Off-Street Parking and Loading Space Regulations
Section 405.775 General.

The regulations contained in this Section and the following Sections shall govern the size, number, location, and design of all off-street parking and loading facilities within the City of Union.

A.
The regulations of this Section shall govern the dimensions of off-street parking spaces, including those provided in developments approved in planned districts or by special procedure prior to the enactment hereof, anything in such planned district or special procedure approval to the contrary notwithstanding.
1.
Minimum off-street parking dimensions. Except as otherwise provided for in this Article, the requirements for off-street parking in this Zoning Code shall be implemented with regard to the minimum dimensions in the following table:

Parking space — description. A required off-street parking space shall be an area of not less than one hundred seventy-one (171) square feet and not less than nine (9) feet wide by nineteen (19) feet long measured perpendicularly to the sides of the parking space exclusive of access drives or aisles, ramps, streets or alleys or from private driveways or aisles leading to streets or alleys and to be used for the storage or parking of passenger automobiles or commercial vehicles under one and one-half (1½) ton capacity.

Parking space for disabled persons. Parking spaces designated for use by vehicles displaying the distinguishing "disabled" license plate issued pursuant to Sections 301.142 or 301.071, RSMo., shall meet the requirements of the Federal Americans with Disabilities Act, as amended, and any rules or regulations established pursuant thereto.
4.
Measurement of space. When determination of the number of required off-street parking spaces results in a requirement of a fractional space, any fraction up to and including one-half (½) shall be disregarded, and fractions over one-half (½) shall be interpreted as one (1) parking space.
5.
Access.
a.
Parking facilities shall be designed with appropriate means of vehicular access to a street or alley in such a manner as will least interfere with the movement of traffic and so designed as to permit adequate maneuvering area for vehicles to turnaround where only one (1) entry or exit is provided in order that no backing of vehicles into the street is required. No driveway or curb cut in any district shall exceed twenty-five (25) feet in width.
b.
Off-street parking areas in the commercial or industrial districts shall provide ingress and egress to any public right-of-way only at such location as recommended by the City Engineer and approved by the Planning and Zoning Commission.

Surfacing. All parking areas and driveways within the City of Union shall be paved in accordance with the applicable standards for the area to be paved as set forth in the American Association of State Highway Transportation Officials. The edition in effect when the paving is performed shall control. In the event there is no specific listing for a given type of area to be paved, such areas shall be two (2) inches of rolled asphaltic or Portland concrete over a compacted base of four (4) inches. All paving must be maintained in good condition. The requirements established by this Section shall be applicable to all driveways and parking areas, established after August 9, 2004, whose access is from any City street or alley or a paved private street. Any driveway or parking areas in existence as of August 9, 2004, shall not be required to be paved unless and until such time as the owner or an authorized agent of the owner elects to change the status or condition of the property in a manner which would require the issuance of a building permit with respect to any building or buildings situated or to be erected thereon, except in those instances where an electrical service upgrade permit, mechanical permit and/or an on-site sewer permit is sought on single-family residential property. Any application for a building permit regarding new or existing buildings on any lot upon which there is situated any unpaved driveway or parking area shall also contain the plans necessary to convert such unpaved areas to paved areas if the use thereof is to be continued after the desired construction or changes have been completed. Such application shall also contain a statement as to which existing unpaved areas are not to be utilized after the proposed improvements are made. If the building permit pertains to a commercial or industrial use, the applicant shall also deposit with the City at the time the application for a building permit is submitted one (1) of the following:

