§ 425-304

Conditional uses.

A zoning ordinance may provide for conditional uses to be granted by the Planning Board according to definite specifications and standards which shall be clearly set forth with sufficient certainty and definiteness to enable the developers to know their limit and extent.
A. 
The following conditional uses are established in the City of Vineland:
(1) 
Boardinghouse, rooming house.
(2) 
Hospital, medical center, convalescent home.
(3) 
Church, congregation.
(4) 
Funeral home.
(5) 
Cemetery, crematorium.
(6) 
Recreational facility.
(7) 
Campground.
(8) 
Heliport, helistop, helipad.
(9) 
Resource extraction.
(10) 
Production of bitumen products.
(11) 
Medical cannabis dispensary.
(12) 
Cannabis retailer.
(13) 
Harm reduction center, subject to the following conditional use requirements:
(a) 
The use shall be located a minimum of 1,000 feet from any of the following uses: child day care facility; public or private elementary, middle, or high school; playground; public park; or house of worship, as measured from property the nearest points of any property line;
(b) 
The program must be duly licensed and registered by the NJ Department of Health;
(c) 
Hours of operation shall be limited to 7:00 AM to 8:00 PM;
(d) 
In addition to any other required submission items for a site plan application, the facility operator must provide a plan for addressing loitering by users during and after operational hours;
(e) 
The facility must disclose whether it may seek to operate a "sterile syringe program" or any kind of supervised drug use or injection site programs at the facility. Any program that would include such accessory uses must also provide a plan for accessing emergency services;
(f) 
A sterile syringe program may be permitted as an accessory use to a harm reduction center only if such sterile syringe program is operated as a mobile program where sterile syringes are delivered or collected by a mobile vehicle operated by the program, and not as a fixed location where syringes and/or needles are distributed to users directly from the site.
(14) 
Sterile syringe program, subject to the following conditional use requirements:
(a) 
A sterile syringe program at a fixed location shall be permitted only as an accessory to a harm reduction center, hospital, emergency medical service facility, or substance abuse counseling or treatment center located in the IN-1 Institutional Zone.
B. 
Specific standards. Specific standards for each conditional use are provided in the Zoning Schedule, Sheet 2, Conditional Use Specific Standards.[1] Failure to meet any one or more of the specific standards for a conditional use shall constitute a variance in accordance with N.J.S.A. 40:55D-70d(3).
C. 
General standards. Any conditional use shall be subject to the design standards contained in Article VII of this chapter. Failure to meet any one or more of the general standards for a conditional use shall constitute a variance in accordance with N.J.S.A. 40:55D-70(c). Additionally, the following articles are made a part of this article by reference, and all requirements contained therein shall be considered as general standards:
(1) 
Article X, Campgrounds.
(2) 
Article XIII, Heliports, Helistops, Helipads.
(3) 
Article XIVA, Resource Extraction.
(4) 
Article XXVII, Medical and Adult Use Cannabis.
D. 
Application. An application for a conditional use, if all specific standards are met, shall be submitted to the Planning Board. The Planning Board shall grant or deny an application for a conditional use within 95 days of submission of a complete application by a developer to the Planning Board Secretary, or within such further time as may be consented to by the applicant. The review by the Planning Board of a conditional use shall include site plan review pursuant to Article VI of this chapter. The time period for action by the Planning Board on conditional uses shall apply to such site plan review. In instances where all specific standards are not met, an application for a conditional use shall be submitted to the Zoning Board of Adjustment pursuant to N.J.S.A. 40:55D-76b. The Zoning Board of Adjustment shall act on the conditional use and site plan in lieu of the Planning Board. Whenever review or approval of the application by the County Planning Board is required pursuant to N.J.S.A. 40:27-6.3, in the case of a subdivision, or N.J.S.A. 40:27-6.6, in the case of a site plan, the Planning Board or Zoning Board of Adjustment, whichever is appropriate, shall condition any approval that it grants upon timely receipt of a favorable report on the application by the County Planning Board or approval by the County Planning Board by its failure to report thereon within the required time period.
