CHAPTER 7

B COMMERCIAL DISTRICT

9-7-1: PERMITTED USES:

Permitted uses in the B commercial district are:
Agricultural implement sales and service shops.
Air conditioning and heating sales and service.
Auction rooms.
Automobile sales and service shops.
Automobile service stations.
Bakeries, where all goods are sold on the premises at retail.
Banks.
Barbershops and beauty shops.
Battery and tire service stations.
Beverage distributors, but not including bottling plants.
Billiard and pool rooms.
Bookbinding.
Books and stationery stores.
Bowling alleys and skating rinks.
Business, music, dance or commercial schools.
Catering establishments.
Clubs, lodges or fraternal organizations.
Dance halls.
Drugstores.
Dry cleaners pick up station and facilities for cleaning not more than one thousand (1,000) pounds of dry goods per day and using nonflammable cleaning agents.
Electrical appliance shops.
Employment agencies.
Expressing, baggage, and transfer delivery service.
Florist shops and greenhouses for retail trade only.
Garages or lots, public or private, for storage of private automobiles, passenger automobiles, trucks, or buses.
Grocery, fruit or vegetable stores.
Hardware stores.
Laboratories.
Launderettes, laundromats and laundries.
Manufacturing or processing which is clearly incidental to use is permitted. Such manufacturing or processing is limited to that which employs not more than ten (10) persons in the manufacturing or processing.
Marine sales and service.
Meat markets or poultry stores, if no slaughtering or stripping is involved.
Medical clinics.
Motels and hotels.
Offices.
Package liquor stores.
Painting and decorating shops.
Pet shops.
Plumbing, heating, and roofing supply and workshops.
Printing, publishing, and issuing of newspapers, periodicals, books and other reading matter.
Printing shops.
Radio broadcasting stations.
Radio, television sales and service.
Required off street parking.
Restaurants, including the sale of alcoholic beverages.
Retail stores and services, department, furniture and home appliance stores.
Shoe repair shops.
Signs, subject to chapter 11 of this title.
Special uses, subject to the conditions of chapter 2, article B of this title.
Tailor and dressmaking shops, not employing more than five (5) people.
Taverns.
Taxi service stations.
Telegraph service stations.
Temporary buildings incidental only to construction of a permitted use.
Theaters.
Tourist homes.
Trailer sales.
Undertaking establishments.
Used car lots.
Wholesale establishments.
Uses customarily incidental to any of the above uses and accessory buildings when located on the same lot. (Ord., 5-13-1968; amd. Ord., 11-8-1982)

9-7-2: BUILDING HEIGHT:

No building shall hereafter be erected so as to exceed twenty five feet (25') in height; except, that additions to existing buildings may be extended not to exceed the height of the existing principal building. (Ord., 5-13-1968)

9-7-3: YARDS:

No building or structure shall hereafter be erected and no building or structure shall hereafter be enlarged which would, when erected, conflict with or, when enlarged or altered, further conflict with the following requirements for yards: (Ord., 5-13-1968; amd. 2015 Code)
   A.   Front Yard: All new structures permitted in this district shall be set back from the front street line a distance sufficient to provide a sidewalk not less than ten feet (10') wide.
   B.   Side Yards: Where a lot is used for any of the purposes permitted in this district and is located at the intersection of two (2) or more streets, and where an R district adjoins the rear of said lot, the side yard on the side of the lot adjacent to the street shall not be less than ten feet (10') in width; except, that the building width of the lot shall not be reduced to less than twenty feet (20'). In all other cases, a side yard is not required except on the side of a lot adjoining a dwelling district, in which case, there shall be a side yard of not less than five feet (5').
   C.   Rear Yard: There shall be a rear yard having a depth of not less than ten feet (10') when abutting upon a public alley and not less than twenty feet (20') when no dedicated alley or public way exists at the rear of the lot. (Ord., 5-13-1968)

9-7-4: STANDARDS:

All buildings, structures and uses in the B commercial district shall comply with the following regulations: (Ord., 5-13-1968)
   A.   No building shall be used for residential purposes. (Ord., 5-13-1968; amd. 2015 Code)
   B.   All operation and production activities shall be conducted or maintained wholly inside an enclosed building. Where open storage is used, the area should be effectively screened by a decorative solid wall or fence, or dense evergreen planting, of sufficient height to block the view of the storage area from any park or residential district. No open storage shall be permitted within sixty feet (60') of an adjoining residential district or public park.
   C.   No noise from the operations (other than that emanating from vehicular traffic), either continuous or intermittent, shall be detectable at the boundary line of any residential district.
   D.   No toxic matter, noxious matter, smoke or gas and no odorous or particulate matter detectable beyond the lot lines shall be emitted.
   E.   No vibrations shall be detectable beyond the lot lines.
   F.   No glare or heat shall be detectable beyond the lot lines.
   G.   Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon any residential district or into public streets or parks.
   H.   No fuel except electricity, oil or gas shall be used.
   I.   The storage or use of chemicals, either solid, liquid or gas, shall be subject to the following conditions:
      1.   The storage, utilization or manufacture of materials or products ranging from incombustible to moderate burning is permitted.
      2.   The storage, utilization or manufacture of materials ranging from free to active burning is permitted, provided the following condition is met: Said materials or products shall be stored, utilized or manufactured within completely enclosed buildings having incombustible exterior walls and protected throughout by an automatic fire extinguishing system.
      3.   The storage, utilization or manufacture of flammable materials which produce explosive vapors or gases is prohibited; except, that storage of gasoline and fuel oil for use solely for heating or operation of vehicles in connection with the principal use is permitted, provided storage is underground and does not exceed a capacity of one thousand (1,000) gallons. Automobile service stations are not subject to the terms of this subsection I3.
   J.   No raw materials shall be processed into any of the following basic products: metals of any kind, gases, plastics, textiles, paper and leather.
   K.   All premises shall be furnished with all weather surface walks, and except for parking areas, grounds shall be planted and landscaped. (Ord., 5-13-1968)
