16.32

Residential District R

16.32.02 - Purpose

To provide and protect areas for low density, single-family residences while permitting the limited establishment of public and quasi-public uses which serve the requirements of households.

16.32.04 - Location

The Residential District includes any parcels currently zoned Residential at the time of adoption of this Section. The zone can be expanded to properties located North of State Route 9 and has had a wastewater feasibility study from the Southwest Department of Health allowing for lots of 12,000 square feet.

16.32.06 - Permitted Uses

Uses contained in this Chapter flow directly from Chapter 30 - Zones and Uses. In the event of a conflict, Chapter 30 verbiage is the principal deciding factor. Uses fall into one of four categories, namely Permitted, Permitted with Conditions, Conditional Use, and Prohibited.

A.

SINGLE-FAMILY DWELLINGS.

1.

Minimum square feet of home must meet all requirements of the International Residential Building Code.

B.

HOUSEHOLD PETS.

C.

AGRICULTURE.

1.

Tilling of soil, the raising of crops, horticulture, and gardening for personal use.

2.

Animals and fowl for recreational use or family food production for the primary use of persons residing on the premises.

a.

The keeping of animals shall meet all standards set by the local Health Department, State and Federal regulatory agencies.

D.

ACCESSORY BUILDINGS AND USES CUSTOMARILY INCIDENTAL TO THE PERMITTED USES ALLOWED HEREIN.

E.

GUEST HOUSE/CASITA.

F.

RESIDENTIAL HOSTING FACILITY (RHF).

16.32.09 - Prohibited Uses

The following uses are prohibited:

A.

Short-Term Rentals.

16.32.10 - Height Regulations

No building may exceed twenty-five feet (25').

16.32.14 - Dwelling Standards

The following dwelling standards apply to parcels of less than one acre:

A.

Dwellings in the residential zone shall not exceed a size greater than 4,800 square feet of living area, or 15% of the parcel, whichever is greater.

B.

The parcel shall be permitted a single septic tank, which has a maximum capacity of 2,000 gallons.

C.

The parcel shall be permitted no more than a single culinary water connection of 3/4 inch.

16.32.16 - Signs

16.32.18 - Modifying Regulations

Buildings shall have a minimum side setback of eight feet (8'), and a total of the two (2) side setbacks shall be twenty feet (20'). All accessory buildings shall have a side setback of at least ten feet (10').
