13 - CLASS 2 REVIEW
This section establishes procedures for issuance of a certificate of zoning review for uses requiring Class (2) review.

Class (2) review is required for any proposed use shown on Table 17.04.030 as a Class (2) use, for Class (1) uses requiring Class (2) review in Section 17.12.020, and for other specific reviews established by this title.

Applications for certificates of zoning review for Class (2) uses shall be made in writing, to the administrative official, on forms supplied by the city. A general site plan, conforming to the provisions of Section 17.11.040, shall accompany the application for Class (2) review. The administrative official may request any additional information under the provisions of subsection 17.11.020(2).

Applications for Class (2) review shall be processed as prescribed in Title 18 of this code.

Notice of administrative approvals, subject to notice under Title 18 of this code, shall be made as follows:
A.
The administrator shall notify the adjacent property owners and applicant of his intent to approve or deny an application, together with any conditions. State and federal agencies with jurisdiction and affected tribes shall be notified of the intent to grant or deny a critical areas permit together with any conditions. Notification shall be made by mail only. The notice shall include:
1.
A description of the proposal and decision of the city, including any conditions of approval;
2.
A place where further information may be obtained; and
3.
A statement that the decision of the city will be final, unless an appeal requesting a public hearing is filed with the city clerk within fifteen (15) days of the date of the notice.

A.
After considering any comments received from other agencies, jurisdictions, or adjoining property owners, the administrative official shall take one or more of the following actions:
1.
Establish conditions for approval, or require other changes in the proposed site plan;
2.
Refer the site plan to the hearing examiner for a Class (3) review.
B.
Conditional Approval. The administrative official may attach conditions in order to assure the development is consistent with the intent of this title, the zoning district, and other applicable ordinances, resolutions, development standards.
C.
Findings and Conclusions. The administrative official shall prepare written findings and conclusions, stating the specific reasons and citing the specific chapters and sections of this title, upon which his decision to approve, approve with conditions, or deny the issuance of a certificate of zoning review is based. The findings shall demonstrate that the administrative official's decision complies with the objectives of the Union Gap comprehensive plan, the intent of the zoning district, and the provisions and standards established herein.

No use requiring Class (2) review by the administrative official shall be entitled to a development permit until and unless the administrative official approves a final site plan and authorizes issuance of a certificate of zoning review. The certificate of zoning review is not a building or development permit and does not, by itself, authorize the construction or occupancy of any use or structure.

The timely submittal of an appeal of the decision of the administrator regarding a Class (2) review voids the decision. The hearing examiner then considers the matter as a Class (3) review.
