21 - GREENWAY OVERLAY
The Yakima greenway master plan was adopted to preserve, maintain and, enhance the Yakima River as natural resources for all citizens to enjoy. The greenway overlay is established to achieve the following:
A.
Make the greenway more attractive and accessible to the public;
B.
Assure development conserves riparian shoreline vegetation and controls erosion;
C.
Implement the shoreline master program and the Yakima greenway master plan;
D.
Limit development to activities which are particularly dependent on a location in the greenway;
E.
Preserve, protect, and restore the fragile natural resources and culturally significant features along the greenway;
F.
Increase public access to publicly-owned areas of the greenway where increased use is appropriate;
G.
Protect public and private properties from adverse effects of improper development in hazardous shoreline and critical areas;
H.
Give preference to uses creating long-term over short-term benefits.

A.
All zoning districts lying within the greenway overlay are subject to the development requirements of this overlay, in addition to the provisions of the underlying principal zoning district.
B.
The greenway overlay applies to those areas so designated on the official zoning map.

A.
Except for single family dwellings, the uses listed as Type I permitted uses within the underlying primary zoning district shall be subject to Type II review to ensure that the use is compatible with the Yakima greenway master plan.
B.
Type I, II and III uses within the greenway overlay are subject to:
1.
The purpose and intent of this chapter;
2.
The design standards of the Yakima greenway master plan, including the philosophy and goals expressed in the introduction to the design standards, which shall be given substantial weight in the decision of the reviewing body;
3.
The provisions of Chapter 17.19;
4.
Any other review criteria for the use required by the underlying zoning district and this code.
