developed.

means basic utilities, facilities and services needed to sustain residential and commercial activities.

means a nonprofit or quasi-public use such as a church, library, school, hospital, or municipally owned or operated building, structure or land.

means a sign inside any business that is not intended to be seen from outside the building in which the business is located.

means any area, lot, parcel, building or structure or part thereof used for the storage, collection, processing, purchase, sale or abandonment of wastepaper, scrap metal, or other scrap or discarded goods, materials, machinery, two or more unregistered and inoperable motor vehicles or other types of junk.

means an establishment in which more than four dogs or domesticated animals of more than four months old are housed, groomed, bred, boarded, trained or sold.

means a room or portion thereof equipped with plumbing and appliances for the purpose of preparing food.

means areas devoted to or developed and maintained predominantly with native or exotic plant materials, including lawn, groundcover, trees, shrubs, and other plant materials; and may also include accessory decorative outdoor landscape elements such as pools, fountains, and paved or decorated surfaces, all of which are suitably designed, selected, installed, and maintained to enhance a site.

means a plan which indicates the type, size and location of vegetative and accent material proposed for the landscaping of a site, including all irrigation and other devices necessary to maintain such landscaping.

means a facility that provides care, protection, and supervision for seven to fourteen children, inclusive, including children under ten years of age who reside at the home, as set forth in Health and Safety Code Section 1597.465.

means a retail sales facility offering for sale an assortment of distilled, fermented, brewed or similarly prepared beverages that contain amounts of alcohol sufficient to cause the sale of the beverage to be regulated by the state of California and: (1) where the sale of such beverages is the predominant product sold in such facility, whether such finding is determined by total annual retail sales or square footage of the facility dedicated to the storage and/or display of such merchandise; and (2) the retail sales facility is not the direct, corporately owned marketing and/or sales facility of the producer of the alcoholic beverage and where the alcoholic beverage is primarily intended to be consumed off-site from the place of sale. Liquor stores commonly range in size from two thousand to five thousand square feet. A convenience market selling distilled spirits that meets criteria (1) and (2) above shall also be considered as a liquor store for the purposes of this title. Liquor stores are prohibited as of the effective date of the ordinance codified in this chapter.

means an off-street space or berth which is on the same lot as the building(s) it services, abuts a street, alley or other appropriate means of access, and is used for the temporary parking of a commercial vehicle which is being loaded with or unloaded of merchandise or materials.

means a trademark or symbol used to identify a business.

means land which abuts at least one public street or any numbered or otherwise designated parcel of land which is shown on:

"Net lot area" means the area within the lot lines of a lot exclusive of any dedications for public rights-of-way, public parks and public school sites.

"Corner lot" means a lot or parcel of land abutting upon two or more streets at their intersection, or upon two parts of the same street forming an interior angle of less than one hundred thirty-five degrees.

means that portion of the lot that is covered by buildings and structures, which is derived as the quotient of the gross lot acreage divided by the area covered by the footprint(s) of the buildings or structures.

means the average linear measurement between the front and rear lot lines when measured at ninety-degree angles from the front lot line.

"Flag lot" means a lot having access to a street by means of a private driveway access easement, or parcel of land not meeting the requirements of this development code for lot width, but having a dimension of at least twenty feet at its narrowest point.

means the length of the defined front lot line measured at the street right-of-way line.

"Interior lot" means a lot other than a corner lot.

means the lines bounding a lot as defined in this section.

"Front lot line" means the lot line fronting the street right-of-way which provides the primary access to the lot. If the lot is a corner lot, the narrower of the two street frontages shall be designated as the front lot line.

"Rear lot line" means the lot line opposite and most distant from the front lot line; or in the case of an irregularly shaped lot, a straight line not less than ten feet long, within the lot, and most nearly parallel to and at the maximum distance from the front lot line.

"Side lot line" means any lot lines other than the front or rear lot lines.

"Reversed corner lot" means a corner lot in which the rear lot line abuts the side lot line of the nearest lot to its rear.

"Substandard lot" means any lot which does not meet the minimum dimensions required by this development code; the area of any easement which restricts the normal usage of the lot may be included.

