CHAPTER 2

Zoning Districts and Land Uses

Sec. 2.01.01 Purpose and Applicability

  • Purpose.  The purpose of Subchapter 2.01, Zoning Districts, is to establish zoning districts to implement the Comprehensive Plan.
  • Applicability. Chapter 2, Zoning Districts and Land Uses, applies to all land, buildings, and structures within the corporate boundaries of the Village.
  • Effective on: 2/7/2016

    Sec. 2.01.02 Districts Established

    The Village is divided into the following zoning districts:

    Retail ServiceC-1 Light Business Light intensity retail, office, and service uses.
    General CommercialC-2 Commercial Large scale uses that require highway and arterial street access and high visibility.
    Business ParkM-1 Business Park A mixed use center of light industrial and business uses with enhanced design standards.

    Sec. 2.01.03 Official Zoning Map

  • Map Adoption. The zoning boundaries set out in this Subchapter are delineated on the Official Zoning Map, which is incorporated by reference as a part of the UDC.
  • Zoning Map Amendment. Amendments to district boundaries shown on the Official Zoning Map are permitted if the proposed amendment is in conformity with the:
    1. Procedures set out in Sec. 9.04.09, Zoning Map Amendments; and
    2. Recommendations of the Comprehensive Plan.
  • Interpretation of District Boundaries. The district boundaries shown on the Official Zoning Map usually coincide with streets, alleys, property lines, or their extensions. Where uncertainty exists as to the precise boundary location on the Official Zoning Map, the following rules shall apply:
    1. Boundaries following rights-of-ways, drainage-ways, arroyos, or easements are construed to follow such centerlines;
    2. Distances not specifically indicated on the Official Zoning Map shall be determined by the Development Administrator from the graphic scale shown on the Official Zoning Map;
    3. When a right-of-way or easement is vacated, district boundaries of adjoining properties shall automatically extend to the centerline of the vacated right-of-way or easement; and
    4. Where physical features on the ground differ from the Official Zoning Map, or if a question arises how a parcel of property is zoned and cannot be resolved by the application of this Section, by a boundary survey, or other anecdotal evidence, the Administrator shall consider the property to be zoned the less intensive of the zoning districts that are effected by the question. The decision of the Administrator may be appealed, or an application to amend the Official Zoning Map, filed to define the boundary.

  • Effective on: 11/6/2015

    Sec. 2.01.04 Zoning of Annexed Territory

    For the purposes of ensuring that all land has a zoning designation, any land that is not assigned a zoning district on the Official Zoning Map, and any land that is annexed into the Village, shall be zoned in accordance with the recommendations of the Comprehensive Plan. Alternatively, such lands shall be zoned Single-Family Detached (R-1).

    Sec. 2.02.01 Purpose

  • Generally. The purpose of this Subchapter is to designate land uses into the zoning districts, as set out in Sec. 2.01.02, Districts Established.
  • Land Use/Zoning District Matrices. The Zoning Matrices set out in Sec. 2.02.03, Residential Uses, and Sec. 2.02.04, Nonresidential Uses, indicate zoning districts where land uses are permitted, permitted subject to a special use permit, permitted as a temporary or accessory use, or prohibited.
  • Uses Not Listed.
    1. Authorization of Proposed Use. If a proposed use is not specified in Sec. 2.02.03, Residential Uses, or Sec. 2.02.04, Nonresidential Uses, the Development Administrator shall determine if a proposed use is either a subcategory, or functionally similar, to a permitted, special use, or prohibited use, and apply the UDC accordingly.
    2. If Not Authorized, Then Prohibited. If a proposed use is not a subcategory of, or functionally similar to a permitted or special use, the use is prohibited.
    3. Decision Criteria. The following criteria shall be used to evaluate an unlisted use by the Development Administrator, or at the Development Administrator’s discretion, by the Planning and Zoning Commission:
      1. Development and use characteristics, such as character, scale, building bulk, use intensity;
      2. Compliance with all district development standards;
      3. The use is substantially similar or compatible with other district uses; and
      4. Any other reasonable criteria to assess the proposed use, such as a Plan of Operation.
    4. Findings of Fact and Effect of Decision. Uses approved as either a subcategory or functionally similar to a use shall be subject to all requirements of the use that it is assigned.

    Sec. 2.02.02 Legend

    The following symbols are used in the zoning district/land use matrices: 

    1. "P" means "Permitted", subject to the requirements of the UDC.
    2. "PA" means "Permitted Accessory Use", subject to the requirements of the UDC.
    3. "TA" means "Temporary Accessory Use", subject to the requirements of the UDC.
    4. "S" means "Special Use Permit", subject to Village Council approval. 
    5. "TS" means "Special Use Permit, Temporary", subject to Village Council approval.
    6. "-" means "Prohibited" in the specified zoning district.
