Planning and Zoning Commission and Zoning Administrator
The Virgin Town Planning and Zoning Commission shall consist of five (5) seat members appointed by the Virgin Town Mayor with the advice and consent of the Virgin Town Council. The Virgin Town Council may designate, by resolution, the composition of the Virgin Town Planning and Zoning Commission. It is the intent of this ordinance that seat members are not all from the same field of expertise. All seat members of the Virgin Town Planning and Zoning Commission shall be residents of Virgin Town. At least three (3) of the five (5) regular seat members shall hold no other public office or position within the Town. The Virgin Town Mayor may appoint, with the advice and consent of the Virgin Town Council, one (1) or two (2) alternate members of the Virgin Town Planning and Zoning Commission, who shall serve in the absence of a member from the Commission, at the request of a member who wishes to abstain from a particular item due to a conflict of interest, or as chairman of an appointed committee at the request of the chair of the Virgin Town Planning and Zoning Commission, and whose terms shall be staggered, and of the same length as regular members. The Virgin Town Council may, in addition to the Zoning Administrator, appoint a representative from among its members to act as a liaison between the Virgin Town Council and the Virgin Town Planning and Zoning Commission.
A.
TERMS OF OFFICE. The regular terms of office for all seats shall be for four (4) years. The Virgin Town Planning and Zoning Commission member's terms shall be staggered so that the terms of no more than three members may expire at one time. A Planning and Zoning Commission member may be appointed for a term of less than their seat's term to provide for staggered terms or to complete a vacated, unexpired term. For each new appointment, reaffirmation, or vacancy, it shall be done by written resolution, which shall state the member's name, the seat number being appointed, date of appointment, and date of seat expiration. Each term shall begin on January 1 of the year of appointment and shall end on December 31 of the year when the appointment term expires. The term of office for the Virgin Town Council member designated liaison for the Virgin Town Planning and Zoning Commission shall correspond to his or her tenure of office as the Virgin Town Council member. The Virgin Town Clerk shall keep a membership ledger for each member appointed, which shall contain the members full name, seat number appointed, date of appointment, and date of seat expiration.
B.
VACANCIES AND REMOVALS FOR CAUSE. Vacancies of appointed members occurring otherwise than through the expiration of terms shall be filled for the remainder of the unexpired term by appointment of the Virgin Town Mayor with the advice and consent of the Virgin Town Council. The Virgin Town Council shall have the right to remove any member of the Virgin Town Planning and Zoning Commission for misconduct and may remove any member for nonperformance of duty. Nonperformance of duty shall include a repeated failure to attend Virgin Town Planning and Zoning Commission meetings.
C.
COMPENSATION. The Virgin Town Council may fix per diem compensation for the members of the Virgin Town Planning and Zoning Commission, based on necessary and reasonable expenses.
D.
OFFICERS. The Virgin Town Planning and Zoning Commission shall elect from its appointed members, a Chairperson and Chairperson Pro-Tern, whose term shall be for one (1) year.
E.
MEETINGS. The Virgin Town Planning and Zoning Commission shall conduct regularly scheduled meetings. All meetings of the Virgin Town Planning and Zoning Commission shall be open to the public.
F.
RULES AND PROCEDURES. The Virgin Town Planning and Zoning Commission may adopt such rules and regulations governing its procedure as it may consider necessary or advisable, consistent with State Law, and shall keep a record of its proceedings, such record shall be open to inspection by the public at all reasonable times.
G.
QUORUM AND VOTE. A quorum of the Virgin Town Planning and Zoning Commission shall consist of two (2) members and a Chairperson or Chairperson Pro Tern. Evidence shall not be presented unless a quorum is present. A majority vote shall consist of at least a majority of the Commission's members present.
H.
DUTIES AND POWERS. The Virgin Town Planning and Zoning Commission shall have the duty to exercise all powers and functions conferred upon it by the statues of the State of Utah and the ordinances of the Town of Virgin relating to planning and zoning.

The Mayor, with the advice and consent of the Virgin Town Council shall appoint a Town Zoning Administrator ("Zoning Administrator"). The Zoning Administrator shall be an employee or independent contractor of the Town subject to the following purpose, duties and responsibilities:
A.
PURPOSES OF POSITION. The purposes of the position of Zoning Administrator is to have a Town official who's primary function is to: 1) facilitate and induce economic and residential growth within the Town, while 2) ensuring that all aspects of said development and growth is done in compliance with the Town's General Plan and simplified Land Use Ordinances which balance and respect both the historical & rural nature of the Town and the private property rights of its residents.
B.
SCOPE OF DUTIES. The Zoning Administrator's general duties and responsibilities shall include (but are not limited to):
1.
Review and propose modifications to the Town's General Plan and VULU with the intent of simplifying and refining the Town's Land Use Ordinances for the purpose of eliminating regulations that would be in conflict with each other or a deterrent to growth and economic development within the Town.
2.
Answer inquiries from land owners, prospective developers, architects, engineers and the general public regarding land use, economic development, policies and long term plans of the Town.
3.
Meet with land owners, prospective developers and other agencies providing public utility or municipal services within the Town to review conceptual plans and provide constructive feedback, insight and brainstorming on development options that would comply with the Town's General Plan and VULU.
4.
Be available, present and participate in public meetings and private meetings with landowners and residents of the Town who may have questions or concerns about possible growth and specific development being proposed within the Town.
5.
Intake new subdivision and site development plans and review all new construction plans for compliance with VULU and applicable safety and building codes.
6.
Reports to the Virgin Town Mayor and Virgin Town Council and acts as a liaison between the Virgin Town Council, the Virgin Town Planning and Zoning Commission, the Virgin Town Appeal Authority, Virgin Town Staff and (as designated by the Virgin Town Mayor and Virgin Town Council) with other entities and bodies providing public utility and municipal services within the Town.
7.
Attend all Virgin Town Council and Virgin Town Planning and Zoning Commission Meetings to present agenda items relating to zoning and land use and provide both applicants and said bodies with a written staff recommendation outlining the Town's Land Use Ordinances applicable to the application/request and an analysis of whether the applicant has met all requirements (or deficiencies) and any other conditions of approval he/she would recommend.
8.
Work closely with Virgin Town Mayor, Virgin Town Council Virgin Town Planning and Zoning Commission, the Virgin Town Engineer, Virgin Town Staff and other departments of the Town in analyzing and creating plans for long and short term infrastructure development, including parks, trails, streets, water, sewer, storm drainage, parking and other public facilities.
9.
Coordinate and monitor all economic development activities with contractors, developers, property owners, Washington County and other interested groups, solicits potential economic developers to the Town; generates and nurtures professional working relationships with private developers, realtors, business leaders, banking and financial leaders, professional economic development and trade associations, state and local government leaders, economic development professionals and other community leaders.
10.
Work with the Virgin Town Attorney and developers in the preparation of development agreements and reimbursement agreements, when applicable.
11.
Perform any other duties as required of the Zoning Administrator elsewhere in VULU.
12.
Perform related duties as assigned by the Virgin Town Mayor.

The Virgin Town Planning and Zoning Commission may, upon the approval of the Virgin Town Council, employ experts and a staff, including consultants and a secretary, and to pay such expenses as may be deemed reasonable and necessary for carrying out its responsibilities, upon presentation of proper receipts and vouchers, but not in excess of such sums as may be appropriated by the Virgin Town Council.