a.
An irrevocable letter of credit in favor of the City of Union equal in value to the estimated cost of the required paving. In the event there is a discrepancy between the estimate of the applicant and the City Engineer, the estimate of the City Engineer shall control. Any such letter of credit shall provide that the City of Union shall have the right to draw against any such letter of credit in the event the applicant fails to complete the required paving in a reasonable amount of time after the building permit is issued. In determining what is a reasonable amount of time, the City Engineer's decision shall control. In making such decision, the City Engineer shall take into consideration the size of the project, the weather conditions and any other factor which is beyond the control of the applicant.
b.
Escrow funds equal in value to the estimated cost of the required paving. In the event there is a discrepancy between the estimate of the applicant and the City Engineer, the estimate of the City Engineer shall control. The City of Union shall have the right to draw against any such escrow funds in the event the applicant fails to complete the required paving in a reasonable amount of time after the building permit is issued. In determining what is a reasonable amount of time, the City Engineer's decision shall control. In making such decision, the City Engineer shall take into consideration the size of the project, the weather conditions and any other factor which is beyond the control of the applicant; or
c.
A surety approved by the City staff and City attorney equal in value to the estimated cost of the required paving. In the event there is a discrepancy between the estimate of the applicant and the City Engineer, the estimate of the City Engineer shall control.
7.
Lighting. Any lighting used to illuminate an off-street parking area shall be arranged so as to reflect the light away from all adjoining properties.
8.
Parking for one (1) or more uses. Parking for one (1) or more uses in a commercial or industrial district may be provided on a separate lot from the use or uses to be served when said separate lot is within a similar zoning district type and within three hundred (300) feet of the use or uses to be served, as measured along pedestrian pathway. When two (2) or more uses combine to provide the required parking space jointly, the parking space so provided shall equal the total space required if each were to provide parking space separately. Joint or remote parking areas provided in accordance with this paragraph shall be comprised of a minimum number of stalls as provided in conjunction with uses in the "B-3" Neighborhood Business District. Such parking must be approved by the City Engineer or designated Zoning Enforcement Official. Subsequent to approval, said parking plan and an appropriate legal instrument of agreement among the owners of the various properties involved shall be recorded with the Franklin County Recorder of Deeds. Such recorded plans and agreement shall be binding upon the owners of the properties involved and their successors and assigns and shall limit and control the use of land included in the plan to those uses and conditions approved by the Zoning Enforcement Official and agreed to by the owners of the properties involved.
9.
Additions to existing uses. No off-street parking space required under this Chapter shall be used for any other purpose. Where a change in use creates greater parking requirements than the amount being provided, an occupancy permit shall not be issued until provision is made for the increased amount of required off-street parking.
10.
Housing for the elderly. The off-street parking requirements for housing for the elderly in residential zoning districts may be reduced to .75 spaces per dwelling unit when approved by the Planning and Zoning Commission. When such a reduction is approved, an area of sufficient size shall be designated on the site plan to accommodate additional parking, should conversion to conventional housing occur in the future.
11.
Storm water. Adequate storm water drainage facilities shall be installed in accordance with City of Union storm water regulations.
12.
Striping. All parking spaces other than those directly serving one- and two-family detached dwellings shall be properly marked by durable paint in stripes a minimum of four (4) inches wide and extending the length of the parking space.
13.
Residential parking. The required parking spaces for residences shall be located in the side and rear yard and in the front yard on a driveway providing access to a garage, carport or other permitted parking area for a dwelling. Driveways and parking areas shall be an improved surface of asphalt or concrete.
14.
Existing spaces. Off-street parking and loading spaces in existence on the effective date of this Ordinance may not be reduced below the number required herein for equivalent new construction.
15.
Change in use. A permitted use in an existing building that does not meet the parking requirements of the Section may be used without full compliance with the required number of parking spaces provided:

a.
The amount of parking available is at least seventy-five percent (75%) of the parking required for the new use in Section 405.785 based upon net floor area.
b.
The applicant provides the maximum number of parking spaces able to be accommodated on the site while complying with all other provisions of this Code and without being required to remove or partially remove an existing structure.
c.
Net Floor Area. The net floor area of a commercial, industrial or office use in an existing building changing its use, shall exclude the area set aside for the purposes of kitchen facilities, mechanical rooms, closets and similar rooms, passage ways, storage rooms and toilet facilities, or other spaces accessory to the primary use when calculating the parking space minimums.
16.
Inoperable vehicles. No trucks, truck trailers, or vehicles of any type shall be on skids, jacks, or any other device that will make them immobile or inoperable, except for emergency repairs.
17.
Use of trucks or trailers for storage. No trucks or trailers of any kind, except those already in use as of the effective date of this Ordinance, or any portions thereof, shall be used for storage purposes.
18.
Vehicles being repaired. Garages and repair establishments shall not store or temporarily store any vehicle to be repaired for a period of more than fifteen (15) days. This does not include vehicles that are garaged or vehicles which may be authorized for storage for longer periods by the Board of Aldermen under conditional use permit.
19.
Planned commercial and industrial parking. The minimum off-street parking and loading requirements for any use or building in a planned commercial or industrial district shall not be reduced below that required for the same use in any other commercial, industrial district as set forth in this Article XIX, Off-Street Parking and Loading Space Requirements. These requirements may exceed minimum standards as required by conditions where determined necessary. However, where the planned commercial and industrial district includes two or more uses, the Planning and Zoning Commission may recommend, and the Board of Aldermen may approve, a total reduction of not more than twenty percent (20%), or thirty percent (30%) for developments greater than two hundred thousand (200,000) square feet in gross floor area under single ownership or management control, of the required off-street parking and loading spaces, where it has been demonstrated by study of the combined uses and customary operation of the uses that adequate parking would be provided.
20.
Ownership.
a.
When required accessory off-street parking facilities are provided elsewhere than on the lot on which the principal use served is located, they shall be in the same possession, either by deed or long-term lease or agreement(s) as outlined in Subsection (8) above, as the property occupied by such principal use, and the owner shall be bound by covenants filed of record in the office of the City Clerk, requiring the owner and his/her heirs and assigns to maintain the required number of off-street parking spaces during the existence of the principal use.
b.
No parking facilities accessory to a business or manufacturing use shall be located in a residential district.
21.
New or enlarged business establishments.
a.
Any new business constructed or any additions to an existing structure which occurs after the effective date hereof shall provide two (2) parking spaces for every three (3) principals, agents or employees. The requirements of this Subsection shall be in addition to the requirements of Subsections (3) and (4) hereof. Further any specific parking requirements for a specific business shall take precedence over this Subsection.
b.
All such required employee parking spaces shall be clearly designated on all building permit applications and all such employee parking spaces shall be clearly marked so as to indicate that such space is for employee parking or shall be located in a specific area reserved for employee parking (See Section 405.835, Article XXII of this Chapter).

