CHAPTER 1272

Mixed-Use Development District

1272.01 PURPOSE.

   The purposes of the Mixed-Use Development District are to:
   (a)   To provide for the integration of basic industrial and manufacturing uses with office, service, and destination specialty retail uses into a cohesive employment center;
   (b)   To provide for and encourage the reuse and redevelopment of properties within the District as high-density mixed-use developments with the potential to create jobs and to enhance the tax base of the Village;
   (c)   To recognize the unique nature of the areas zoned Mixed-Use Development District and to provide for the orderly development of those properties.
   (d)   To insure that the appropriate use and value of property within and adjacent to the district will not suffer a significant negative impact.
   (e)   To identify the development characteristics of the wide range of uses permitted in the Mixed-Use Development District such as marketing and image requirements and expectations, parking, lighting, signs, etc. that are unique to this district and are not intended, expected or appropriate to other lands or districts in the Village.

1272.02 PERMITTED USES.

   (a)   Uses Permitted by Right. A use listed in the Schedule of Permitted Uses shall be permitted by right as a principal use when denoted by the letter "P" provided that all requirements of other Village ordinances and this Zoning Code have been met.
   (b)   Conditional Uses. A use listed in the Schedule of Permitted Uses shall be permitted as a conditional use when denoted by the letter "C" provided that the Planning Commission first makes the determination that the requirements of Chapter 1294 have been met according to the procedures set forth in Chapter 1258 .
   (c)   Accessory Uses. A use listed in the Schedule of Permitted Uses shall be permitted as an accessory use when denoted by the letter "A". Such use shall be permitted as a subordinate building or use when it is clearly incidental to and located on the same lot as the principal building or use and it complies with all other of this Zoning Code.

1272.03 LOT AREA REQUIREMENTS.

   All lots within the Mixed-Use Development District shall comply with the minimum requirements set forth in the following Schedule of Minimum Lot Requirements:

1272.04 SETBACK REQUIREMENTS.

   The following regulations are established to regulate the design and development of buildings in the Mixed-Use Development District. Every building in the Mixed-Use Development District shall be located on a lot in compliance with the setback and spacing requirements set forth in following Schedule of Setback Requirements:

1272.05 HEIGHT REGULATIONS.

   Buildings and structures shall comply with the height regulations set forth below:
   (a)   Principal buildings shall not exceed a height of five stories or 60 feet.
   (b)   Accessory buildings shall not exceed 25 feet.
   (c)   Mechanical rooms, mechanical equipment, chimneys, flagpoles, water tanks and other appurtenances may be erected above such maximum height, but are limited to a height not exceeding 75 feet above finished grade.
   (d)   Architectural or decorative features may extend above the maximum building height but shall not exceed a total of 70 feet from grade.

1272.06 ACCESSORY USE REGULATIONS.

   Accessory uses, buildings and structures permitted in the Mixed-Use Development District as set forth in Section 1272.02 shall conform to the following requirements:
   (a)   Setback Requirements. Accessory uses, buildings and structures shall meet all the building setback requirements set forth in the Schedule of Setback Requirements in Section 1272.04 , unless otherwise specified in this Code.
   (b)   Off-Street Parking and Loading. Off-street parking and loading areas shall conform to the minimum parking setback requirements specified in the Schedule of Setback Requirements in Section 1272.04 , shall conform to the regulations of Chapter 1292 , and shall comply with the provisions of Section 1272.08 .
   (c)   Fences and Walls. Fences and walls shall be permitted accessory uses provided they comply with Chapter 1298 , Landscaping, Screening and Outdoor Lighting Regulations.
   (d)   Signs. Signs shall be permitted accessory uses provided they comply with the regulations of Chapter 1296 and the provisions of Section 1272.08 .
   (e)   Warehousing and Storage. Warehousing and storage shall be a conditional accessory use provided that the Planning Commission first makes the determination that the requirements of Chapter 1294 have been met according to the procedures set forth in Chapter 1258 .
   (f)   Arcades. Arcades shall be a conditional accessory use provided that the Planning Commission first makes the determination that the requirements of Chapter 1294 have been met according to the procedures set forth in Chapter 1258 .
   (g)   Restaurants. Restaurants shall be a conditional accessory use provided that the Planning Commission first makes the determination that the requirements of Chapter 1294 have been met according to the procedures set forth in Chapter 1258 .

1272.07 DEVELOPMENT STANDARDS.

   (a)   In the Mixed-Use Development District, all exterior wall areas of each elevation of any building or other structure erected or the expansion of existing buildings and other structures shall be constructed of brick, split face block or such other materials as may be approved by the Planning Commission.
   (b)   Each proposed development or redevelopment of property within the District shall be subject to development plan review as provided in Section 1258.05.
   (c)   In recognition of the special character of the Mixed-Use Development District and its future development with respect to the mixture of permitted uses and the unique development opportunity it represents, the Planning Commission and Village Council shall have the authority and responsibility to consider, in addition to the other standards set forth in Section 1258.05, the compatibility of any proposed use within the District.

1272.08 SUPPLEMENTAL REGULATIONS.

   (a)   For purposes of this chapter "destination specialty retail" shall mean a large scale retail store specializing in a single category of goods that is unique within the regional market area. Such stores shall be a minimum of 200,000 square feet in floor area and shall have no other stores, branches, or retail outlets located within 100 miles of Walton Hills.
   (b)   For purposes of this chapter "medical facilities" shall mean those facilities that provide short term medical care or treatment that is not customarily provided in a medical office. Medical facilities shall include hospitals, surgical centers, outpatient clinics, emergency rooms, trauma centers, and similar uses.
   (c)   For purposes of this chapter "college and university" shall mean an institution, of higher learning, including a community college, that provides a general education in the liberal arts and sciences and grants a bachelor's degree or associates degree. It shall not include specialty/personal instruction schools, of any sort, as defined by this Code.
   (d)   All machinery, equipment, raw material and all operations required in the use of the premises shall be enclosed within a building or structure or stored outdoors in such a nature so as to conceal all such items from the view of any person standing at the nearest residential district line and at the street line of the nearest public street.
   (e)   Storage of all materials shall be designed and arranged so as to be accessible to firefighting equipment and in compliance with standards established by the American Insurance Association.
   (f)   No road or driveway serving one or more premises in the Mixed-Use Development District shall have connection with or discharge traffic into a residential district of the Village other than on Alexander Road.
   (g)   All buildings and each tenant space occupied within the Mixed-Use Development District shall have displayed at every entrance to the building and tenant space the address of the building and in the case of a multi-tenant building the tenant space number. All such identification of the building and/or tenant space shall be located and sized as prescribed by the Fire Inspector.
   (h)   All outside storage of material, equipment and fleet vehicles shall conform to the principal building setbacks.
   (i)   Permanent signs attached to buildings.

(a)   Except as otherwise permitted in Section 1296.05(b)(2) for lots that have 200 feet or more of street frontage.
(b)   Plus 1 sq. ft. for every 10 feet of lot frontage >200 feet. Notwithstanding any provision of this code, the area of any free-standing sign shall not exceed 200 square feet.