"Through lot" means a lot which fronts upon two streets which do not intersect at the boundaries of the lot.

means the average linear distance between side lot lines when measured parallel to the front lot line.

means a housing first, low-barrier, service-enriched shelter focused on moving people into permanent housing that provides temporary living facilities while case managers connect individuals experiencing homelessness to income, public benefits, health services, shelter, and housing. "Low barrier" means best practices to reduce barriers to entry, and may include, but is not limited to, the following: (1) the presence of partners if it is not a population-specific site, such as for survivors of domestic violence or sexual violence, women, or youth; (2) pets; (3) the storage of possessions; (4) privacy, such as partitions around beds in a dormitory setting or in larger rooms containing more than two beds, or private rooms.

means the lowest floor of the lowest enclosed area (including basement or cellar). An unfinished or flood-resistant enclosure, usable solely for parking of vehicles, building access or storage in an area other than a basement area is not considered a building's lowest floor; provided, that such enclosure is not built so as to render the structure in violation of the applicable nonelevation design requirements of the floodplain requirements of this development code.

means an automobile entrance to a shopping, office or business center used primarily by customers with either full or restricted access. Entrances used solely for loading and unloading are not considered major entrances.

means a street or intersection of two streets which have an ultimate general plan or specific plan right-of-way of seventy-eight feet or more.

means a structure designed for single-family residential use that is factory made and transported to or assembled on the site. A manufactured home is:

means a use engaged in the manufacture, predominantly from previously prepared materials, of finished products or parts, including processing, fabrication, assembly, treatment and packaging of such products, and incidental processing of extracted or raw materials.

means the Subdivision Map Act of the State of California, Government Code Section 66410 et seq.

means a permanent roof structure which is attached to and supported on a building and projects over a building setback line.

means the maximum area of the lot that may be covered by buildings and roofed structures. This may be expressed in square footage or as a percentage of the minimum lot area.

means a facility or location, whether fixed or mobile, which provides, makes available or distributes marijuana to a primary caregiver, a qualified patient or a person with an identification card issued in accordance with California Health and Safety Code Sections 11362.5 et seq.

means signs usually located on tablets, plaques, or cut into the façade of the building. They can include religious symbols, the names of the building or site, dates of erection, and other important historical facts.

means a sign located adjacent to a drive-through lane of a fast food service facility, which lists the products available and the prices, and is designed to be read by the occupant of a vehicle.

means a structure containing separate storage spaces which are leased or rented on an individual basis.

means the amount of land that must be contained in a lot for a dwelling unit to be built on that lot.

means a special permit which will allow minor adjustments to certain requirements set forth in this development code when it can be shown that strict compliance would be impractical or undesirable in meeting the purpose and intent of this development code and that the adjustment will not have an adverse effect on the adjoining properties. A minor exception is granted at the discretion of the planning director subject to limitations set forth in this development code.

means the development in a compact urban form of a structure or tract of land with two or more different uses such as, but not limited to, residential, commercial, recreational, office, manufacturing or public use.

means any area or tract of land where two or more lots are rented or leased or held out for rent or lease to accommodate two or more manufactured homes or mobilehomes used for human habitation.

means any mobilehome park where spaces are legally subdivided lots or which may be conveyed in fee.

means a wireless communication facility that consists of a vertical unguyed structure, erected on the ground to support wireless communication antennas and connecting appurtenances.

means a freestanding low profile sign supported by a solid base (as opposed to poles or open braces).

means an establishment otherwise defined as a hotel with at least twenty-five percent of all rooms having direct access to the parking areas without the necessity of passing through the main lobby of the building.

means a machine capable of self-propulsion, with or without human guidance, whether for the performance of work or as a mode of transportation.

means a sign whose entirety or components rotate, move and swing in any manner to attract attention and signs consisting of any flashing, blinking, indexing, fluctuating or otherwise animated lights and components including searchlights and electric message boards.

means a retail/service commercial center which provides goods and merchandise to the immediate surrounding area and is approximately two to three acres in size.

means nonionizing electromagnetic radiation (i.e., electromagnetic radiation primarily in the visible, infrared, and radio frequency portions of the electromagnetic spectrum).

means establishments primarily providing preparation and retail sales of alcoholic beverages, as licensed by the Alcoholic Beverage Control Department.

means any sound that is undesirable because it interferes with speech or hearing, or is intense enough to damage hearing, or is otherwise annoying.