B.
Zoning District "B-1" shall be exempt from meeting the on-site parking requirements.
C.
The number of parking spaces required for physically handicapped persons shall be determined as follows:
Minimum accessible parking spaces shall be as required by the current Americans with Disabilities Act. |
D.
Off-street parking facilities in residential districts in accordance with the requirements of this Section shall be used solely for the parking of passenger automobiles or as set forth in other sections of this Code.

E.
All parking spaces accessory to single-family dwelling units shall be located on the same lot as the principal building. No parking space accessory to single-family dwellings shall be located on a front yard.
F.
Parking spaces and lots accessory to single-family attached, two-family and multiple-family dwellings shall be permitted in front, side and rear yards provided that a minimum of fifty percent (50%) of the total required yard area is maintained as yard area and, further, that the following requirements are met:
1.
Front yard. Parking lot shall be located a minimum of seven (7) feet from the building served and a minimum of four (4) feet from the front property line or sidewalk, whichever is closest to the building.
2.
Side yard. Parking lot shall be located a minimum of seven (7) feet from the building served and a minimum of four (4) feet from the side property line. In case of a corner lot the parking lot shall be a minimum of four (4) feet from the property line or sidewalk whichever is closest to the building.
3.
Rear yard. Parking lot shall be located a minimum of seven (7) feet from the building served and a minimum of six (6) feet from the rear lot line. If the rear lot line faces an alley or street the parking lot shall be a minimum of four (4) feet from the alley, street or sidewalk whichever is closest to the building.
G.
No signs shall be displayed in any parking area within any residential district, except such as may be necessary for the orderly use of the parking facilities.
Section 405.795 Loading Space Requirements.

A.
General. Every building or structure used for business, trade, or industry shall provide adequate space for the loading and unloading of vehicles off the street or public alley. Such space shall have access to a public alley or, if there is not an alley, to a street. Off-street loading and unloading space shall be in addition to and not considered as meeting a part of the requirements for off-street parking space. Off-street loading and unloading space shall not be used or designated, intended or constructed to be used in a manner to obstruct or interfere with the free use of any street, alley, or adjoining property.
B.
Number Of Spaces. The following Tables shall be used to determine the number of Off-Street Loading and Unloading spaces required in all Zoning Districts.

C.
Design And Maintenance.
1.
Loading space — description. An off-street loading and unloading space shall be a hard-surfaced area of land, open and enclosed, other than a street or public way, used principally for the standing, loading, or unloading of motor trucks, tractors, and trailers so as to avoid undue interference with the public use of streets and alleys.
2.
Location. No permitted or required loading space shall be closer than fifty (50) feet to any property in a residential district unless completely enclosed by building walls, or a uniformly painted solid fence or wall, or any combination thereof not less than six (6) feet in height. No permitted or required loading space shall be located within twenty-five (25) feet of the nearest point of intersection of any two (2) streets. Loading spaces open to the sky may be located in any required yards.
3.
Measurement. When determination of the number of required off-street loading spaces results in a requirement of a fractional space any fraction up to and including one-half (½) shall be disregarded, and fractions over one-half (½) shall be interpreted as one (1) loading space.
4.
Surfacing. All open off-street loading spaces shall be improved with a compacted macadam base, not less than seven (7) inches thick, surfaced with not less than two (2) inches of asphalt concrete or some comparable all-weather dustless material.
