ARTICLE 13

- INTERPRETATION, SEVERABILITY, VIOLATIONS, PENALTIES, WHEN EFFECTIVE

Sec. 13.1.- Interpretation.

In their interpretation and application, the provisions of this zoning ordinance shall be held to be the minimum requirements for the promotion of the public health, safety, morals, and welfare.

Sec. 13.2. - Severability.

If any section, clause, provision, or portion of this ordinance is adjudged unconstitutional or invalid by a court of competent jurisdiction, the remainder of this ordinance shall not be affected thereby.

Sec. 13.3. - Violations.

It shall be unlawful to construct or use any structure, land, or water in violation of any of the provisions of this ordinance. In case of any violation, the board of trustees, enforcing officer, the village planning commission, or any property owner who would be specifically damaged by such violation may institute appropriate action or proceeding to enjoin a violation of this ordinance.

Sec. 13.4. - Penalties.

Any person, firm, or corporation who fails to comply with the provisions of this ordinance shall, upon conviction thereof, forfeit not less than $10.00, nor more than $200.00 for each offense. Each day a violation exists or continues shall constitute a separate offense.

Sec. 13.5. - When effective.

This ordinance is hereby declared to be urgent and necessary for the immediate preservation of the public peace, health, and safety, and shall be in full force and effect from and after its due passage, approval, and recording, and public as provided by law.