"Ambient noise" means the all-encompassing noise level associated with a given environment, being a composite of sounds from all sounds, excluding alleged offensive noises, at the location and approximate time at which a comparison with alleged offensive noises is to be made.

means the "A" weighted sound pressure level in decibels obtained using a sound level meter. The unit of measurement should be designated as dBA.

means any building, structure, enclosure or premises whereupon, or within which, five to ten cats, four months of age or older, are kept or maintained for noncommercial reasons. Each cat must be altered by six months of age.

means any building, structure, enclosure or premises whereupon, or within which, five to ten dogs, four months of age or older, are kept or maintained for noncommercial reasons. Each animal shall be individually licensed at four months and altered upon reaching six months of age.

means any sign exhibiting noncommercial speech or message; signage unrelated to the buying or selling of commodities or services.

means a parcel the size, dimensions or use of which was lawful prior to the adoption of, revision or amendment to this development code or other relevant ordinance, but which fails by reason of such adoption, revision or amendment, to conform to the present requirements of this development code or other relevant ordinance.

means a structure or building the size, dimensions or locations of which was lawful prior to the adoption of, revisions or amendment to this development code or other relevant ordinance, but which fails by reason of such adoption, revision or amendment, to conform to the present requirements of this development code or other relevant ordinance.

means a use or activity which was lawful prior to the adoption of, revision of, amendment to this development code or other relevant ordinance, but which fails, by reason of such adoption, revision or amendment, to conform to the present requirements of this development code or other relevant ordinance.

means a building whose primary function is to provide office space for professional, medical, and administrative purposes. Office buildings may include secondary and supporting retail uses that are generally located on the first floor.

means a group of three or more office establishments planned, constructed and managed as a total entity with customer and employee parking provided on-site, provision for goods delivery separated from customer access, aesthetic considerations and protection from the elements.

refers to the professional office zoning designation or any equivalent specific plan zoning designation.

means any sign which advertises businesses, services, goods, persons, places or events at a location other than that upon which the sign is located.

means any sign which advertises businesses, services, goods, persons, places or events at a location upon which the sign is located.

"Active open space" means any parcel or area of land or water which is essentially unimproved and set aside, dedicated, designated or reserved for public or private use or enjoyment, or for the use and enjoyment of owners and occupants of land adjoining or neighboring such open space and which contains recreational facilities such as pools and swimming areas, courts and other game areas, playing fields and equipment or other required facilities for various activities.

"Common open space" means land within or related to a development, not individually owned or dedicated for public use, which is designed and intended for the common use or enjoyment of the residents of the development and which may include such complementary structures and improvements as are necessary and appropriate.

refers to the open space, public park and recreation, and conservation zoning designations or any equivalent specific plan zoning designation.

"Passive open space" means any parcel or area of land or water which is essentially unimproved and set aside, dedicated, designated or reserved for nonstructured recreational activities in order to preserve the natural and aesthetic qualities of the area.

"Private open space" means an open space, fenced or otherwise, which is reserved for exclusive use by the occupants of specified dwelling units.

"Public open space" means open space owned and maintained by a public agency for the use and enjoyment of the general public.

"Roof overhang" means the lower part of a roof which extends beyond the façade of a lower wall.

means a district established by ordinance, which may be applied to properties only when combined with a base district.

means the owner of record on any parcel of real property as designated on the county assessor's tax roll. Where such person is no longer the owner, the term shall mean any person entitled to be shown as the owner on the next subsequent roll and where the land is subject to a recorded written agreement of sale, the term means any person shall and therein as purchaser. However, for purposes of complying with notice and similar requirements within this development code or elsewhere in state law, where the city is authorized to use the county tax assessor's roll or similar identification of property owners, the term "owner of property" shall mean that individual(s) as shown on such roll provided the roll utilized is the most recent.

means any person authorized to act for the owner of a property by virtue of a notarized statement of authorization, a proof of contract to purchase, or lease to the property.

means the extension of the main walls of a building above the roof level.

means an area of land, under one ownership that has been legally subdivided or combined in conformance with the State Subdivision Map Act and is shown as a single parcel on the latest equalized assessment role.

