CHAPTER 1268

Commercial and Office Building District Regulations

1268.01 PURPOSE.

   The B-1, Limited Commercial District, the B-2, Business District and the O, Office Building District are established to accomplish the general purposes of this Zoning Code as stated in Chapter 1250, and to achieve the following specific objectives:
   (a)   To provide standards for the existing commercial locations of the Village and to concentrate new commercial development in buildings that typically locate side-by-side;
   (b)   To provide appropriate locations for the development of research and office complexes, while maintaining the residential character of the Village;
   (c)   To provide sufficient land area for retail, service, and commercial in the Village, while protecting and maintaining residential areas from commercial encroachment; and,
   (d)   To protect residential neighborhoods adjacent to such districts and uses by regulating the sites, particularly at the common boundaries, that would create congestion, noise, or other objectionable influences.

1268.02 PERMITTED USES.

   (a)   Uses Permitted By Right. A use listed in Schedule 1268.02 shall be permitted by right as a principal use in the district when denoted by the letter "P" provided that all requirements of other Village ordinances and this Zoning Code have been met.
   (b)   Conditional Uses. A use listed in Schedule 1268.02 shall be permitted as a conditional use in a district when denoted by the letter "C"; provided the Planning Commission first makes the determination that the requirements of Chapter 1294 have been met, according to the procedures set forth in Chapter 1258.
   (c)   Accessory Uses. A use listed in Schedule 1268.02 shall be permitted as an accessory use in a district when denoted by the letter "A". Such use shall be permitted as a subordinate building or use when it is clearly incidental to and located on the same lot as the principal building or use. Accessory uses are further regulated in subsequent sections of this Zoning Code.

1 Such uses shall be an integral part of the office building development and located on the same lot with the building or buildings to which they are accessory.
2 Outdoor storage shall be located on a lot in conformance with the minimum setbacks for buildings set forth in Schedule 1268.05. Outdoor storage shall be screened in conformance with the regulations in Section 1298.07, Screening of Accessory Uses.

1268.03 PROHIBITED USES.

   Except for those uses pursuant to Section 1268.02, the following uses are prohibited within the B-1 Limited Commercial District, the B-2 Business District and the O Office Building District.
   (a)   Sale of firearms or ammunition for firearms.
   (b)   Adult Oriented Establishments.

1268.04 LOT AREA REQUIREMENTS.

   (a)   The minimum lot requirements for uses in the Commercial and Office Building Districts are specified in Schedule 1268.04.

1268.05 SETBACK REQUIREMENTS.

   (a)   The following regulations are established to regulate the design and development of buildings in the B-1, Limited Commercial; B-2, Business; and O, Office Building districts. Every permitted use of land and structures shall be located on a lot in a manner that maintains the minimum building and off-street parking lot setbacks set forth in this section for the district in which the lot is located, measured from the appropriate lot line. Setbacks shall remain unobstructed by structures except as otherwise specifically permitted in this Code.

1268.06 HEIGHT REQUIREMENTS.

   Buildings and structures shall comply with the height regulations set forth below, based on the district in which the lot is located:
   (a)   In the B-1, Limited Commercial District and the B-2, Business District, buildings and structures shall not exceed two and one-half stories or a height of thirty-five feet.
   (b)   In the O Office Building District, buildings and structures shall not exceed a height of seventy-five feet.
   (c)   Accessory buildings shall not exceed a height of eighteen feet.
   (d)   The height of any accessory structure such as chimneys, flagpoles, and other mechanical appurtenances erected upon or constructed as an integral part of a building may be erected above such maximum height, but limited to a height not exceeding seventy-five feet above finished grade.

1268.07 ACCESSORY USE REGULATIONS.

   Accessory uses, buildings, and structures permitted in the Commercial and Office districts are enumerated below and shall conform to the requirements of this Section.
   (a)   Setback Requirements. Accessory uses, buildings, and structures shall meet all the building setback requirements of Schedule 1268.05, unless otherwise specified in this Section.
   (b)   Off-Street Parking and Loading. Off-street parking and loading areas shall conform to the minimum parking setback requirements specified in Schedule 1268.05, and shall otherwise conform to the regulations of Chapter 1292, Off-Street Parking and Loading Regulations.
   (c)   Signs. Signage shall conform to the regulations in Chapter 1296, Sign Regulations.
   (d)   Fences and Walls. Fences and walls shall be permitted accessory uses provided they comply with Chapter 1298, Landscaping, Screening and Outdoor Lighting Regulations.
   (e)   Satellite Dishes. Satellite dishes shall be a permitted accessory use.

1268.08 CONSTRUCTION STANDARDS.

   In all Commercial and Office Building Districts, all exterior wall areas of each elevation of any building or other structure erected, or the expansion of existing buildings and other structures, shall be constructed of brick, split faced block or similar masonry or other type of material as may be approved by the Planning Commission.
