CHAPTER 17

02 - INTERNATIONAL ZONING CODE

17.02.010 - Adopted.

A certain document, two copies of which are on file in the office of the Building Official of the City of Uvalde, being marked and designated as the International Zoning Code, 2021 edition, as published by the International Code Council, be and is hereby adopted as the Zoning Code of the City of Uvalde, in the State of Texas for regulating and governing the development, erection, construction, enlargement, alteration, repair, movement, removal, demolition, conversion, occupancy, use, height, area and maintenance of all buildings, structures and lots in the City of Uvalde; providing for the issuance of permits, including conditional use permits, and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Zoning Code on file in the office of the City of Uvalde are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in section 3 of this chapter.

17.02.020 - Amendments.

The following sections of the International Zoning Code are hereby revised:

Section 101.1 Insert: City of Uvalde

Section 101.2 Insert: in accordance with the comprehensive plan.

Section 103.2 Amended to read: The establishment of the commission shall be in accordance with the policies and procedures as set forth in state law. The commission shall consist of seven members and three alternates who shall be appointed by the mayor and confirmed by the city council.

Section 103.3. Amended to read: The terms of office for the members of the commission shall be three years. Members of the planning commission may be removed by a majority vote of the city council.

Section 103.4. Amended to read: All members shall serve without pay and shall hold no other municipal office.

Section 103.5. Amended to read: The chairperson of the planning commission shall be appointed by the mayor and confirmed by the city council, and such chairperson, shall hold office for a period of one year.

Section 103.6. Amended to read: The commission shall elect a vice chairperson and secretary and such other officers as may be deemed necessary for a period of one year.

Section 106.2 Delete: 180 days. Insert 365 days

Section 107.1 Insert: An application for a zoning amendment or a variance from zoning ordinance must be accompanied by a fee of $200.00.

Section 108.2 Amend to read: The board shall consist of five members and two alternates who shall serve in the absence of one or more regular members when requested to do so by the mayor or city manager.

Section 108.9 Insert: The concurring vote of four members of the board is necessary to reverse any order, requirement, decision, determination or interpretation by the code official or grant a variance.

Section 109. Delete.

Section 110.1 Insert: Before the 10 th day before the hearing date, written notice of each public hearing before the zoning commission on a proposed change in a zoning classification shall be sent to each owner of real property within 200 feet of the property on which the change in classification is proposed.

Section 110.2.1. Remove the words "examiner" and "commission."

Section 110.2.2. Insert: within 30 days

Section 110.4. Insert: The concurring vote of four members of the Board of Adjustment is necessary to reverse any order requirement, decision, determination or interpretation by the code official or grant a variance.

Section 202 Add:

ACCESSORY DWELLING UNIT. A self-contained housing unit including provisions for living, sleeping eating, cooking and sanitation within an accessory structure that is clearly subordinate to the main residential structure.

BED AND BREAKFAST. An accommodation offered by an inn, or especially a private residence home, consisting of several rooms which are set aside for overnight guests whose paid accommodations include breakfast.

GUNS, FIREARMS AND/OR GUNSMITHING. The activity of repairing, refinishing, modifying and/or customizing a gun and/or firearm of any type but not for the purpose of sale, resale or trade.

HISTORIC PRESERVATION DESIGN GUIDELINES. The Design Standards and Guidelines for the Historic Districts within the City of Uvalde, Texas as adopted an approved by the HPB, the commission and the council.

HISTORIC PRESERVATION OVERLAY DISTRICTS. Areas designated as "H" historic preservation overlay districts, as provided by section 18.01.050 hereof and shown accordingly on the zoning map for the city, shall be subject to the regulations of the historic preservation design guidelines and chapter 18.01 historic preservation ordinance, which are intended to further the purposes of the "H" historic preservation overlay district.

HPB. Historic preservation board as authorized by chapter 18.01, historic preservation.

INDUSTRIALIZED HOUSING. Industrialized housing has the meaning given to it in the Texas Occupations Code, Section 1202.002 and includes modular components.

MANUFACTURED HOME. A manufactured home has the meaning given to it by the Texas Occupations Code, Chapter 1201.

MANUFACTURED HOME PARK. A manufactured home park means a unified development for at least four manufactured housing spaces arranged on a tract of land in compliance with the city's subdivision ordinance and this section, with the individual lots or parcels being held under a common ownership and rented or leased to the occupants. Unless specifically provided otherwise or context requires otherwise, reference to a "manufactured home park" in this section shall include "manufactured home subdivision."

MANUFACTURED HOME SUBDIVISION. A manufactured home subdivision means a unified development for at least four manufactured housing spaced arranged on a tract of land in compliance with the city's subdivision ordinance and this section, with the individual lots or parcels being developed and sold to occupant owners.

MODULAR COMPONENT. A component of a structure as defined in Chapter 1202, Texas Occupations Code, as amended from time to time.

Insert:

HOME OCCUPATION. A home occupation shall not be interpreted to include barbershops, beauty parlors, restaurants, or the conduct of a business involving retails sales, but is intended to include only those personal services which are subordinate to the use of the premises as a dwelling.

PARKING SPACE, AUTOMOBILE. An all-weather surfaced space

YARD. Where there is an alley, the depth of the rear yard may be considered to extend to the center line of the alley.

Amend to read:

ALLEY. more than 12 feet but less than 30.

STREET. 30 feet.

501.1 Residential Zones Defined Division 2 shall be amended to read:

"Any use permitted in R, Division 1 zones and two family dwellings in 2a and three and four family dwellings in 2b."

601.1 Commercial and commercial/residential zones. CR Division 1 shall be amended to read:

"Any use permitted in a C, Division 1 zone and residential use permitted."

Table 602.1 Commercial and Commercial/Residential Zones Bulk Regulations shall be amended by adding the following:

"Division 3 & 4 minimum front yard 20 feet, minimum side yard 15 feet on a corner lot and 5 feet for interior lots."

Section 801.2 Insert:

801.2.5 Parking minimums are waived in C and CR Division 1.

801.2.6 Uses with different parking demand patterns may share up to 50 percent of required parking spaces with approval of city staff.

801.2.7 City staff may give variances to parking requirements on a case-by-case basis.

Section 802.1 Amend table to read:

* Fences in front or side yards on street corners must be constructed so that there is visibility from both streets.

Section 901.1 Delete: Home occupations shall be conducted wholly within the primary structure on the premises.

Section 1002 Insert:

ELECTRONIC MESSAGE SIGN OR CENTER. Such signs shall not exceed brightness level of 0.3 candles above ambient light. In all zoning districts such signs shall come equipped with automatic dimming technology, which automatically adjusts the signs brightness based on ambient light. _____