"Public parking area" means an area, other than a private parking area or street, used for the parking of vehicles and available for general public use, either free or for a fee.

means an area with minimum dimensions as established in the parking standards for the zoning district, which is accessible and available for the parking of one vehicle.

"Off-street parking space" means a temporary parking area for a motor vehicle that is not located on a dedicated street right-of-way.

"On-street parking space" means a temporary storage area for a motor vehicle which is located on a dedicated street right-of-way.

"Public parks" mean an open space intended for public recreational use which is operated by the city or some other government agency.

means a set of criteria relating to certain characteristics or desired qualities that a particular use, structure or development should achieve. Performance standards may be quantitative measures or qualitative design objectives.

means a sign entirely constructed of durable materials and intended to exist for the duration of the time that the use or the occupant is located on the premises.

means written governmental permission issued by an authorized official, empowering the holder thereof to do some act not forbidden by law, but not allowed without such authorization.

means any use allowed in a zoning district by right and subject to the restrictions applicable to that zoning district.

means an individual, firm, partnership, joint venture, association, social club, fraternal organization, corporation, estate, trust, receiver, syndicate, the federal or state government, a city (excepting the city of Temecula), county, district, or any other group or combinations hereof acting as an entity.

mean establishments primarily engaged in the provision of services for the non-medical enhancement of personal appearance. Example uses may include, but are not limited to, nail salons, tanning salons, and tattoo shops.

means any contiguous part or portion of a project which is developed as a unit in the same time period.

means a high profile sign supported by one or more poles or similar structures and permanently attached directly into or upon the ground.

means a covered pedestrian entrance to a building which is located on the first floor level.

means a sign that is not attached to a building or structure, vehicle or trailer. Examples of portable signs include, but are not limited to: A-Frames and T-Frames.

means a lot or building site, or a specified portion of a lot or building site, that meets the requirements needed for the location, maintenance and operation of a use on the property.

means a tenant who occupies more than fifty percent of the total floor area of a building.

means the primary or predominant use of any lot.

means a landing area used to take off or land private helicopters for the purpose of picking up and discharging passengers, cargo or medical emergency passengers and does not include fueling or service facilities. The use of the heliport shall be accessory and incidental to the primary use of the property. Private heliports do not include facilities for regularly scheduled commercial operations such as commuter passenger service.

means a landing area used to take off or land helicopters for the purpose of picking up and discharging general, acute care and emergency care passengers. The use of the heliport shall be accessory and incidental to an existing hospital facility.

means the entire parcel of real property, including all structures thereon, all or part of which undergoes or is proposed to undergo construction, demolition, or a change in ownership status.

means a horizontally extending sign which protrudes from a building or structure below the parapet wall or eave line.

means an on-premises sign that contains words such as Entrance, Enter, In, Out, Restrooms, No Parking or other similar words, and/or contains arrows or characters indicating traffic directions. Temporary real estate signs are not included in this group of signs.

means and includes all public streets and utility easements, now and hereafter owned by the city, but only to the extent of the city's right, title, interest or authority to grant a license to occupy and use such streets and easements for telecommunications facilities and antennas.

means a high profile sign having a solid base and permanently attached directly into or upon the ground.

means a use serving the public at large, and operated by a private entity under a franchise or other similar governmental authorization, designed to promote the interests of the general public or operated by a recognized civic organization for the benefit of the general public.

means an object that stands out as a prominent feature of the landscape when viewed with the naked eye.

means a vehicular portable structure without permanent foundation which can be towed, hauled or driven, which is primarily designed as a temporary living accommodation for recreational, camping or travel use and which may include, but is not limited to, travel trailers, truck campers, camping trailers and self-propelled motor homes.

means an area used or intended to be used for camping by recreational vehicles.

means the typical recreational activities that are offered in a developed community park, such as baseball, soccer and pickleball as well as swimming, camping, marinas, health resorts and retreat centers that offer similar activities in an indoor setting. These uses require considerable physical infrastructure and are dependent upon significant utilities to operate.

means low intensity outdoor activities such as walking, hiking, bicycling, picnicking, nature education and bird watching. These uses do not require substantial infrastructure and require little to no utilities to operate.

mean facilities used for the process of sorting, cleaning, treating and reconstituting waste or other discarded materials for the purpose of using the altered form.

means the actual cost to replace or reconstruct a damaged structure or facility as determined by a qualified and approved appraiser.

means a housing arrangement chosen voluntarily by persons sixty years of age or over, or their authorized representative, where varying levels and intensities of care and supervision, protective supervision, personal care, or health-related services are provided, based upon their varying needs, as determined in order to be admitted and to remain in the facility.

means any family home, group care facility, or similar facility determined by the Director of Social Services, established for twenty-four-hour nonmedical care of persons in need of personal services, supervision or assistance essential for sustaining the activities of daily living or for the protection of the individual.

means a facility licensed by the California State Department of Social Services that provides housing accommodations and support services for the elderly, persons with special health care needs and the chronically ill. Support services may include meals, counseling and other services.

mean and include hillside, very low, low, low medium, medium, and high density residential zoning designations or any equivalent specific plan zoning designation.

means the process of obtaining materials or energy from waste materials, particularly solid waste.

means any establishment where the primary business is the preparation, service, and retail sales of meals comprising a varied selection of foods and nonalcoholic beverages prepared, served, and consumed on the premises. Entertainment establishments that allow dancing shall be considered a class III establishment.

means any establishment where the primary business is the preparation, service, and retail sales of meals comprising a varied selection of foods, nonalcoholic beverages, beer, and wine prepared, served, and consumed on the premises.

To be classified as a restaurant (bona fide public eating establishment) with beer and wine sales, an establishment shall meet the following requirements.

means any establishment where the primary business is the preparation, service, and retail sales of meals comprising a varied selection of foods, nonalcoholic beverages, beer, wine, and distilled spirits, prepared, served, and consumed on the premises.

To be classified as a restaurant (bona fide public eating establishment) with beer, wine, and distilled spirit sales, an establishment shall meet the following requirements.

"Drive-in restaurant" means a building or portion thereof where food and/or beverages are sold in a form ready for consumption and where all or a significant portion of the consumption takes place and is designated to take place outside the confines of the building, often in a motor vehicle.

"Fast food restaurant" means a restaurant which supplies food and beverages primarily in disposable containers and which is characterized by high automobile accessibility, self-service and short stays by customers.

means the selling of goods, wares or merchandise directly to the ultimate consumer.

means a trail or way designed for or used by equestrians, pedestrians and cyclists using nonmotorized bicycles.

means a corridor, either public or private, on which a right of passage has been recorded.

means a sign, together with all its parts and supports, which is erected, constructed, placed on or above, or extends above the roof, the eave line or above the top of the parapet wall of a building.

means an area for a building fully enclosed by walls, windows, doors, a roof and a floor.

means the recovery of waste materials.

mean pipes that carry only domestic or commercial sewage to a treatment plant and into which storm, surface, and ground waters are not intentionally admitted.

means a parabolic or disc shaped antenna of either solid or mesh construction intended for the purpose of receiving communications from orbiting satellite transceivers. However, this term shall not include any satellite antennas smaller than thirty-six inches in diameter.

means a parabolic or dish-shaped antenna or other apparatus or device that is designed for the purpose of receiving radio or television broadcast signals.

means a highway, road, drive or street that, in addition to its transportation function, provides opportunities for the enjoyment of natural and man-made scenic resources and access or direct views to areas or scenes of exceptional beauty or cultural interest. The aesthetic values of scenic routes often are protected and enhanced by regulations governing the development of property or the placement of outdoor advertising.

means a commercial establishment limited to offering specialized instruction in technical, commercial or trade skills, including, but not limited to, cosmetology school, mechanical school, driving school, real estate or other specialized instruction. This definition does not include a community college or university.

means a method of visually shielding or obscuring one abutting or nearby structure or use from another by fencing, walls, berms or densely planted vegetation.

means any premises used for the sale or handling of used goods including the establishments for the sale or trade of used clothing, furniture and appliances.

means a tenant, other than the primary tenant, that shares an office building of three stories or more with at least one other tenant.

means licensed housing for persons sixty-two years of age or older, or licensed housing for persons fifty-five years of age or older, including such housing facilities as retirement villas, apartments, condominiums, etc.; but not including state-licensed rest homes, group homes, convalescent hospitals, etc., which are regulated by other provisions of this development code.

means a sewage treatment system that includes a settling tank through which liquid sewage flows and in which solid sewage settles and is decomposed by bacteria in the absence of oxygen.

means a line within a lot, parallel to and measured from corresponding lot line, forming the boundary of a required yard and governing the placement of structures and uses on the lot.

means a group of three or more commercial establishments planned, constructed and managed as a total entity with customer and employee parking provided on-site, provision for goods delivery separated from customer access, aesthetic considerations and protection from the elements.

shall mean the rental of a dwelling unit (in whole or in part), accessory structure, and/or a recreational vehicle located upon a parcel or a portion thereof, by owner(s) or lessee(s) to another person or group of people for occupancy, dwelling, lodging or sleeping purposes for a period of less than thirty consecutive calendar days.

A short-term rental includes any contract or agreement that initially defined the rental term to be greater than thirty consecutive days and which was subsequently amended, either verbally or in writing to permit the occupant(s) of the owner(s) or lessee(s) short-term rental to surrender the subject dwelling unit before the expiration of the initial rental term that results in an actual rental term of less than thirty consecutive days.

The rental of units within city-approved hotels, motels, bed and breakfasts, community care facilities, and social care facilities shall not be considered to be a short-term rental.

means a paved surface or leveled area used as a pedestrian walkway which parallels and is usually separated from the street.

means any object, device, display or structure, or part thereof, situated outdoors or indoors, made of any material, which is used to identify, display, direct or attract attention to an object, person, institution, organization, business, product, service, idea, event or location by any means, including words, letters, figures, designs, symbols, fixtures, colors, illumination or projected images.

for all signs, except multitenant signs, is computed by including the entire area within a single, continuous, rectilinear perimeter of not more than eight straight lines, enclosing the extreme edge of the writing, representation, emblem or other display. It does not generally include any background, supporting framework or bracing that is incidental to the display itself. In case of two sided signs, the area shall be computed as including the maximum single-display surface.

For multitenant signs, the total sign area shall include the area which surrounds the lettering and the logos for all tenants (i.e., sign area for each tenant is not computed individually).

means any words, letters, numbers, figures, characters, designs, or other symbolic representations incorporated into a sign.

means the area for the building elevation surface which the sign is directly placed on.

means the greatest vertical distance measured from the finished grade to the uppermost part of the sign.

means the functional equivalent of a traditional family, whose members are a nontransient interactive group, where such persons jointly occupy a single dwelling unit, jointly use common areas, and share household activities and responsibilities (e.g., meals, chores, and expenses).

means a plan drawn to scale showing uses and structures proposed for a property as required by the applicable regulations, including lot lines, streets, building sites, reserved open space and other specific development proposals.

means the degree of deviation of a surface from the horizontal, usually expressed in percent or degrees. The slope percentage is the ratio of the rise to the run time one hundred.

means a facility that provides care, protection, and supervision for eight or fewer children, including children under ten years of age who reside at the home, as set forth in Health and Safety Code Section 1597.44.

means the provision of direct sunlight to an area specified for solar energy collection or the enjoyment of the property owner.

mean a complete design or assembly consisting of a solar energy collector, energy storage facility and components for the distribution of transformed energy.

means a wood or masonry fence with no openings.

means all decomposable and nondecomposable solid, semisolid and liquid wastes, including garbage, trash, refuse, paper, rubbish, ashes, industrial wastes, demolition and construction wastes, discarded home and industrial appliances, manure, vegetable or animal solid and semisolid wastes, and other discussed solid and semisolid wastes, excluding sewage wastes.

means a retail market that specializes in a specific type or class of food, drink, and related products. In no case shall a specialty market be less than ten thousand square feet.

means under Governmental Code Section 65450 et seq., a legal tool for detailed design and implementation of a defined portion of the area covered by the general plan. A specific plan may include all detailed regulations, conditions, programs and/or proposed legislation that may be necessary or convenient for the systematic implementation of any general plan element(s).

"Private stable" means a building or portion of a building used to shelter and feed horses or ponies which are used exclusively by the occupants of the property on which the stable is situated.

"Development standards" mean requirements in this development code or other city ordinances that govern building and development including, but not limited to, lot area, height limits, frontage, landscaping and floor area ratio.

means a roofed one-story enclosed structure used for storage or workspace that does not include plumbing.

mean any facilities designed to control, retain or remove water runoff.

"Full story" means that portion of the building included between the surface of any floor and the surface of the floor next above it, or if there be no floor above it, than the space between the floor and the ceiling above it. Basements and underground parking lots shall be included, if the vertical distance from the average adjoining grade to the ceiling is over five feet.

"Half story" means a space under a sloping roof where the line of intersection of the roof and wall face is not more than three feet above the floor level, and in which the possible floor area with head room of five feet or less occupies at least forty percent of the total floor area of the story directly beneath.

means a publicly accessible vehicular right-of-way, other than an alley, which affords a primary means of access to abutting property.

means the boundary of a parcel or a building which fronts a public street.

means that portion of a lot's net area and improvements that is exposed to view from the street.

means a combination of materials which is assembled for use, occupancy or ornamentation whether installed on, above or below the surface of land or water. Includes, but is not limited to any building, road, pipe, flume, conduit, siphon, aqueduct, telephone line, or electrical power transmission and distribution area.

means the division of a tract of land into defined lots, either improved or unimproved, which can be separately conveyed by sale or lease, and which can be altered or developed. "Subdivision" includes condominium projects as defined by the California Government Code.

means a sign used to identify residential subdivisions that contain project name, unit square feet, price, developer's name, address and telephone number, and other pertinent information about the project.

means a facility that provides housing with no limit on length of stay, that is occupied by the target population as defined by Section 50675.14 of the California Health and Safety Code, and that is linked to on-site or off-site services that assist tenants in retaining housing, improving their health status, maximizing their ability to live and, when possible, work in the community.

means a separate area on the alcoholic beverage manufacturer's licensed premises maintained and operated by and for an alcoholic beverage manufacturer, wherein alcoholic beverages may be sold and served by an employee or designated representative of the alcoholic beverage manufacturer to consumers of legal drinking age for consumption on the alcoholic beverage manufacturer's licensed premises. Alcoholic beverages manufactured elsewhere may not be sold in the tasting room or on the alcoholic beverage manufacturer's licensed premises. A tasting room is, and at all times shall remain, an ancillary use to the alcoholic beverage manufacturing use.

means establishments primarily providing preparation and retail sales of alcoholic beverages as licensed by the Alcoholic Beverage Control Department. Taverns, and bars with dancing shall obtain a class III entertainment license.

means a facility that transmits and/or receives electromagnetic signals. It includes antennas, microwave dishes, horns, and other types of equipment for the transmission or receipt of such signals, telecommunication towers or similar structures supporting such equipment, equipment buildings, parking area, and other accessory development.

means a temporary sign which is made of cloth, bunting, plastic, wood, vinyl, poster board, painted windows or other similar materials, and which is located on site of the business use or activity, and is erected or placed for a prescribed period of time to promote, advertise, announce or provide the following information:

can include temporary business advertising signs, real estate signs, political signs, construction, contractor, financing and remodeling signs, employment opportunity signs, future tenant identification signs, garage sale signs, helium balloons, ambient air balloons, model home signs and flags. Seasonal window displays that contain traditional holiday characters and messages and which are intended to create or enhance holiday character of an area and not reference or display service available or rendered, or goods produced, sold or available for sale are not considered temporary signs.

may identify businesses or buildings. They may be either a single tenant identification sign, multi-tenant identification sign, or a building identification sign.

means an electronically controlled changeable copy sign which conveys only information such as time, date, temperature or atmospheric conditions, where different alternating copy changes are shown on the same copy area. Each message remains displayed for a specific minimum period of time with a total blackout between message changes. The copy shall not travel in any direction. Time and temperature signs shall be included in the permitted wall or freestanding sign area and shall not include any advertising.

means the area of the heliport where the helicopter lands on and takes off from.

means a residential facility that provides rental housing accommodations and support services for persons and families, but restricts occupancy to no more than twenty-four months. Support services may include meals, counseling, and other services.

means a lot, lot area or parcel of land use, designed or maintained for the purpose of storing, parking, refueling, repairing, dispatching, servicing or keeping motor trucks and associated equipment together with those facilities necessary to service, dispatch, store or maintain such vehicles, their cargos and crews.

means the defined future right-of-way shown on an adopted precise plan of highway alignment, or the streets rights-of-way shown within the boundary of a recorded tract map, a recorded parcel map or a recorded site plan. The latest adopted or recorded document in the above case shall take precedence. If none of these exist, the ultimate right-of-way shall be considered the right-of-way required by the highway classification as shown on the master plan of highways. In all other instances, the ultimate right-of-way shall be considered to be the existing right-of-way.

means a sign which is perpendicular to and suspended below the ceiling or roof of a canopy or permanent awning.

means land in its natural state.

means the purpose for which land or a building is used, arranged, designed or intended, or for which the land or building is or may be occupied or maintained.

"Principal use" means a use which fulfills a primary function of a household, establishment, institution, or other entity.

"Private or public utility" means any closely regulated agency which, under public franchise or ownership, or under certificate of convenience and necessity, provides the public with electricity, gas, heat, steam, communication, rail transportation, water, sewage collection or other similar service.

means establishments engaged in the generation, transmission and/or distribution of electricity, gas or steam, including water and irrigation systems and sanitary systems used for the collection and disposal of garbage, sewage and other wastes by means of destroying or processing materials.

are used for motels, hotels, and other similar uses to identify the availability of rooms.

means permission to depart from this development code when, because of special circumstances applicable to the property, strict application of the provisions of this development code deprives such property of privileges enjoyed by other property in the vicinity which is under identical zoning.

"Disassembled vehicle" means a vehicle without hoods, doors, fenders, body panels, headlights, trunk lids, tires, wheels, windows or windshields.

means the portion of a vehicle extending beyond the wheel stops or curb.

"Wrecked vehicle" means a vehicle with dented areas, rusted exterior body parts or broken glass parts exceeding one square foot in area.

means a private, nonexclusive vehicular easement affording access to abutting properties.

means an automated machine that dispenses items to consumers after cash, a credit card, or other forms of payment are inserted into the machine. Vending machines may not be visible from the public right-of-way and are to be located indoor only.

means a right which has been legally established and cannot be revoked by subsequent conditions or changes in law without due process of law.

means an area which is designated on the general plan as a village center or has been rezoned with the application of the village center overlay zoning district. A village center designation is intended to create a mixture of land uses with pedestrian orientation with plazas, open spaces and mass transit opportunities.

means a substantial solid barrier intended to enclose, separate or surround.

"Community theme wall" means a solid wall used to establish an architectural identity or theme within a community.

means a permanent sign mounted on the wall of a building.

means an opening which is in a wall of a building, designed to allow light and/or ventilation into the building, enclosed by casement or sash and contains glass or other similar transparent or semi-transparent material.

means any sign which is painted, attached, glued or affixed to a window or is otherwise easily visible from the exterior of the building where the advertised product or service is available.

means landscaping characterized by the use of vegetation which is drought tolerant or low water use in character.

means an open space area on a lot that is unoccupied or unobstructed from the ground upwards, except as permitted by this development code.

"Actual front yard" means the space extending across the full width of the front of the lot, the depth of which is the minimum horizontal distance between the front lot line or street right-of-way line and the primary structure on the lot.

"Actual rear yard" means the space extending across the full width of the rear of the lot, the depth of which is the minimum horizontal distance between the rear lot line and the primary structure on the lot.

"Actual side yard" means the space between the setback line of the main building and the side lot line, extending from the front yard to the rear yard; the measured distance of the yard shall represent the shortest distance between the side lot line and that portion of the main building nearest the line from which the measurement is taken.

"Required front yard" means the space extending across the full width of the front of the lot, the depth of which is the minimum horizontal distance between the front lot line or street right-of-way line and the structural setback line parallel thereto on the lot.

"Required rear yard" means the space extending across the full width of the rear of lot, the depth of which is the minimum horizontal distance between the rear lot line and the structural setback line parallel thereto on the lot.

"Required side yard" means the space between the setback line of the main building and the side lot line, extending from the front yard to the rear yard; the measured distance of the yard shall represent the shortest distance between the side lot line and that portion of the main building nearest the line from which the measurement is taken.

means the location of a building on a lot in such a manner that one or more of the building's sides rest directly on a side lot line.

means a specifically delineated area, district or zone within the city in which regulations and requirements uniformly govern the use, placement, spacing and size of land and buildings.

means the map or maps which are a part of this development code and delineate the boundaries and zoning districts.
